Abstract

Tujuan penelitian ini untuk membahas hukum bunga bank konvensional menurut pendapat para ulama, yang kemudian akan melanjutkan pembahasan dengan analisis hukum berdasarkan teori ushul fiqh untuk mengetahui kekuatan hukum bunga bank konvensional. Penelitian ini merupakan penelitian pustaka. Pendekatan yang digunakan dalam penelitian ini adalah pendekatan konseptual mengingat tujuan yang ingin dicapai dalam penelitian ini adalah untuk menghasilkan salah satu konsep pemikiran hukum Islam tentang hukum bunga bank yang tidak dibatasi oleh pandangan atau pendapat yang ada, tetapi sebenarnya mengacu pada kaidah syariah. hukum yang disepakati oleh mayoritas ulama. Hasil penelitian ini adalah: Para ulama memiliki pendapat yang berbeda tentang hukum bunga bank. Mereka yang melarang mendalilkan bahwa bunga bank memiliki kesamaan dengan riba, sehingga harus dilarang. Adapun yang membenarkan bunga bank menjelaskan bahwa bunga bank tidak sama dengan riba, sehingga hukumnya halal. Adapun bagi yang menganggapnya sebagai syubhat, karena menurut mereka bunga bank selain memiliki kesamaan dengan riba juga memiliki sejumlah perbedaan, sehingga hukumnya adalah syubhat. Hukum bunga bank jika dilihat dari perspektif ushul fiqh, maka baik yang melarang, yang membenarkan, maupun yang menganggap syubhat, semuanya bukan berasal dari qath'î, tetapi dalil zhannî karena bersumber dari hasil ijtihad dengan metode qiyâs. Karena tidak adanya dalil qath 'maka penulis berpendapat bahwa arah baru penetapan hukum halal-haram transaksi perbankan dengan sistem bunga harus dilihat dari besar kecilnya manfaat (maslahah) dan kerugian (mudharat). yang timbul dari penjualan.

Abstract

This study aims to determine, analyze and understand the extent of the application of Islamic economics in terms of compensation at the shichona distro from the maqashid sharia perspective. This type of research is descriptive qualitative research based on the results of interviews and documentation using analysis techniques from Miles and Hubberman. The results showed that Distro Syaichona in compensating employees there are two types of compensation namely direct compensation and indirect compensation. Direct compensation provided by Distro Syaichona is in the form of salaries, incentives and allowances. While indirect compensation is in the form of social assistance and employee welfare. In this case, social assistance is in the form of death assistance, calamities and money lending. The application of compensation from the maqashid sharia perspective carried out by Distro Syaichona has not fully implemented hifdz al-mal in accordance with Islamic economics, the contributing factor is that Distro Syaichona has not implemented the principle of not delaying employee rights properly, because there is still a delay in providing compensation even though it is not too frequent. But on the other hand, Syaichona Distro applies the principle of hifdz al-din which is in accordance with Islamic economics, namely the principle of fairness and worthiness.

Abstract

This study aims to find the concept of Indonesian Islamic moderation from the perspective of maqashid shariah and tries to present forms of Islamic moderation that follow the Qur'an and al-hadith (maqashid shariah). By conducting qualitative research with a descriptive approach through library research methods that focus on observing (examining) previous research studies and analyzing the mils and Huberman models related to conformity with maqashid sharia. This study resulted in the primary forms of Indonesian Islamic moderation, namely: the state of Indonesia, neither a radical religion nor a liberal religion. It is conceptualized in five aspects belonging to the wasathiyah concept, namely: Maintaining Religion (Hifdzu al-din), Nurturing the Soul (hifdzu al-nafs), Maintaining Intellect (hifdz al-aqli), Caring for offspring (hifdz al-nasl). ), Maintaining property (hifdz al-mal). So, the presence of maqashid sharia as a spirit with these five principles in maintaining the integrity of Religion and the State ensures that love for Religion and the State can save humanity and maintain the dignity of Islam itself.

