Abstract

Dried rosella flower products are a business opportunity for the community. One of those who use this opportunity is a dried rosella flower business actor from Selopanggung Village, Kediri Regency. Many business actors who sell products from processed rosella flowers sometimes only pursue profit and therefore pay less attention to the quality of the products they sell. Conventional drying carried out on the side of the road is relatively exposed to dust and sand from the wind or from passing motor vehicles. Product management that is carried out without paying attention to the quality and quality of the product has the potential to have an impact on reducing consumers. Consumer protection law training is carried out with the aim of increasing the understanding of business actors so that they care about the quality and quality of traded commodities, considering that dried rosella will be brewed and drunk by the public. The research used in writing this scientific article is empirical juridical. The data collected is qualitative data. The research approach used in this writing uses a statute approach. Maintaining product quality and quality is a form of business actor's concern for consumers in accordance with Law 8/1999. Understanding of dried rosella flower business actors in Selopanggung Village regarding consumer protection laws can help business actors avoid potential economic and legal problems.

Abstract

Salah satu permasalahan yang terjadi di Indonesia dengan pertumbuhan teknologi bermedia sosial menyebabkan timbulnya fenomena baru dalam generasi Z atau para remaja sebagai ajang untuk melakukan kecenderungan berpelilaku bullying (CYBER BULLYING) yang diawali dari komentar negatif yang memiliki kualitas berulang. Permasalahan terkait pola pikir bahwa yang melakukan suatu perbuatan yang tidak disengaja yang menyebabkann hal yang tidak mengenakan terhadap seseorang. Dengan demikian, untuk mengatasi permasalahan tersebut perlu adanya peraturan perundang – undang yang mengatur kegiatan di media sosial. Dengan adanya pengabdian masyarakat ini bertujuan untuk memberikan edukasi berupa wawasan hukum terkait dengan aturan-aturan dalam kegiatan bermedia sosial dengan baik, serta dalam pengabdian ini juga memberikan kesempatan kepada pelajar SMAN 1 SOOKO untuk menyaksikan langsung pemaparan materi tentang peraturan – peraturan yang mengatur kegiatan sosial media dengan seorang jaksa atau praktisi hukum. Dengan adanya pengabdian ini menghasilkan peningkatan pengetahuan pelajar SMAN 1 Sooko Kab. Mojokerto mengenai konsep dan penerapan kegiatan yang baik dalam bermedia sosial sesuai dengan ketentuan undang – undang yang berlaku. Pemberian edukasi kepada pelajart ini dilakukan melalui pemaparan materi yang disampaikan oleh narasumber dan dilanjutan dengan pemberian contoh-contoh Tindakan cyber bullying serta tanya jawab yang bertujuan untuk mengukur seberapa paham para pelajar mengenai tema cyber bullying. Artinya, pelajar tidak hanya diberikan pemaparan materi saja tetapi juga dilakukan pemberian contoh-contoh Tindakan cyber bullying.

Abstract

This research aims to understand the concept of implementing water subscription contracts between the Regional Water Company (PDAM) and Consumers in PDAM Surya Sembada, Surabaya City. The study is motivated by issues of contract violations that occur after consumers subscribe to water services with PDAM Surya Sembada, Surabaya City. The research methodology employed is juridical empirical with a case study approach focusing on instances at PDAM Surya Sembada, Surabaya City. Legal resources include primary, secondary, and non-legal sources. Data were collected through field studies and literature reviews at the Enforcement Division office, PDAM Surya Sembada, Surabaya City. Findings reveal that in the 2023 period, there were 290 cases of water subscription contract violations, comprising 104 cases of default and 186 cases of unlawful conduct by consumers. Resolution of violations occurred without litigation but through non litigious approaches in accordance with the company's operational standards, referencing the Surabaya City Mayor Regulation No. 29 of 2011 regarding the Management and Provision of Drinking Water by the Regional Water Company Surya Sembada, incorporated into the water subscription contract by the company.

