Abstract

This study evaluates legal certainty in the implementation of Regional Regulations (Perda) in West Sumatra based on Minangkabau customary values. Using a juridical-empirical approach and normative analysis, this research examines how well these regulations can be integrated into the existing legal system without disregarding local customs. The main findings indicate that although Minangkabau-based Perda are legally recognized, there are inconsistencies in their implementation due to differences between positive law and customary law. This leads to challenges in applying the law consistently and fairly. This research contributes to the literature by highlighting the need for more effective harmonization between state law and customary law to enhance legal certainty in culturally rich regions like West Sumatra. The practical implications include the importance of strengthening cooperation between policymakers and customary communities in the legislative and legal implementation processes.

Abstract

Abstract: Law enforcement is an important process that must reflect a balance between the state's right to maintain public peace and individual rights protected by law. This journal aims to analyze how the principle of balance is applied in the legal system in Indonesia, with a focus on the application of individual basic rights in the legal process. This research uses normative juridical methods with a statutory approach and case analysis to understand the application of these principles in practice. The research results show that although regulations in Indonesia have adhered to this principle of balance, their implementation still faces challenges, such as permits and weakening legal authorities' understanding of individual rights. The main recommendation from this research is the need to strengthen the capacity of law enforcement institutions and review legal policies that ignore individual rights. Keywords: Law Enforcement, State Rights, Individual Rights

Abstract

Abstract: The circulation of hazardous cosmetic products containing high-risk chemicals poses a serious threat to consumers. This article examines the legal responsibilities of business actors in ensuring consumer protection based on Law No. 8 of 1999 on Consumer Protection. The study aims to analyze issues related to the violation of business actors' responsibilities, the effectiveness of government oversight, and legal remedies available to harmed consumers. The research adopts a normative juridical approach by analyzing relevant laws and real-life cases. The findings reveal that business actors are responsible for ensuring product safety, providing accurate information, and complying with licensing standards. However, weak government oversight and low consumer legal awareness remain major obstacles to law enforcement. This article highlights the importance of strengthening regulatory oversight and educating consumers to prevent the distribution of hazardous cosmetic products. Through collaboration between the government, business actors, and the public, effective consumer protection can be achieved. Keywords: Legal Responsibility, Hazardous Cosmetics, Consumer Protection.

Abstract

Abstract: Social media platforms such as Facebook are now widely used as tools for product promotion and transactions. However, this transaction model often lacks adequate legal protection for consumers. This study aims to analyze the form of legal protection for consumers who purchase products through Facebook advertisements. The research method used is normative juridical, with a statutory and literature approach. The findings indicate that transactions through Facebook ads are generally conducted directly between sellers and buyers without third-party intermediaries, thereby increasing the risk of consumer loss—especially in cases of fraud, mismatched goods, or undelivered products. Law No. 8 of 1999 on Consumer Protection has not been fully effective in protecting consumers in such transactions, as it does not specifically regulate commercial activities on social media. Therefore, additional regulations are needed, along with efforts to improve public digital literacy so that consumers better understand their rights and avoid potential losses. Keywords: consumer protection, Facebook ads, online transactions.

Abstract

This article aims to initiate the implementation of fast, cheap, and simple justice in resolving divorce cases in Indonesia. This principle is a basic principle in the trading system that aims to provide efficient access to justice for the community. This study uses a normative legal method with a qualitative approach, which is based on laws and regulations, court decisions, and related literature studies. The results of the study indicate that although normatively the principle of fast, cheap, and simple justice has been regulated in the Indonesian legal system, its application in divorce cases deals with obstacles. These obstacles include the length of the administrative process, costs that are still felt to be burdensome by some people, and limited facilities and infrastructure in several judicial institutions. Therefore, efforts are needed to improve the system and increase the efficiency of judicial procedures so that as mentioned can truly be realized in practice. Keywords: Fast Justice, Divorce, Low Cost

Abstract

Abstract: This paper attempts to explain a little about law from a marxist perspective. Therefore, this paper is more appropriate to be positioned as an introductory article to open an understanding of the Marxist theory of constitutional law. They have used various approaches in discussing the nature of law, and even with these various approaches, the legal theory they produce has its own characteristics. This can be seen, among other things, in the existence of economic and political factors in their approach to law, as well as in the content of criticism of the capitalist system. The last mentioned, can even be considered as a spirit that tends to be typical in Marxist thought which always criticizes the capitalist system and its influence in human life. There are still many gaps and deficiencies that are expected to become material for further writing on the Marxist theory of law. The author's discussion in this paper has not gone so far as to explain the influence of Marxist theory of law in encouraging the emergence of schools of thought in legal science, has not gone so far as to explain the criticisms leveled against Marxist theory of law, and has not yet reached the forms of practice. marxist theory of law at the state level. At least, these 3 (three) things are expected to be the inspiration for subsequent writings on the Marxist theory of law. Keywords: Role, Marxist, Theory, Constitutional Law.

Abstract

This study aims to analyze the legal protection provided to children in the criminal justice process in Indonesia. This study uses a normative legal method with a statutory approach and case studies. The main focus of this study is to evaluate the effectiveness of existing laws and regulations and their implementation in protecting the rights of children in conflict with the law, both as perpetrators and victims of criminal acts.  The results of the study indicate that although there have been various regulations designed to protect children in the criminal justice process, their implementation still faces a number of challenges. Some of these include the lack of understanding and training for law enforcement officers, as well as the gap between legal regulations and practices in the field. Therefore, this study recommends increasing the capacity and understanding of law enforcement officers and reviewing existing policies to ensure optimal protection for children in the criminal justice system.
