Abstract

Land disputes in Indonesia are still very high, including land disputes that occur on ulayat lands. In the settlement of land disputes in court, sometimes indigenous peoples have to lose in defending their rights due to the weakness of the legality factor of land ownership rights on ulayat land. To minimize customary land disputes, regulations are needed that guarantee legal protection and certainty for the customary lands of indigenous peoples. The research method used is normative legal research. In this study using a statutory approach. The analysis used is descriptive qualitative analysis. The ulayat land of the customary law community unit has received recognition regarding its existence as long as the fact is that it still exists. The acknowledgment of this existence has been stated in Article 3 of the Basic Agrarian Law, but in the implementing regulations there is still a legal vacuum that results in weak aspects of protection and legal certainty for the existence of ulayat land. The existence of customary law institutions that do not yet have legality becomes a barrier for customary law community units in defending their rights in ulayat land disputes. The existence of ulayat lands cannot be separated from the recognition of customary law communities who are part of the existence of ulayat lands. Legal certainty in providing protection for ulayat lands of customary law community units is very necessary to maintain the existence of ulayat lands.

Abstract

The measurement and mapping of land parcels for land registration is the initial subject in the framework of land certification to obtain a land title certificate. Problems and constraints that occur in the measurement and mapping of land parcels if not given a solution that can certainly cause more land disputes. Complete Systematic Land Registration is one of the efforts of the Ministry of Agrarian Affairs and Spatial Planning or the National Land Agency of the Republic of Indonesia in order to resolve the problems that occur, including the uncharted land parcels with old land titles and other fields that have not been granted land titles. a method of measuring the old parcels of land that are not in accordance with the current conditions, parsing land parcels that have experienced land disputes.

Abstract

East Kalimantan cannot be detached from the spotlight of the prevention and eradication of criminal acts of corruption. This is because of the opportunity that exists in East Kalimantan is more wide open. The number of orientation field a more natural resources in East Kalimantan turns out to be a sweet target object for the perpetrators of the corruptor if no supervision and intensive prevention beforehand by the stakeholders concerned. This is where the role of the Prosecutor in East Kalimantan are challenged not only to uphold the law but also embodies the prevention of the occurrence of the crime of corruption that occurs in East Kalimantan. This research aims to find out and assess the efforts of the Prosecutor of East Kalimantan as well as obstacles faced in preventing criminal acts of corruption. In this study using a Purposive Sampling Technique. The technique of data collection is the observation, in-depth interviews and documentation. The data type is the type of primer and under with data analysis is qualitative. Results achieved in this study the existence of the description of the role of the Prosecutor in carrying out efforts in the prevention and eradication of corruption so that created a conducive society, secure, and comfortable away from the criminal acts of corruption.

Abstract

Constitutional Court Decision Number. 135/PUU-XIII/2015 states that citizens who are mentally/memory impaired can still participate in general election contestation. However, in reality, there are still many mentally disabled persons who are considered incompetent and unable to use their right to vote in elections. This is what later became the author's interest in discussing the Implementation of Voting Rights in Elections for People with Mental Disabilities, especially in Samarinda City. The author's research objective in conducting this research was to find out how the implementation and constraints faced in exercising the right to vote. The type of research used in this thesis is empirical juridical. Currently, people with mental disabled have enough awareness to participate in elections. However, the involvement of persons with mental disability to use their right to vote is limited to used their right to vote. Obstacles that occur in the use of the right to vote for persons with Mental Disabilities, there are: the problem of not specifically classifying Persons with Mental Disabilities, the absence of active communication from Persons with Mental Disabilities, the process of matching and researching data is not optimal, and the lack of delivery of electoral information. In overcoming these obstacles, the General Election Comissions seeks to form a Democratic Volunteer (Relations) using a door to door system.