Abstract

Seiring dengan perkembangan zaman, teknologi yang ada di dunia ini pun juga semakin ikut berkembang, contohnya seperti perkembangan teknologi dalam penggunaan internet. Saat ini, internet dapat dimanfaatkan untuk dapat berkomunikasi secara daring (online) melalui sosial media. Dalam penggunaan sosial media, tidak menutup kemungkinan dapat terjadi tindak kejahatan yang dapat dilakukan secara daring (online) atau yang biasanya disebut dengan kejahatan siber (cybercrime). Salah satu jenis dari kejahatan siber adalah cyberstalking yang merupakan perilaku menguntit seseorang secara daring (online) dengan memanfaatkan teknologi internet yang diwujudkan dengan beberapa metode dalam melakukan tindakan tersebut. Di Indonesia sendiri belum terdapat peraturan perundang-undangan yang mengatur secara spesifik mengenai kejahatan cyberstalking ini. Saat ini yang menjadi acuan dari pengaturan cyberstalking adalah Undang-Undang Informasi dan Transaksi Elektronik (UU ITE) meskipun isi dari pasal-pasal tersebut tidak secara eksplisit mengatur tentang cyberstalking. Sebagai pengguna sosial media, setiap individu wajib untuk memahami memahami kemungkinan tindak kejahatan yang dapat terjadi dalam penggunaan internet, sehingga dapat melakukan upaya preventif agar meminimalisir kemungkinan menjadi korban cyberstalking.

Abstract

The occurrence of massive changes in the realm of human life, one of which requires humans to be attached to cyber technology. Today's society, especially the younger generation, cannot be kept away from using the internet. Internet of Things makes Indonesia an opportunity to become one of the countries that can develop this technology. Like a double-edged coin, these opportunities can pose various threats including misuse of personal data, the emergence of the development of cybercrime with the latest tools such as cracking, illegal access, etc. The formulation of the problem that can be put forward by the author is (1) how is the impact of Internet of Things technology on today's young generation (2) how is the effectiveness of Internet of Things technology for the younger generation. The implementation of community service activities related to healthy and intelligent internet education based on the Internet of Things consists of 2 (two) parts, a literature study related to the activity title, namely healthy and intelligent internet education based on the Internet of Things, coordinating with the Miru Village government, Sekaran District, Lamongan Regency. The second stage in the implementation of community service activities was carried out offline on Thursday, July 14, 2022 at the Miru Village Hall which was attended by 20 Miru Village youth groups from several vulnerable groups aged 17-30 years. The result of this research is that cybercrime is closely related to transnational crime. The emergence of new criminal acts as part of the negative impact of Internet of Things technology such as online gender-based sexual violence crimes, theft of personal data and cyberbullying in Indonesia's young generation makes generation Z and millennial generation need education on how to use the internet in a healthy, intelligent and responsible manner.

Abstract

The handling of transnational crimes, namely corruption, requires the support of cooperation with other countries, both informally and formally between countries. The regulation of asset return is stated in the Opening of the United Nations Convention Against Corruption in 2003. Assets resulting from corruption crimes by perpetrators are mostly taken abroad and recovery in Indonesia faces challenges and obstacles. One of the factors that become an obstacle in the process of returning assets resulting from corruption transnationally is related to the return of assets when the requesting country and the requested country do not have bilateral agreements such as extradition and Mutual Legal Assistance. The problems that will be raised in this study are (1) how is the implementation of requests for mutual legal assistance in criminal matters (MLA) for perpetrators of corruption? (2) what are the obstacles and challenges in the process of mutual legal assistance in criminal matters (MLA) in prosecuting perpetrators of criminal acts of corruption in Indonesia? The writing of this legal article belongs to the category of socio-legal research or empirical law. The research approach applied in writing this scientific article uses a statutory approach, a conceptual approach, and a case approach. The data collection technique used in this paper is a field study taking data through interviews with the Directorate of Central Authority and International Law, Ministry of Law and Human Rights. The results obtained in this study are the renewal of the extradition law of the State of Indonesia is very important to do considering not only repatriating convicts but also adding regulations for the return of assets resulting from corruption abroad through Mutual Legal Assistance, regulation of assets of wealth convicts of corruption as a preventive measure. and repressive measures to be frozen, confiscated, and repatriated to Indonesia from abroad.

