Abstract

The purpose of this study is to measure legal protection and employment opportunities for persons with disabilities who work in various companies in the city of Semarang, Central Java. As is known, the right to work for citizens is regulated in Article 27 Paragraph 2 of the 1945 Constitution, which mandates the right of citizens to get a decent job and life. Every citizen has the same rights and the state (government) has regulated these rights in terms of obtaining employment without exception, including persons with disabilities. This study uses a juridical-empirical (non-doctrinal) approach, which examines how employment opportunities and legal protection of persons with disabilities in the city of Semarang, especially in PT. Samwon Clothing Indonesia. Primary data sources were obtained from PT. Samwon Busana Indonesia through interviews, secondary data in the form of legal material. Data Collection Method with Interview and Documentation methods, Data Analysis is done by a descriptive method. The results showed that employment opportunities for workers with disabilities in the city of Semarang, especially in PT Samwon Busana Indonesia had fulfilled one percent of the total employees. The total disability workers at the company are 14 out of a total of 1317 employees. In terms of legal protection, all employees both with disabilities and do not get the same rights and opportunities to be treated fairly. In addition, fulfillment of the rights of workers with disabilities is also fulfilled without discrimination.

Abstract

Judge forgiveness (rechterlijk pardon) is a new concept in the Draft Criminal Code (RKUHP) which authorizes judges not to impose a crime even though the defendant is proven guilty with several provisions as a condition of forgiveness. The position of the victim becomes important to discuss regarding the existence of this concept because the defendant who should be responsible for his actions can be released from the charge, on the other hand, the victim as the object of the crime, in general, is the party who has suffered losses for his legal interests. So, this concept ideally accommodates the interests of the victim adequately as a condition for forgiveness. The urgency of the victim's position in the concept was rechterlijk pardon further elaborated through a study entitled "An Overview of the Concept of Judge (Forgiveness Rechterlijk Pardon) concerning the Legal Interests of Criminal Victims (Concept Study of the 2019 RKUHP)". The focus of this research problem is to find out the history and concept of judge forgiveness in the RKUHP and to further review the concept of judge forgiveness about the legal interests of victims of criminal acts. This research is juridical-normative research using a historical approach, a comparative approach, and a conceptual approach. Sources of data used are data secondary consisting of legal materials (primary, secondary, tertiary). The method of collecting data is through literature or document studies and presented in a descriptive-analytical manner. The results showed that the formulation of rechterlijk pardon since the first RKUHP (1993) was motivated by the desire to include the goals and guidelines of punishment as a general principle of the Indonesian criminal system. While the concept is based on the "idea of balance" from the main elements of public interest and individual interests (actor-victim), actions and inner attitudes, certainty, flexibility, and justice. The current formulation does not represent this idea because the formulation is incomplete and clear regarding the terms of forgiveness so that from the victim's side there is uncertainty about the protection of his legal interests.Pemaafan hakim (rechterlijk pardon) merupakan konsep baru dalam Rancangan Kitab Undang-Undang Hukum Pidana (RKUHP) yang memberi kewenangan kepada hakim untuk tidak mengenakan pidana meskipun terdakwa terbukti bersalah dengan beberapa ketentuan sebagai syarat pemaafan. Posisi korban menjadi penting didiskusikan terkait keberadaan konsepsi, sebab terdakwa yang seharusnya mempertanggungjawabkan perbuatannya dapat dibebaskan dari tuntutan itu, di sisi lain korban sebagai objek kejahatan secara umum adalah pihak yang mengalami kerugian atas kepentingan hukumnya. Maka konsep ini idealnya mengakomodir kepentingan korban secara memadai sebagai syarat adanya pemaafan. Urgensitas kedudukan korban tersebut dalam konsep rechterlijk pardon dielaborasi lebih lanjut melalui penelitian dengan judul “Tinjauan Terhadap Konsep Pemaafan Hakim (Rechterlijk Pardon) Kaitannya dengan Kepentingan Hukum Korban Tindak Pidana (Studi Konsep RKUHP 2019)”. Fokus permasalahan penelitian ini adalah untuk mengetahui sejarah dan konsep pemaafan hakim dalam RKUHP serta meninjau lebih jauh konsep pemaafan hakim kaitannya dengan kepentingan hukum korban tindak pidana. Penelitian ini merupakan penelitian yuridis-normatif dengan menggunakan pendekatan historis, pendekatan perbandingan, serta pendekatan konseptual. Sumber data yang digunakan adalah data sekunder yang terdiri dari bahan-bahan hukum (primer, sekunder, tersier). Metode pengumpulan data dilakukan melalui studi kepustakaan atau dokumen dan disajikan secara deskriptif-analitis. Hasil penelitian menunjukkan bahwa perumusan rechterlijk pardon sejak RKUHP pertama (1993) dilatarbelakangi oleh kehendak memasukkan tujuan dan pedoman pemidanaan sebagai prinsip umum sistem pemidanaan Indonesia. Sedangkan konsepsinya didasarkan pada“ ide keseimbangan” dari unsur pokok kepentingan umum dan kepentingan perorangan (pelaku-korban), perbuatan dan sikap batin, kepastian, fleksibilitas dan keadilan. Rumusan saat ini belum merepresentasikan ide tersebut disebabkan formulasi yang tidak lengkap dan jelas perihal syarat-syarat pemberian maaf sehingga dari sisi korban terdapat ketidakpastian perlindungan atas kepentingan hukumnya.

