Abstract

Provinsi Kalimantan Utara mengambil kepiting bakau menjadi andalan komoditi unggulannya. Keadaan sosial ekonomi masyarakat petani tambak di Kaltara bisa dikatakan membaik nasibnya sejak meningkatnya harga beli kepiting. Penurunan nilai penangkapan kepiting bakau di wilayah ini diduga akibat dari permen KKP no 56/2016 yaitu tentang larangan penangkapan kepiting dengan ukuran tertentu dan penangapan kepiting bertelur di alam. Tujuan dari pelaksanaan pengabdian msyarakat ini adalah untuk meluruskan kesalah fahaman tentang peraturan pemerintah dalam upaya mengatur usaha perdagangan kepiting bakau di Kalimantan Utara. Pendekatan dan metodologi yang digunakan dalam pengabdian masyarakat ini ini adalah dengan dengan wawancara, kuesioner, dokumen, dan lain-lain. Hasil kegiatan ini menunjukan bahwa Provinsi Kaltara memiliki sumberdaya kepiting bakau melimpah dan dapat digunakan untuk meningkatkan kesejahteraan masyarakat dan perekonomian daerah sehingga dibutuhkan regulasi daerah untuk mendukung pengelolaan sumberdaya tersebut dalam bentuk peraturan gubernur. Secara filosofi lahirnya peraturan menteri No.56 Tahun 2016 tersebut pada dasarnya memiliki nilai yang sangat baik sehingga harus sejalan dengan dasar hukum yang ada di atasnya yakni UU No. 45 Tahun 2009 yang memiliki tujuan utama dalam pengelolaan perikanan adalah agar tercapainya kesejahtraan masyarakat dan produktivitas sumberdaya hayati yang berkelanjutan.

Abstract

Kehidupan manusia pada dasarnya adalah dinamis, hal ini dapat dilihat dari perkembangan baik secara fisik maupun perkembangan sosial masyarakat, karena manusia merupakan makhluk hidup yang tidak dapat hidup sendiri sehingga mereka selalu bergantung pada orang lain. Adanya hukum merupakan sarana sebagai pengatur kehidupan masyarakat supaya dapat hidup aman dan tentram tanpa terganggu hak dan kewajibannya sebagai manusia. Perkembangan manusia juga diiringi dengan perkembangan zaman dan teknologi, terutama bidang teknologi informasi, yang menjadikan manusia memiliki ketergantungan pada dunia teknologi yakni media sosial dan internet. Sehingga masyarakat perlu waspada dan sadar akan efek negative terhadap kemajuan teknologi tersebut. Salah satu hal yang marak dewasa ini adalah tentang penggunaan media sosial dalam komunikasi. Program Pengabdian kepada Masyarakat yang kami laksanakan ini merupakan solusi dan memahamkan masyarakat dalam menyikapi media sosial dan peraturan hukum yang mengatur. Sehingga dengan adanya kegiatan ini, mereka lebih memahami bagaimana bersikap terhadap kemajuan teknologi tersebut. Manfaat yang didapat dari pelaksanaan kegiatan ini bahwa masyarakat Kelurahan Karang Harapan menyadari betul kebutuhan media sosial tetapi mereka baru menyadari bahwa bermedia sosial juga diperlukan etika untuk menghindarkan diri mereka dari hal-hal yang dapat merugikan diri mereka sendiri seperti pencemaran nama baik, terlebih pemahaman baru terhadap Undang-Undang Informasi dan Transaksi Elektronik.

Abstract

Berbicara mengenai problema akan Kota Layak Anak yang terdapat di Tarakan, maka itu akan menyangkut pemenuhan akan pengaturan hak-hak anak di wilayah yang bersangkutan. Penelitian ini terfokus pada daerah perbatasan, khusnya Tarakan, dengan mengetahui peran pemerintah daerahnya dalam mewujudkan daerahnya sebagai daerah layak anak. Pelecehan anak sangatlah berpengaruh dalam hal penentuan kota Tarakan sebagai kota layak anak, maka dari itu diperlukan secara teratur dan berkesinambungan usaha untuk meminimalkan hal itu, dan juga dibutuhkan partisipasi masyarakat dan peran pemerintah secara keseluruhan diwujudkan dalam ketersediaan alokasi dana untuk menyediakan perlindungan terhadap hak-hak anak. Ini adalah tantangan besar, khususnya untuk mengoptimalkan pelaksanaan hak-hak anak-anak dari orangtua, masyarakat, kabupaten atau kota, propinsi, dan tingkat nasional di masa sekarang dan di masa depan. Bila kita tidak segera mengambil tindakan inisiatif dan juga kepedulian dari kepentingan pengabaian anak, hak anak khususnya tumbuh dan berkembang, akan menjadi sangat tidak optimal, lebih buruk lagi itu akan berakibat hilangnya generasi.Talking about Child Friendly Cities (KLA) problem, it will intersect with the regulatory fulfillment of children’s rights in the related region. This research focused on the border areas particularly in Tarakan, by knowing the role of Local Government in realizing the region as a Child Friendly Cities. Child abuse is very influential in determining Tarakan city as a Child Friendly City (KLA), and therefore required a regular and continuous efforts to minimize it, and it also required the participation of the community and also the role of government which is manifested in the availability of the funds allocation to provide the protection of the children’s rights. This is a big challenge in particular to accelerate the implementation of the children’s rights at their parents, community, regency/city, provincial, and national levels in the present and future. If we do not immediately take the initiative and concern for the best interests of the child neglect, children’s rights especially growing and developing will be unoptimal, worse it will lead to the loss of a great generation.

