Abstract

The authoritative document entity commonly referred to as the Certificate of Ownership (SHM) is legally constructed as a supremacy manifestation of the dominant right to geocadastral space, as determined by the legislative norm of lex generalis contained in Law Number 5 of 1960 concerning Basic Agrarian Principles (UUPA). Terminologically, Article 20 paragraph (1) of the UUPA affirms that the dominant right is an absolute hereditary prerogative and has the highest legal density in the agrarian civil structure. This study is intended as an academic examination of the legal empire of the SHM document which was born from a legal substratum that experienced validity dysfunction, using the doctrinal paradigm of the principle of Nemo Plus Juris ad alium transferre potest quam ipse habet. This research is articulated through a doctrinal-normative legal approach based on the explication of positive legal literature and judicial jurisprudence. The results of the investigation conclude that the SHM entity derived from the legal anomaly-affected legal basis does not have normative validity that can be constitutionally maintained. The internality of the Nemo Plus Juris principle shows that legal actors do not have the authority to transfer rights that are not legally attached to them, so that the legal alienation process by the defendants in the form of a sale and purchase is null and void in material law. The implication is that the plaintiff's legal standing as a legal subject with land rights that are previously legally valid has the legitimacy to file an administrative cancellation of the SHM and reconstruction of the ownership status to the entity that is legally entitled. The judicium issued by the Panel of Judges at the Tondano District Court in the a quo case has substantially been in line with the principles of proportionality and legality, and has utilized legal instruments as a protective medium for the existence of legitimate agrarian rights. This confirms the supremacy of law in maintaining the integrity of the national land system from manipulative penetration based on flawed formalities of the right base.

Abstract

Interfaith marriages often experience difficulties in official registration, which has an impact on legal status and civil rights. In the Constitutional Court Decision Number 68/PUU/XII/2014, it firmly rejected interfaith marriages, this decision emphasized that interfaith marriages have no constitutional basis in Indonesia and are still regulated by applicable laws. This study aims to analyze court decisions relating to applications for registration of marriages between adherents of different religions, especially before and after the issuance of SEMA No. 2 of 2023. This study uses a normative research method and a case study approach to decision number 91/Pdt.P//2022/PN Bks. This study attempts to answer questions related to the registration of interfaith marriages

Abstract

This study aims to analyze the effectiveness of divorce registration orders in court decisions, particularly in default verdict cases, and to identify obstacles and solutions within Indonesia’s civil registration system. The analysis reveals that although divorce registration orders are normatively regulated under Law Number 1 of 1974 on Marriage and Ministry of Home Affairs Regulation Number 108 of 2019, their implementation still faces various challenges such as lack of inter-agency information system integration, limited human resources and infrastructure, and low public awareness. This ineffectiveness potentially causes legal uncertainty and administrative problems for citizens. Therefore, this study recommends strengthening digital system integration, enhancing human resource capacity, conducting extensive legal socialization, improving service infrastructure, reinforcing data security, and enforcing strict supervision and law enforcement. The implementation of these recommendations is expected to improve the effectiveness of divorce registration and strengthen the protection of civil rights for Indonesian citizens.

Abstract

Penelitian ini mengkaji perlindungan hukum terhadap perempuan korban kekerasan dalam rumah tangga (KDRT) dengan fokus pada alasan yuridis perlunya pengaturan hukum terkait, serta efektivitas mekanisme penegakan hukum di Indonesia. Masalah KDRT tidak hanya melibatkan pelanggaran hak asasi manusia, tetapi juga berdampak signifikan terhadap stabilitas keluarga sebagai unit sosial dasar. Dengan pendekatan normatif, penelitian ini mengidentifikasi faktor-faktor yang mempengaruhi peningkatan kasus KDRT, termasuk ketergantungan ekonomi, norma budaya patriarki, dan hambatan dalam sistem hukum. Berdasarkan analisis terhadap Undang-Undang No. 23 Tahun 2004 tentang Penghapusan Kekerasan Dalam Rumah Tangga, ditemukan bahwa pengaturan hukum yang tegas dibutuhkan untuk memberikan perlindungan bagi korban, sekaligus mencegah berulangnya kekerasan. Penelitian ini juga menyoroti pentingnya peran pemerintah, lembaga masyarakat, dan sistem peradilan dalam menciptakan lingkungan yang aman bagi perempuan korban. Hasil penelitian diharapkan dapat menjadi acuan dalam memperbaiki kebijakan hukum terkait KDRT di Indonesia.

Abstract

The purpose of this study is to determine the validity of the sale and purchase acquisition in evidence in decision number 332/Pdt.G/2024/PN Tnn. The method used in this research is Normative Juridical. The results of this study are that the Panel of Judges to decide the case, the Panel of Judges looks at the facts of the trial from the proof of letters, witness evidence and even other legal facts presented at the trial. Especially in deciding this case with number 332/Pdt.G/2024/PN Tnn, the panel of judges considered that the Plaintiff, who was actually burdened with proof, could not prove the truth about the arguments and claims he presented at the trial. Meanwhile, the Defendant was able to prove so accurately in denying every argument postulated by the plaintiff against the plaintiff through presenting accurate letter evidence and also witness testimony showing that the true ownership of the land that was the object of the dispute belonged to the Defendant. So the judge's consideration in looking at the flow of the trial to decide this case focuses on every evidence and fact of the trial presented by the Defendant. As well as in the burden of proof in Article 163 HIR, the plaintiff has the obligation to prove the facts they submit, while the defendant is obliged to prove the rebuttal submitted. The plaintiff is not required to prove the truth of the defendant's rebuttal, and vice versa, there is no need to prove the truth of the rebuttal.