Abstract

This article aims to explore the challenges increasing number of workers leads to a decrease in workers' bargaining power, which in turn raises the potential for abuse by employers. The government, as the policymaker, is expected to protect workers and guarantee Human Rights as stipulated in the 1945 Constitution. This research adopts a non-doctrinal approach with a normative perspective, utilizing documentation and literature studies as data sources. The research findings indicate that the issues of equality and justice in Indonesian labor law have not yet been fully realized. Changes in norms in various aspects of labor law, from Law Number 13 of 2013 concerning Manpower to Law Number 6 of 2023 concerning the Determination of Government Regulations replacing Law Number 2 of 2022 concerning Copyright, further highlight the disparities faced by workers, who are often subject to oppression in their relationships with employers. Several forms of injustice that still frequently occur include discrimination in recruitment processes and treatment in the workplace, harassment, intimidation, labor exploitation, violations of Health and Safety (K3) norms, injustice in the wage system, and the fulfillment of workers' rights in termination of employment.Artikel ini bertujuan mengkaji tantangan peningkatan jumlah tenaga kerja menyebabkan posisi tawar pekerja menjadi lebih lemah, yang pada akhirnya meningkatkan kemungkinan terjadinya penyalahgunaan oleh pengusaha. Pemerintah diharapkan dapat melindungi hak pekerja dan memastikan pemenuhan Hak Asasi Manusia sesuai dengan UUD 1945. Penelitian ini memakai pendekatan normatif non-doktrinal dengan memanfaatkan studi dokumentasi dan literatur sebagai sumber data. Hasil penelitian mengindikasikan bahwa prinsip kesetaraan dan keadilan dalam Hukum Ketenagakerjaan di Indonesia masih belum sepenuhnya terlaksana. Perubahan norma dalam aspek ketenagakerjaan dari Undang-Undang Nomor 13 Tahun 2013 ke Undang-Undang Nomor 6 Tahun 2023 menunjukkan adanya ketimpangan yang menyebabkan pekerja sering menjadi korban penindasan dalam hubungan kerja dengan pengusaha. Beberapa bentuk ketidakadilan yang masih sering terjadi meliputi diskriminasi dalam proses rekrutmen dan perlakuan di tempat kerja, pelecehan, intimidasi, eksploitasi tenaga kerja, pelanggaran norma Kesehatan dan Keselamatan Kerja (K3), ketidakadilan dalam sistem pengupahan, serta pelanggaran hak pekerja yang mengalami PHK.

Abstract

The increasing complexity of labor relations in Indonesia has led to widespread inequality, discrimination, and human rights violations in the workplace. These conditions underscore the urgent need for stronger legal protections to ensure justice and equality for all workers. This article examines the humanitarian challenges arising from the expanding labor force, which has weakened workers’ bargaining power and increased their vulnerability to exploitation by employers. As the primary policymaker, the government bears the constitutional obligation to protect workers and uphold human rights, as mandated by the 1945 Constitution of the Republic of Indonesia. Employing a non-doctrinal research approach with a normative perspective, this study utilizes documentation and literature as primary data sources. The findings reveal that equality and justice within Indonesia’s labor system have not been fully realized. The legal transition from Law No. 13 of 2013 on Manpower to Law No. 6 of 2023 on Job Creation further underscores disparities in labor relations, as workers continue to face structural vulnerabilities. Common forms of injustice include discrimination in recruitment and workplace practices, harassment, intimidation, labor exploitation, violations of occupational health and safety standards, unfair wage systems, and neglect of workers’ rights during termination of employment. These findings emphasize the urgent need for comprehensive labor law reform to ensure fairness, dignity, and the protection of fundamental rights for all workers. Meningkatnya kompleksitas hubungan industrial di Indonesia telah menimbulkan ketimpangan, diskriminasi, dan pelanggaran hak asasi manusia di lingkungan kerja. Kondisi tersebut menegaskan urgensi penguatan perlindungan hukum guna menjamin keadilan dan kesetaraan bagi seluruh pekerja. Artikel ini mengkaji tantangan kemanusiaan yang muncul akibat meningkatnya jumlah tenaga kerja, yang berimplikasi pada melemahnya posisi tawar pekerja dan meningkatnya kerentanan terhadap eksploitasi oleh pemberi kerja. Sebagai pembuat kebijakan utama, pemerintah memiliki kewajiban konstitusional untuk melindungi pekerja dan menegakkan hak asasi manusia sebagaimana diamanatkan dalam Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Dengan menggunakan pendekatan penelitian non-doktrinal melalui perspektif normatif, studi ini memanfaatkan dokumentasi dan kajian pustaka sebagai sumber data utama. Hasil penelitian menunjukkan bahwa prinsip kesetaraan dan keadilan dalam sistem ketenagakerjaan Indonesia belum sepenuhnya terwujud. Peralihan regulasi dari Undang-Undang No. 13 Tahun 2013 tentang Ketenagakerjaan ke Undang-Undang No. 6 Tahun 2023 tentang Cipta Kerja semakin menegaskan adanya disparitas dalam hubungan industrial, di mana pekerja masih menghadapi kerentanan struktural. Bentuk-bentuk ketidakadilan yang umum terjadi meliputi diskriminasi dalam rekrutmen dan praktik kerja, pelecehan, intimidasi, eksploitasi tenaga kerja, pelanggaran standar keselamatan dan kesehatan kerja, sistem upah yang tidak adil, serta pengabaian hak-hak pekerja saat pemutusan hubungan kerja. Temuan ini menegaskan perlunya reformasi hukum ketenagakerjaan yang komprehensif untuk menjamin keadilan, martabat, serta perlindungan hak-hak fundamental bagi seluruh pekerja.
