Abstract

Children are a state's future and should be treated as such by being safeguarded, protected, and guaranteed to get their rights to life in order to ensure their success as future leaders and contributors to society. Of course, some kids can actually act in ways that disrupt the lives of others their age and even put their lives in danger. As a general rule, this constitutes criminal behavior. Naturally, the resolution of crimes committed by adults and those committed by minors are handled in different ways. Law 11 of 2011 pertaining to the Criminal Justice System for Children addresses the punishment of minors specifically. When dealing with juvenile offenders, restorative justice is used to restore harmony between the juvenile offender and any juvenile victims for the greater good. This, of course, depends on the kindness and cooperation of young victims in diverting criminal cases involving children away from the court system. According to Law Number 11 of 2011 concerning the Criminal Justice System A. - son, this journal discusses the guarantee of protection obtained by child victims in cases of bullying when resolving criminal cases outside of court, or commonly called diversion.

Abstract

The autonomy legislation of the region in terms of its administrative organization is inseparable from the application of the principle of separation of powers and of inequality. Zonin might be related to the geographical place and potential of each area that can't be compared anywhere else. practice the precept of neighborhood autonomy to hold the Republic of Indonesia among the critical government and the nearby government. The question, consequently, is how applying the precept of regional cooperation can improve the welfare and internationality of areas with potentially incomparable situations such as geography and assets. nearby autonomy as a device for attaining prosperity in a really perfect shape of cooperation.

Abstract

ABSTRAK Konstitusi merupakan hukum dasar yang disusun dalam bentuk tertulis yang harus dihormati dan dipatuhi baik oleh pemangku kekuasaan maupun rakyat. Di dalam konstitusi juga memuat ketentuan hukum yang memiliki sifat pokok serta fundamental mengenai sistem ketatanegaraan. Pentingnya konstitusi di dalam sebuah negara yaitu untuk membatasi pemerintah dalam negara agar tidak terjadi kesewenangan penyelenggaraan negara oleh pemerintah. Konstitusi tertulis di Negara Indonesia yaitu UUD NRI Tahun 1945 yang di dalamnya mengatur mengenai ketentuan pokok dalam melaksanakan pemerintahan negara serta sebagai pengimplementasian dari asas legalitas. UUD NRI Tahun 1945 juga mengatur mengenai periodesasi jabatan dari seorang Presiden dan sudah jelas maknanya hanya selama 2 (dua) periode saja. Namun, beberapa waktu lalu muncul isu mengenai periodesasi jabatan seorang Presiden akan diperpanjang hingga periode ketiga yang menimbulkan pro dan kontra di tengah ruang publik. Tujuan dari studi ini untuk menganalisis bagaimana masa jabatan Presiden selama 3 (tiga) periode apabila dikaitkan dengan pembatasan kekuasaan dalam konstitusionalisme dan prinsip pokok negar ahukum serta kesesuainnya dengan UUD NRI Tahun 1945. Penelitian ini memanfaatkan metode penelitian yang bersifat normatif dan menerapkan pendekatan terhadap hukum serta melaksanakan analisis melalui bahan – bahan kepustakaan. Hasil studi menunjukan bagaimanakah kesesuaian dari permasalahan tersebut dengan UUD NRI Tahunn 1945 dan juga dampak yang terjadi apabila isu ini direalisasikan. Kata Kunci: Konstitusi, UUD NRI Tahun 1945, Presiden, Masa Jabatan, Hukum. ABSTRACT The Constitution is the fundamental law that is formulated in a written form and must be respected and adhered to by both those in power and the citizens. Within the constitution, there are fundamental legal provisions regarding the system of government. The importance of the constitution in a country is to limit the government's authority to prevent any abuse of power. In Indonesia, the written constitution is the 1945 Constitution (UUD NRI 1945), which regulates the fundamental principles of state governance and serves as the implementation of the principle of legality. The 1945 Constitution also specifies the term limits for a President, which is clearly defined as two terms. However, there was a recent debate about extending the presidential term to a third period, leading to both support and opposition within the public discourse. The objective of this study is to analyze how a President's three-term tenure relates to the limitations on power in constitutionalism and the fundamental principles of the rule of law, and its compatibility with the 1945 Constitution. This study employs a Normative research method with a focus on legal texts and conducts an analysis based on existing literature. The study results demonstrate the compatibility of this issue with the 1945 Constitution and the potential consequences if this issue were to be realized.
