Abstract

Banyaknya para pemegang saham yang tidak diketahui keberadaannya sehingga tidak bisa dihubungi, sementara pembagian deviden perusahaan dan laporan keuangan yang harus diketahui oleh para pemegang saham tidak dapat terlaksana sebagaimana mestinya. Tujuan pengabdian masyarakat ini untuk memberikan pemahaman pada masyarakat tentang mekanisme rapat umum pemegang saham berdasarkan penetapan pengadilan negeri. Metode kegiatan dilakukan secara webinar (online) melalui zoom meeting dan live youtube, selama 120 menit (60 menit ceramah, 60 menit tanya jawab). Peserta berjumlah 25 orang yang terdiri dari akademisi (dosen), pengacara, notaris/ppat, pihak bank dan wartawan. Kegiatan pengabdian masyarakat mendapatkan respon yang positif dari peserta. Terdapat kurang lebih 40 pertanyaan yang dikemukan peserta terkait permasalahan pembagian deviden, pengesahan laporan keuangan, perencanaan kegiatan perusahaan dan hal-hal yang perlu dipertimbangan dan dievaluasi dalam menjalankan perusahaan.

Abstract

This study evaluates legal certainty in the implementation of Regional Regulations (Perda) in West Sumatra based on Minangkabau customary values. Using a juridical-empirical approach and normative analysis, this research examines how well these regulations can be integrated into the existing legal system without disregarding local customs. The main findings indicate that although Minangkabau-based Perda are legally recognized, there are inconsistencies in their implementation due to differences between positive law and customary law. This leads to challenges in applying the law consistently and fairly. This research contributes to the literature by highlighting the need for more effective harmonization between state law and customary law to enhance legal certainty in culturally rich regions like West Sumatra. The practical implications include the importance of strengthening cooperation between policymakers and customary communities in the legislative and legal implementation processes.

Abstract

Abstract: Law enforcement is an important process that must reflect a balance between the state's right to maintain public peace and individual rights protected by law. This journal aims to analyze how the principle of balance is applied in the legal system in Indonesia, with a focus on the application of individual basic rights in the legal process. This research uses normative juridical methods with a statutory approach and case analysis to understand the application of these principles in practice. The research results show that although regulations in Indonesia have adhered to this principle of balance, their implementation still faces challenges, such as permits and weakening legal authorities' understanding of individual rights. The main recommendation from this research is the need to strengthen the capacity of law enforcement institutions and review legal policies that ignore individual rights.Keywords: Law Enforcement, State Rights, Individual Rights

Abstract

Abstract: The circulation of hazardous cosmetic products containing high-risk chemicals poses a serious threat to consumers. This article examines the legal responsibilities of business actors in ensuring consumer protection based on Law No. 8 of 1999 on Consumer Protection. The study aims to analyze issues related to the violation of business actors' responsibilities, the effectiveness of government oversight, and legal remedies available to harmed consumers. The research adopts a normative juridical approach by analyzing relevant laws and real-life cases. The findings reveal that business actors are responsible for ensuring product safety, providing accurate information, and complying with licensing standards. However, weak government oversight and low consumer legal awareness remain major obstacles to law enforcement. This article highlights the importance of strengthening regulatory oversight and educating consumers to prevent the distribution of hazardous cosmetic products. Through collaboration between the government, business actors, and the public, effective consumer protection can be achieved.Keywords: Legal Responsibility, Hazardous Cosmetics, Consumer Protection.

Abstract

This study aims to analyze the legal protection provided to children in the criminal justice process in Indonesia. This study uses a normative legal method with a statutory approach and case studies. The main focus of this study is to evaluate the effectiveness of existing laws and regulations and their implementation in protecting the rights of children in conflict with the law, both as perpetrators and victims of criminal acts.  The results of the study indicate that although there have been various regulations designed to protect children in the criminal justice process, their implementation still faces a number of challenges. Some of these include the lack of understanding and training for law enforcement officers, as well as the gap between legal regulations and practices in the field. Therefore, this study recommends increasing the capacity and understanding of law enforcement officers and reviewing existing policies to ensure optimal protection for children in the criminal justice system.

