Abstract

Indigenous culture plays a vital role in shaping normative frameworks that support modern governance. This study examines the Minangkabau indigenous community’s tradition of consensus-based deliberation (musyawarah) as a democratic pillar that contributes to the achievement of the Sustainable Development Goals (SDGs), particularly SDG 16.7 on inclusive and participatory decision-making. Using a normative legal research method with a qualitative approach, the study explores how Minangkabau customary law integrates communal values into decision-making processes that promote social justice and poverty alleviation. In Minangkabau society, deliberation is not merely procedural but reflects a collective ethic where truth is determined through group consensus rather than individual assertion. This principle fosters inclusive governance, equitable outcomes and social cohesion. The study further analyzes the alignment between this indigenous practice and the Islamic principle of syuraa (consultation), which serves as a moral foundation for participatory democracy in Islamic jurisprudence. The results show that deliberative consensus functions as an effective participatory democracy mechanism based on local wisdom in realizing social justice and poverty alleviation. These findings confirm the relevance of integrating customary values and the principle of syūrā in strengthening equitable social governance and supporting the sustainable achievement of the SDGs.

Abstract

This study aims to identify and analyze the obstacles faced by the police in determining suspects in cases involving the promotion of online gambling sites through information technology. This research employs an empirical legal research method, which examines the application of legal norms based on real conditions in the field. Data were collected through interviews, observations, and a literature review of primary and secondary legal materials. The study was conducted at the Regional Police of South Sulawesi (Polda Sulsel).The results indicate that the legal procedure for determining suspects in online gambling promotion cases at Polda Sulawesi Selatan involves several stages: investigation, inquiry, collection of valid evidence, and witness examination. Once at least two sufficient pieces of evidence are obtained in accordance with the Indonesian Criminal Procedure Code (KUHAP), the investigator formally determines the perpetrator as a suspect. Law enforcement is carried out carefully, as offenders often disguise their digital identities using fake accounts, virtual private networks (VPNs), and proxy servers. The main challenges faced by the police include difficulties in tracing perpetrators’ identities due to digital obfuscation, limited access to encrypted communication data, and the lack of public participation in reporting online gambling promotion activities. These findings highlight the importance of improving investigators’ technical capacity and strengthening inter-agency cooperation, particularly with the Ministry of Communication and Informatics and digital platform providers, to enhance the effectiveness of law enforcement against cybercrime based on information technology.

Abstract

Abstrak: Penelitian ini bertujuan untuk mengetahui dan menganalisis akibat hukum pemutusan kerja secara sepihak yang tidak berdasarkan Undang-Undang Ketenagakerjaan Nomor 13 Tahun 2003 serta untuk mengetahui upaya hukum jika terjadi Pemutusan Hubungan Kerja sepihak oleh suatu perusahaan. Penelitian ini menggunakan pendekatan hukum normatif, adapun hasil penelitian yaitu Pertama: akibat hukum pemutusan hubungan kerja sepihak oleh pengusaha yang tidak berdasar pada Undang-Undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan adalah batal demi hukum selain itu apabila PHK tidak terhindarkan pengusaha wajib membayar uang pesangon, uang penghargaan serta uang pengganti hak yang besarannya telah diatur dalam UU Ketenagakerjaan. Kedua: upaya hukum yang dapat ditempuh jika terjadi pemutusan hubungan kerja sepihak oleh suatu perusahaan adalah dengan menempuh jalur Non Litigasi diantaranya bipartit, mediasi, konsiliasi, arbitrase, sebagai syarat untuk menempuh jalur Litigasi melalui gugatan di Pengadilan Hubungan Industrial. Abstract: This research aims to determine and analyze the legal consequences of unilateral termination of employment not based on Law Number 13 of 2003 Concerning Manpower and to determine the legal remedies in the event of unilateral termination of employment by a company. This research uses a normative legal approach. The results of the research are as follows: first, the legal consequences of unilateral termination of employment by employers not based on Law Number 13 of 2003 Concerning Manpower are null and void. Furthermore, if the termination is unavoidable, the employer is obliged to pay severance pay, reward money, and compensation for rights, the amounts of which are regulated in the Manpower Law. Second: Legal remedies that can be taken in the event of unilateral termination of employment by a company include non-litigation, including bipartite negotiations, mediation, conciliation, and arbitration, as a prerequisite for pursuing litigation through a lawsuit in the Industrial Relations Court.
