Abstract

This qualitative study aimed to describe potential settlements of community's land problems on state-owned enterprises’ assets. To this end, a qualitative approach was applied. Data were garnered by reviewing literature from journal articles, online media, regulations, and reports relevant to the research topic. Data were analyzed using an interactive model comprising data collection, data reduction, data display, and drawing of conclusion. The finding revealed a number of land-related problems in SOEs’ assets. The first problem is related to people's one-sided occupation of SOEs’assets, people’s one-sided occupation of the past land, dual certificate issues between the government and the community, dual recordings between SOEs and Regional government, and customary land claim upon the state’s land. Efforts in resolving these issues also face high barriers, including hindrances in object write-off and subject nomination, inefficient court-based conflict settlement, the bad precedent of SOEs’ asset release, and an indication of post-certification trades. In this regard, some potential settlement mechanisms were proposed, including the release of fixed assets by reducing the state’s equity capital, asset utilization cooperation, the granting of land rights upon the Right of Management, and other agreement-based options. This study's findings gave implications for future policies related to the settlement of SOEs’ land problems.

Abstract

Menteri Koordinator Bidang Politik, Hukum, dan Keamanan, Mahfud MD telah memberi rekomendasi pada Presiden Joko Widodo terkait wacana kebijakan grasi massal bagi narapidana kasus narkoba di dalam Lapas. Pemberian grasi massal diperuntukkan bagi narapidana kasus narkoba yang hanya sebagai pengguna atau pecandu, tidak bagi pengedar apalagi bandar. Alasan kuat yang melatarbelakangi wacana kebijakan tersebut yakni untuk mengurangi kepadatan isi hunian Lapas, mengingat narapidana kasus narkotika berjumlah lebih dari setengah total penghuni Lapas se-Indonesia. Penelitian ini bertujuan untuk menggambarkan desain kebijakan wacana grasi massal bagi narapidana kasus pengguna/pecandu narkotika. Manfaat penelitian ini untuk memberikan kontribusi literatur akademik di bidang desain kebijakan dan memberi rekomendasi kepada pemerintah. Metode yang digunakan sejalan dengan paradigma post posivitisme dengan studi kepustakaan/literatur/dokumen sebagai data primer. Berdasarkan analisis yang dilakukan didapatkan hasil bahwa desain wacana kebijakan tersebut memiliki kekurangan secara yuridis dan sosiologis di setiap dimensi nya (Dimensi tujuan kebijakan, model kausal, alat kebijakan, dan target kebijakan). Peneliti juga merekomendasikan kepada pemerintah selaku aktor utama wacana kebijakan tersebut antara lain: Penyegeraan revisi UU narkotika; Perkuat posisi pemasyarakatan dalam politik penegakan hukum Indonesia; Pengoptimalan dan perluasan tugas Tim Asesmen Terpadu (TAT); Revolusi mental dan integritas penegak hukum; serta Pemanfaatan basecamp militer sebagai tempat rehabilitasi.

Abstract

Abstract – Melampaui Saluran Whistleblowing Terpercaya: Upaya Kolektif untuk Memojokkan Korupsi Tujuan utama - Studi ini bertujuan membangun model determinan whistleblowing pada pegawai instansi publik.Metode - Studi ini menerapkan metode regresi multivariat. Responden penelitian ini terdiri dari pegawai pada beberapa instansi pemerintah pusat dan daerah.Temuan Utama - Penelitian ini menunjukkan peningkatan preferensi whistleblowing, persepsi dukungan organisasi dan kepercayaan pada kanal pelaporan internal berpengaruh positif terhadap minat whistleblowing. Faktor persepsi keseriusan pelanggaran juga berpengaruh positif dengan minat whistleblowing. Walaupun demikian, persepsi kolektivisme berpengaruh negatif dengan kemungkinan melapor.Implikasi Teori dan Kebijakan - Kanal whistleblowing internal terpercaya dapat terwujud dengan memperkuat iklim etis untuk menguatkan persepsi keamanan dan mengurangi biaya risiko pelaporan. Organisasi disarankan meningkatkan kesiapan dan mengembangkan kebijakan yang dapat mencegah korupsi dengan memberikan dukungan, keteladanan etis dan pengakuan seimbang akan integritas etis dan kestabilan kelompok.Kebaruan penelitian - Studi ini mengkaji dinamika faktor individual, situasional, dan kultural secara bersamaan dalam kerangka pencegahan korupsi sektor publik. Abstract - Beyond Trusted Whistleblowing Channels: Collective Efforts to Clamp Down on Corruption Main Purpose - This study aims to model the determinants of whistleblowing in public agency employees.Method - This study applied a multivariate regression method. The respondents consisted of employees in several central and local government agencies.Main Findings - This study shows that increasing whistleblowing preference, perceived organisational support and trust in internal reporting channels positively affect whistleblowing interest. The perceived seriousness of the offence factor also positively influences interest in whistleblowing. However, perceived collectivism harms the likelihood of reporting.Theory and Practical Implications - Trusted internal whistleblowing channels can be realised by strengthening the ethical climate to strengthen perceptions of safety and reduce the risk costs of reporting. Organisations are advised to improve preparedness and develop policies that prevent corruption by providing support, ethical role models and balanced recognition of ethical integrity and group stability.Novelty - This study simultaneously examines the dynamics of individual, situational and cultural factors within the public sector corruption prevention framework.

