Abstract

Land Deed Making Officials (PPAT) are often Public Officials who intentionally or unintentionally act negligently in making the deed of sale and purchase. One of them is not involving all the heirs as parties. It can cause losses to interested parties on the object of the sale and purchase deed. For this reason, it is necessary to do research on the power of law, by analyzing the Decision of the Ngawi District Court 14/ /Pdt.G./2019/PN Ngw, which there are two problems to be raised, namely the legal power of the sale and purchase deed which does not include all heirs as parties and the responsibility of PPAT to make a deed of sale and purchase without the permission of all heirs as parties. To answer these problems, research is carried out using normative legal research methods. The results of the study showed that the Deed of Sale and Purchase which did not include all heirs was null and void. Therefore, it is recommended that a PPAT must comprehensively ensure that all heirs participate in the making of the Deed of Sale and Purchase.

Abstract

Abstract

Abstract

In meeting electricity needs, there is currently a shift in the use of fossil energy to water energy because fossil energy is no longer available. The use of water as a new renewable energy, as stated in the Electricity Supply Business Plan (RUPTL), which prioritizes Hydroelectric Power Plants (PLTA), is considered to require lower investment and stable electricity production compared to Solar Power Plants (PLTS) or Wind Power Plants (PLTB). Providing this water requires conservation costs and other water management costs. So the main topic studied in this research is the problems and impacts of the imposition of water fees including Natural Resource Management Services Fees (BJPSDA) and Surface Water Tax (PAP) on water resource conservation. The research used is explanatory doctrinal research using document studies. The results of the research are that apart from the BJPSDA, there is a PAP which has not been subject to earmarking. Both are regulated in different regulations but are imposed on the same object, namely water. Based on the analysis, it is necessary to evaluate how the implementation of the fee has been able to fulfill the community's rights to water and can maintain the sustainability of water availability through water resource conservation. Therefore, it is necessary to reconsider the imposition of double levies on surface water beneficiaries by changing the BJPSDA manager to a party who has a greater interest in water conservation results and applying the PAP earmarking concept.

Abstract

Franchise agreements play a pivotal role in the advancement of the franchise business in Indonesia. However, these agreements often lead to differing interpretations and have weak evidentiary power because only created as private deeds. In the relevant regulations, there is no provision that requires it to be made in the form of an authentic deed. In fact, an authentic deed offers the necessary evidentiary strength to protect the rights of all parties involved. Notaries are legally empowered to draft authentic deeds and provide legal advice and its possible implications. This research is doctrinal with a prescriptive approach, aiming to examine the use of authentic deeds in franchise agreements to ensure legal protection. The goal is to reduce disputes and legal exploitation that can occur with private deeds. Through the analysis of secondary data and interviews, it is a fact that disputes often occur due to differences in the interpretation of the content of the agreement. Therefore, franchise agreements should be executed as authentic deeds rather than just private deeds. This practice is significant because franchise agreements include fundamental elements like the rights and obligations of the parties, as well as intellectual property rights elements, such as trademarks and trade secrets. In fact, the use of authentic deeds is not intended to seek validity but to seek the value of legal certainty.

Abstract

The medical advancements in human organ transplantation hides a dark reality: illegal organ trafficking, donor identity fraud, and exploitation of the vulnerable individuals. Without strict oversight, these practices can lead to injustice and human rights violations. Notarial deeds serve as a legal safeguard, ensuring that every transplantation procedure is in accordance with regulations, remain transparent, and free from abuse. This article examines the strategic role of notarial deeds in guaranteeing the validity of the agreement between organ donors and recipients, as stipulated in Article 24 paragraph (1) letter d of the Minister of Health Regulation No. 38/2016. This research is doctrinal approach with a normative legal study based on relevant legal sources. The case study of Decision Number 464/Pid.Sus/2023/PN.Ckr and the findings at Dr. Saiful Anwar Hospital reveal various irregularities in the practice of human organ transplantation, including the involvement of intermediaries in illegal human organs transactions. A notarial deed is not just a formal document, but a legal instrument that protects the rights of the parties, ensures compliance with regulations, and closes loopholes for exploitation and abuse in human organ transplant procedures.

Abstract

Mixed marriages in Indonesia often lead to legal complications, one of which concerns the commingling of assets that results in the erosion of the land ownership rights of Indonesian citizens (WNI). This issue arose because, prior to the issuance of Constitutional Court Decision No. 69/PUU-XIII/2015, the prevailing regulations did not allow WNI to enter into a prenuptial agreement after the marriage had taken place. Notably, not everyone understands the legal consequences of mixed marriages, which may lead to the absence of a prenuptial agreement before marriage. With the issuance of Constitutional Court Decision No. 69/PUU-XIII/2015, it is now possible to create a postnuptial agreement after the marriage has been solemnized. The purpose of this study is to analyze the issues surrounding land ownership rights arising in mixed marriages in Indonesia and to explore the solutions developed to achieve justice for all WNI without exception. The research employs a normative juridical or doctrinal approach, relying on secondary or library- based data. The findings indicate that the provisions on land ownership for WNI in. mixed marriages prior to the Constitutional Court Decision No. 69/PUU-XIII/2015 triggered significant controversy, as they were perceived as inconsistent with the principles of justice for WNI, particularly those engaged in mixed marriages without a prenuptial agreement. Following this decision, the regulations concerning marital agreements in mixed marriages were amended, allowing for the execution of postnuptial agreements. This development provides a viable solution to the issues of joint property in mixed marriages for those who had not entered into a prenuptial agreement before marriage, thereby fostering justice for all WNI.

Abstract

In carrying out their profession, notaries are required to comply with the professional code of ethics and all provisions of applicable laws and regulations regarding the position of notary. However, in practice, several cases were found that showed a violation of the notary's obligations, one of which was the non-granting of Sale and Purchase Agreement ("PPJB") Deed to the client. Based on this, the problems that need to be studied are: the application of sanctions against notaries who violate the notary code of ethics and the law on notary positions; and the authority of the notary supervisory council that examines, adjudicates, and decides the violation in question. To answer these problems, this study uses a normative juridical research method with literature review. The results of this study shows that the legal consequences of notaries who violate the provisions regarding the position of notary as stated in the law and other legal provisions is the disrespectful dismissal of the notary from his position. Regarding the authority of Notary Supervisory Council, in this case Central Supervisory Council is authorize to summon the reported Notary for an examination; impose a sanction of temporary dismissal; and propose a disrespectful dismissal sanction to Minister. Consequently, the legal consequences of this breach are expected to provide a valuable lesson for notaries in their professional conduct.