Abstract

This study discusses the right to education policy for Persons With Disabilities (PwDs) In Border Area of Nunukan-Indonesia. This research aims to find out whether the legal regulation on human rights for with disabilities provided by the Indonesian government is appropriate or not and to find out whether the government of Nunukan District also provided some policies in handling a person with disabilities, in particular, their right to education. This research used a normative legal method, which complemented with field research. As a result, in order to fulfil human rights for PwDs, the Indonesian government was stipulated plenty of national laws, namely National Education System Law, the Protection of Children Law, and individually regulated by Law No. 8 of 2016 on Persons with Disabilities. Also, the most crucial factor is that the Nunukan District has not been set up the local regulation pertaining to PwDs. Only several policies are stipulated to overcome the right to education problems, but it does not enough to ensure the correct implementation of this right in the field.

Abstract

AbstractVarious weaknesses are still found in the protection of the rights of citizens, pertaining to the right to education in border area, that resulted in the backwardness and poverty of its citizens. The government of Nunukan District has released a regulation in fulfilling the right to education of citizens, that is regional regulation Number 05 Year 2012 on the management and implementation of education. Legal model for the fulfillment of the right to education of citizens in the border area should refer to the constitutional rights of citizens and in accordance with the international covenant on ECOSOC rights and principles of national education. IntisariPersoalan kebijakan perlindungan hak-hak warga negara khususnya terkait hak pendidikan di wilayah perbatasan selama ini masih terdapat berbagai macam kelemahan yang berakibat keterbelakangan, ketertinggalan dan kemiskinan warga negara di wilayah perbatasan. Kebijakan Pemda Kab. Nunukan dalam rangka pemenuhan hak atas pendidikan warga negara di wilayah perbatasan dituangkan ke dalam Perda Nomor 05 tahun 2012 tentang Pengelolaan Dan Penyelenggaraan Pendidikan. Model hukum Pemenuhan hak atas pendidikan warga negara di wilayah perbatasan harus mengacu pada hak konstitusional Warga Negara yang dijamin dalam konstitusi Indonesia dan sesuai dengan Konvenan Internasional Hak Ekosob dan prinsip-prinsip penyelenggaraan pendidikan nasional.

Abstract

Nunukan Regency, which borders Sabah and Sarawak, Malaysia has problems regarding the repatriation of Indonesian Citizens in the capacity as Indonesian Migrant Workers who working in Malaysia. The repatriation is related to immigration violations such as not having complete documents to enter Malaysian territory as a worker, so it can be categorized as illegal Indonesian Migrant Workers. This research uses a doctrinal approach by reviewing the regulations related to migrant workers plus analysis of documents and data obtained from in-depth interviews with the Placement and Protection of Indonesian Migrant Workers Agency in Nunukan and Immigration in Nunukan. Legal protection for illegal Indonesian Migrant Workers through the Placement and Protection of Indonesian Migrant Workers Agency and Immigration in Nunukan is taken in 3 (three) ways, (1) prevention of non-procedural illegal Indonesian Migrant Workers; (2) deportation; and (3) the return of illegal Indonesian citizens/Indonesian Migrant Workers to their hometown. The efforts to protect the law are coupled with the closure of illegal cross-border routes between Indonesia and Malaysia in the Nunukan Regency area. It is hoped that all legal protection efforts will minimize the presence of illegal Indonesian Migrant Workers.

