Abstract

Tujuan penelitian ini adalah untuk mengetahui bagaimana implementasi pengembangan pariwisata di Kecamatan Pantai Cermin. Metode penelitian ini adalah deskriptif kualitatif. Pengembangan pariwisata belum berjalan secara maksimal dikarenakan tidak menerapkan prinsip-prinsip implementasi. Pemberdayaan masyarakat yang menjadi upaya prioritas dalam mendukung efektifitas dan efisiensi suatu program kurang sesuai dengan kondisi masyarakat. Melalui penelitian ditemukan bahwa antara pemerintah Kabupaten Serdang Bedagai dengan Pemerintah Kecamatan Pantai Cermin kurang berkoordinasi dan komunikasi dalam proses implementasi dan dapat diduga adanya disposis yang salah sesuai dengan prinsip-prinsip implementasi. Hal ini dapat diketahui melalui kurangnya sumberdaya manusia yang memahami dalam mendukung suatu program pembangunan melalui implementasi suatu program. Sebagai novelty dalam penelitian bahwa penetapan kebijakan yang dilakukan telah mengalami kesalahan dari awal dengan tidak menyesuaikan dengan kondisi masyarakat dan adanya ego sektoral dalam menjalankan suatu implementasi program dikalangan pemerintah Kabupaten Serdang Bedagai dengan Pemerintah Kecamatan Pantai Cermin. Solusi yang ditawarkan dengan adanya perbedaan kondisi social menuntut pemberdayaan masyarakat dalam bidang pertanian untuk dikembangkan sejalan dengan kepariwsataan, sedangkan kordinasi, komunikasi, dan disposisi yang diharapkan dapat dilakukan dengan membentuk bagian atau bidang pengembangan pariwisata di tingkat kecamatan khususnya di Kecamatan Pantai Cermin. Abstract

ABSTRACTPPAT in making the deed is to ensure that the payment of BPHTB the debt has been paid by the taxpayer. For this reason, it is necessary to study the role of PPAT in the imposition of BPHTB in the transfer of land rights and building, the legal consequences of the imposition of BPHTB in the deed of sale and purchase of land and buildings and the mechanism for imposing BPHTB in the deed of sale and purchase. Type The research used in writing this thesis is juridical normative empirical, which is descriptive analysis. The data collection techniques used used is literature study and field research. The role of PPAT in The imposition of BPHTB in the Transfer of Land and Building Rights, namely convey the necessary information related to the imposition process BPHTB in the imposition of BPHTB tax on the transfer of land rights and building. The legal consequences of the imposition of BPHTB in the Deed of Sale and Purchase of Land and The building, namely the Sale and Purchase Deed, cannot be carried out before the BPHTB is signed the sale and purchase transfer transaction has not been paid by the taxpayer, which also result in legal certainty in the transition. In addition there are The sanctions imposed by Article 91 paragraph (1) are in the form of paying fines 7,500,000.00 (seven million five hundred thousand rupiah) for each commit a violation if the signing of the Sale and Purchase Deed is done before PPAT before the parties pay the BPHTB tax. Imposition mechanism BPHTB in the Deed of Sale and Purchase, namely preparing complete documents and data tax object, the taxpayer fills in the information on the tax object and the value of the BPHTB payable into the Tax Deposit Form (SSPD) BPHTB, then calculate the value of BPHTB payable. Next is the Taxpayer and PPAT/Notary sign the SSPD form. The payment process is carried out when the documents SSPD BPHTB which is verified as complete and declared correct. Abstract

