Abstract

Copyright law reform in the digital economy era is an urgent need to maintain the consistency of Indonesia's state ideology, particularly in the face of globalization and the dominance of purely economic interests. The main problem in this study is the lack of alignment between business actors and government institutions regarding copyright, as well as the weak implementation of Pancasila values in copyright regulations. This study aims to analyze how the principles of social justice of Pancasila can be applied in copyright law reform amidst the development of the digital economy. The method used is a juridical-normative approach with a qualitative analysis of laws and regulations, related policies, and expert views through literature studies. The results of the study indicate that the dominant economic orientation in copyright regulation tends to ignore the values of humanity and social justice. Furthermore, the lack of synergy between the government and business actors leads to weak legal effectiveness. Therefore, it is necessary to reformulate policies that support Pancasila values, as well as strengthen human resource capacity so that copyright law can become a fair and ethical instrument in the digital era.

Abstract

Consumer protection in telemedicine services in Indonesia has become increasingly important due to the rapid advancement of technology. These services face risks related to data privacy, unclear consumer rights, and challenges in interactions with healthcare providers. This study aims to evaluate the implementation of consumer rights protection in telemedicine services in Indonesia and analyze the effectiveness of existing regulations in safeguarding these rights. Key issues faced by consumers, such as uncertainties in complaint mechanisms and privacy breaches, are the main focus of this research. The methodology employed is policy evaluation, which includes an analysis of relevant regulations such as the Ministry of Health Regulation No. 20 of 2019 and the Consumer Protection Law. Interviews with legal experts were also conducted to gain deeper insights, along with comparisons to telemedicine regulations in other countries. Findings indicate that despite the existence of regulations, field implementation often does not align with legal provisions. Limitations in supervision and gaps between regulations and on-the-ground practices have resulted in consumer rights violations, particularly concerning data security and complaint mechanisms. Recommendations for improving consumer literacy, strengthening regulations, and establishing stricter monitoring mechanisms are proposed to enhance consumer protection in telemedicine services.

Abstract

To create a conducive business climate and to avoid unhealthy business competition, which can harm fellow business actors, including guaranteeing the quality of goods and services produced for the benefit of society as consumers, it is necessary to have legal institutions that regulate orderly business competition, known as the Business Competition Law. In Indonesia, the normative provisions of business competition law are regulated in Law No. 5 of 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition. In this connection, Law No. 5 of 1999 has regulated and established a number of rules aimed at creating a conducive business climate and healthy business competition, including through the regulation of prohibited closed agreements as regulated in Article 15 of Law No. 5 of 1999. Regulations come in various forms and types, all of which aim to create a conducive business climate and avoid unhealthy business competition, which can harm all parties.

Abstract

The Job Creation Law, first introduced in 2020, has sparked significant controversy, prompting widespread protests across Indonesia. Although the Constitutional Court ruled the law conditionally unconstitutional and demanded changes, the 2023 revisions have continued to attract criticism for inadequately addressing workers' grievances. This article evaluates the constitutionality of the Job Creation Law, focusing on the rights of contract workers within the outsourcing system. Through a juridical analysis of two precedent cases and the new Job Creation Law, this article examines the potential success of the petitioners' lawsuits. The conclusion indicates that despite some improvements, the law still contains significant weaknesses that need to be addressed to effectively protect workers' rights.

Abstract

Abstrak: Penggunaan perjanjian nominee dapat menjadi strategi yang umum untuk melindungi kepentingan atau menyembunyikan identitas investor. Namun, dalam praktiknya, keabsahan perjanjian nominee ini sering dipertanyakan, terutama dalam perspektif hukum perdata. Analisis terhadap keabsahan perjanjian nominee dalam perspektif hukum perdata menunjukkan bahwa penggunaannya dalam konteks penanaman modal memerlukan pertimbangan yang cermat terhadap prinsip-prinsip hukum perdata yang mendasarinya, serta dampaknya terhadap transparansi, kepastian hukum, dan perlindungan pihak-pihak yang terlibat. Oleh karena itu, dalam mempertimbangkan penggunaan perjanjian nominee, penting untuk mendapatkan nasihat hukum yang kompeten dan mempertimbangkan implikasi hukumnya secara menyeluruh. Metode yang diterapkan dalam penelitian hukum ini adalah metode penelitian yuridis normatif, yang bertitik tolak pada penelitian analisis subtansi peraturan perundang-undangan, buku-buku, jurnal dan makalah. Adapun teknik pengumpulan data yang diharapkan penulis ialah melalui studi kepustakaan. Kesimpulan dari penelitian ini, pertama menurut Kitab Undang-Undang Hukum Perdata (KUHPerdata), perjanjian nominee tidak sah. Kedua, perjanjian nominee termasuk dalam perjanjian innominaat yang telah digunakan secara luas dalam praktik. Kata Kunci: Hukum Perdata, Perjanjian Nominee, Penanaman Modal Abstract: Nominee agreements can be a common strategy to protect investors' interests or hide their identities. However, in practice, the validity of these nominee agreements is often questioned, especially from a civil law perspective. An analysis of the validity of nominee agreements from a civil law perspective reveals that their use in the context of investment necessitates careful consideration of the underlying civil law principles, as well as their impact on transparency, legal certainty, and the protection of the parties involved. Therefore, when considering the use of nominee agreements, it is important to obtain competent legal advice and thoroughly consider its legal implications. The normative juridical research method is used in this legal research, which focuses on analyzing the substance of laws and regulations, books, journals, and papers. The author expects data collection to be done through library research. The conclusion of this research is that, first, according to the Civil Code (KUHPerdata), nominee agreements are not valid. Second, nominee agreements are included in innominaat agreements, which have been widely used in practice. Keywords: Civil Law, Nominee Agreement, Investment

Abstract

This research aims to analyze the carrier's responsibilities in sea transportation, as well as evaluate the suitability of the Panel of Judges' legal considerations in the case between PT. Asuransi FPG Indonesia and PT. Pelayaran Tempuran Emas related to subrogation in insurance and responsibility of sea carriers. The research method used is normative descriptive analytical using primary, secondary and tertiary data. Various regulations that are used as references include Law no. 40 of 2014 concerning Insurance, Law no. 17 of 2008 concerning Shipping, Government Regulation no. 20 of 2010 concerning Water Transport (PP No. 20/2010), Government Regulation no. 51 of 2002 concerning Shipping (PP No. 51/2002), and Minister of Transportation Regulation No. 76 of 2017 concerning the Organization and Working Procedures of the Shipping Court. This research analyzes Decision Number 415/Pdt.G/2019/Pn. Jkt. Utr. regarding the dispute between PT. FPG Indonesia InsuranceJaya Iriantoin vain against PT. The Golden Tempuran Voyage, which was later canceled on appeal through Decision Number 452/PDT/2021/PT.DKI. The decision stated that the Plaintiff was not entitled to receive compensation payments that had been paid to PT RAPP. The conclusion highlights the responsibility of the carrier in maintaining the safety of goods, as well as the importance of the right of subrogation in insurance law, although there is uncertainty in the legal interpretation used.
