Abstract

Abstract Diversity implementation by law enforcers is based on the authority of law enforcers called the dis-cretion or discretion of children as the potential of the State in the context of the survival and glory of the nation, is how the government’s commitment to make children a top priority in the development of juvenile judges and courts as the last stronghold in the process settlement of children who are fac-ing law in the Court. The police and the community must synergize and develop the same perception of diversion and restorative justice. Parents must participate in providing protection for children by fulfilling children’s rights, protecting the interests of children and further increasing supervision of the environment and where children play. Abstract

Copyright is very important part of Intelectual Property Right. That is particularly in the field creation of Copyright about song and music, its offence extremely concerned and serious in Indonesia. Copyright is the exclusive right or special right which has meaning that other people cannot take all advantages on the right as from creator economy for its creatures without any license creator or copyright holders legitimate. The Consequences are in every utilization of music for Commercial Business activities and or for purpose relates with business/aims commercial such as Café, Hotel, restaurant and others, must request permission first to the creator and or copyright holder over the use of creation in regards about the song and music. Abstract

Hak Cipta merupakan bagian yang sangat penting dari Hak Kekayaan Intelektual, khususnya di bidang karya kreatif musik dan lagu; pelanggaran tersebut sangat memprihatinkan dan serius di Indonesia. Hak Cipta adalah hak eksklusif atau hak khusus yang berarti bahwa orang lain tidak dapat memanfaatkan hak ekonomi pencipta atas ciptaannya tanpa persetujuan terlebih dahulu dari pencipta atau pemegang hak cipta yang sah. Konsekuensinya dalam setiap penggunaan musik untuk usaha komersial dan/atau kepentingan yang berkaitan dengan kegiatan usaha/tujuan komersial seperti kafe, hotel, restoran dan lain sebagainya harus terlebih dahulu meminta persetujuan pencipta atau pemegang hak cipta atas penggunaan ciptaan musik tersebut. Penelitian ini dibuat dan disusun dengan menggunakan metode penelitian normatif yuridis yang mengacu pada norma-norma hukum yang terdapat dalam peraturan perundang-undangan. Konsekuensi hak cipta (musik dan lagu) sebagai suatu hak yang eksklusif (khusus) adalah bahwa setiap orang yang ingin memanfaatkan hak ekonomi pencipta atas ciptaannya penggunaan yang bersifat komersil diwajibkan menurut hukum untuk meminta izin kepada pencipta atau pemegang hak ciptanya yang sah. Akibat hukum penggunaan karya cipta (musik dan lagu) tnpa izin dari pencipta atau pemegang hak ciptanya yang sah adalah gugatan ganti rugi secara perdata melalui Pengadilan Niaga dan tuntutan pidana berupa tindak pidana pelanggaran hak cipta yang menurut undang undang merupakan suatu jenis tindak pidana aduan. Kata Kunci: Lisensi, Karya Cipta, Musik, Lagu, Akibat Hukum.

