Abstract

In 1984 the People's Republic of China (PRC) and the United Kingdom (UK) signed an international agreement to hand over Hong Kong to the PRC on the condition that it be granted a high level of autonomy, except in the field of defence and cooperation with foreign powers. In 2020, PRC Government issued the 2020 Hong Kong Security Law, which contains restrictions on political rights for the people of Hong Kong. This provision will automatically lead to discourse in international law, whether the HKSL 2020 is a manifestation of the implementation of PRC's legal sovereignty or violates the Sino-British Joint Declaration 1984 as a treaty which contains requirements for the transfer of Hong Kong. This article is intended to examine these problems using a normative, historical and conceptual approach. As a result, even though PRC has sovereignty to implement its national law in the territory, the authority must be placed within the limits of compliance with international law. Non-compliance with international treaties will lead to consequences of internationally wrongful acts as a breach of the treaty.

Abstract

In order to investigate the State's duty to provide fundamental rights in a State of exigency, this research aims to assess how the State implements human rights standards on disaster management and response in Indonesia. This study examines whether human rights standards have been included in Indonesian disaster management laws and regulations, as well as how these standards have been applied in the wake of the September 28, 2018, Palu tragedy. The inquiry was carried out through field research utilizing a standard questionnaire based on human rights implementation criteria, in compliance with The Core Humanitarian Standard on Quality and Accountability (CHS) 2014 standards. An FGD amongst stakeholders was held before the research to get more detailed and impartial information between the government and the disaster victims. Human rights standards are not being applied to disaster management in Palu, as evidenced by reports of victims being treated unfairly and inadequately supplied with necessities. According to the research's findings, there is a conflict between the State authority's propensity to apply positive-legalistic regulation of disaster management and the regulation's lax protection of human rights.

Abstract

The increasing utilization of outer space has brought about unprecedented opportunities and potential security challenges. The development of anti-satellite (ASAT) weapons has raised concerns about the militarization of space and the potential for conflict. This research examines the legal framework governing ASAT weapons under international space law, focusing on the Outer Space Treaty (OST) and the International Telecommunication Union (ITU) Radio Regulations. It analyzes the limitations of existing legal instruments in addressing the threats posed by ASATs, particularly their potential to generate space debris and disrupt critical satellite infrastructure. This research adopts normative (doctrinal) legal methods by incorporating statutes and conceptual frameworks to analyze primary and secondary legal sources in order to investigate legal standards regarding militarization and disarmament in space. This research highlight that the current legal framework is insufficient to prevent the proliferation and use of ASAT weapons and proposes the development of a new international treaty specifically addressing ASATs. This treaty would provide clearer definitions, stricter regulations, and stronger enforcement mechanisms to ensure the long-term sustainability and security of space activities. This research also explores the role of the ITU in promoting the peaceful and responsible use of outer space through its Radio Regulations and technical expertise. The findings emphasize the need for greater cooperation between the ITU and other international organizations to address the challenges posed by ASAT weapons and ensure the continued benefits of space technology for all humankind.
