Abstract

Dalam keadaan darurat karena adanya Pandemi Covid-19, Pemerintah menerbitkan Peraturan Pemerintah Pengganti Undang-Undang (Perppu) Nomor 1 Tahun 2020 dalam rangka upaya penstabilan keuangan negara. Pasal 27 ayat 2 Perppu tersebut memberikan jaminan tidak dapat dipidananya pejabat pemerintah dalam rangka pelaksanaan ketentuan Perppu dimaksud. Hal ini menimbulkan anggapan bahwa pemerintah telah sewenangwenang dan melanggar konstitusi. Penelitian ini menguji dan mendiskusikan aspek legalitas, proporsionalitas dan konstitusionalitas ketentuan imunitas dimaksud dengan melalui pendekatan yuridis normatif. Dari hasil analisa dan pembahasan didapatkan kesimpulan bahwa Pasal 27 ayat 2 Perppu ini telah sesuai secara legalitas, proporsionalitas dan konstitusionalitas sehingga tidak bertentangan dengan konstitusi di Indonesia. Hasil pembahasan ini diharapkan dapat menjadi pedoman dan pembanding bagi masyarakat dan sarjana hukum dalam menilai konstitusional atau tidaknya isi ketentuan imunitas pada Undang-Undang Nomor 2 Tahun 2020 yang menetapkan Perppu tersebut menjadi UU.

Abstract

The universal notion of Human Rights evokes our curiosity on how the same value can be adopted by different time, space, place, and culture. In another side, Capability Approach helps us conceiving how the same human capabilities can be interpreted differently by different functioning. This research aims to serve a different perspective on using Capability Approach to fathom the fulfillment of Human Rights particularly by presenting the relativism of culture around the world by utilizing socio-legal approach. Furthermore, it will discuss evidence from Indonesia, particularly in land acquisition and politic participation, as example how its civilization leads to the deviation of Human Right`s universality. The result of this study shows key finding that the government or society which can be apprehended violates human rights, will be seen reasonably respect human rights for its people if the insight of cultural relativism can be understood.

Abstract

There is still a huge debate on business policy in Indonesia pertaining the fact that the Government of Indonesia is still reluctance to ratify one of the important conventions for the business world namely CISG (Convention on Contracts for the International Sale of Goods). This paper attempts to discuss the issues which will deliver inter-disciplinary areas such as law, economics, and public policy. By analyzing this matter with a comprehensive measure, it will ensure an appropriate understanding and thus create more precise analysis to serve a contribution in suggesting solve-problem. Despite having its particular point of view, the author based and used other scholar`s arguments to compare and present the debate towards current business circumstance on practice, policy, and relevant regulations. The finding of this paper is either the current condition of business practice or global pressure are inadequate to force the immediate urgency to ratify the CISG. While the last option comes from the political will of government, the author believes that the government should seek to ratify the CISG in a convenient timing rather than alter the National Civil Code.

Abstract

The development of the promotion and protection of human rights, in general, has been gladdening. However, in instances where human rights are affected by business activity, efforts to uphold them meet certain obstacles. This is exacerbated when the business activity involves a complex and international dimension in it—i.e., in the case of multinational enterprises. This paper provides three arguments to support the establishment of international binding treaty on business and human rights. It examines the current Corporate Social Responsibility platform, state responsibility to protect human rights, and also the importance and benefits of legally binding treaty. This research found that the implementation of the current CSR platform fails to prevent business harm to human rights. Therefore, state responsibility is fundamental in this matter and should be enhanced by the duty to establish an international treaty. A legally binding treaty is important to protect human rights from irresponsible business activity and can be beneficial and relevant to the interest of parties involved in business and human rights.

Abstract

The previous movement of Government of Indonesia (GOI) to terminate its expiring Bilateral Investment Treaties (BITs) with many countries does not mean like the end point of rigorous policy. It then leaves a question mark about the legal standing after the concession and how the government establishes a new model to create a balance in BIT. This research is conducted to, firstly, analyze the legal position of government and foreign investor in a terminated BIT. Furthermore, it will discuss how the government can take benefit through learning experience from the previous mistakes in old BITs and the latest development in international investment law. Finally, this study focuses how a balance on BIT can be achieved for both host state and foreign investor. The result of this study shows that the government did not breach any international law procedure in particular by fathoming Vienna Convention on the Law and Treaties and protection for the investor is not diminish immediately due to the existence of survival clause. Further investigation identifies that to obtain a greater benefit following the termination, GOI should develop better balanced provisions in its next BIT model. This effort can be done by taking care of principle of extraterritorial obligation, full protection and security clause, indirect expropriation, and regulatory measure clause, and most importantly how to deal with dispute settlement.

