Abstract

Minangkabau nature which has beauty, diversity of customs, the majority of which are Muslim, has beautiful nature, mountainous destinations and beautiful beaches, which are a halal tourist attraction in Indonesia in general, West Sumatra in particular. As the main destination for world tourists from other Islamic countries such as Malaysia, Dubai and others. Because West Sumatra is one of the halal tourist destinations, and the lowest government in West Sumatra is Nagari, it is interesting to study..This study uses a legal research method with an empirical/sociologicalapproach legal study(socio legal study) and normative (normative legal study ). The results of the study explain that the prospect of halal tourism that can be developed needs to be socialized to the City and Regency Governments and Nagari Nagari which have tourism potential. to be developed and managed by forming policy policies that are sourced from the Nagari Potential which will later give birth to policies that can contribute to Nagari PAD.

Abstract

Beda pendapat atau sengketa dalam konteks bisnis sering terjadi, dan Indonesia memiliki sebuah Lembaga penyelesaian sengketa alternatif yaitu Arbitrase. Menurut pendapat para ahli, Arbitrase merupakan salah satu cara penyelesaian sengketa yang melibatkan pihak-pihak yang bersengketa untuk sepakat dalam memilih hakim atau para hakim yang akan mengambil keputusan, dan para pihak juga harus sepakat untuk menghormati keputusan yang diambil oleh hakim tersebut. Hingga saat ini masih dominannya penyelesaian sengketa para pihak melalui peradilan (litigation) meskipun penyelesaian alternatif sengketa (non-litigation) sudah diatur melalui peraturan perundang-undangan. Implementasi Lembaga Arbitrase berdasarkan prinsip non-litigious minded sebagaimana penyelesaian sengketa secaramusyawarah dan mencari perdamaian para pihak sehingga meminimalisir permusuhan ataupun dendam dari para pihak bersengketa. Permasalahan penelitian ini adalah pertama, Bagaimana Pelaksanaan Penyelesaian Sengketa Bisnis melalui Arbitrase di Indonesia berdasarkan Prinsip Non-Litigious Minded. Kedua, Bagaimana Para pihak Menghormati Putusan Arbitrase Terhadap Penyelesaian Sengketa Bisnis. Penelitian ini menggunakan metode yuridis normative yang dimana menggunakan sumber data penelitian studi kepustakaan yang menggunakan sumber data sekunder seperti dokumen-dokumen resmi, buku, laporan penelitian, skripsi, tesis, disertasi, dan peraturan perundang-undangan yang berkaitan dengan objek penelitian yang sedang diteliti. Adapuun bahan hukum yang dikumpulkan melalui kajian pustaka meliputi: bahan hukum primer, bahan hukum sekunder, dan bahan non-hukum

Abstract

After the election of Mr. Prabowo Subianto, he has launched breakthroughs aimed at changing Indonesia for the better in the future. One of the breakthroughs that Mr. Prabowo Subianto has made includes Danantara as Indonesia's SWF, Free Nutritious Meals (MGB), and the Red and White Cooperative. In these three projects, the author will examine the existence of the Red and White Cooperative which has been ratified through Presidential Instruction Number 9 of 2025 concerning the Acceleration of the Establishment of Red and White Village/District Cooperatives. With Presidential Instruction Number 9 of 2025, all cooperatives that have been established in villages will be replaced with the Red and White Cooperative. This change actually goes against the founding values of cooperatives, namely deliberation and democracy. This research is legal research with a statutory approach, analytical approach and conceptual approach. The results of this research explain that firstly, the application of the nature of investment capital in cooperatives certainly cannot be applied absolutely to the risks that occur but is only limited to business risks that occur in the business sector financed by investors. Second, in Indonesia, even though the concept of cooperatives is covered by law, the existence of cooperatives still cannot run effectively. Third, on the economic side, the urgency of establishing the Red and White Cooperative is a good breakthrough for fulfilling the economic welfare of village communities. But from a legal perspective, it is necessary to understand the Top & Down principle in formation so that the capital carried out by the central government does not fulfill the principles of forming cooperatives based on kinship, democracy and independence. Then, in Law Number 6 of 2014 concerning villages, villages are actually the subject of development, so the formation of cooperatives should be based on the decisions of the village community.

Abstract

A good and healthy environment is a human right of every Indonesian citizen. The mandate of the 1945 Constitution is not obtained by citizens as they should. The proof is that high air pollution, such as air quality in some areas, causes environmental damage. As for the negative impact of air pollution, in addition to material losses, it also causes immaterial losses in poor air quality. Facing the occurrence of environmental damage due to air pollution in the city of Jakarta, citizens have the right to sue the government as state administrators who have neglected to protect the rights of their citizens, as regulated in Article 91 paragraph (1) and (2) of Law no. 32 of 2009. The results of this study are that the Citizen Lawsuit lawsuit becomes a forum for the community if they experience losses due to pollution and environmental damage. This Citizen Lawsuit lawsuit only asks for accountability for Government policies that result in losses for citizens, such as the lawsuit filed by the Optimistic Capital Coalition on Number 374/Pdt.G/2019/Pn.Jkt.Pst which was received by the Panel of Judges in 2021.
