Abstract

Land disputes in Indonesia are still very high, including land disputes that occur on ulayat lands. In the settlement of land disputes in court, sometimes indigenous peoples have to lose in defending their rights due to the weakness of the legality factor of land ownership rights on ulayat land. To minimize customary land disputes, regulations are needed that guarantee legal protection and certainty for the customary lands of indigenous peoples. The research method used is normative legal research. In this study using a statutory approach. The analysis used is descriptive qualitative analysis. The ulayat land of the customary law community unit has received recognition regarding its existence as long as the fact is that it still exists. The acknowledgment of this existence has been stated in Article 3 of the Basic Agrarian Law, but in the implementing regulations there is still a legal vacuum that results in weak aspects of protection and legal certainty for the existence of ulayat land. The existence of customary law institutions that do not yet have legality becomes a barrier for customary law community units in defending their rights in ulayat land disputes. The existence of ulayat lands cannot be separated from the recognition of customary law communities who are part of the existence of ulayat lands. Legal certainty in providing protection for ulayat lands of customary law community units is very necessary to maintain the existence of ulayat lands.

Abstract

Pengaturan hukum tentang pengendalian, pengawasan, penentuan daerah/tempat penjualan, kewenangan penerbitan ijin minuman beralkohol dan ketentuan mengenai pengaturan minuman beralkohol tradisional memiliki urgenitas, mengingat Bali sebagai salah satu tujuan wisata domestic dan manca negara. Bahwa minuman beralkohol tradisional juga digunakan sebagai salah satu pelengkap sarana upacara keagamaan. Peneliti melihat telah terjadi kekosongan hukum setelah terbitnya Peraturan Presiden No 74 tahun 2013 tentang Pengendalian dan Pengawasan Minuman Beralkohol. Keadaan ini tentu dapat memunculkan persoalan ketidakpastian hukum. Artikel ini merupakan penelitian hukum normative, dengan melakukan pendekatan peraturan perundangan, pendekatan sejarah, dan pendekatan konsep. Hasil penelitian menunjukkan bahwa Peraturan Presiden (Perpres) No. 74 tahun 2013 dan Undang-Undang No. 23 tahun 2014 secara eksplisit telah mengatur tentang pengendalian, pengawasan, penentuan tempat penjualan minuman beralkohol dan minuman beralkohol tradisional serta mengatur tentang kewenangan pemberian ijin usaha. Pengaturan tentang minuman beralkohol telah diatur dalam Undang-Undang dan peraturan Presiden, ketentuan tersebut hendaknya segera ditindaklanjuti dengan menerbitkan peraturan daerah sebagai implementasi peraturan diatasnya, didasarkan asas hierarki, dengan demikian dapat memberikan kepastian hukum dan memberikan manfaat bagi masyarakat luas.

Abstract

Constitution in the government system of the Republic of Indonesia adheres the concept of trias politica, which is a concept stating that power is not transferred to the same person/institution, to prevent abuse of power and to guarantee human rights of citizens. The concept of trias politica is applied in the form of three institutions, namely executive, legislative and judicial institutions. These three institutions have different duties, rights, obligations, and responsibilities according to their authority. It turns out, however that the aim of preventing abuse of power by means of power distribution is not running well and there has been an overlap of authority among the institutions. This research is the author's study of the Legal Arrangements concerning Regional Unit Price Standards upon the issuance of Presidential Regulation Number. 33 of 2020 concerning Regional Unit Price Standards, its impact to Financial and Administrative Rights of the chairman and members of the Regional People's Representative Council. It is a normative legal research applying statutory approach, conceptual and comparative approaches. It was concluded that the placement of legislature as a quasi-executive results in the legislature shall comply with every regulation issued by the executive, this causes in an overlap of authority between the executive and the legislative institutions

Abstract

Legal arrangements regarding control, supervision, determination of areas/places of sale, authority to issue alcoholic beverage permits and provisions regarding the regulation of traditional alcoholic beverages have urgency, considering that Bali is one of the domestic and international tourist destinations. That traditional alcoholic drinks are also used as a complementary means of religious ceremonies. Researchers see that there has been a legal vacuum after Presidential Regulation No. 74 of 2013 was issued concerning Control and Supervision of Alcoholic Beverages. This situation can certainly raise the issue of legal uncertainty. This article is a normative legal research, using a statutory, historical, and conceptual approach. The research results show that Presidential Regulation (Perpres) No. 74 of 2013 and Law no. 23 of 2014 explicitly regulates control, supervision, determination of places to sell alcoholic and traditional alcoholic beverages and regulates the authority to grant business licenses. Regulations regarding alcoholic beverages have been regulated in laws and presidential regulations, these provisions should be followed up immediately by issuing regional regulations as the implementation of the regulations above, based on the principle of hierarchy, thereby providing legal certainty and providing benefits to the wider community.

Abstract

Justice theory, which emphasizes the fair and equitable allocation of risks and benefits, has significantly influenced the idea of environmental justice. Indonesia and Uzbekistan have made it mandatory for laws and regulations to implement the concept of environmental justice. Still, in practice, the rules created give birth to social-environmental conflict dimensions that are increasingly prevalent and far removed from environmental justice. This research aims to understand and analyze environmental justice regulation in Indonesia and Uzbekistan. This research uses a normative juridical approach with a literature review involving primary and secondary legal sources. The results show that the provisions of the Job Creation Bill in the forestry and environmental sectors negate access to justice via litigation at the State Administrative Court (PTUN) so that there is no public space to continue an AMDAL decision or environmental approval as part of an environmental licensing instrument in the realm of administrative law.  Regulatory problems that co-occur and are followed by implementation problems at a later date relating to the legitimacy and protection of people's constitutional rights will harm the community's sense of justice. At the same time, the issue of environmental injustice in Uzbekistan arises from the ecological crisis beginning with green space, waste management, and the water crisis that has afflicted the nation, as indicated by the preceding explanation. The government must establish national policies, institutional instruments, and central and regional environmental management authorities to facilitate development with an eye toward environmental justice.

