Abstract

Globalization has increased the number of mixed-nationality and interfaith marriages, giving rise to cross-jurisdictional legal complexities, particularly for Muslim parties. This study aims to analyze the application of the principles of Private International Law—namely, lex patriae, lex domicilii, lex loci celebrationis, and lex rei sitae—in the resolution of disputes regarding mixed-nationality marriages and international inheritance. The methodology employed is normative legal research using a comparative law approach and analysis of court decisions. The results of the study indicate that the validity of mixed marriages is determined through a combination of formal requirements based on lex loci celebrationis and substantive requirements subject to lex patriae or lex domicilii, which often conflict with Sharia norms and the public policy of the forum state. In international inheritance, the differences between the faraidh system and Western law lead to fragmentation in dispute resolution, particularly regarding immovable property governed by lex rei sitae. To reduce legal uncertainty, cross-jurisdictional marriage contracts, international wills, mandatory bequests, and asset transfers that comply with the principle of dual compliance are necessary. Abstract

The phenomenon of globalization has significantly increased the mobility of individuals and assets across national borders, giving rise to complex transnational inheritance cases. This article critically analyzes the problems and solutions of cross-border asset distribution from the perspectives of Islamic Law and Indonesian Positive Law. Using a normative juridical approach with comparative and conceptual methods, this study reveals that transnational inheritance is fraught with conflicts of laws, primarily due to the differing connecting factors in Private International Law, such as lex rei sitae, lex patriae, and lex domicilii. Furthermore, the fundamental differences between the rigid, divinely ordained shares in Islamic inheritance law and the testamentary freedom in Western civil law systems exacerbate legal uncertainty. The findings indicate that the absence of a comprehensive Private International Law codification in Indonesia and the territorial limitations of religious courts create significant hurdles in executing cross-border inheritance. To resolve these issues, this article proposes a dual-track solution: the strategic application of Private International Law principles through international wills, and the utilization of flexible Islamic legal mechanisms such as hibah (inter vivos gifts), wasiat wajibah (mandatory wills), and takharuj (compensatory withdrawal). These solutions aim to provide legal certainty and achieve substantive justice in transnational succession..

Abstract

The purpose of this research is to find out how the regulation of Inheritance Law according to the Civil Code and how the elimination of inheritance rights and its legal consequences for the heirs. By using normative juridical research methods, it is concluded: 1. Although the heirs in inheritance law are guaranteed the right to inherit as an absolute part (legitieme portie), but in certain cases and circumstances, the heirs' inheritance rights can be revoked or nullified, among others, due to committing crimes such as persecution of the testator, forgery of wills, and so forth. 2. The legal consequences of the elimination of the right to inherit, among others, are that the heirs concerned, in addition to not being entitled to inheritance, can be ostracized or excluded as members of the extended family of the testator.
