Abstract

The innovation of electronic land certificates is one of the Indonesian government's efforts to improve modern land services with information technology and telecommunications. Nevertheless, it is crucial to anticipate and formulate policies for the application of this service product, so that one's ownership and rights are guaranteed to be valid. This research aims to analyze the position and function of electronic land certificates as evidence of ownership and rights to one's land in front of a judge. This research applies descriptive qualitative method. Primary and secondary data were obtained through interviews and document studies. The data were analyzed using a sociolegal approach. The results showed that the electronic land certificate is a legal product of a series of electronic land registration. Electronic land certificates are legally valid and are legally used as evidence of ownership of a person's land parcel in court. This research concludes that the suitability of physical and juridical data recorded electronically, stages and standardization of archiving is the key to modern land registration services. In addition, cross-country, public/private cooperation needs to be implemented immediately, in line with global cybersecurity threats. Inovasi atas sertipikat tanah elektronik menjadi salah satu upaya pemerintah Indonesia untuk meningkatkan layanan pertanahan modern dengan teknologi informasi dan telekomunikasi. Namun demikian, antisipasi dan perumusan kebijakan penggunaan produk layanan tersebut menjadi penting, agar kepemilikan dan hak seseorang senantiasa terjamin keabsahannya. Penelitian ini bertujuan untuk menganalisis kedudukan dan fungsi sertipikat tanah elektronik sebagai alat bukti kepemilikan dan hak atas tanah seseorang di depan hakim. Penelitian ini menggunakan metode kualitatif deskriptif. Data primer dan sekunder diperoleh melalui wawancara serta studi dokumen. Data-data tersebut kemudian dianalisis menggunakan pendekatan sosiolegal. Hasil penelitian menunjukkan bahwa sertipikat tanah elektronik merupakan produk hukum dari rangkaian pendaftaran tanah secara elektronik. Sertipikat tanah elektronik secara hukum sah dan legal digunakan sebagai alat bukti kepemilikan bidang tanah seseorang di pengadilan. Penelitian ini menyimpulkan bahwa kesesuaian data fisik dan yuridis yang terekam secara elektronik, tahapan dan standarisasi pengarsipan menjadi kunci atas layanan pendaftaran tanah modern. Selain itu, kerja sama lintas negara, publik/swasta perlu segera dilaksanakan, seiring adanya ancaman keamanan siber yang bersifat global.

Abstract

ABSTRACT The HT-el service has been implemented nationally since April 2020, which in its implementation involves other parties such as Land Deed Maker Officials and Creditors as working partners. The purpose of this study is to describe the service mechanism, problems, and efforts to resolve the HT-el service with a location at the Land Office of Tanjung Jabung Barat Regency. This study uses a qualitative method with a descriptive approach to be able to see and understand the real conditions of the object under study. The results of the study found that the HT-el service mechanism had not been fully implemented in accordance with applicable regulations, for example, the existence of an HT-el certificate that was issued without going through an inspection process, accounts run by non-account owners, payment of deposit orders made by the bank (creditor). Problems faced by PPAT, Creditors and Kantah such as: internet network disturbances, the uploaded application file is not appropriate, ranking errors because the validation has not been completely correct, the online checking process cannot be carried out because all land parcel certificates have not been validated, NIK of the debtor or the approval party does not match, the deed code is not found in the HT-el system. Keywords: Electronic Mortgage, PPAT, Bank   INTISARI Layanan HT-el dilaksanakan secara nasional sejak bulan April 2020, yang dalam pelaksanaannya melibatkan pihak lain seperti Pejabat Pembuat Akta Tanah dan Kreditor sebagai mitra kerjanya. Tujuan penelitian ini adalah mendeskripsikan mekanisme layanan, permasalahan dan upaya penyelesaian terhadap layanan HT-el dengan lokasi di Kantor Pertanahan Kabupaten Tanjung Jabung Barat. Penelitian ini menggunakan metode kualitatif dengan pendekatan deskriptif agar dapat melihat dan memahami kondisi secara nyata terhadap objek yang diteliti. Hasil penelitian menemukan bahwa mekanisme layanan HT-el belum sepenuhnya dilakukan sesuai dengan ketentuan yang berlaku, misalnya adanya sertipikat HT-el yang terbit tanpa melalui proses pemeriksaan, akun yang dijalankan oleh bukan pemilik akun, pembayaran Surat Perintah Setor dilakukan oleh pihak Bank (Kreditor). Permasalahan yang dihadapi oleh PPAT, Kreditor dan Kantah seperti: gangguan jaringan internet, berkas permohonan yang diunggah belum sesuai, kesalahan peringkat karena validasi yang dilakukan belum sepenuhnya benar datanya, proses pengecekan secara online tidak dapat dilakukan karena belum tervalidasinya seluruh sertipikat bidang tanah, NIK dari Debitor ataupun pihak persetujuan tidak sesuai, Kode akta tidak ditemukan pada sistem HT-el. Abstract

The rapid development of a region's environment has led to the emergence of slum areas due to the growing population and increased industrial and commercial activities. One way to address slum areas is through the Land Consolidation program. The implementation of land consolidation often encounters failures, so examples of successful implementation of the program are needed. This study aims to determine the stages of implementing the land consolidation program, the factors that inhibit and drive land consolidation, and the impact of land consolidation on the environmental and socio-economic conditions of the community. This study was conducted using a survey method with a mixed-method approach. Data collection methods were carried out using questionnaires, interviews, observations, and literature studies. The results of this study indicate that the implementation of land consolidation is running in accordance with applicable regulations. In its implementation, there are inhibiting and driving factors, both internal and external. Land consolidation has an impact on improving environmental quality and the socio-economic conditions of the community. The results of the implementation of land consolidation in Penawangan Village can be used as a reference for the level of success if a similar program is duplicated in a similar location and can identify efforts to overcome problems that arise later during implementation.