Abstract

The principle of "The Right Man On The Right Place" is in line with the concept of a merit system that has been formulated in the State Civil Apparatus Law. Increasing the capacity and capability of bureaucratic performance is one of the important things in Bureaucratic Reform in Indonesia. Methods that can be used to improve employee performance can be done by implementing civil servant management that pays attention to one of the issues related to employee placement. Employee placement is an organizational strategic planning because it is a policy in determining the level of effectiveness of employees and organizations in achieving goals. The formulation in this research is how to implement merit-based civil servant management in the placement of structural positions for DKI Jakarta Provincial Government employees in accordance with the qualifications, competencies and performance needed by the organization. This research aims to prepare the best scheme to ensure that the placement in structural positions for employees is in accordance with the merit system theory, which includes competence, qualifications and performance based on existing phenomena. The data was analyzed using qualitative data analysis techniques, namely descriptive phenomenological analysis. In the discussion of the research focus, the implementation of civil servant management based on 3 aspects of the merit system, namely qualifications, competencies and performance, as well as a discussion of the framework for civil servant management based on the merit system in the placement of structural positions for employees are presented. The results found that the DKI Jakarta Provincial Civil Service Agency uses the results of the Assessment Center as policy material for stakeholders to be able to reduce the mismatch between employee competency profiles and the tasks needed or to be carried out. The process of civil servant management based on the merit system begins with an analysis related to the formation needs, qualifications and competencies needed for civil servants and organizations. Then the process of mapping employee competency profiles through the Assessment Center is carried out to determine employee competence as a basis for placement. In another context, the management of civil servants based on the merit system has also been prepared and developed the concept of talent management in supporting efforts to map the 9 Boxes of talent for existing civil servants to get a picture of the competencies and profiles of civil servants that can be projected according to organizational needs.

Abstract

The idea of a cashless society has attracted attention because of its potential to transform financial transactions. The shift toward a cashless government presents a valuable opportunity to modernize public services, increase transparency, and promote financial inclusion. If all transactions occur electronically, it has potential to decrease corruption and curb cultural fraud. However, it comes with challenges. Governments must carefully design and implement strategies to address issues related to digital infrastructure, cybersecurity, digital literacy, and the inclusion of vulnerable populations. This academic study aims to examine the research gap concerning the implementation of a cashless government as a crucial ICS. By examining the benefits, challenges, and potential risks linked to the approach, we can gain a clearer understanding of its potential, effectiveness and feasibility as a solution. Due to the significant cultural influence in corruption attempts, a resilient ICS is crucial. By doing so, they can fully leverage the advantages of a cashless system, ensuring its benefits reach all regional area throughout Indonesia. Abstract

Kepercayaan publik terhadap institusi Polri merupakan faktor utama dalam efektivitas pelaksanaan tugas dan kewajibannya. Dalam perjalanannya, kepercayaan ini mengalami fluktuasi dari tahun ke tahun akibat berbagai permasalahan yang terjadi terutama beberapa kasus yang mencederai institusi ini. Upaya untuk kembali meningkatkan kepercayaan publik terhadap Polri dilakukan salah satunya dengan melibatkan prinsip meritokrasi. Penelitian ini bertujuan untuk menganalisis sejauhmana implementasi meritokrasi dalam pengembangan kompetensi penyidik Polri sebagai strategi untuk meningkatkan kembali kepercayaan publik terhadap institusi kepolisian. Penelitian ini menggunakan analisis konsep meritokrasi dengan pendekatan kualitatif dengan studi literatur terhadap bahan hukum primer dan sekunder terkait sistem meritokrasi dalam kepolisian. Berbasis kajian pustaka termasuk buku, jurnal penelitian dan sumber dokumen lainnya, penelitian ini menyoroti pentingnya meritokrasi dalam rekrutmen, promosi, dan evaluasi kinerja penyidik guna meningkatkan profesionalisme dan transparansi dalam proses penyidikan. Hasil penelitian menunjukkan bahwa implementasi meritokrasi menjadi konsep penting untuk meningkatkan kepercayaan publik dengan cara menyediakan kebijakan berbasis merit, yang tercermin dalam rekrutmen dan seleksi, promosi, penilaian, dan penghargaan. Meritokrasi secara khusus kemudian dapat digunakan untuk mengembangkan kompetensi penyidik Polri melalui Assessment Center Polri dengan tujuan akhir menjamin adanya peningkatan kinerja penyidik.

