Abstract

Abstract: This article discusses about the legal reasoning used by the judges to sanction a criminal law hacking in the website of President of the Republic of Indonesia in State Court of Jember No. 253/Pid.B/2013/PN.JR. The results of the study explained that in Islamic criminal law, there is an element of the crime of access to computer hacking and/or electronic systems belonging to others without permission. This is regulated in article 30 paragraph (1) of act 11 year 2008 on information and electronic transactions which can be analogized as like entering someone else’s home without permission, the act is prohibited by Islam because there are some similarities in its legal argumentation. It is because there is no provision in the text about this criminal act. The criminal act of accessing a computer/electronic systems owned by others without permission in the Islamic Criminal Law (Fiqh Jinayah) can be categorized as jarimah tazir submitted to ulil amri, in this case is the government.Keywords: Legal sanctions, crime, hacking website.

Abstract

This study discusses the tradition of banning sasuku marriages in the Minang community. These rules resulted in many legal rules that run on the Minang community, customary law, Islamic law, and state law. The number of legal rules makes the marriage law of the Minang community seem gray, on the one hand, they must comply with Islamic law and state law which does not regulate the prohibition of ethnic marriage. Meanwhile, on the other hand, there are customs that make rules regarding the prohibition of sasuku marriages. This research uses a qualitative paradigm, with the type of research being a conceptual approach. The data used are secondary data from several journals, which are then combined with the legal facts of the Minang community regarding the prohibition of ethnic marriage. This conclusion shows that the occurrence of legal pluralism in Minang society is a social necessity. The prohibition of tribal marriages in addition to having an impact on the social order also threatens the existence of Islamic law in the aspect of marriage in terms of determining a mate, including abolishing Indonesian marriage law regarding marriages carried out on voluntary terms from both parties.

Abstract

The granting of rights in civil relations for children born out of wedlock with their biological fathers can be regarded as an effort to protect children's rights as human beings or citizens. Legislation should exist to protect children's human rights as legitimate children. Article 2 Paragraph (2) and Article 43 Paragraph (1) of Law no. 1 of 1974 concerning Marriage is considered to cause legal uncertainty, which results in loss of marital status and the legal status of children born outside of marriage according to the law. On the other hand, the shari'ah rules relating to the validity of Marriage and civil relations, including lineage, guardianship, inheritance, are expressly regulated by the shari'ah, carried out and internalized in their implementation. This study aims to analyze how the rights of children outside of Marriage in the decision of the Constitutional Court Number 46/PUU-VIII/2010 from the perspective of Progressive Law and how the lineage rights of children outside of Marriage according to maqāsid-al-sharī'ah. This study uses a qualitative method with a juridical-normative approach. The object of this research study is Constitutional Court Decision No. 46/PUU-VIII/2010. The Constitutional Court's decision caused the child's civil rights to be strengthened in the eyes of the law to reflect the application of progressive legal principles. Based on the maqāṣid-al-sharī'ah perspective, the Constitutional Court's decision that defends the rights of children outside of Marriage can be categorized as protecting the soul, which includes maṣlaḥah ḍarūriyah.

Abstract

Islam with its legal instruments has standard standards. The principles and characteristics of Islamic law are these standards. Patented sharia law provides guidance and special footing as a form of differentiation with legal products in general. The formula of Islamic law has a standard that is both vertical and horizontal. This paper will discuss more fully about the principles and characteristics of Islamic law. The idea in this paper uses a literature review, based on several related literatures, and then constructed in a structured and orderly manner. The principles and character of Islamic law will always remain and will never change. However, in reality, it will give rise to many interpretations and heremeneutics, especially when it collides with social conditions that continue to develop. The strength of the characteristic principles of Islamic law makes Islamic legal products (fiqh) always contextual and dynamic.

