Abstract

Abstract In essence, children cannot protect themselves from various things kinds of actions that cause various kinds of effects, children must be assisted by others in protecting themselves, given the situation and conditions, rights of life and the right to freedom as basic rights and basic freedoms cannot obliterated, but must be protected. Because children's rights are a part from human rights that are guaranteed and protected by law international law and national law. In Republican Laws Indonesia Number 35 of 2014 concerning Child Protection states; Child is an integral part of human survival and sustainability of a nation and state. In order to be able to be responsible for the future of the nation and country, every child needs to get the widest opportunity to grow and develop optimally, both physically, mentally and socially. Therefore safeguards are needed to realize the welfare of children with provide guarantees for the fulfillment of their rights without any treatment discriminatory. Thus when the child is an adult then the child will know and understand what his rights and obligations are good for family, community, nation and country. Nature prioritizes the interests of the child is a natural behavior, this indicates a correlation between that behavior working together in a collaborative life. ABSTRAK Intinya, anak tidak dapat melindungi diri dari berbagai hal macam tindakan yang menimbulkan berbagai macam efek, anak-anak harus dibantu oleh orang lain dalam melindungi diri mereka sendiri, mengingat situasi dan kondisi, hak hidup dan hak kebebasan sebagai hak dasar dan kebebasan dasar tidak bisa dilenyapkan, tetapi harus dilindungi. Karena hak anak adalah bagian dari hak asasi manusia yang dijamin dan dilindungi oleh hukum internasional dan hukum nasional. Dalam Undang-Undang Republik Indonesia Nomor 35 Tahun 2014 tentang Perlindungan Anak; Anak adalah bagian integral dari kelangsungan hidup manusia dan keberlanjutan suatu bangsa dan negara. Agar dapat bertanggung jawab atas masa depan bangsa dan negara, setiap anak perlu mendapatkan kesempatan seluas-luasnya untuk tumbuh dan berkembang secara optimal, baik secara fisik, mental dan sosial. Oleh karena itu diperlukan perlindungan untuk mewujudkan kesejahteraan anak-anak dengan memberikan jaminan untuk pemenuhan hak-hak mereka tanpa perlakuan yang diskriminatif. Dengan demikian ketika anak sudah dewasa maka anak akan tahu dan mengerti apa hak dan kewajibannya baik untuk keluarga, masyarakat, bangsa dan negara. Sifat memprioritaskan kepentingan anak adalah perilaku alami, ini menunjukkan korelasi antara perilaku yang bekerja bersama dalam kehidupan kolaboratif. Abstract

Isu Kepailitan merupakan permasalahan yang sangat rentan terjadi pada suatu perusahaan terkhususnya di kala suatu perusahaan menghadapi persoalan likuiditas keuangan dan hal ini jelas akan menjadi ancaman untuk dipailitkan hanya dengan melalui permohonan dari sedikitnya dua pihak kreditur.Salah satu dampak dari dinyatakannya pailit suatu perusahaan adalah terhadap nasib para pekerja/buruh yang masih bekerja di perusahaan tersebut. Persoalan gaji terutang dan/atau pesangon yang merupakan kewajiban pengusaha untuk membayar kepada pekerja/buruh menjadi teralihkan ke kurator pada saat pernyataan pailit diucapkan pengadilan niaga pada pengadilan negeri.Pengaturan hukum mengenai hak pekerja/buruh akibat adanya pernyataan pailit suatu perusahaan sudah tertera pada Undang-Undang Ketenagakerjaan RI Nomor 13 tahun 2003, yang mana telah diperkuat kembali melalui Putusan Mahkamah Konstitusi Nomor 67 tahun 2013 terhadap Undang-Undang Ketenagakerjaan RI Nomor 13 tahun 2003. Selain itu, Undang-Undang Kepailitan dan Penundaan Kewajiban Pembayaran Utang Nomor 37 tahun 2004 juga mengatur mengenai hak pekerja dalam hal upah terutang yang akan menjadi utang debitur di dalam harta pailit.Secara umum pengaturan hukum terhadap hak pekerja/buruh terkait perusahaan yang mengalami kepailitan sudah jelas, namun pada kenyataannya pelaksanaan di lapangan dalam pemenuhan hak pekerja/buruh tidak sepenuhnya sesuai dengan ketentuan perundangan yang berlaku sehingga timbul ketidakjelasan dalam implementasi hukum positif yang ada di Indonesia, khususnya di Kota Batam. Hal ini tentu tidak sesuai dengan azas kepastian hukum yang berlaku di negara ini.

