Abstract

Democracy and Reform in Indonesia have had a significant impact on the people's participation and control over the nation's direction and development, one of which is the participation and control of the people in the formation and enforcement of the law. This study will attempt to provide an overview of the extent of public monitoring/control in law enforcement in Indonesia. The study is a normative juridical research, using secondary data as the main source, which is then analyzed qualitatively. The results show that public monitoring/control through social media in law enforcement in Indonesia has a great influence in determining the demands, defenses, and verdicts of individuals in legal cases. For example, in the case of Ferdy Sambo, the Indonesian people expressed their hopes on social media that Ferdy Sambo should be sentenced to death, although the prosecutor's office sentenced him to life imprisonment. However, the judge later gave Ferdy Sambo the death penalty in accordance with the aspirations of the Indonesian people. Nonetheless, comments and expressions of aspirations by the public through social media need to be regulated so as not to violate the rights of individuals who are involved in legal cases, including the right to be presumed innocent. Therefore, the government needs to develop and consider online petitions as a means for people to express their aspirations in an orderly and accountable manner.

Abstract

This is a conceptual article discussing the phenomenon of staycations, or vacations taken in the same location as one's workplace, between bosses and female employees that has gone viral on social media. This practice can potentially lead to sexual harassment of female employees and reaffirms the domination of men over women in the workplace. Furthermore, many staycation victims are reluctant to report incidents due to a lack of trust in the state's protection system for its citizens. In this article, the author will discuss factors that contribute to victims' reluctance to report such harassment, such as gender inequality and power imbalances in work relationships. As a solution, an active role is needed from the government and companies to ensure the safety and protection of employee rights, especially for women. In addition, there is a need for increased awareness and education about workers' rights and self-protection against sexual harassment in the workplace.

Abstract

This research examines the national and international legal frameworks governing community involvement in environmental damage prevention and the challenges and various forms of community participation in environmental damage prevention efforts globally. This study uses a qualitative method to conduct normative legal research, which involves a literature review of various international legal instruments and field cases related to community participation in the prevention of environmental damage and uses Seherly Arnenstein's theory of community participation to examine community participation in environmental conservation. The results show that community participation in preventing environmental damage has a legal position at the national and international levels. At the international level, several agreements, such as the United Nations Framework Convention on Climate Change (UNFCCC), the Convention on Biological Diversity (CBD), and the Basel Convention, have established a legal framework for preventing environmental damage, including community participation. Meanwhile, at the national level, Law No. 32/2009 on Environmental Protection and Management (UU PPLH) has regulated the rights and obligations of the community in protecting the environment. Furthermore, this study found that community participation in preventing environmental damage can be done through various means, such as decision-making processes, access to environmental information, and participation in implementing environmental policies. However, there are still challenges and obstacles in its implementation, such as limited access to information, lack of public awareness, and lack of government and private sector support. Based on this, more significant efforts are needed to strengthen community participation in preventing environmental damage, including increasing access to environmental education and information and establishing more active and effective forums for community participation. The active involvement of the government, civil society organizations, and private institutions is needed to ensure that community participation in preventing environmental damage can be achieved.

Abstract

Legal protection for traditional retail businesses in the perspective of Pancasila state law must include efforts to create a sustainable and inclusive economic environment. By the principles of Pancasila, legal protection for traditional retail businesses can play an important role in maintaining the continuity of traditional businesses and preserving local cultural values. The Pancasila legal state is not only a legal framework but also reflects the soul and values of the Indonesian nation. The research method used in this research is descriptive-qualitative with a library approach. The law governing the layout of modern retail stores to protect traditional stores by adhering to Pancasila values has a significant impact on business and socio-economic conditions in Indonesia. Presidential Regulation Number 112 of 2007 is the main basis for setting the role of modern shops and traditional shops. Apart from implementation challenges, this regulation protects small and traditional businesses by providing equal opportunities for training and protection as well as maintaining a balance of competition. Reconstruction of modern shop organizations in residential areas with due observance of Pancasila values encourages cooperation and harmonization of modernity and local culture. By bringing together cooperation, solidarity, and diversity, this framework creates a fair, inclusive, and sustainable business environment.Keywords: Traditional retail; modern retail; law; reconstruction; PancasilaAbstrakPerlindungan hukum terhadap usaha ritel tradisional dalam perspektif hukum negara Pancasila harus mencakup upaya untuk menciptakan lingkungan ekonomi yang berkelanjutan dan inklusif. Sesuai dengan asas Pancasila, perlindungan hukum terhadap usaha ritel tradisional dapat berperan penting dalam menjaga keberlangsungan usaha tradisional dan melestarikan nilai-nilai budaya lokal. Negara hukum Pancasila bukan hanya kerangka hukum, tetapi juga mencerminkan jiwa dan nilai-nilai bangsa Indonesia. Metode penelitian yang digunakan dalam penelitian ini adalah deskriptif-kualitatif dengan pendekatan kepustakaan. Undang-undang yang mengatur tata letak toko ritel modern untuk melindungi toko tradisional dengan berpegang teguh pada nilai-nilai Pancasila berdampak signifikan terhadap kondisi bisnis dan sosial ekonomi di Indonesia. Peraturan Presiden Nomor 112 Tahun 2007 menjadi dasar utama pengaturan peran toko modern dan toko tradisional. Terlepas dari tantangan implementasi, peraturan ini melindungi usaha kecil dan tradisional dengan memberikan kesempatan yang sama untuk pelatihan dan perlindungan serta menjaga keseimbangan persaingan.Rekonstruksi organisasi toko modern di kawasan pemukiman dengan memperhatikan nilai-nilai Pancasila mendorong kerjasama dan harmonisasi modernitas dan budaya lokal. Dengan menyatukan gotong royong, solidaritas dan keragaman, kerangka kerja ini menciptakan lingkungan bisnis yang adil, inklusif dan berkelanjutan.