Abstract

Ketika Islam mulai memasuki masa kemunduran, pada masa berakhirnya periode klasik Islam. Eropa bangkit dari keterbelakangannya. Kebangkitan itu bukan saja terlihat dalam bidang politik dengan keberhasilan Eropa mengalahkan kerajaan-kerajaan Islam dan bagian dunia lainnya, tetapi terutama dalam bidang ilmu pengetahuan dan teknologi. Bahkan, kemajuan dalam bidang ilmu dan teknologi itulah yang mendukung keberhasilan politiknya. Kemajuan-kemajuan Eropa ini tidak dapat dipisahkan dari pemerintahan Islam di Spanyol. Dari Islam Spanyol di Eropa banyak menimba Ilmu. Pada periode klasik, ketika Islam mencapai masa keemasannya, Spanyol merupakan pusat peradaban Islam yang sangat penting, menyaingi Baghdad di Timur. Ketika itu, orang-orang Eropa Kristen banyak belajar di perguruan-perguruan tinggi Islam di sana. Islam menjadi guru bagi orang-orang Eropa. Karena itu, kehadiran Islam di Spanyol banyak menarik perhatian peneliti untuk mengetahui lebih jauh tentang peradaban Islam di Spanyol.

Abstract

Abstract The historical nature of the Qur'an led to the emergence of hermeneutical ideas and theories (methods of interpretation). This theory is a very urgent effort to be developed in understanding the meaning of the Qur'an as a whole. The hope is that the theological and legal ethical parts can be placed in a unified whole (total). Through this method, a weltanschauung (worldview) of the Qur'an can be formulated and understood. If humans want to think optimally and want to use their rational mind, they will realize that in fact the greatest blessing of the Qur'an is the thought and understanding of the intentions and meanings contained therein to then realize their ideas in actions that are both religious and spiritual. . In this case, then Sahiron Syamsuddin, mapped the flow of contemporary Qur'anic study methods into three groups: a) The traditionalist quasi-objectivist view; b) The modernist quasi-objectivist view; c) Subjectivist views. The study of the science of the Qur'an in the West was first carried out by the Orientalism group, which at the beginning of its emergence was closely related to the psycho-historical relationship between Islam and the West in the intellectual, trade and war fields. Therefore, the study of the science of the Qur'an in the study of orientalism is not only oriented to the emotional-intellectual relationship, but also the emotional-political east, namely in order to facilitate the political expansion of the West towards the East. But along with the times, orientalism in the end moved purely on an objective-independent study of the east. The flow of orientalism, at least, goes through three periods, namely the period before the crusades, the crusades to the European enlightenment period, and the last period from the enlightenment to modern times. This is marked by the presence of orientalists in the East (Islam) who also functioned as colonial advisors, in addition to conducting scientific studies. Keywords: Al-Qur’an, Hermeneutics, Contemporary. Abstrak Sifat Al-Qur’an yang bersifat historis menyebabkan munculnya gagasan dan teori hermeneutika (metode penafsiran). Teori ini menjadi kerja-usaha yang sangat mendesak untuk dikembangkan dalam memahami makna Al-Qur’an secara utuh. Harapannya, bagian-bagian teologis dan etika legalnya dapat ditempatkan dalam keseluruhan (totalitas) yang padu. Melalui metode ini, sebuah weltanschauung (pandangan dunia) Al-Qur’an dapat dirumuskan dan dipahami. Bila manusia mau berpikir secara optimal dan mau memanfaatkan akal rasionalnya, ia akan menyadari bahwa sesungguhnya berkah Al-Qur’an yang teramat besar adalah pemikiran dan pemahaman maksud-maksud serta makna yang terkandung di dalamnya untuk kemudian mewujudkan gagasannya dalam perbuatan yang bersifat keagamaan dan keduaniaan. Dalam hal ini, kemudian Sahiron Syamsuddin, memetakan aliran metode studi qur’an kontemporer menjadi tiga kelompok: a) Pandangan quasi- obyektivis tradisionalis; b) Pandangan quasi-obeyektivis modernis; c) Pandangan aliran subyektivis. Studi ilmu al-Qur’an di Barat pertama kali dilakukan oleh kelompok Orientalisme yang pada awal kemunculannya berkaitan erat dengan psiko- historis hubungan Islam dan Barat di bidang intelektual, perdagangan dan peperangan. Oleh karena itu, studi ilmu al-Qur’an dalam kajian orientalisme tidak hanya berorientasi pada hubungan emosi-intelektual, melainkan juga emosi-politis ketimuran, yaitu dalam rangka memperlancar ekspansi politik Barat terhadap Timur. Tetapi seiring perkembangan zaman, orientalisme pada akhirnya bergerak murni pada kajian ketimuran secara obyektif- independen. Alur perjalanan orientalisme itu, setidaknya, melalui tiga periode, yaitu periode sebelum perang salib, perang salib hingga masa pencerahan Eropa, dan periode terakhir adalah mulai pencerahan hingga zaman modern. Hal ini ditandai dengan kehadiran para orientalis di Timur (Islam) yang juga berfungsi sebagai penasehat kolonial, disamping melakukan kajian-kajian ilmiah. Kata Kunci : Al-Qur’an, Hermeneutika, Kontemporer.

