Abstract

The implementation of conciliation council in civil cases is urgently needed to give sense of justice among parties and to give limitation of cassation process. The limitation of cassation process is either substantively or procedurally. It is executed in order to reach reconciliation among parties which is stated on Article 130 HIR/154 R.Bg. Supreme Court had noticed to all judges by The Supreme Court Instruction No. 1/2002, that; The judges should act as a mediator in conciliation council and they gives a beneficial proposition for parties to entered negotiation in order to settle the dispute.Key word : civil case, conciliation council, and mediation

Abstract

Partisipasi pemilih dalam pemilu di Indonesia dapat terlihat dari pemilihan umum Presiden dan Wakil Presiden, pemilihan DPR dan DPD. Sedangkan di tingkat lokal, ada pemilihan langsung Kepala Daerah (Pilkada) di tingkat Provinsi dan Kabupaten/Kota. Pada Pilkada Langsung (Pemilihan Gubernur dan Wakil Gubernur Kalimantan Tengah) pada tanggal 9 Desember 2020, Jumlah partisipasi pemilih di Kecamatan Kapuas Murung mencapai 66,33%. Pencapiaan ini di bawah target provinsi yaitu 70% dan target nasional yaitu 77,5%. Apakah hal itu menandakan kurangnya partisipasi masyarakat dalam menggunakan hak pilihnya pada pemilihan Gubernur dan Wakil Gubernur Kalimantan Tengah Tahun 2020 di Kecamatan kapuas Murung. Penelitian ini berupaya mendeskripsikan penyebab terjadinya capaian target nasional partisipasi masyarakat pada pemilihan Gubernur dan Wakil Gubernur Kalimantan Tengah Tahun 2020. Peneliti menggunakan pendekatan kualitatif dan jenis penelitian deskriptif, teknik pengumpulan data menggunakan wawancara dan dokumentasi, dengan sumber data primer dan data sekunder. Hasil penelitian menunjukan bahwa terdapat 7 faktor untuk melihat mengapa di Kecamatan Kapuas Murung tidak mencapai target nasional pada pemilihan Gubernur dan Wakil Gubernur Kalimantan Tengah Tahun 2020 yaitu faktor pandemi Covid-19, faktor kepercayaan, faktor money politic, faktor pendidikan, faktor lingkungan keluarga, faktor pekerjaan, serta faktor situasi dan kondisi. Faktor-faktor tersebut menjadi penyebab tidak tercapainya target nasional pada pemilihan Gubernur dan wakil Gubernur Kalimantan Tengah Tahun 2020 di Kecamatan Kapuas Murung.

Abstract

This study analyses the framework model cooperation of the sister city that the Banjarmasin city government will carry out in wetland environmental governance (wetland governance). The model of sister city cooperation design that will be carried out is through the bottom-up model cooperation. This cooperation model focuses on the active participation of the community (citizen diplomacy) and community collaboration as transnational actors in managing the wetland environment (wetland governance) in Banjarmasin. Community participation (citizen diplomacy) and the active collaboration of the community with the city government as a transnational actor has become a fascinating new study in government and international relations, so it is crucial to study further. The wetland environmental management model in this model is integrated wetland environmental management. So far, the integrated wetland environmental management planning methodology has paid little attention to aspects that integrate institutions, technology, and funding. This model also describes ideally that wetland environmental management accommodates various interests of development activities, such as agricultural development, industrial interests, and environmental carrying capacity (ecological demands). The operationalisation of the integrated wetland environment concept as a planning unit in development has been limited to rehabilitating and conserving soil and water. At the same time, the organisation is still ad hoc, and the intact institutions regarding the management of the wetland environment have not been patterned. For wetland environmental management to be carried out optimally, it must involve all stakeholders and plan in an integrated, comprehensive, sustainable, and environmentally friendly manner with wetlands as a management unit. The bottom-up sister, the city cooperation model, was then made based on these problems. This collaboration is an effort to involve all parties, especially the community, so that every decision taken in planning is a collective decision and encourages mutual involvement and commitment to implement it.

Abstract

Community involvement plays a crucial role in the process of development planning, which is a crucial stage in the overall development process. This process involves analyzing the needs and issues in the field and seeking recommendations for solutions that will be outlined in the form of planning documents. However, based on the results of the data analysis in the field, community participation in development planning in Pelaihari Village in 2021 is still low, as demonstrated by the lack of attendance of community representatives and the inadequate presence of resource persons. Besides, there need to be more proposals for the process of development planning consensus (Musrenbang). This study aims to investigate the reasons for the lack of community involvement in Pelaihari Village's development planning in 2021. Explanatory qualitative research methods are used in this study to gather information from sources including the Sub-District Heads of Pelaihari Village, a representative of the neighborhood head in Pelaihari Village, the head of Pelaihari District, and the head of the Tanah Laut Regency Development Planning Department. The findings of the field study on the reasons for low community involvement in development planning in Pelaihari Village in 2021 show that the first factor is the mindset of the people who still do not trust and understand the process of development planning and the benefits of their participation in it. The second is the technical factor of implementation which is still not optimal and not suitable for urban areas, and the last is the Pelaihari sub-district heads' lack of initiative in gathering information to share with the community and their lack of creativity in planning technological implementation and engaging the community. Finally, the recommendations in this study are directed at the Tanah Laut District Government, the Pelaihari District Head, and the Pelaihari Sub-District Head. They include improving technical implementation, changing community attitudes through socialization, and boosting village head initiatives and innovations

Abstract

The tourism potential of the Flower River can be further developed if there is good management of structured tourism awareness groups under the supervision of the village government. In addition, the embodiment of Sapta Pesona (safe, orderly, clean, relaxed, beautiful, friendly, and memorable) in the Flower River creates a conducive and ideal environment for the development of tourism activities in a place. The purpose of the service is to increase public awareness to create an ideal Tourism Village based on 7 Sapta Pesona. The methodology used to develop the potential of this village is through the socialization of Awakening, the Sapta Pesona-Based Tourism Village, and the Development of Tourism Awareness Groups. From this activity, it will increase understanding of developing the tourism potential of Aranio Village, open up the insight of Flower River tourism managers so that they can plan programs that can rebuild Flower River tourism, the village government obtains the necessary reforms to revive tourist villages and can form legally aware tourism groups.

Abstract

The performance and productivity of any enterprise is a contentious topic of discussion in development. This research looks at the performance of Small and Medium Enterprises (SMEs) and how they are regulated to increase company productivity. Specifically, the paper sought to establish how policies and regulations contribute to leadership tasks, loyalty, employee motivation and job performance, affecting a firm’s production capacity. Policies and Regulations are examined in this paper because to enhance the performance of Small and Medium-sized Enterprises, the government of Indonesia issued regulation No. 20/2008, Article 3 about Micro, Small and Medium Enterprises intending to support the growth and development of the economy since 99% of the country’s economy is support by SMEs which also employees 97% of the working population of the country, yet there is still limited research on policies in relation performance and Productivity of SMEs. Though policies are a fundamental component in business growth, it has been established that employee performance affects company productivity, affecting local employment rates. The sample population was taken from Indonesia’s Small and Medium Enterprises (SMEs) employees. The sample size was 250, and PLS software was applied to analyze the data. The study’s findings showed the leadership role’s significance concerning existing Policies and Regulations regarding SMEs. It was also revealed that motivational policies enable employees to go beyond expectations and show higher levels of job performance in their respective tasks, increasing productivity.