Abstract

AbstractIndonesia as an archipelagic country with archipelago characteristics has an official number of islands around 16.056 with a water area of approximately 2/3 of its land area. Having a coastline of 95.181 km makes Indonesia’s coastal areas one of the most productive centers of economic activity. The economic potential should also be supported by the management of the coastal environment which has the potential to be damaged and polluted in coastal areas. Nunukan Regency, North Kalimantan Province, since its formation in 1999 has had a Regional Spational Plan in the form of Perda Number 19 of 2013 concerning Regional Spatial Planning for 2013 - 2033. Perda number 19 of 2013 contains a process system for spatial planning, spatial use, and spatial use control as an elaboration of Law Number 26 of 2007 concerning Spatial Planning and contains management of the coastal area of Nunukan Regency as a representation of the elaboration of Law Number 27 of 2007 concerning Management of Coastal Zone and Small Islands. Based on the report from the DPUPR-PERKIM audit team for North Kalimantan Province, it was found that there were indications of violations in the use of space for the community’s special terminal object (water jetty) on the coastal border of south Nunukan District. This study raises the issue of position and legal implications for the use of special terminal space based on Regional Regulation Number 19 of 2013. Researchers use welfare theory in studying its legal standing. And the implications of legal authority for the existence of special terminal using the legal theory of effectiveness. This type of research is normative legal research with data collection techniques based on legal materials combined with field data. The results of the study found a legal analysis that there was a discrepancy in the use of space for the position of a special terminal along the coastal border. As an implication of the legal position of a special terminal, legislation has provided legal protection and has provided clear and firms limits on prosecution. Spatial Law enforcement is carried out by forming Spatial Planning Civil Servants Investigators (PPNS) as a recommendation from the results of this study.Keywords: Legal Position, authority, local government, PPNS.

Abstract

Pada dasarnya hukum diciptakan sebagai alat perubahan sosial. Salah satu berkurangnya hutan yang ada di Tarakan disebabkan oleh pertumbuhan penduduk dan mengklaim hutan yang ada sebagai hutan adat sehingga diperlukan kebijakan pemerintah daerah untuk menetapkan kawasan hutan tertentu. Hal ini di samping sebuah perintah UU juga merupakan tugas Pemerintah Daerah. Yang intinya sebagai peran Hukum Administrasi pada intinya, pertama, yang memungkinkan tugas administrasi negara, Kedua, melindungi warga negara terhadap tindakan sikap administrasi negara dan juga melindungi administrasi negara itu sendiri. Metode yang digunakan dalam penelitian ini termasuk jenis penelitian empiris. Sedangkan untuk memperoleh data menggunakan study pusktaka, observasi dan wawancara, kemudian data primer, sekunder dan tersier dianalisis untuk memecahkan masalah yang ditimbulkan. Status lahan hutan di Wilayah Adat di kota Tarakan adalah hutan negara, hutan harus dikelola sesuai dengan hak ulayat masyarakat adat. Suatu kawasan hutan tidak dapat dikatakan sebagai kawasan hutan adat begitu saja, tetapi harus melalui beberapa prosedur dan salah satu peran Pemerintah daerah Kota Tarakan adalah mengeluarkan peraturan Daerah Nomor 4 Tahun 2012 tentang Rencana Tata Ruang Kota 2012-2032 yang di dalamnya memuat tentang hutan. Basically the law was created as a tool for social change. One of the existing forest loss in Tarakan caused by population growth and forest claimed as indigenous forest policy that required local governments to establish a particular forest area. This is in addition to a command law is also the duty of Local Government. Which is essentially the role of Administrative Law in essence, the first, which allows the state administration tasks, Second, to protect citizens against the actions and attitude of the state administration also protects the state administration itself. The method used in this study include the type of empirical research. As for obtaining data using pusktaka study, observation and interview, then the primary data, secondary and tertiary analyzed to solve the problems posed . Status of forest land in the town of Tarakan Indigenous Territory is a state forest, the forest must be managed in accordance with the customary rights of indigenous peoples. A forest can not be regarded as indigenous forests for granted, but must go through one of several procedures and the role of local government is issuing regulations Tarakan City Region No. 4 of 2012 on City Spatial Plan 2012-2032 in which the load on the forest .

Abstract

This research aimed to establish the legitimacy of protecting coastal residents from a social justice perspective. This was normative legal research conducted following cases, statutes, facts, and comparisons. The results of this study show how important it is to prioritize social equity for coastal protection. As natural calamities become more frequent, property protection becomes more difficult. Countries endowed with substantial financial and human resources can effectively tackle the challenges associated with climate change mitigation through the development and establishment of state-of-the-art scientific and technological infrastructure. In multicultural social justice, all individuals are valued. Priorities for environmental and social justice are prevalent in developing nations afflicted by coastal ecological degradation and widening income gaps. Developed nations like Germany have implemented and enforced coastal protection policies to uphold environmental justice principles. Second, the community-led governance initiatives generated genuine participation through mutual aid. Environmental law advances the cause of social justice. Environmental justice, which emphasizes the distribution of resources and the preservation of vulnerable groups, has emerged as the essence of justice in the ecological age.