Abstract

JDIHN contains legal documents stored digitally in an electronic database that can be accessed from anywhere by the general public. Based on Presidential Decree 33/2012, universities are also ordered to form JDIH in their respective environments. Legal regulations and policies must be formed and socialized in each Higher Education Units so that the teaching and learning process runs well. However, many of the legal regulations and policies made in this higher education environment, if analyzed using legal science, have many administrative and substantive defects. In order to achieve the goals of National legal development and as an effort to prevent disharmonization of legal regulations and policies vertically and horizontally within Higher Education units. This research is a normative legal research type, using a statute approach and a conceptual approach. JDIH in the implementation of Higher Education is expected to be able to minimize disharmonization of regulations and policies that occur in local universities so that they can be minimized or resolved. This method is also a means of realizing the principle of transparency in public services in order to realize good governance and achieve the goals of national legal development. The implementation of JDIH integration starting from each Higher Education Institutions as a member to the Ministry of Education and Culture's JDIH as coordinator, which then continues with integration into BPHN, needs to be regulated in a Ministerial Regulation so that there is no overlap in The authority

Abstract

The armed conflict in Myanmar has escalated since the military coup in 2021. In this armed conflict, many civilian casualties have fallen and civilian facilities have been destroyed. This type of research is normative legal research with a descriptive prescriptive nature. This scientific article consists of three sub-discussions. First, this scientific article discusses international regulations governing the protection of Myanmar civilians when a non-international armed conflict is taking place. Second, it discusses gross human rights violations committed by the Military Junta against Myanmar civilians when in conflict with the Rebel Forces. Third, it discusses international mechanisms that can be carried out to resolve the conflict and protect Myanmar civilians. The results of this study state that the armed conflict between the Rebel Forces fighting against the military junta in Myanmar territory meets the elements of a Non-International Armed Conflict as stipulated by International Humanitarian Law. Since the 2021 military coup, there have been many gross human rights violations by the military junta, including attacks on demonstrators, torture, cutting off access to aid, and indiscriminate airstrikes. International mechanisms that can be used to resolve this problem include conducting diplomatic intervention and international community political resolution, implementing accountability for enforcing international legal instruments, and conducting humanitarian intervention and civil protection.

Abstract

The problem in this research is the act of default carried out by the auction winner. Article 1 paragraph 29 of Minister of Finance Regulation Number 213/PMK.06/2020 concerning Auction Implementation Instructions explains that buyers are required to pay for the auction object won in the auction no later than 5 (five) working days after the auction. The aim of this research is to understand the problems that occur in the implementation of voluntary non-execution auctions at the Office of the Notary/PPAT/Class II Auction Officer Dr. HR. Ibnu Arly, S.H., M.Kn and IBID Surabaya auction center. As well as to understand the legal protection for auction organizers against auction winners who default. The type of research is juridical-empirical with descriptive qualitative research characteristics. Using a conceptual approach, statutory approach and case approach. Legal materials come from primary legal materials, secondary legal materials and non-legal materials. Procedures for collecting legal materials include observation, interviews and literature study. The research results found that there are two legal protections for auction organizers against defaults committed by auction winners, namely preventive and repressive. As a preventive measure, hold an open house and sellers are required to submit a Land Registration Certificate (SKTP). For repayment, the security deposit belonging to the auction participant who defaults will not be returned and will not be allowed to participate in the auction again for 6 (six) months.   Keywords: Legal Protection, Default, Auction.