Abstract

The purpose of this study is to find out a new concept of spiritual leadership based on Maqashid Syari'ah in educational institutions. This research uses a qualitative approach that uses literature studies and content analysis techniques. Spiritual leadership in educational institutions has three concepts, namely, assuming a leader has leadership traits since birth, group function is seen as leadership because the success or failure of a leader depends on how the group works and making concepts that are more advanced and better. This study also shows that leaders need to understand the importance of vision, altruistic love, and the expectations of members in leadership. The net result of the concept of spiritual leadership in educational institutions based on maqashid shari'ah must adjust to five forms of protection, namely, religious protection, protection of life, protection of property, protection of reason, and protection of lineage. From this form of protection, leadership in educational institutions will be more practical, structured, and consistent. Abstract

Abstract: Philanthropy has an important role in developing society in Indonesia, and Islamic educational institutions, in this case Islamic boarding schools, actively participate in implementing philanthropy for the welfare of social life and society. This research aims to examine the essential values, forms of programs and ideology used at the Dalwa Pasuruan Islamic boarding school in implementing philanthropy. The paradigm practiced in this research is postpositivistic with a case study method. The instruments that will be used in this research include: In-depth interviews, active observation and documentation. The data analysis uses the analysis steps described by Robert K. Yin, namely: compiling (collecting data), disassembling (deconstruction), reassembling (recombining), interpreting (interpretation), concluding (conclusion). Meanwhile, to validate the accuracy of the data using triangulation techniques. The results of this research show: first, the essential values of philanthropy in Islamic education used at the Dalwa Islamic boarding school originate from religious texts and humanitarian calls. Second, there are three forms of philanthropic programs in Islamic education implemented at the Dalwa Islamic boarding school, namely philanthropy for students, community, teachers and Asatidz. Third, the ideology that is the basis for constructing Islamic education philanthropy at the Dalwa Islamic boarding school is a scientific hybrid: ḥaḍramiyah and makiyah as well as a philanthropic ideology that leads to unaffiliation with Islamic organizations. Keywords: Philanthropy, Islamic Education, Islamic Boarding School Abstrak: Filantropi memiliki peran penting dalam membangun masyarakat di Indonesia, dan lembaga pendidikan islam dalam hal ini pesantren turut berpartisipasi aktif dalam implementasi filantropi demi kesejahteraan kehidupan sosial dan masyarakat. Penelitian ini bertujuan untuk mengkaji nilai-nilai esensial, bentuk program-program dan idiologi yang digunakan di pesantren dalwa pasuruan dalam menerapkan filantropi. Paradigma yang dipraktikkan dalam penelitian ini adalah postpositivistik dengan metode studi kasus. Instrumen yang akan digunakan dalam penelitian ini meliputi: Wawancara mendalam (Indepth Interview), Observasi aktif dan Dokumentasi. Adapun analisis data menggunakan langkah-langkah analisis yang dijelaskan oleh Robert K. Yin, yaitu: compiling (mengumpulkan data), disassembling (dekonstruksi), reassembling (penggabungan kembali), interpreting (penafsiran), concluding (penyimpulan). Sedangkan untuk memvalidasi keakuratan data menggunakan teknik triangulasi. Hasil penelitian ini menunjukkan: pertama, nilai-nilai esensial dari filantropi dalam pendidikan Islam yang digunakan pada pesantren Dalwa bersumber dari teks agama dan panggilan kemanusiaan. Kedua, bentuk program-program filantropi dalam pendidikan Islam yang diimplementasikan pada pesantren Dalwa terdapat tiga bentuk yaitu filantropi pada Santri, Masyarakat, Guru dan Asatidz. Ketiga, Ideologi yang menjadi landasan dalam mengkonstruksi filantropi pendidikan Islam yang dimiliki pesantren dalwa yaitu hibrida keilmuan: ḥaḍramiyah dan makiyah serta ideologi filantropi yang mengarah pada ketidakafiliasian dengan organisasi Islam.