Abstract

Kegiatan pengabdian kepada Masyarakat di wilayah kampung tua teluk lengung dilaksanakan untuk membantu Masyarakat dalam hal kebutuhan pokok guna untuk saling menolong dan mewujudkan sikap kepedulian, Kegiatan bakti social merupakan bentuk dari sifat manusia yang memiliki simpati dan empati. Bakti sosial merupak kegiatan yang mencerminkan adanya rasa peduli kepada masyarakat yang membutuhkan serta keinginan untuk menolong meringankan kebutuhan hidupnya. Salah satunya dengan berbagi sembako yang merupakan cabang dari bakti sosial sebgai kegiatan pengabdian kepada masyarakat. Dengan adanya kegiatan ini dapat menjalin tali silahturahmi antar sesama sehinga akan membangun keakraban antara masayarak dengan seluruh civitas akademika Universitas Batam. Kegiatan pembagian sembako ini dinilai telah tercapai untuk meringankan Masyarakat khususnya masyarakat yang kurang mampu dengan harapan dapat membantu pemenuhan kebutuhan masyarakat.

Abstract

Cross-border drug trafficking is a form of transnational crime that threatens legal stability and global security. The Riau Islands as a strategic border region of Indonesia faces serious challenges in combating this crime due to limited law enforcement capacity, geographic vulnerability, and weak coordination between countries. This study aims to analyze the effectiveness of international legal regulations on cross-border drug trafficking and evaluate the challenges of its implementation in the Riau Islands region. The method used is normative juridical with a legislative and conceptual approach based on literature studies. The results of the study indicate that the weak harmonization of international norms with national laws, as well as limited capacity for legal enforcement and diplomacy, are the main obstacles. Therefore, it is necessary to strengthen the implementation of international conventions, cross-country coordination, and develop national legal institutions to effectively address the challenges of cross-border drug crimes.

Abstract

Digital transformation in public services is a form of adaptation to the development of information technology aimed at improving efficiency, transparency, and accountability. In the immigration sector, residence permit services for foreigners are among the strategic services that demand legal certainty, speed, and accuracy. However, various obstacles are still encountered in its implementation, such as system incompatibility, technical disruptions, low digital literacy, and potential procedural deviations. This study aims to analyse, from a legal perspective, the effectiveness of digital transformation in residence permit services to achieve transparency and accountability at the Class I Special Immigration Office TPI Batam. The methods used in this research are normative and empirical legal research methods. The normative approach reviews relevant laws and regulations, such as the 1945 Constitution of the Republic of Indonesia, Law Number 6 of 2011 concerning Immigration, and Presidential Regulation Number 95 of 2018 concerning the Electronic-Based Government System. Meanwhile, using a socio-legal approach, the empirical approach is carried out through interviews and observations of implementing digital services in the field. The research results indicate that, normatively, the regulations governing the digital transformation of residence permit services are already adequate. However, their effectiveness is still not optimal in practice due to various technical, institutional, and social obstacles. The digital system has driven improvements but does not yet fully ensure transparency and accountability due to weak internal supervision and a lack of human resource support. Therefore, updates to the technological system, human resource training, increased public digital literacy, and tightening regulations and supervision are needed as strategic efforts.

Abstract

The 7-day Visa on Arrival (VOA) policy is one of the innovations in Indonesia's immigration system aimed at increasing the number of foreign tourist visits, mainly in strategic border areas such as Batam City. The implementation of this policy is based on Government Regulation Number 45 of 2024 concerning PNBP, Circular Letter of the Director General of Immigration Number IMI-272. KU.01.03 of 2024, as well as the Decree of the Minister of Law and Human Rights Number M. HH-06.01.01 of 2023. Although normatively this policy already has a strong legal basis, the effectiveness of its implementation still needs to be studied comprehensively. This study aims to analyze the legal arrangements of the 7-day VOA policy from the perspective of immigration and tourism, evaluate its implementation in increasing foreign tourist visits to Batam City, and identify obstacles and provide solutions to improve the policy's effectiveness. The research methods used are normative and empirical juridical approaches, with data collection techniques through literature studies and field interviews at the Batam City Immigration Checkpoint. They also use socio-legal approaches and theoretical analysis from Lawrence M. Friedman and Soerjono Soekanto. The study results show that even though the 7-day VOA policy has been implemented administratively and has legitimate regulations, its implementation is still not optimal. The main obstacles are limited human resources, a lack of socialization, and low legal awareness among tourists. Therefore, it is necessary to strengthen the substance of policies, increase the capacity of the apparatus, integrate technology, and socialize with tourism industry players. Thus, this policy is expected to be not only normatively legal but also substantively effective in encouraging the growth of the national tourism sector