Abstract

This research aims to analyze the role of Regional Regulations (Perda) in protecting the rights of indigenous peoples in Indonesia, considering the importance of recognizing and protecting these rights in order to maintain local wisdom and cultural sustainability. Regional regulations have a strategic role in providing a clear and specific legal framework for the protection of indigenous peoples in various regions. The research method used is a normative juridical approach with analysis of various relevant laws and regulations, including case studies of regional regulations that have been implemented in several regions. The research results show that regional regulations make a significant contribution in strengthening recognition of the rights of indigenous peoples, but their implementation still faces various challenges, including limited resources and synchronization with national policies. Greater efforts are needed to harmonize laws and strengthen regional capacity to optimize protection of indigenous peoples.

Abstract

Legal certainty to provide protection to consumers in the form of protection of consumer rights, which is strengthened through special legislation, namely the Consumer Protection Law, gives hope that business actors will not act arbitrarily which always harms consumer rights. Law no. 8 of 1999 concerning Consumer Protection regulates consumer protection. Based on Article 1 point 1, it is stated that consumer protection is all efforts to ensure legal certainty to provide protection to consumers. The Consumer Dispute Protection Agency is tasked with resolving consumer disputes both through litigation and non-litigation. This method uses a normative juridical method, namely by providing a clear, systematic picture of various matters relating to the duties of the Consumer Dispute Resolution Agency according to Law No. 8 of 1999 concerning consumer protection. The results of this research show that the Consumer Dispute Resolution Agency (BPSK) according to Law NO 8 of 1999 is the body tasked with handling and resolving disputes between business actors and consumers. Consumer dispute resolution body (BPSK) is a special institution formed by the government in level II regions to resolve consumer disputes outside of court.

Abstract

This journal discusses the Harmonization of State Administrative Law with the Constitution in the Government system in Indonesia. The purpose of the study is to analyze the extent to which State Administrative Law is in line with the values ​​contained in the constitution and how its implementation can strengthen an effective, transparent, and accountable government system. The research method used is a normative legal approach with qualitative analysis, which examines laws and regulations, legal doctrines, and related court decisions. The results of the study indicate that although state administrative law has accommodated constitutional principles, such as justice, legal certainty, and protection of human rights, there are still gaps in implementation. This is due to inconsistencies in regulations, overlapping authority between institutions, and lack of supervision in government administration practices. Therefore, harmonization steps are needed that involve revising regulations, strengthening institutions, and fostering state apparatus to ensure that state administrative law can optimally support the goals of the constitution.

Abstract

This study aims to analyze the role of Religious Court decisions in resolving joint property disputes after divorce, and to assess the extent to which the decision provides justice and legal certainty for the parties. The method used in this study is an empirical approach, with a case study at the Padang Religious Court. Data were obtained through a study of court decision documents, interviews with judges, and observations of the trial process and implementation of decisions. The results of the study indicate that Religious Court decisions have an important role in resolving joint property disputes, but there are still obstacles in their implementation, such as a lack of legal understanding from the parties, administrative obstacles, and limitations in the execution mechanism. Most decisions have considered the principles of justice and proportionality in the division of property, therefore, strengthening is needed in the aspects of legal socialization and the effectiveness of the implementation of decisions to ensure the protection of the rights of the parties after divorce.

Abstract

This study aims to analyze the effectiveness of the mediation process in resolving divorce cases at the Padang Religious Court and identify factors influencing the success and failure of mediation. The research method used is empirical legal research with a qualitative approach. Data were obtained through interviews with the mediator judge and the parties, as well as a study of divorce case documents that have undergone mediation at the Padang Religious Court. The collected data were analyzed descriptively qualitatively by linking applicable legal provisions with their implementation in practice. The results indicate that the mediation process in divorce cases at the Padang Religious Court has not been fully effective in reducing the divorce rate. This is due to the parties' low good faith in reconciliation, long-standing domestic conflicts, and limited time for mediation. Nevertheless, mediation remains an important means of communication and clarification between husband and wife before the case is decided by the judge. Therefore, it is necessary to optimize the role of the mediator and increase the awareness of the parties so that the objectives of mediation can be optimally achieved.
