Abstract

Nowadays, in Indonesia, there are so many laws appear after KUHP which regulate about criminal laws, beside providing the rules of material criminal law againts to KUHP, also providing the formal rules which againts to KUHAP (formal criminal laws). In criminal laws that related to financial government, has common law which is regulated by laws itself. And corruption criminal laws which has the regime of law itself, but it is still unclear where could be qualificated as crimnal laws in financial government and which could be qualificated as corruption criminal laws. It is still in the “grey area”

Abstract

Industrial revolution has substantially changed the economy and society. The fusion of technologies and information marked the fourth industrial revolution which brings about new challenges relating to protection of intellectual property, including copyrights. With regard to this, there has been several changes in the law relating to copyrights in Indonesia. The nature of copyright infringement has been changed from ordinary offense to complaint-based offense. This fundamental change undoubtedly affects the enforcement of the copyright law in Indonesia. Thus this paper aims to answer and review the legal reasoning behind the shift in offense in Copyright Law in Indonesia. This normative legal research employed a descriptive-analytic method. The result shows that the complaint-based offense is suitable in copyright protection considering that only the copyright owner knows the details of the object of the creation.

Abstract

Pertambangan minerba dan kehutanan merupakan salah satu sumberdaya alam tak terbarukan (unrenewable) yang harus dapat dikelola dengan baik.Pengelolaan sumber daya alam tersebut harus mengacu pada UUD 1945. Indonesiamerupakan salah satu negara yang menggunakan sarana hukum pidana sebagaiujung tombak penegakan hukum SDA. Penelitian ini bertujuan untuk mengetahuiperan hukum pidana dan kebijakan pidana dalam mencegah dan menanggulangitindak pidana didaldigunakan adalah metode penelitian normatif, yaitu suatu metode penulisan hukumyang bertujuan untuk memperoleh bahan hukum pustaka dengan cara mengumpulkandan menganalisis bahan hukum terkait dengan permasalahan. Hasil dari penelitianini: Pertama, Penggunaan sanksi pidana dalam penegakan aturan sumberdaya alamyang ada merupakan tuntutan sosial mengingat kepentingan hukum yang harusdilindungi. Fungsi hukum pidana tidak hanya sekedar untuk mempertahankan danmelindungi nilai-nilai moral, tetapi telah bergeser ke arah pendekatan kemanfaatan.Kedua, Di Indonesia kebijakan pidana mengenai SDA merupakan administrativepenal law. Hal ini dikarenakan perkembangan kebijakan pidana di bidang SDA telahberkembang secara signifikan, pada awalnya pengaturan pidana hanya digunakansebagai alat bantu dalam penegakan hukum SDA. Abstract

Trade mark not only functions as an identity but also contains economic value so there are many efforts regarding bad-faith trademark registration. This study aimed to find the concept of bad-faith registration and to know the law enforcement in Indonesia. This was a normative legal research, with statute approach, conceptual approach, and case approach. The results of the study showed that: first, the concept of bad-faith has been regulated in Trademark Law Number 19 of 1992, Trademark Law Number 15 of 2001 and Law Number 20 of 2016. The concept of bad-faith is when an applicant is reasonably suspected to register his trade mark improperly and dishonestly to imitate, copy, or follow the trade mark of other parties for the interests of his business, create unfair business competition atmosphere, deceive, or mislead consumers. Second, the law enforcement on bad-faith trade mark registration is carried out by (a) rejecting the trade mark since registration process; (b) removal of trade mark by trade mark owners, government (ministers) or third parties; (c) revocation of trade mark by lawsuit in Commercial Court.

Abstract

This research was conducted using research methods, namely, the type of normative legal research, problem approach using the Statute Approach and Conceptual Approach, the nature of this research is analytical descriptive, descriptive research type with primary huum sources, secondary legal materials and tertiary legal materials obtained through library research.         From the results of research and discussion of the issues raised at least some conclusions can be drawn. First, from the results of the elaboration of the, it can be seen that the actions of commissioners, directors and bank employees violate the precautionary principle (bank compliance) including Banking Crimes. Second, Credit Officers (Managers) are responsible for checking credit that has been decided in accordance with the principle of prudence, believe in the correctness of data and information in credit decisions, believe supporting documents for credit decisions are complete, valid, valid and legally binding, believing that analysis and evaluation credit has been done correctly. The Credit Administration is responsible for ensuring compliance with the Precautionary Principle by giving opinions.

Abstract

The objective of this study are: First, to find the reasoning behind changes in offenses in the Copyright Law number 28 /2014. Second, reviewing the impact of offense changes and their influence on the enforcement of copyright in Indonesia. This study uses a normative juridical method. Normative legal research is carried out through qualitative descriptive. While the legal material is collected, sorted and subsequently studied and analyzed for content, to obtain the level of synchronization, the feasibility of norms, and the submission of new normative ideas.The results of this study are that the complaint offense in the 2014 Copyright Law is suitable considering that copyright is something unformed. When a complaint is imposed, the copyright owner must know the details of the object of his creation. The impact of the offense change has become a crucial factor in the enforcement of copyright law in Indonesia. Given that so far the application of normal offenses seems to be running in place because law enforcers become passive and with complaints offense, all stakeholders can protect the copyright of the creator.

Abstract

Terrorism is a human-made disaster, which is usually in the form of organised crime. In prevention, terrorism cannot be done only through legal approaches alone but covers all aspects of society. While eradication aimed at combating terrorism, uncovering and addressing criminal cases and perpetrators of terror in the form of the establishment of the measures included in the crime of terror, handling, ranging up to the judicial investigation and threatened sanctions to perpetrators of terror. The method used is doctrinal with the statute approach, the conceptual approach, the historical approach, and the philosophical approach. The result shows that deradicalisation in Indonesia is carried out by BNPT for terrorists, families and sympathisers, while counter-radicalisation is carried out for the general public to increase the deterrent power of radical terrorism. In comparison, Thailand used the application of a curriculum in education as the concept of deradicalisation

Abstract

The rampant corruption is in the utilization and its influence on global warming. It is expected in the future, in addition to the availability of maps of forest area easily accessible with some clear regional boundaries, there are also institutional and human resource capacity strengthening in the areas permitting the process to prevent corruption in the management of forest areas in Indonesia resulted in the destruction of natural resources, especially forests. Various activities in that sector become a critical point of the occurrence of corruption cases. In addition to the inadequacy of the forest area maps, unclear set of area boundaries, and the violations of licensing criteria, the cases of illegal logging become the factors that cause damages to the forest land in Indonesia. The purpose of this paper is to find out the relationship between corruption in the permitting conversion of forest land field of the ministry. The method used in this study was descriptive analytical research describing and analyzing the available facts in accordance with the issue that became the object of the research study.
