Abstract

There are many cosmetics on the market today with various types of brands in line with women's desire to always look beautiful. This is then exploited by irresponsible business actors by producing or trading cosmetics that do not meet the requirements for distribution to the public. Not a few women are interested in buying products at low prices but with fast visible results. So many women choose shortcuts to buy a product even though the cosmetics they buy do not meet the requirements and are not registered with BPOM. It is not uncommon for these illegal cosmetics to be obtained at affordable prices because there is no distribution permit number from BPOM. There is no cosmetic raw material label, and there is no product expiration date. Because the price is cheap and can be purchased easily, cosmetics without a distribution permit are easily consumed by the public. Consumers' ignorance of the side effects of cosmetics containing dangerous ingredients is one of the reasons many women continue to use illegal cosmetics. Consumers usually do not research a product before buying, this is also one of the factors that causes cosmetic products containing dangerous ingredients to still be in demand by many women. They generally buy cosmetic products without prior consideration considering that the products they buy have direct side effects. The data analysis method used is sociological juridical.

Abstract

The customary law is recognized as a form of law in the life and culture of Indonesian society, regulated in the 1945 Constitution. Customary law is the values that develop in society regarding truth and justice. In terms of legal substance, the 1945 Constitution expressly provides a place and basis for the application of legal norms and legal institutions originating from laws that live and apply in society (living live) where customary law is made part of national law. The confirmation of the Constitution is related to the inclusion of two new articles in the second amendment to the 1945 Constitution, namely article 18 B Paragraph (2) which explains that the state recognizes and respects customary law community units and their traditional rights as long as they are still alive and in accordance with development of society and the principles of the Unitary State of the Republic of Indonesia as regulated in law. Second, Article 28 I Paragraph (3) which contains an explanation regarding the recognition of customary law which states that the cultural identity and rights of traditional communities are respected in line with developments over time and civilization. From the formulation of these two articles, it can be concluded that every Indonesian citizen who lives under state regulations, both citizens and government officials, without exception, is required to uphold the laws that apply in the life and culture of Indonesian society, including criminal law, civil or customary law.

Abstract

The main ideas of critical legal studies are the law seeking wrong legitimacy; Shackled by contradictions; There are no basic Principles in law; and Law is not neutral. The development of critical legal studies is used to understand oppressive legal policies and structures. Another advantage of critical legal studies is the great attention it pays to the recognition of the individual as the main subject of will in the social order. The weakness of the original nature of critical thinking is that it always deconstructs itself so that changes and fluctuations always occur. It is hoped that the idea of critical legal studies will be maximally applied in Indonesia as a jack of all trades in law enforcement in Indonesia. Thoughts about critical legal studies are expected to be used by law enforcers in Indonesia in solving legal problems that are being faced.