Abstract

Keselamatan berlalu lintas merupakan kebutuhan dasar manusia yang berkaitan dengan hak untuk hidup dan merasa aman. Namun, tingginya angka kecelakaan lalu lintas di Indonesia menunjukkan masih rendahnya budaya hukum pengemudi. Penelitian ini bertujuan untuk menganalisis potret budaya hukum pengemudi kendaraan bermotor di Indonesia dan faktor-faktor yang mempengaruhinya terhadap keselamatan lalu lintas. Metode penelitian yang digunakan adalah dengan pendekatan yuridis sosiologis dan memanfaatkan Teori Sistem Hukum Lawrence M. Friedman. Hasil penelitian menunjukkan bahwa budaya hukum pengemudi di Indonesia masih rendah, ditandai dengan kurangnya pengetahuan dan pemahaman hukum lalu lintas, sikap yang mengabaikan keselamatan, serta perilaku yang cenderung melanggar aturan. Faktor-faktor yang mempengaruhi budaya hukum pengemudi meliputi faktor internal (usia, jenis kelamin, tingkat pendidikan, pemahaman agama, dan pengalaman berkendara) dan faktor eksternal (lingkungan sosial, penegakan hukum, kondisi infrastruktur jalan, dan akses terhadap informasi serta edukasi lalu lintas). Upaya perbaikan budaya hukum pengemudi perlu dilakukan secara komprehensif dan berkelanjutan melalui peningkatan efektivitas penegakan hukum, optimalisasi program edukasi dan sosialisasi, penguatan peran serta masyarakat, pemanfaatan teknologi, serta kerjasama antar stakeholder.

Abstract

Artificial Intelligence (AI) has become an integral part of everyday life, and this technology has now transformed the way we work and has controlled various industries and sectors of human life. The potential benefits of AI today are enormous, including increased efficiency, productivity, and innovation. However, the use of AI also raises concerns about ethical, legal, social, and privacy issues for society. This paper aims to measure the benefits of AI in human life, the urgency of regulating the use of AI technology, and the concept of regulating the use of AI in Indonesia. This paper reviews various literature and studies related to AI and its impact on society. The results show that AI has the potential to bring significant benefits to human life, but its unregulated use can also pose significant risks. Therefore, it is important to establish regulations that address AI concerns from ethical, legal, and social perspectives. This paper also proposes a concept of regulating AI in Indonesia that includes general requirements, development to use and sanctions, and AI use must also uphold ethical and legal principles, such as transparency, accountability, and human rights protection. This paper emphasizes the importance of balancing the benefits and risks of AI to ensure safe and responsible use in society.

Abstract

Indonesia is an archipelago with a larger water area than land, which produces abundant marine wealth which is a strategic potential for national economic development. Geo-politically, Indonesia has a very strategic role because it is located between the Asian continent and the Australian continent, as well as the Pacific and Indian oceans, placing Indonesia as the world's maritime axis in the context of global trade connecting the Asia-Pacific region with Australia. Indonesia is often faced with various security issues and violations of the law in Indonesia's marine territory, including illegal fishing, which causes significant losses. Illegal fishing is a form of illegal action that can have an impact on the country's economy. Therefore, illegal fishing can be qualified as an economic crime. Illegal fishing can be classified as property crimes because its existence clearly threatens the safety of the State's property or wealth. Thus, the qualification as an economic crime is more on the basis of consideration of the consequences/loss caused to the state economy.