ABSTRACTLeasing is often used as a god of help or a god of savior for most Indonesian people. However, at this time the existence of leasing that violates the law on the forced withdrawal of goods that are the object of leasing is very disturbing to consumers.The problems in this study are the position of the leasing consumer in the event of a default in the leasing agreement, the dispute resolution process due to default against the leasing company at PT FIF GROUP. and implementation of confiscation of goods (Objek Leasing) at PT FIF GROUP. This research method uses empirical legal research and descriptive analytical research.If the customer has exceeded the promised time limit, the customer will get (bad RO) and the customer will also be blacklisted from the company and will not be able to apply for credit withdrawal at any leasing company or dealer he wants to take credit for. If the customer makes payments smoothly and there are no obstacles, the customer will have a good position. Settlement of disputes in leasing contracts can be done in two ways, namely through court and out of court. Implementation of the trial based on court decisions or the decision of the Constitutional Court no. 18/PUU-XVII-2019 there has been no confiscation by PT. FIF. Determination of court confiscation to withdraw the object of leasing as determined by the Constitutional Court (MK). It is suggested that PT FEDERAL INTERNATIONAL FINANCE should use more government regulations, namely using court decisions or decisions of the Constitutional Court to confiscate or take goods (leasing objects).Keywords: Leasing, Achievement Wan, Confiscation of Goods

Abstract

ABSTRACTThe problems experienced by many financial institutions that provide credit and financing services, namely the transfer of objects fiduciary guarantee by the debtor to a third party. The problem is getting worse complicated, due to the transfer of the object of collateral by the debtor and other parties these three (whether through buying and selling, renting, or otherwise) will happen the intersection of rights between a third party as the ruler of the object and the creditoras the legal owner of the object.The problem raised in this thesis is the implementation of execution fiduciary guarantee object through parate execution due to transfer of collateral object fiduciary by the debtor to a third party. Legal protection for banks BCA multifinance in the execution of the object of fiduciary guarantee against the object of the fiduciary guarantee that has been transferred to a third party. Types of research used in this research is empirical juridical. This research descriptive research. The source of the data in this study was obtained by collect primary data and secondary data. Data collection techniques in This research is a field study (field research). Data analysis to be carried out in this study is a qualitative analysis.The purpose of the legal implications of the debtor is to transfer the object of collateral fiduciary to a third party in a financing agreement, resulting in the fiduciary agreement becomes null because in the fiduciary agreement the object Fiduciary guarantee is one of the important elements of a fiduciary agreement there is a legal consequence if an object of the fiduciary guarantee is lose their property rights.Legal protection for creditors in a fiduciary guarantee agreement born from the making of a deed of imposition of a fiduciary guarantee made notarial, and continues to be confirmed by registration with the Fiduciary Registration Officein order to obtain a fiduciary certificate. Abstract

ABSTRACTThe thing which is the most disadvantaged party is the debtor, but it is possible that the bank as the creditor will also suffer losses from these problems.The problem in this research is how to regulate the law regardingthe debtor in the working capital credit agreement, how is the settlement process if the debtor is in default and how is the Judge's Consideration in Decision No. 466/Pdt/2020/PT MDN. This research method uses normative legal research and analytical descriptive research.The results of this study, legal arrangements regarding debtors in credit agreementsworking capital based on the provisions of Article 1338 of the Civil Code. The process of settling debtors with outstanding performance in a credit agreement can be carried out by saving credit through rescheduling, reconditioning and restructuring. Furthermore,settlement of credit by means of the execution of the executive title by the creditor, sale of objects to be objects of collateral through auctions, sales of collateral in underhand. The judge's consideration in the decision no. 466/2020/PT.MDN, namely the plaintiff or defendant I, must comply with the agreement that has been agreed uponincluding the existence of the plaintiff's bad credit, which should be Defendant I submitting a default suit to the Binjai District Court or submitting a request for execution to the Binjai District Court or other courts anywhere within the territory of the Republic of Indonesia, instead of submitting it to another institution, namely to Defendant II to resolve legal issues between the plaintiff and Defendant I.It is recommended that the creditor must be able to anticipate things that are done to the debtor due to default by conducting deliberation to find the best solution, moreover the debtor has good faith to pay the pending debt in accordance with the agreement that has been made.Keywords: Legal Protection, Guarantee, Credit Agreement