Abstract

Citizenship is a fundamental legal status that forms the basis for recognizing every individual's civil, political, social, and economic rights. However, in practice, legal and social issues still cause individuals to lose their citizenship status (involuntary statelessness) unintentionally. This study highlights the case of Setia Watti S. Lalang in Batam City as a concrete example of the failure of legal and administrative systems to ensure the protection of the right to citizenship per the principles of human rights. Setia Watti, a woman born in Indonesia who in practice lives as an Indonesian citizen, faces uncertainty regarding her legal status due to documentation issues and overlapping policies between various agencies. This study aims to analyze the legal regulation of citizenship in Indonesia from a juridical perspective, examine the law's implementation in such cases, and identify challenges and obstacles in resolving cases of loss of citizenship. The methods used are normative juridical and empirical juridical legal research methods with a statute approach and a socio-legal approach, as well as collecting primary data through interviews and field observations. The research results show a gap between positive legal norms, the administrative practices implemented by the relevant agencies, and a lack of coordination among institutions in handling cases of loss of citizenship. In addition, the legal approach that is not yet based on human rights further marginalizes vulnerable groups such as women and children from mixed marriages. This study recommends the need for affirmative policies, improvements to derivative regulations of the Citizenship Law, cross-sectoral synergy and active participation of civil society in advocating for the fulfillment of the right to citizenship.

Abstract

The Criminal Act of Human Trafficking (TPPO) is a transnational crime that has a serious impact on human rights, especially in border areas such as Batam City, which has direct access to neighboring countries through the Batam Centre International Port. Preventing TPPO requires effective collaboration between Immigration and various stakeholders such as the Police, port authorities, and civil society organizations. This study aims to analyze the legal regulations, implementation, obstacles, and solutions regarding the collaboration between Immigration and stakeholders in efforts to prevent TIP at Batam Centre International Port. The methods used are normative juridical and empirical juridical legal research methods with a statutory approach and a sociological approach. Data was obtained through document studies and direct interviews with Immigration, the Police, KSOP, and NGOs. The analysis was carried out using three main theories: Max Weber's Theory of Authority, Lawrence M. Friedman's Legal System Theory, and Soerjono Soekanto's Theory of Legal Effectiveness. The results of the study show that although the legal framework for collaboration has been regulated through Law Number 6 of 2011 and Law Number 21 of 2007, as well as several technical memorandums of understanding, its implementation is still not optimal. The identified obstacles include overlapping authorities, the absence of inter-agency SOPs, limited resources, and a weak culture of cooperation. Current collaboration remains sectoral and has not been institutionalized on a permanent basis. This study recommends the establishment of integrated inter-agency SOPs, the creation of permanent coordination posts at ports, and collaborative training and incentive systems to strengthen institutional synergy in the prevention of human trafficking in border areas.

Abstract

The international port in Batam City serves as the main entry point for the flow of foreigners, playing a strategic role in tourism, business, and cross-border activities. To improve the efficiency of immigration checks and reduce manual queues, the government has implemented the autogate system, an automated inspection system based on biometric technology. However, the implementation of this system still faces various challenges from technical, legal, and social aspects, such as system disruptions, regulatory gaps, and low user understanding. This study aims to analyze the legal regulations of the autogate system, evaluate the effectiveness of its implementation, and identify obstacles and possible solutions to facilitate the movement of foreigners at the international port of Batam City. This study uses a normative juridical and empirical juridical approach, with secondary data collected through document studies and primary data gathered through interviews and direct observation at Batam Center, Sekupang, and Harbour Bay ports. The analysis is conducted based on the framework of Modern Law Theory (Eugen Ehrlich), Legal System Theory (Lawrence M. Friedman), and Legal Certainty Theory (Sudikno Mertokusumo). The research results indicate that the autogate system already has a legal basis through the Immigration Law, Minister of Law and Human Rights Regulations, as well as regulations on personal data protection. However, its implementation has not been optimal due to weak infrastructure readiness, lack of staff training, and uneven public understanding. Therefore, it is necessary to strengthen technical policies, enhance technology and human resource capacity, and conduct ongoing public outreach to improve the effectiveness and legal certainty in the use of the autogate system.

Abstract

The crime of trafficking in persons (TPPO) is a form of transnational crime that continues to grow and threatens human rights, especially in border areas such as Batam, which is one of the strategic routes to neighboring countries. The Immigration Office, as a law enforcement institution in the field of immigration, has a vital role in preventing the practice of trafficking through its supervisory functions and administrative actions at the entrances and exits of Indonesian territory. This study aims to analyze legal arrangements and implementation, as well as obstacles and solutions to immigration's role in preventing trafficking, with a focus on the Special Class I Immigration Office of TPI Batam. This study uses normative and empirical juridical methods, with a statute approach and a socio-legal approach. Data was collected through literature studies, observations, and interviews with Immigration officials and officers. The theories used in the analysis include the Theory of the State of Law, the Theory of the Legal System, and the Theory of Legal Certainty. The results of the study show that national and international legal arrangements have provided an adequate basis for the role of Immigration in the prevention of trafficking. However, its implementation in the field still faces a number of obstacles, including limited administrative authority, a lack of data integration between agencies, limited human resources, and a lack of optimal understanding of trafficking indicators. For this reason, it is necessary to update more technical SOPs, increase cross-sector and international cooperation, provide continuous training for officers, and strengthen information systems and surveillance technology as an integrated solution strategy.
