Abstract

Undang-Undang RI Nomor 1 Tahun 1974 tentang Perkawinan junto Undang-Undang RI Nomor 16 Tahun 2016 tentang Perubahan Atas Undang-Undang RI Nomor 1 Tahun 1974 mengatur bahwa perkawinan adalah ikatan lahir bathin antara seorang pria dengan seorang wanita sebagai suami isteri dengan tujuan membentuk keluarga (rumah tangga) yang bahagia dan kekal berdasarkan Ketuhanan Yang Maha Esa. Perkawinan mempunyai hubungan yang erat sekali dengan agama/kerohanian, sehingga perkawinan bukan saja mempunyai unsur lahir/jasmani, tetapi unsur bathin/rokhani juga mempunyai peranan yang penting. Salah satu akibat perkawinan yang dapat membentuk keluarga yang bahagia, adalah dengan hadirnya keturunan dalam perkawinan tersebut, yang pemeliharaan dan pendidikannya menjadi hak dan kewajiban orang tua. Agar diperoleh keturunan yang baik dan sehat maka calon suami dan istri yang akan melangsungkan perkawinan harus telah matang jiwa raganya sehingga dapat pula mewujudkan tujuan perkawinan karena tercipta keluarga yang harmonis dan tidak mudah berakhir dengan perceraian. Di samping itu, perkawinan mempunyai hubungan dengan masalah kependudukan. Ternyata bahwa batas umur yang lebih rendah bagi seorang wanita untuk kawin, mengakibatkan laju kelahiran yang lebih tinggi jika dibandingkan dengan batas umur yang lebih tinggi. Berhubung dengan hal itu, maka diperlukan pengaturan batas usia minimal untuk kawin bagi pasangan calon suami isteri.

Abstract

Sebagai negara yang berpegang pada prinsip non refoulment yakni pelarangan pengembalian atau pengusiran pencari suaka dan pengungsi serta letak yang strategis menimbulkan beberapa konsekuensi, terhitung sejak tahun 1979 Indonesia telah menaati prinsip non refoulment dibuktikan dengan menampung imigran ilegal yakni pengungsi (refugee) dan para pencari suaka (asylum seeker) yang mengharap perlindungan dan tempat tinggal sementara hingga kondisi negara asalnya telah aman untuk ditinggali. Akibat yang timbul dari peristiwa yang telah berlangsung cukup lama tersebut terjadi hubungan interaksi antara imigran ilegal dengan WNI. Bahkan menurut berbagai data beberapa diantara mereka telah melangsungkan perkawinan siri hingga dianugerahi keturunan. Permasalahan yang terjadi akibat hal tersebut yakni perkawinan siri antara imigran ilegal dengan WNI tidak diakui sah oleh negara, sehingga anak yang lahir dari perkawinan tersebut menyandang status sebagai anak luar kawin hal ini bersesuaian dengan ketentuan yang termaktub pada UU Nomor 1 Tahun 1974 tentang Perkawinan. Oleh karena itu, pengkajian mengenai kejelasan status perkawinan antara WNI dan Imigran Ilegal serta kejelasan status kewarganegaraan anak yang lahir dari perkawinan tersebut diperlukan.

Abstract

This research aims to analyze the application of the principle of audi et alteram partem in the proceedings of simple claims in the District Court and to examine the constraints and obstacles in applying the principle of audi et alteram partem in the proceedings of simple claims in the District Court. The research method used in this study is empirical research, which involves collecting data directly through field studies conducted at the District Court of Makassar and the District Court of Sungguminasa. Data collection techniques include interviews and literature review, followed by qualitative analysis and descriptive presentation. The results of this study indicate that: 1) The principle of audi et alteram partem applies to the proceedings of simple claims. Although the proceedings of simple claims are specifically regulated in the Supreme Court Regulation No. 2 of 2015 concerning Simple Justice in the General Judiciary, this principle must still be upheld. In the proceedings of simple claims, both the plaintiff and the defendant have the opportunity to express their opinions before the judge makes a decision. Parties who are absent in the first hearing will be summoned again to attend the second hearing in order to listen to arguments from the other party. 2) The constraints in applying the principle of audi et alteram partem include time limitations in the proceedings of simple claims, which may not provide sufficient time for the parties involved to present their arguments comprehensively and clearly, lack of legal support, making it difficult for them to effectively present their arguments, and lack of strong evidence, making it difficult for the judge to make accurate decisions.

Abstract

This study aims to analyze the arrangements related to the utilization of the river riparian which is used as a restaurant business in the Tello Baru Sub-District, Makassar City and to analyze the form of government supervision of the implementation of river riparian utilization permits in the Tello Baru Sub-District, Makassar City. This research is an empirical research, where the data is qualified as primary and secondary data. Primary data was obtained through interviews, and secondary data was obtained through literature studies. The data collected is then processed using a qualitative analysis approach.The results of the study show that the utilization of river banks which are used as a restaurant business in Tello Baru Village, Makassar City is not in accordance with the Decree of the Minister of PUPR Number 1559/KPTS/M/2020 which states that river banks can only be used for certain activities and certain buildings, which include: Buildings natural resources infrastructure, bridge and wharf facilities, gas and drinking water pipelines, electrical and telecommunication cable stretches, other activities as long as they do not interfere with the function of the river, including activities to plant vegetables, and electricity buildings. So that the use of the Tello River opportunity for floating restaurant activities can be said to not realize orderly spatial planning. And then the form of government supervision of the implementation of river riparian utilization permits in Tello Baru Village, Makassar City is felt to be lacking, in this case the Pompengan Jeneberang River Basin Center (BBWS) as the vanguard of the Ministry of PUPR as the guardian of Law No. 17 of 2019 concerning Water Resources is considered to be still not active in monitoring the abuse of the Tello River border area resulting in violations of the use of the river border. as it is now. The Pompengan Jeneberang River Basin Center (BBWS) is considered to be lacking in coordination and cooperation with the City Government and Village Governments through which the Tello River passes.

Abstract

Introduction to The Problem: The revelation of cases of misuse of humanitarian donations by philanthropic organizations reported by the media. The Aksi Cepat Tanggap (ACT) organization, which is one of the suspects in the misuse of humanitarian donations, is a big question about the implementation of supervision carried out by the government. There are not many cases of ACT, there are several institutions or community organizations to government organizations that have misused their donations. The form of misuse of humanitarian donations with the misuse of public funds to the waste of funds.Purpose/Objective Study: This research aims to reconstruct the legal liability of social philanthropy institutions in the misuse of humanitarian funds. Thus, the collection of humanitarian donations can provide real benefits to the community, and government programs related to poverty alleviation can have a real impact.Design/Methodology/Approach: This type of research is normative juridical with an analytical descriptive approach that discusses legal symptoms and problems with a legislative and doctrinal approach.Findings: The author identifies a significant gap in governmental oversight concerning the collection of money or goods intended for humanitarian aid. This lack of supervision has resulted in the opportunistic exploitation of disaster events, where individuals or groups capitalize on the urgency and generosity elicited by such crises. These actors collect donations ostensibly for relief efforts but instead divert these resources to serve their own personal or financial interests. The absence of stringent regulatory frameworks and effective monitoring mechanisms allows for this misuse, undermining public trust and depriving genuine victims of the essential aid they desperately need. The author underscores the critical need for robust government intervention and accountability measures to safeguard the integrity of humanitarian donations and ensure they reach those most in need.Keywords: Reconstruction; Philanthropic Institutions; Humanitarian Donations
