Abstract

Limiting the term of office of the head of government is an important prerequisite for realizing a democratic state life. In Indonesia, these restrictions are imposed on the President and Vice President with a term of office of 5 years and after that, they can be re-elected only for 1 term of office. Using the normative juridical method, this study shows that this choice has become a source of debate in other parts of the world, and several presidential countries have chosen different models of restrictions. In Indonesia, it has been revealed that this choice is not based on a deep conceptual debate and empirically has threatened the continuity of a principled election. As a solution, this study offers the application of the concept of a single term of office for the President and Vice President in Indonesia. This research also enriches the study of state administration in the theme of structuring the presidential system.

Abstract

Penelitian ini membahas mengenai perlindungan hukum bagi ahli waris yang dirugikan atas akta hibah yang dibuat secara melawan hukum. Dalam penelitian ini terdapat 2 (dua) pokok permasalahan, yaitu: (i) mengenai bentuk perlidnungan hukum bagi ahli waris yang dirugikan atas akta hibah yang dibuat secara melawan hukum; dan (ii) mengenai tanggungjawab notaris dan akibat hukum terhadap akta hibah yang batal demi hukum pada putusan Mahkamah Agung nomor 1298K/Pdt/2019. Untuk menjawab permasalahan tersebut, digunakan metode penelitian hukum yuridis-normatif dengan tipologi penelitian eksplanatoris. Data yang digunakan dalam penelitian ini adalah data sekunder dengan alat pengumpulan data yaitu studi pustaka. Hasil Penelitian ini adalah: (i) perlindungan hukum bagi ahli waris yang dirugikan atas akta hibah yang dibuat secara melawan hukum telah terpenuhi dengan adanya putusan hakim yang menyatakan akta hibah batal demi hukum, tidak sah dan tidak memiliki kekuatan hukum, namun gugatan materiil ahli waris harusnya diterima karena ahli waris telah menjelaskan secara rinci mengenai ganti rugi materiil, sehingga putusan hakim tidak mengabulkan gugatan materiil kurang adil mengingat kerugian yang dialami adalah kerugian yang nyata.; dan (ii) notaris telah memenuhi unsur melakukan perbuatan melawan hukum sehingga harus bertanggungjawab secara perdata, pidana dan administratif. Kata Kunci: hibah, tanggungjawab notaris, perbuatan melawan hukum

Abstract

Penulisan artikel hukum ini secara obyektif bertujuan untuk menganalisis mengenai tanggung jawab Notaris terhadap pembuatan Surat Keterangan Waris yang tidak  mencantumkan ahli waris secara lengkap sehingga berakibat Surat Keterangan Waris tersebut cacat hukum dan dipermasalahkan sebagaimana tercantum dalam Putusan Mahkamah Agung Republik Indonesia Nomor 1026K/Pdt/2018. Artikel hukum ini juga mengkaji bentuk perlindungan Notaris kedepan dalam membuat Surat Keterangan Waris. Penulisan artikel ini menggunakan pendekatan yuridis normatif yang dilakukan dengan studi pustaka. Data yang dipakai dalam penulisan ini adalah data sekunder, yang terdiri dari bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Untuk menganalisis data-data tersebut, penulis menggunakan metode analisis kualitatif, dengan bentuk hasil kajian berbentuk eksplanatoris. Berkenaan dengan pertanggung jawaban Notaris dalam pembuatan Surat Keterangan Waris, diperoleh kesimpulan bahwa pertanggungjawaban hukum melekat pada Notaris terhadap akta-akta yang dibuatnya termasuk dalam pembuatan Surat Keterangan Waris. Dalam hal Notaris telah melakukan segala prosedur dalam membuat Surat Keterangan Waris, namun terdapat cacat hukum di kemudian hari, maka dirinya tidak dapat dipertanggungjawabkan secara hukum. Dalam rangka mengamankan Notaris kedepan dalam hal pembuatan Surat Keterangan Waris, Notaris dapat bila perlu mengamankan dirinya dengan dokumen-dokumen tambahan yakni Surat Permohonan Ahli Waris yang berisikan permohonan untuk dibuatkan Surat Keterangan Waris oleh Notaris, dan dokumen Berita Acara Serah Terima Dokumen yang berisikan bahwa telah diserahkan oleh Ahli Waris dan telah diterima oleh Notaris sejumlah dokumen yang berkaitan dengan Pewaris, Perkawinan Pewaris, dan dokumen-dokumen administrasi ahli waris. kedua dokumen pendukung tersebut akan dicantumkan dalam awal bagian Surat Keterangan Waris yang menerangkan sebagai salah satu dasar bagi Notaris untuk membuatkan Surat Keterangan Waris.Kata Kunci: Surat Keterangan Waris, Pertanggungjawaban Notaris, Perlindungan Notaris