Abstract

Latar Belakang: Undang-Undang Dasar 1945 serta UU No. 32 Tahun 2009 menegaskan hak masyarakat atas lingkungan yang sehat dan pentingnya perlindungan serta pengelolaan lingkungan, termasuk pengendalian limbah B3 (Bahan Berbahaya dan Beracun). Limbah B3 industri, jika tidak dikelola dengan baik, dapat menimbulkan pencemaran yang berbahaya bagi lingkungan dan kesehatan manusia.Permasalahan pengelolaan limbah B3 kerap terjadi karena lemahnya pengawasan, seperti yang terjadi di Kampung Tukul, akibat dari kelalaian Perusahaan dalam pengelolaan limbah B3 mengakibatkan pencemaran Sungai dan tanah akibat dari tumpahan oli bekas berdampak buruk bagi masyarakat sekitar. Oleh karena itu, perusahaan tambang seperti PT. CEP diharapkan bertanggung jawab secara sosial dan lingkungan, sesuai kewajiban dalam UU No. 32 Tahun 2009, khususnya Pasal 59 ayat (1) agar dampak negatif serupa tidak terjadi lagi. Metode Penelitian: Penelitian ini menggunakan metode yuridis empiris yang memadukan kajian hukum dengan fakta sosial nyata. Data primer diperoleh melalui wawancara langsung dengan pihak PT. Christian Eka Pratama dan koordinator lingkungan perusahaan, sedangkan data sekunder didapat dari dokumen hukum, jurnal, dan sumber pustaka terkait. Teknik pengumpulan data meliputi studi lapangan (wawancara) dan studi kepustakaan. Analisis data dilakukan secara kualitatif dengan pendekatan deskriptif untuk memahami fenomena hukum dan sosial terkait pengelolaan limbah B3. Hasil Penelitian: Christian Eka Pratama mengelola limbah B3 dengan tujuan mencegah pencemaran dan dampak kesehatan, mengikuti regulasi dan prinsip kehati-hatian. Prosesnya meliputi identifikasi, penyimpanan aman, pengangkutan ke pihak berizin, sosialisasi, monitoring, dan pelaporan rutin. Perusahaan juga rutin memantau, mengevaluasi, dan melaporkan dampak lingkungan serta melibatkan masyarakat untuk transparansi dan perbaikan berkelanjutan. Kesimpulan: Christian Eka Pratama telah mengelola limbah B3 sesuai Undang-Undang No. 32/2009 dan PP No. 22/2021, dengan proses lengkap mulai dari pengurangan hingga pengolahan limbah. Perusahaan menunjukkan komitmen kuat meski masih menghadapi kendala seperti persyaratan pengurangan limbah B3, namun PT.CEP terus bekerja sama dengan KLHK, menyediakan tempat penyimpanan sementara, dan melaporkan pengelolaan limbah secara rutin kepada Dinas Lingkungan Hidup Kutai Barat.

Abstract

AbstrakKeberadaan sungai karang mumus, Kelurahan Sungai Dama, Kecamatan Samarinda Ilir, Kota Samarinda Kalimantan Timur selalu menjadi sorotan publik karena menurunnya kualitas air pencemaran sungai karang mumus yang disebabkan oleh limbah rumah tangga. Kurangnya kesadaran masyarakat terhadap akibat hukum yang ada bila mencemari lingkungan merupakan penyebab utama tidak efektifnya penegakan Peraturan Daerah Nomor 02 Tahun 2011 Tentang Pengelolaan Sampah di masyarakat. Hasil dari kegiatan pengabdian dapat terlihat dari bertambahnya wawasan masyarakat terhadap pemahaman akibat hukum pencemaran lingkungan sungai karang mumus yang mampu menumbuhkan kesadaran masyarakat dalam mencegah pencemaran lingkungan  sungai karang mumus, sehingga perlu adanya kegiatan sosialisasi lanjutan setingkat RW di Kelurahan Sungai Dama, Kecamatan Samarinda Ilir, Kota Samarinda Kalimantan Timur.