Abstract

As has been mandated in legislation, the state apparatus in improving the quality of Administrative by improving welfare and professionalism as well as enacting system careers based on performance with the principle of reward and punishment, the State Apparatus should be able to be disciplined in achieving good governance and authoritative. Administrative Reform continues to be improved, especially with regard to quality, service efficiency, and protection of the public as well as professional skills, and well-being are all concerned agencies in supporting the implementation of tasks. In fact still many state officials who commit violations in the form of sanctions Weight Environmental example that occurred in the high Court as Satya Adhi Wicaksana. In order To create clean governance and authoritative, certainly needed discipline of the officials and personnel administration. Therefore we need a set of rules that can support the creation of employee discipline.

Abstract

The measurement and mapping of land parcels for land registration is the initial subject in the framework of land certification to obtain a land title certificate. Problems and constraints that occur in the measurement and mapping of land parcels if not given a solution that can certainly cause more land disputes. Complete Systematic Land Registration is one of the efforts of the Ministry of Agrarian Affairs and Spatial Planning or the National Land Agency of the Republic of Indonesia in order to resolve the problems that occur, including the uncharted land parcels with old land titles and other fields that have not been granted land titles. a method of measuring the old parcels of land that are not in accordance with the current conditions, parsing land parcels that have experienced land disputes.

Abstract

Pembatalan sertifikat hak pakai tanah pada tanah negara sebagai bagian dari aset pemerintah menimbulkan polemik terkait dapatkah sertifikat hak pakai tanah pada tanah negara yang telah menjadi nilai aset pemerintah dibatalkan oleh Badan Pertanahan Nasional atau tidak dapat dibatalkan karena telah menjadi aset tetap pemerintah. Selain itu bila dapat dibatalkan bagaimana dengan status tanah akibat pembatalan sertifikat hak pakai tanah diatas tanah negara sedangkan tanah negara tersebut telah tercatat sebagai aset pemerintah. Dalam ruang lingkup daerah Pemerintah Kota Samarinda juga tidak terlepas dari polemik tersebut. Banyaknya tanah negara yang tercatat sebagai aset Pemerintah Kota Samarinda yang diakui hanya sebagian saja yang bersertifikat hak pakai tanah sedangkan sebagian lagi masih belum di sertifikasikan namun telah diinventarisasi sebagai aset Pemerintah Kota Samarinda. Hal tersebut mendorong Badan Pertanahan Nasional yang diwakili oleh Badan Pertanahan Nasional Kota Samarinda untuk lebih aktif turut serta dalam menyelesaikan polemik terkait prosedur pembatalan sertifikat hak pakai atas tanah sebagai satu-satunya alat penegak hukum agraria nasional dengan melaksanakan sesuai ketentuan peraturan perundang-undangan yang berlaku salah satunya ialah Peraturan Menteri Negeri Agraria/Kepala Badan Pertanahan Nasional Nomor 9 Tahun 1999 Tentang Tata Cara Pemberian Dan Pembatalan Hak Atas Tanah Negara Dan Hak Pengelolaan.

Abstract

East Kalimantan cannot be detached from the spotlight of the prevention and eradication of criminal acts of corruption. This is because of the opportunity that exists in East Kalimantan is more wide open. The number of orientation field a more natural resources in East Kalimantan turns out to be a sweet target object for the perpetrators of the corruptor if no supervision and intensive prevention beforehand by the stakeholders concerned. This is where the role of the Prosecutor in East Kalimantan are challenged not only to uphold the law but also embodies the prevention of the occurrence of the crime of corruption that occurs in East Kalimantan. This research aims to find out and assess the efforts of the Prosecutor of East Kalimantan as well as obstacles faced in preventing criminal acts of corruption. In this study using a Purposive Sampling Technique. The technique of data collection is the observation, in-depth interviews and documentation. The data type is the type of primer and under with data analysis is qualitative. Results achieved in this study the existence of the description of the role of the Prosecutor in carrying out efforts in the prevention and eradication of corruption so that created a conducive society, secure, and comfortable away from the criminal acts of corruption.

Abstract

Constitutional Court Decision Number. 135/PUU-XIII/2015 states that citizens who are mentally/memory impaired can still participate in general election contestation. However, in reality, there are still many mentally disabled persons who are considered incompetent and unable to use their right to vote in elections. This is what later became the author's interest in discussing the Implementation of Voting Rights in Elections for People with Mental Disabilities, especially in Samarinda City. The author's research objective in conducting this research was to find out how the implementation and constraints faced in exercising the right to vote. The type of research used in this thesis is empirical juridical. Currently, people with mental disabled have enough awareness to participate in elections. However, the involvement of persons with mental disability to use their right to vote is limited to used their right to vote. Obstacles that occur in the use of the right to vote for persons with Mental Disabilities, there are: the problem of not specifically classifying Persons with Mental Disabilities, the absence of active communication from Persons with Mental Disabilities, the process of matching and researching data is not optimal, and the lack of delivery of electoral information. In overcoming these obstacles, the General Election Comissions seeks to form a Democratic Volunteer (Relations) using a door to door system.