Abstract

The Origins of Muhammadan Jurisprudence is the work of Joseph Schacht which is the foundation of Islamic scholarship in the West. This is the main book about the field of study which later was known as "orientalism of Islamic law". Not only was it phenomenal, this book was also controversial. Schacht's work received rave reviews from leading orientalis, H.A.R. Gibb, for example, considers that the book will be the foundation for all future studies of society and Islamic law, at least in the West. As the title suggests, the Origins did discuss the intricate issues surrounding the early history of the formation and origins of Islamic law, the day of its birth and its originality. Joseph Schacht argued that the emergence of classical fiqh schools, then the consequence of the emergence of hadith experts and according to him, hadith experts had falsified the hadith to defeat the rules made by fiqh expert groups, Theory of Projecting Back and Common Link, the theory of the results of Schacht as a theory of reconstruction of the occurrence of sanad hadith. To get a justification for Schacht's opinion on the backward projection of the Hadith and connect it with important figures from the previous period, then connected back to friends and finally to the prophet. So that it can be said that the Qur'an and Hadith do not contribute to the formation of Islamic law. Musthafa Azami broke the Scacht theory about projecting back with the explanation, that fiqh had developed since the time of the Prophet. Fiqh is ijtihady. Therefore, it is difficult to accept the opinion of Schacht that fiqh only developed during the appointment of Qadhi during the Umayyad Dynasty.Keywords: Orientalism, Sanad, Hadits

Abstract

Dalam kehidupan bermasyarakat dan beragama, sudah seharusnya kita mengenal tentang perkawinan atau ikatan pernikahan antara satu dengan yang lainnya, karena menurut ajaran Islam hal ini dianjurkan untuk mendapatkan ketentraman dan juga keturunanbagi yang melakukannya. Pernikahan yang dilakukan menurut fiqih munakahatt selain memenuhi rukun nikah, juga harusdicatat oleh PegawaiPencatat Nikah di Kantor Urusan Agama, karenadalamhukum Indonesia terdapat pada pasal 2 Undang-Undang No 1 Tahun 1974 ayat 2 dinyatakanbahwa“tiap-tiap perkawinan dicatat menurut peraturan perundang-undangan yang berlaku”. Namun sejalan dengan perkembangan zaman juga dinamika yang terjadi dalam masyarakat kita, maka banyak sekali terdapat perubahan, dan di masa sekarang masyarakat modern menginginkan akra surat untuk dapat dijadikan bukti otentik, karena tidak cukup hanya saksi hidup saja.Atas dasar ini sangatlah diperlukan sebuah bukti kuat dan mengikat yang disebut dengan akta. Dengan demikian akta adalah salah satu ketentuan pernikahan yang harus dipenuhi.

Abstract

This article discusses the Effectiveness of E-Court Case Resolution during the Covid-19 Period at the Probolinggo Religious Court. The sub-topic of discussion or the formulation of the problem here is how to implement the settlement of cases with the e-court system during the Covid-19 pandemic at the Probolinggo City Religious Court, the effectiveness of the E-Court system during the Covid-19 pandemic and what are the Obstacles and Challenges for E-System Services Court for the people of Probolinggo City at the Religious Court of Probolinggo City. This research was carried out at the Religious Court of Probolinggo City using a normative juridical research type by researching and examining theories, concepts, legal principles and related laws and regulations. Data acquisition is taken from primary and secondary data. The data acquisition method is by interviewing and taking data related to research. However, there are still many Probolinggo City residents who are in litigation who do not know about the existence of an E-court system due to the lack of socialization from the courts and because of several factors such as people who are technologically illiterate. It is better for the government that the e-court system can be socialized more clearly to the people who are in litigation and wish to register their case status through the e-court.