Abstract

Article History Received: Revised: Published: Keywords: Consumer Protection Law, Maritime Transportation, Shipping Companies Abstract: Maritime cargo transportation is inherently fraught with risks that can cause losses to cargo owners. The goods being transported are at risk of damage or loss during the journey due to natural factors or human negligence, including ship accidents that can result in total loss. Therefore, it is crucial to explore the extent of the compensation obligations of shipping companies for transported goods under consumer protection law, as well as the application of compensation in cases of cargo ship accidents. This study employs a normative juridical method, focusing on the analysis of statutory regulations, books, journals, and relevant papers. The data collection technique utilized is library research, encompassing secondary materials. The findings of this study indicate that, first, the compensation obligations of shipping companies are in accordance with Law Number 8 of 1999 concerning Consumer Protection. From the perspective of consumer protection law, shipping companies are responsible for losses suffered by senders or third parties due to negligence in performing transportation services. This responsibility includes damage or delays in the delivery of goods. Second, in the event of a cargo ship accident, the affected parties can file an official and written claim with the shipping company, supported by valid documentation. Claim resolution is typically based on principles of kinship and deliberation but may also involve repairs to damaged goods as a form of compensation. KataKunci: Hukum Perlindungan Konsumen, Pengangkutan Laut, Perusahaan Kapal Abstrak: Pengangkutan barang melalui laut tidak terlepas dari berbagai risiko yang dapat merugikan pemilik barang. Barang yang diangkut berisiko mengalami kerusakan atau kehilangan selama perjalanan akibat faktor alam atau kelalaian manusia, termasuk kecelakaan kapal yang dapat menyebabkan kerugian total. Oleh karena itu, penting untuk mengeksplorasi sejauh mana kewajiban ganti rugi perusahaan perkapalan pengangkut barang berdasarkan hukum perlindungan konsumen, serta bagaimana penerapan ganti rugi dalam kasus kecelakaan kapal pengangkut barang. Penelitian ini menggunakan metode yuridis normatif dengan analisis substansi peraturan perundang-undangan, buku, jurnal, dan makalah terkait. Teknik pengumpulan data dilakukan melalui studi kepustakaan (library research) yang mencakup bahan sekunder. Hasil penelitian menunjukkan bahwa, pertama, kewajiban ganti rugi perusahaan perkapalan pengangkut barang sesuai dengan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Dalam perspektif hukum perlindungan konsumen, perusahaan pengangkutan barang bertanggung jawab atas kerugian yang dialami oleh pengirim atau pihak ketiga akibat kelalaian dalam pelaksanaan layanan pengangkutan. Tanggung jawab ini mencakup kerusakan atau keterlambatan pengiriman barang. Kedua, dalam kasus kecelakaan kapal pengangkut barang, pihak yang dirugikan dapat mengajukan klaim resmi dan tertulis kepada perusahaan pengangkut dengan melampirkan dokumen-dokumen yang sah. Penyelesaian klaim biasanya dilakukan berdasarkan asas kekeluargaan dan musyawarah, namun juga dapat meliputi perbaikan terhadap barang-barang yang rusak sebagai bentuk pembayaran ganti rugi.

Abstract

The granting of special privileges to foreign investors in certain sectors has the potential to violate human rights, such as the right to land and the right to a healthy environment. Foreign investors often do not exhibit the same level of concern for the rights of local communities as domestic entrepreneurs. Regulations regarding special privileges for foreign investors in Indonesia are frequently unclear, leading to varied interpretations. This situation creates legal uncertainty and opens up opportunities for abuse. This normative juridical research produced several findings. First, the regulation of special privileges for foreign investors in Indonesia is governed by legislation, particularly Law No. 25 of 2007 on Investment. This law provides various facilities, including special privileges, to foreign investors. However, these regulations are not yet fully effective, raising concerns about legal certainty. This indicates the need for reforms in the legal and investment regulation systems so that Indonesia can become a prime destination for investors.Second, Indonesia has implemented the principles of National Treatment (NT) and Most-Favoured-Nation (MFN) in Law No. 25 of 2007 on Investment. Article 6(1) of the law mandates that the government must provide equal treatment to all investors, regardless of their country of origin, in accordance with applicable regulations. This principle ensures legal fairness through “equal treatment” for all investors, whether domestic or foreign, without discrimination. Thus, the Non-Discrimination Principle has been effectively implemented.

Abstract

In the context of a knowledge-based economy, intellectual property (IP) has emerged as a critical asset for business competitiveness, yet it remains inadequately recognized in Indonesia’s bankruptcy law. Trademarks, copyrights, and patents key components of IP are often excluded from the core bankruptcy estate due to legal ambiguity and the absence of standardized valuation and management procedures. This research aims to reconstruct Indonesian bankruptcy law to better integrate IP as a vital economic asset in insolvency proceedings. Utilizing a descriptive-analytical method with a juridical-normative approach, this study draws upon doctrinal sources and empirical data collected through interviews with legal practitioners and bankruptcy receivers. The findings reveal that current legal structures fail to reflect the real economic value of IP, resulting in underutilized assets and prolonged legal disputes, as exemplified by the Nyonya Meneer case. The study concludes that reform is urgently needed to incorporate IP into the bankruptcy framework, not only as an asset with immediate monetary value but also as a tool for post-bankruptcy recovery and sustainability. A revised legal framework would ensure equitable treatment for both creditors and debtors and align national insolvency policies with the evolving dynamics of global commerce and innovation.

Abstract

Foreign direct investment (FDI) has a strategic role in Indonesia's economic development. However, the realization of foreign investment is not free from challenges related to legal certainty and protection. This study aims to analyze legal protection for foreign investors in Indonesia, both in terms of applicable legal norms and from the aspect of implementation in the field. Through a literature review, information was collected from various sources in the form of journals, articles, and relevant laws and regulations to gain a broad understanding of legal protection for foreign investors at the normative and implementation levels in Indonesia. The results of the study indicate that Indonesian laws and regulations, especially Law No. 25/2007 concerning Investment, various Bilateral Investment Treaties (BITs), and FTAs ​​provide a comprehensive legal protection framework for foreign investors. In the field, legal uncertainty still arises due to overlapping regulations, frequent policy changes, and different interpretations between institutions. Slow and less transparent licensing bureaucracy, as well as the risk of extortion practices, reduce the attractiveness of investment. Reform efforts such as simplifying licensing through OSS, establishing BKPM as a one-stop shop, and ratifying the Omnibus Law on Job Creation have shown progress in increasing certainty and ease of investment.

