Abstract

Abstract: The mechanism for supervision of Constitutional Court’s judges is conducted in two supervisory measures. They are internal supervision conducted by Supreme Court and external supervision by Judicial Commission. Although Judicial Commission is included as the member of internal integrity board of Constitutional Court judges, its supervision is limited for court session. This mechanism does not does not prevent the occurrence of misconduct because this ad hoc supervision board is only set up in case of alleged breach of ethical code by judge(s). In practice, Judicial Commission is not bestowed with sufficient authority to supervise the judges of Constitutional Court, since such role belongs only to ethical board in which the Judicial Commision is omitted from its membership. From the perspective of Islamic judicial law, this limited mechanism of supervision by Judicial Commission towards the judges of Constitutional Court is contradictory to Islamic judicial law. Islamic judicial law recognises Qâdhi al-Qudhâh that performs supervision with necessary authority. The external supervision of Judicial Commission should be given this authority to create a meaningful and effective supervision. Keywords: Islamic Judicial Law, judge supervision, Constitutional Court Abstrak: Mekanisme pengawasan hakim Mahkamah Konstutusi pasca putusan No.12/PUU-XII/214, dilakukan melalui dua jenis pengawasan yang diatur dalam UU No. 8 Tahun 2011, yaitu: Pertama, pengawasan internal yang dilakukan oleh Mahkamah Konstitusi. Kedua, pengawasan eksternal yang dilakukan oleh Komisi Yudisial. Meskipun Komisi Yudisial, dimasukkan dalam anggota Majelis Kehormatan Hakim Konstitusi (MKHK), tetapi pengawasan MKHK hanya sebatas dalam persidangan saja, mekanisme pengawasan Komisi Yudisial dalam MKHK tidak mencegah terjadinya penyimpangan, karena majelis ini baru dibentuk jika ada dugaan pelanggaran etika oleh hakim. Secara praktis, Komisi Yudisial tidak melakukan pengawasan secara leluasa, karena keleluasaan pengawasan hanya diberikan kepada Dewan Etik dan Komisi Yudisial tidak ikut andil dalam Dewan Etik. Dalam perspektif fiqh siyasah, mekanisme pengawasan Komisi Yudisial terhadap hakim Mahkamah Konstitusi yang kurang leluasa, kurang selaras dengan fiqh siyasah, karena dalam lembaga peradilan Islam, Qâdhi al-Qudhâh diberikan keleluasaan wewenang dalam mengawasi hal ihwal para qadhi oleh khalifah. Seharusnya pengawasan eksternal Komisi Yudisial diberikan keleluasaan wewenang dalam mengawasi hakim MK, supaya tercipta pengawasan yang efektif.

Abstract

The tribute of the flag is routinely debated on social media, with a flag ceremony held on 17 August each year. Such issues appear to be annual discussions, although there are logical reasons for the party to unanimously express respect for the flag. This article was presented to add academic literature to honoring the flag by answering how unquestioned human diversity is in Islamic literature, how the urgency of the flag in Islamic literature, and how urgency honors the flag in the legal state. The method used to answer these questions is a descriptive qualitative research method with a literary study approach. The sources used are secondary data obtained by authors of Verses, Hadith, Classical Islamic literature, legislation, journals, processes, and relevant online news. The result of the discussion was to become sunnatullah of the existence of humans who are of different ethnicities and nations. The flag that represents a nation or a nation exists and is recorded in the history of Islamic literature. The salute of the flag as an expression of gratitude, a love of the fatherland, commemorating the hero's ceremonial service, which proved there is no Shirk word in the anthem, the blessing of ceremony-bearers and the words of prayer recited at the end of the ceremony are acceptable, recommended even (should) on postulate ṣaḥīḥ even above ṣarīḥ. The attitude of the flag in the legislation is in Article 20 PP. No. 40 of 1958 and Article 15 of Law No. 24 of 2009, respect means to uphold the state's identity while also being a form of love and acknowledging the sovereignty and honor towards the state.

Abstract

The existence of Delegated Regulations in the Job Creation Law is crucial for the proper implementation of the law. However, the excessive number of delegated regulations, created in a short time without in-depth study, has led to various problems in their implementation. This article captures the dynamics of delegated regulations under the Job Creation Law, assesses their quality, and formulates an ideal oversight model for their formation. This research is a normative legal study that analyzes in detail the concept of delegated regulations and the supervision of Government Regulations and Presidential Regulations as delegated regulations under the Job Creation Law, through three approaches: the statutory regulatory approach, the conceptual approach, and the comparative approach. Legal materials are reviewed and analyzed in depth. Historically, the dynamics of delegated regulations in the Job Creation Law are divided into three periods: after the enactment of Law 11/2020, after the Constitutional Court Decision Number 91/PUU-XVIII/2020, and after the enactment of Law 6/2023 on Job Creation. The dynamics of public rejection of the Job Creation Law's formation have not prevented the government from continuing to issue delegated regulations under it. This has led to numerous weaknesses in the delegation regulations, including their hasty creation (approximately 3 months), excessive government authority, and oversight issues. Therefore, oversight by both the executive and legislative branches, similar to the concepts in Australia and the United Kingdom, is necessary to improve the quality of the delegation regulations.
