Abstract

The industrial revolution 4.0 has influenced businesses in the field of trade in goods and services. In the trade of services, a new type of online rental service / taxi has emerged. Special leased transportation is a door-to-door transportation service with drivers who have operational areas in urban areas, from airports to airports, ports or other transportation nodes and reservations using information technology-based applications, with the tariff rates listed in the application. The implementation of this special rental transportation is based on the Regulation of the Minister of Transportation Number 118 of 2018 concerning the Implementation of Special Rental Transportation. To provide legal certainty on aspects of safety, security, comfort, equality, afford ability, and regularity for the community over the implementation of special rental transportation, and to support development to realize public welfare as mandated by the 1945 Constitution of the Republic of Indonesia.

Abstract

In the market there are many outstanding goods and / or services produced by UMKM. UMKM is indeed a growing business sector in the community that proved able to compete with other business actors. Through the economic policy package of President Joko Widodo, the government encourages the empowerment of UMKM. Although the government encourages the progress and development of UMKM but the circulation of UMKM products should be supervised. This is because there are still many products of UMKM, especially food circulating in the market that has not met the quality standards and labeling, especially labels expired so that this can endanger consumers. Therefore it is necessary to supervise the products of UMKM as an effort to protect the consumer. Supervision includes quality standards, labeling, standard clauses, and advertising. Such supervision is important to protect consumers from loss of goods that do not meet the standards specified in the legislation.

Abstract

The phenomenon of the presence of online transportation both two wheels and four wheels today is growing very rapidly. Many people use this type of transportation with information technology (online) based applications as an option for public transportation currently in Indonesia. Transportation with information technologybased applications is actually the same as other types of public transportation (taxis) but the difference is how to order this transportation that is integrated with the internet so that it makes it easier for people to order. The community feels that they are benefitted by the presence of online transportation because of the easy way of ordering and competitive prices with convenient service. The existence of online transportation is felt to be beneficial for passengers and the public who own capital (cars). For the public, as passengers, it is facilitated by accessing the transportation at relatively cheap prices and good service, meanwhile for the community as owners of capital (cars), they have the opportunity to do business which results in additional income so as to improve welfare for the family. The presence of online transportation, although felt by many people, has many benefits, but as a business activity / business of public transportation services, the existence of online transportation needs to be regulated in a statutory regulation. The regulation is needed to provide legal certainty and protection for drivers, passengers and business people, so that it will create a sense of security, comfort and safety in accordance with the objectives of transportation in accordance with the mandate of legislation.

Abstract

The abundance of knowledge possessed by the company can be utilized optimally to improve company performance to create the best products, services, business processes, and customer services. Less than optimal utilization of knowledge can hamper the company’s performance and not solve various problems. The problems faced by many companies in the past and now, between branch/representative offices and between divisions/other work units, are often the same. Personnel turnover is another reason why the company cannot utilize one’s knowledge. The purpose of this study is focused on determining the impact of Knowledge Management and Talent Management on Employee Retention in the case of the Millennials Workforce. Previous research found that Human Resources Development Manager dealing with the Generation of Millenials where are the generation that can adapt to the environment and is dominated by the use of Information Technology in carrying out the work. The population in this research is Employees of PT Jasarahraja Son. The questionnaire was used to collect data on as many as 60 respondents through simple random sampling. The data used in this research is a quantitative analysis using Structural Equation Modeling (SEM) Partial Least Square method (PLS) with the program Warp PLS 5.0. The Test results showed that the coefficient of determination which looks at the value Adjusted R-Square is 0.69, which means that employee retention can be explained by the variable of Knowledge Management and Talent Management by 69%. The remaining 31% is explained by other variables that are not observed in the study.