Abstract

This study examines the legal consequences and liability arising from actions taken by the Board of Directors and the Board of Commissioners of a limited liability company (Perseroan Terbatas PT) after their official terms of office have expired. Employing a cross-sectional quantitative survey design, a Likert-scale questionnaire was distributed to 270 respondent comprising corporate managers of publicly listed companies on the Indonesia Stock Exchange (large-, mid-, and small-cap) and corporate law practitioners in Greater Jakarta. Construct validity (KMO = 0.68; Bartlett’s Test p < 0.001) and reliability (Cronbach’s α = 0.78–0.84) confirmed the adequacy of the instrument. Descriptive analysis showed moderate mean scores for legal status of actions (Mean = 3.12) and reappointment mechanisms (Mean = 2.75). Pearson’s correlation revealed a significant positive relationship between “ultra vires” actions and civil liability risk (r = 0.582; p < 0.001) as well as criminal liability risk (r = 0.314; p < 0.001), whereas reappointment via the General Meeting of Shareholders (RUPS) correlated negatively with civil (r = –0.423; p < 0.001) and criminal (r = –0.287; p < 0.001) risks. Multiple linear regression reinforced these findings (R² = 0.52 for civil risk; R² = 0.31 for criminal risk). ANOVA indicated that small-cap firms faced the highest civil risk and that practitioners with over ten years of experience reported the lowest concern for criminal risk. These results underscore the need for proactive RUPS scheduling, multi-layered authorization systems, and strengthened compliance functions to mitigate ultra vires risks and reinforce good corporate governance.

Abstract

Protection of well-known trademarks is a crucial aspect of intellectual property systems, especially in the face of global trade dynamics and the development of digital technologies. This study aims to analyze the effectiveness of legal protection for owners of well-known trademarks from the perspective of court decisions in Indonesia. Using a qualitative method based on a normative juridical approach and case studies of court rulings (including the Hugo Boss and Superman cases), this research reveals that trademark protection in Indonesia remains reactive, dependent on litigation, and has not fully prevented the registration of confusingly similar trademarks by parties acting in bad faith. Moreover, the absence of objective standards for defining well-known trademarks and indicators of bad faith weakens legal certainty. On the other hand, courts have begun to show consistency in rejecting trademark registrations that violate the principles of well-known trademark protection, although this has yet to be supported by an adequate administrative system from the Directorate General of Intellectual Property (DJKI). The study recommends the establishment of technical regulations, strengthening DJKI’s capacity, and integrating protection systems with international norms as strategic steps to reinforce legal protection for owners of well-known trademarks in Indonesia.

Abstract

:  This study examines legal protection for consumers in cases of product counterfeiting through the perspectives of consumer protection law and trademark law. The phenomenon of product counterfeiting is increasingly prevalent in Indonesia, causing harm not only to original producers but also endangering consumers as the most vulnerable party. This research employs a normative juridical method with a statute approach and a conceptual approach. Data sources consist of primary legal materials in the form of relevant laws and regulations, as well as secondary legal materials such as literature, journals, and expert opinions. The analysis is conducted qualitatively, emphasizing legal interpretation of applicable norms. The findings indicate that consumers are highly vulnerable in cases of product counterfeiting due to limited access to information, knowledge asymmetry, and the difficulty of distinguishing between genuine and counterfeit products. Legal protection can be pursued through two pathways: prevention and enforcement. Preventive legal strategies include strengthening regulations, integrated supervision, and consumer education. Meanwhile, enforcement is carried out through both criminal and civil legal actions against counterfeiters. Furthermore, the synergy between trademark protection and consumer protection serves as a crucial pillar in preventing counterfeiting practices, as both complement each other in ensuring justice, legal certainty, and utility. This study underscores the importance of the involvement of all stakeholders government, producers, consumers, and law enforcement authorities in establishing a layered protection system. Thus, the ultimate goal of consumer protection is not only to provide legal certainty but also to foster a fair and healthy trading environment.