Abstract

In general, the Constitutional Court has the view that political parties that have seats in the DPR and/or members of the DPR already have legislative space and do not have the legal standing to review laws. However, there are a number of exceptions in many cases where political parties and members of the DPR are considered to have a special position even though they are also discussing the passed laws. This paper discusses the jurisprudential pattern of the Constitutional Court in granting special legal status to political parties and members of the DPR. Using the case approach method in collaboration with the comparison method this paper seeks to map the potential for testing with specific constitutional rights. The findings in this paper reinforce the concept that although the results of law formation in the legislature and legal review in the judiciary are equally binding for citizens, the process of law formation and legal review has a different character and these differences are beneficial within the framework of checks and balances.

Abstract

Abstract

The adat governance of Minangkabau has adopted the democratic principles long before the 1945 Constitution of the Republic of Indonesia has such principles. This was due to the character of Minangkabau society and its culture which are inherited from their ancestors in Minangkabau society. This paper examines how forms of democratic practice in Minangkabau are related to democratic theory and the division of power. This normative legal research is supported by conducting interviews with some prominent adat figures in the Minangkabau society. In conclusion, it shows that the democratic principles in Nagari can exist until now because of the influence of adat figures. The adat figures preserve and combine such principles with religious norms as their indigenous values to be the main reference to run the Nagari.

Abstract

This journal discusses the Threshold Mechanism for the Stability of the Presidential System and the Simple Multiparty System in Indonesia, with the aim of knowing concretely the essential conditions for the realization of an effective presidential government, through the substance of the policy setting limits in force in Indonesia, and the implications of setting thresholds on the stability of Indonesia's presidential and multiparty systems. This research was conducted using normative legal research methods, through library research, with prescriptive research typologies that are conducting intensive, in-depth and detailed and comprehensive approaches to explore deeply about research issues. The results showed that during the general election in the reform era, various rules around thresholds were imposed in order to realize simple multiparty and presidential stability, the rules were in the form of the requirements for the establishment of political parties, the requirements for political parties to participate in general elections, the threshold for votes to be able to participate in general elections next (electoral threshold), the threshold of the vote acquisition of political parties to sit in parliament (parliamentary threshold), the threshold for fraction formation (fractional threshold), the threshold for presidential nomination (presidential threshold). The policy to determine the threshold has legal consequences: 1) Political parties are not recognized as legal entities; 2) Political parties cannot participate in the election; 3) Political Parties cannot obtain seats in the DPR. Although the requirements for party establishment, party registration as a legal entity, and party requirements for participating in elections have effectively reduced the number of political parties, the electoral threshold has failed in practice because the number of parties fused is relatively low and the parliamentary threshold policy is getting worse every year high, but the number of political parties in parliament is still in extreme multiparty conditions.

Abstract

This article examines the problematic citizenship requirements of presidential and vice presidential candidates in Indonesia. The research method used is qualitative, with normative juridical research and constitutional comparisons with fifty countries in the world that adhere to presidential government systems. The results of the study show that each country regulates the citizenship requirements of Presidential and Vice-Presidential Candidates in its constitution. The regulation of the citizenship requirements for the candidates for President and Vice President in Constitution of the Republic of Indonesia is ideal because it is not discriminatory and also does not have multiple interpretations. Based on a comparison with fifty countries, the regulation of citizenship requirements in Indonesia falls into the first category, namely citizen/nasionality by birth/born. The challenge for Indonesia in the future is how to implement these constitutional provisions without being politicized, especially when the Presidential and Vice-Presidential Elections will be held.

Abstract

Indonesia own various of legal models uses to deal with emergencies. Two emergency arrangements in the 1945 Constitution are represented by the phrase "state of danger" in Article 12 of the 1945 Constitution and the phrase " coercive importance " in Article 22 of the 1945 Constitution. Both have different characters and implications for both the power generated and the oversight mechanism. In addition, there are also emergency legal instruments based on laws, which are represented among others by the Disaster Mitigation Act and the Health Quarantine Act. Interestingly, an emergency based on this law is not directly related to an emergency based on the Constitution which has implications for the legal system and character of the resulting emergency power. Dealing with the Covid-19 pandemic The Indonesian government was confronted with these choices to form an emergency policy. The choice of emergency legal scheme chosen by Indonesia is more for activating emergency based on the law in dealing with Covid 19.

Abstract

Government regulation in lieu of law or ‘Perppu’arrangement in Indonesia is more limited than other types of emergency regulations issued by the president in various countries. Such arrangement apprently is not sufficient to be considered as limiting the issuance of the emergency regulations. Some presidential state countries have made changes to provide sufficient restrictions to presidential legislative power. The limitation is not only in terms of its formation procedures but also on the material which can be regulated by the Perppu.