Abstract

Kontroversi perlu tidaknya pembaruan terhadap Undang-Undang Nomor 25 Tahun 2007 tentangPenanaman Modal (UUPM) sudah mengemuka semenjak lahirnya undang-undang tersebut. Meskipundemikian, argumentasi hukum yang selama ini didiskusikan dirasa belum cukup kuat dalam mendorongterjadinya pembaruan pada UUPM khususnya mengenai pengaturan penanaman modal asing. Penelitianini berupaya mengisi kekurangan argumentasi hukum terhadap perlunya pembaruan pengaturan hukumpenanaman modal asing di Indonesia seiring dengan momentum akan dilakukannya pembangunan ibukota negara baru di Indonesia yang sebagian pembiayaannya akan bergantung kepada kegiatan penanamanmodal asing. Metode penelitian yang dilakukan adalah bersifat yuridis normatif dengan melakukan analisaberbagai bahan hukum yang sesuai. Hasil dari penelitian ini menyimpulkan dan menyarankan dilakukannyapenataan ulang pengaturan penanaman modal asing di Indonesia yang tidak hanya menambah beberapaketentuan saja, namun juga merubah cara berpikir dan struktur pengaturan hukum penanaman modalasing di dalam UUPM.

Abstract

Masih rendahnya pengetahuan siswa SMP tentang pentingnya membaca label pangan dan jajanan sehat bergizi merupakan salah satu faktor yang mempengaruhi status gizi. Rendahnya pengetahuan siswa tentang label pangan akan berdampak terhadap konsumsi makanan jajanan yang tidak aman dan sehat. Kegiatan ini bertujuan untuk meningkatkan pengetahuan siswa SMP melalui edukasi mengenai pentingnya membaca label kemasan pangan dan perlindungan konsumen terhadap makanan dan minuman kemasan. Kegiatan dilakukan pada salah satu SMP di Kecamatan Bayang, Kabupaten Pesisir Selatan, pada Bulan Juni Tahun 2022. Kegiatan berupa penyuluhan tentang pentingnya membaca label kemasan dan perlindungan konsumen dengan 2 (dua) orang narasumber. Untuk menilai keberhasilan edukasi ini dilakukan pengamatan langsung terhadap suasana diskusi kelas dan digunakan kuesioner berupa pertanyaan tertutup yang akan diberikan kepada siswa sebelum dan sesudah edukasi. Sebanyak 30 orang siswa SMP mengikuti kegiatan ini yang terdiri dari siswa kelas 7 dan 8. Para peserta antusias memberikan pertanyaan dan ketika diberikan pertanyaan siswa mampu menjawab dengan benar. Hasil kegiatan edukasi ini menggunakan uji paired sample t-test menunjukkan ada peningkatan pengetahuan siswa SMP sebesar 2.3 (p=0,006). Kegiatan pengabdian masyarakat berhasil dilakukan dengan baik. Hasil monitoring dan evaluasi setelah diberikan edukasi diperoleh bahwa siswa lebih teliti dan membaca label kemasan terlebih dahulu sebelum membeli jajanan makanan kemasan. Implikasi dari kegiatan ini yaitu siswa sudah mulai menerapkan membaca label sebelum belanja makanan kemasan.The common knowledge of junior high school students about the importance of reading food labels and nutritious, healthy snacks is one-factor affecting nutritional status. The low knowledge of students about food labels will have an impact on the consumption of snacks that are not safe and healthy. This aim is to increase the knowledge of junior high school students through education about the importance of reading food packaging labels and consumer protection for packaged food and beverages. The activity was carried out at one of the junior high schools in Bayang District, Pesisir Selatan Regency, in June 2022. The activity involved counselling about the importance of reading packaging labels and consumer protection with 2 (two) resource persons. To assess the success of this education, direct observation of the class discussion atmosphere was used, and a questionnaire was given to students before and after education. A total of 30 junior high school students participated in this activity, consisting of students in grades 7 and 8. The participants were enthusiastic about asking questions, and when given questions, the students could answer correctly. The results of this activity showed that there was an increase in the knowledge of junior high school students by 2.3 (p=0.006). Community service activities were carried out successfully. The monitoring and evaluation results after being given education showed that students were more careful and read the packaging labels before buying packaged snacks.

Abstract

An understanding of the importance of regulating investment treaties and implementing measures in accordance with existing rules has been generally understood by States in foreign direct investment. However, the local government where the location of foreign investment activities is carried out has not received sufficient attention. As a result, various cases of international investment disputes have arisen caused by actions taken by local governments. This study discusses how the tribunal views and interprets actions taken by local governments in relation to violations of foreign investor rights. In the span of time over the past eight years, no less than six hundred cases of foreign investment disputes have been investigated. Of these, three available and final cases became the subject of discussion in research and became examples to link them with the legal skills of local government officials in mitigating the occurrence of foreign investment case disputes. The results of this study show that in terms of understanding the rules of international investment law, the government in the country can mitigate or handle the case better with foreign investment disputes.