Abstract

This paper aims to find out how the legal aspects of companies operating special rental transportation are regulated based on the Regulation of the Minister of Transportation (Permenhub.) of the Republic of Indonesia Number 118 of 2018 which is amended by Permenhub. Number 17 of 2019. Transportation is the movement of people or goods from one place to another by using a vehicle in the road traffic room. The information technology system-based transportation adapum is a mode of transportation in the form of legal entities and micro-enterprises or small-scale business actors connecting from one place of origin to one's destination, where the ordering method uses an information technology system and the amount of the fare is listed in the application. Companies in the form of legal entities in the form of Limited Liability Companies, BUMN, BUMD, and Cooperatives as well as micro business actors or small business actors established in accordance with the provisions of laws and regulations. The form of this special rental transportation company is not in accordance with Law Number 22 of 2009 and Article 79 of Government Regulation Number 74 of 2014 concerning the Implementation of Public Transportation.

Abstract

This study aims to examine and analyze the form of cooperative relationships between companies and cooperatives that use the principle of partnership in agribusiness and how the legal protection of the state against cooperatives in cooperation with companies in the field of agribusiness. This study uses normative juridical research methods. Normative juridical research is research that utilizes secondary data and primary data as the main data. This study uses an empirical juridical approach and a statutory approach, which in the discussion of this study will use descriptive analysis to describe the findings in the field. The results of the study indicate that at this time, cooperation between companies and cooperatives that use the principle of partnership in the field of agribusiness can be carried out in aspects such as capital, technology, marketing, production facilities, production processes, product processing, and so on, while the form of state legal protection that the state must implement against cooperatives in cooperation with companies in the agribusiness sector is in the form of preventive legal protection from the government, namely in terms of price determination, such as determining interest on capital loans to determining market prices.

Abstract

This study aims to find out and analyze how the settlement of disputes over the election results of village heads in Indonesia, after the birth of Law No. 6 of 2014 on Villages, as well as how the legal problems that arise from the existence of these regulations. This research is a normative juridical study with the main data used in the form of secondary data, while the approach taken is to use an approach to the laws and regulations (Statute approaches). The results showed that the disputes over the results of village head elections in Indonesia at this time, experienced a development and legal problems in its enforcement. The problem referred to is that when Law No. 6 of 2014 gave the Regent / Mayor authority in resolving disputes over the results of village head elections, with this fact, several legal problems arose, especially when the Regent / Mayor was a state institution whose main task was not to enforce the law, and the handling of the settlement will be difficult to be objective because there will be mixed political responsibilities in the settlement process

Abstract

Salah satu proses penting untuk menentukan suatu putusan perkara perdata adalah pertimbangan hukum Hakim melalui tahapan musyawarah para Hakim. Dalam musyawarah tersebut para Hakim seringkali mempunyai perbedaan pendapat atau dissenting opinion dalam memberikan pertimbangan hukumnya. Penelitian ini bertujuan untuk mengetahui dissenting opinion Hakim dan apa penyebab dissenting opinion Hakim serta akibat hukum bagi para pihak dalam pembatalan Akta Perjanjian Pengikatan Jual Beli (studi kasus Putusan Nomor 24/Pdt.G/2021/PN Bjn). Metode yang digunakan dalam penelitian ini adalah yuridis normatif yang bersumber dari data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier, kemudian dianalisis dengan menggunakan metode deskriptif analitis. Hasil penelitian menunjukkan bahwa dissenting opinion Hakim Anggota II terletak pada pertimbangan hukum atas pokok perkara, sedangkan penyebab dissenting opinion Hakim yaitu Hakim mayoritas hanya memberikan pertimbangan hukumnya dari syarat formil gugatan saja sementara Hakim Anggota II selain syarat formil ia juga mempertimbangkan perkara melalui rasa keadilan dan kepatutan. Kata Kunci : dissenting opinion, perjanjian pengikatan jual beli