Abstract

The rate of conversion of agricultural land to non-agricultural uses in Kaliwates District, Jember Regency, is increasing along with population growth, urbanization, and economic development—threatening the sustainability of local food security. This study aims to (1) analyze the suitability of Protected Rice Fields (LSD) with actual land use, (2) identify the factors causing land use conversion, and (3) formulate control strategies through LSD policies. The data used includes LSD maps, 2023 land use maps, population density data, LSD areas, and land production. The analysis method consists of spatial overlay to measure the level of land use suitability and multiple linear regression to test the influence of variables causing land use conversion. The results show that 73.44% of the LSD area is suitable for land use, while 26.57% is not. The variables of LSD area and land production have a significant effect on the tendency of land use conversion, while population density does not show a significant effect in the tested model. Based on these findings, a control strategy was formulated that includes evaluation of LSD policies, optimization of spatial planning, intensification of production on still productive land, economic incentives to maintain agricultural functions, synchronization of sectoral databases, and strengthening of cross-agency coordination. These findings are expected to be a reference for formulating more effective policies for maintaining sustainable food agricultural land in areas with high urbanization pressures. Laju alih fungsi lahan pertanian menjadi non-pertanian di Kecamatan Kaliwates, Kabupaten Jember, meningkat seiring pertumbuhan penduduk, urbanisasi, dan perkembangan ekonomi—mengancam keberlanjutan ketahanan pangan lokal. Penelitian ini bertujuan untuk (1) menganalisis kesesuaian Lahan Sawah yang Dilindungi (LSD) dengan penggunaan lahan aktual, (2) mengidentifikasi faktor penyebab alih fungsi lahan, dan (3) merumuskan strategi pengendalian melalui kebijakan LSD. Data yang digunakan meliputi peta LSD, peta penggunaan lahan tahun 2023, data kepadatan penduduk, luas LSD, dan produksi lahan. Metode analisis terdiri dari overlay spasial untuk mengukur tingkat kesesuaian penggunaan lahan dan regresi linier berganda untuk menguji pengaruh variabel penyebab alih fungsi. Hasil menunjukkan bahwa 73,44% luas LSD sesuai dengan penggunaan lahan, sedangkan 26,57% tidak sesuai. Variabel luas LSD dan produksi lahan berpengaruh signifikan terhadap kecenderungan alih fungsi lahan, sedangkan kepadatan penduduk tidak menunjukkan pengaruh yang signifikan dalam model yang diuji. Berdasarkan temuan tersebut dirumuskan strategi pengendalian yang mencakup evaluasi kebijakan LSD, optimalisasi tata ruang, intensifikasi produksi pada lahan yang masih produktif, insentif ekonomi untuk mempertahankan fungsi pertanian, sinkronisasi basis data sektoral, serta penguatan koordinasi lintas instansi.Temuan ini diharapkan menjadi acuan perumusan kebijakan yang lebih efektif dalam mempertahankan lahan pertanian pangan berkelanjutan di daerah dengan tekanan urbanisasi tinggi.

Abstract

Functionally, land administration is carried out by the Ministry of ATR/BPN at the central level, the BPN Regional Office at the provincial level, and the Land Office at the district/city level. Land organization units do not reach the village level, so the land office needs to involve the village government to provide records of ownership of unregistered land. The implementation of land administration in Banyuraden Village includes archiving, recording letter registration numbers and dates, digitizing archives, and issuing letters as attachments to conversion applications. The village government that plays a role in organizing land administration is the hamlet, jagabaya, and lurah. Mapping the components that support the function of land administration is necessary for its implementation in the village to be more effective and efficient. The purpose of this study is to identify and map the components that support the function of land administration in Banyuraden Village. Data collection was carried out through interviews, observations, and documentation studies, which were then analyzed using descriptive qualitative methods. The results of the study show that the land policy framework includes policies for recording letter registration numbers and dates, land information infrastructure related to letter C books and digital village maps, and institutional arrangements related to the roles of hamlets and village heads. Secara fungsional administrasi pertanahan dilaksanakan oleh Kementerian ATR/BPN di tingkat pusat, Kantor Wilayah BPN di tingkat provinsi, dan Kantor Pertanahan di kabupaten/kota.  Unit organisasi pertanahan tidak sampai ke kalurahan, sehingga kantor pertanahan perlu melibatkan pemerintah kalurahan untuk menyediakan catatan penguasaan atas tanah yang belum terdaftar. Pelaksanaan administrasi pertanahan di Kalurahan Banyuraden meliputi penyimpanan arsip, pencatatan nomor dan tanggal register surat, digitalisasi arsip, dan penerbitan surat untuk lampiran permohonan konversi. Pemerintah kalurahan yang berperan menyelenggarakan administrasi pertanahan adalah dukuh, jagabaya, dan lurah. Pemetaan komponen yang menopang fungsi administrasi pertanahan diperlukan agar pelaksanaan administrasi pertanahan di kalurahan lebih efektif dan efisien. Tujuan dari penelitian untuk mengidentifikasi dan memetakan komponen yang menopang fungsi administrasi pertanahan di Kalurahan Banyuraden. Pengumpulan data dilakukan melalui wawancara, observasi, dan studi dokumentasi yang kemudian dianalisis dengan metode kualitatif deskriptif. Hasil penelitian menunjukkan bahwa kerangka kebijakan pertanahan meliputi kebijakan pencatatan nomor dan tanggal register surat, infrastruktur informasi pertanahan berkaitan dengan buku letter C dan peta kalurahan digital, kemudian pengaturan kelembagaan berkaitan dengan peran dukuh, jagabaya, dan lurah.