Abstract

This study examines the organizational readiness of the Secretariat General of the House of Representatives of Indonesia in adapting to the challenges posed by open government and open parliament initiatives. The main issue addressed is the lack of synchronization between government openness policies and parliamentary openness efforts in Indonesia. The objective of this research is to explore possible future scenarios for the Secretariat General through scenario planning, a method that provides a strategic framework to navigate uncertain and complex environments. The research utilizes the TAIDA framework (Tracking, Analyzing, Imaging, Deciding, and Acting) to identify key drivers of change and map out potential futures. The results suggest four possible scenarios ranging from a fully aligned, innovative, and efficient Secretariat General to one that lags behind in adapting to these changes. The implications of this study are significant for policymakers, providing strategic insights into how the Secretariat General can improve organizational readiness, enhance public participation, and strengthen governance transparency to align with global trends of openness. These findings offer a roadmap for strengthening Indonesia’s parliamentary system and its commitment to open governance

Abstract

Fraud represents a critical threat to organizational integrity, particularly within state-owned enterprises in Indonesia. This study aims to examine the influence of whistleblowing systems and internal audit on fraud prevention in PT Angkasa Pura Indonesia. Employing a quantitative approach with Partial Least Squares Structural Equation Modeling (PLS-SEM), the research evaluates the relationships of whistleblowing and internal audit to fraud prevention. Data were collected via a structured questionnaire and validated through reliability and validity tests. The findings reveal that whistleblowing systems and internal audit have significant positive effects on fraud prevention, with internal audit showing a stronger influence (β = 0.594; p < 0.001) compared to whistleblowing (β = 0.335; p < 0.001). The structural model explains 75.2% of the variance in fraud prevention outcomes. Dominant indicators were identified: accessibility of reporting channels (whistleblowing), compliance with audit international standards (internal audit), and consistent enforcement of ethical sanctions (fraud prevention). The study concludes that integrating effective whistleblowing mechanisms and high-quality internal audits is essential to strengthening fraud prevention strategies. These mechanisms must be supported by a governance environment that emphasizes ethical enforcement, transparency, and accountability. Practical implications are offered for public enterprises seeking to minimize fraud risk through internal governance reform

Abstract

This study aims to evaluate the achievements of the implementation of the Complete Systematic Land Registration (PTSL) program in 2025 in Indonesia, focusing on target achievement, challenges, and the program's impact on legal certainty and the economic value of land. The method used is qualitative, involving case studies that include in-depth interviews with stakeholders and a review of relevant literature. The evaluation results indicate that the 2025 PTSL has successfully improved legal certainty over land ownership and made a positive contribution to the economic value of community land. However, the program's implementation still faces challenges, including limited human resources, varying levels of community participation, and funding constraints that hinder its smooth operation. The study concludes that there is a need to enhance human resource capacity, strengthen active community participation, and provide adequate funding to ensure that PTSL can run optimally and sustainably. The novelty of this study lies in the use of the latest data and context for 2025, including land digitalization policies, drone GIS mapping technology, and post-pandemic social changes that affect community participation. Additionally, this study highlights the need to align PTSL funding with national priorities, making this analysis relevant for supporting the adaptive and sustainable completion of the PTSL 2025 program.

Abstract

Advocating for the ellimination of patent maintanance feees in Higher Education, especially for Entrepreneurial Universities (EU), is essential. The number of patents is the primary indicator in determining the most innovative university. Therefore, the Minister of Law and Human Rights in 2020 adapted by issuing Permenkumham 20/2020 concerning Requirements and Procedures for Imposing Certain Tariffs on Patent and Copyright. According to Permenkumham 20/2020, in some instances, tariffs on patent services can be imposed in the amount of zero rupiahs, including for Higher Education. The research problem is How to advocate for a policy to eliminate patent maintenance fees at an EU?. This research aims to analyze Policy Advocacy for the Elimination of Patent Maintenance Fees at EU. This study uses the Advocacy Strategy Framework concept proposed by Coffman. The research employs a qualitative research method. The results of the research show that the Advocacy Strategy Framework regarding the Elimination of Patent Maintenance Costs in Permenkumham Number 20/2020 is carried out through three changes, Awareness, Will, and Action carried out to audiences, namely Public and Influencers; Influencers; Influencers and Decision Makers; and Decision Makers. The researcher recommends to the Ministry of Law to compile a Roadmap and Action Plan regarding Elimination of Patent Maintenance Costs in Policy Products in the form of Ministerial Decrees Law and Human Rights or Decision of the Director General of IP regarding the Roadmap and/or Action Plan regarding this matter.