Abstract

The House of Representatives is a state institution that functions in the field of legislation. The current fact is that the DPR's performance in the field of legislation always gets records, because the resulting Law is still below Prolegnas target. On the basis of the problems as referred to, the writing of this article aims to find out what the problems and the efforts that need to be made in overcoming the problem of the formation of laws which fall under the authority of the DPR are. In the discussion, the author tries to provide criticism aimed at the process of forming a law in the DPR, seen from three indicators, namely from the legal substance factor, the legal structure factor and the legal culture factor, the legal substance relating to the current Law does not regulate the maximum number of Prolegnas, the legal structure related to law-forming institutions originating from political parties, and the legal culture related to community rejection of the bill being discussed. The solution to these 3 (three) problems needs to be changed, such as strengthening regulations regarding restrictions on performance-based Prolegnas submissions, making Integrity Facts for DPR members and regulations governing public involvement in making laws stronger, this needs to be done in order to keep it up. maintain the level of public trust in the DPR in carrying out its legislative functions.

Abstract

Penelitian ini bertujuan untuk mengetahui dan menganalisis tentang bagaimana permasalahan dalam pelaksanaan penegakan terhadap konten ilegal saat ini, serta bagaimana tantangan dan upaya yang perlu dilakukan untuk mengatasi permasalahan tersebut, penelitian ini merupakan jenis penelitian yuridis normatif dengan pendekatan perundang-undangan, data yang digunaka merupakan data primer dan data sekunder yang dilengkapi oleh data tersier, data yang diperoleh di analisis dengan menggunakan metode kualitatif. hasil penelitian menunjukan bahwa Penegakan hukum terhadap konten di Indonesia masih belum dilaksanakan secara efektif dan efisien yang dapat dibuktikan dengan masih maraknya konten-konten negatif di berbagai media online. Penegakan hukum terhadap konten ilegal yang bermuatan materi negatif saat ini diatur didalam 2 (dua) peraturan perundang-undangan yang berbeda, dua peraturan tersebut meliputi Undang-Undang ITE dan Peraturan Menteri Komunikasi Dan Informatika Republik Indonesia Nomor 5 Tahun 2020 Tentang Penyelenggara Sistem Elektronik Lingkup Privat. Hambatan yang ada dalam penegakan hukum terhadap konten ilegal disebabkan beberapa faktor seperti Konsistensi Penegakan Hukum Yang Bersifat Represif, Tidak Ada Standar Khusus Kriteria Konten Ilegal, Faktor Sarana Dan Prasarana Serta Manajemen Pengendalian, Faktor Mudahnya Pembuatan Media Sosial dan juga lokasi. Sehingga perlu dilakukan beberapa upaya penyelesaian tentang maraknya konten ilegal yang meliputi Adanya pelibatan pemerintah daerah dalam menegakan hukum terhadap konten ilegal secara prefentif. Adanya persyaratan khusus pembuatan media sosial seperti No id KTP agar pemerintah dapat mengontrol dan melacak apabila pengguna medsos menyebarkan konten-konten negatif. This study aims to find out and analyze about how the problems in the implementation of enforcement of illegal content are currently, as well as how the challenges and efforts that need to be made to overcome these problems, this research is a type of normative juridical research with a statutory approach, the data used are primary data and secondary data equipped with tertiary data, the data obtained in the analysis using the method Qualitative. The results showed that law enforcement on content in Indonesia has not been implemented effectively and efficiently which can be proven by the rampant negative content in various online media. Law enforcement against illegal content containing negative material is currently regulated in 2 (two) different laws and regulations, the two regulations include the ITE Law and the Regulation of the Minister of Communication and Informatics of the Republic of Indonesia Number 5 of 2020 concerning Private Scope Electronic System Operators. Obstacles that exist in law enforcement against illegal content are caused by several factors such as Consistency of Repressive Law Enforcement, No Special Standards for Illegal Content Criteria, Factors of Facilities and Infrastructure and Control Management, Factors of Easy Social Media Creation and also location. So it is necessary to make several efforts to resolve the rampant illegal content, which includes the involvement of local governments in enforcing the law against illegal content preemptively. There are special requirements for creating social media such as ID card so that the government can control and track if social media users spread negative content.
