Abstract

Masdar Farid Mas’udi is intended to maintain the Islamic social construction by discussing zakat historically. He defined zakat as a tax concept which combined the two concepts from the government and Islam. He offered some concepts on interpreting that dualism.

Abstract

The purpose of this study is to measure legal protection and employment opportunities for persons with disabilities who work in various companies in the city of Semarang, Central Java. As is known, the right to work for citizens is regulated in Article 27 Paragraph 2 of the 1945 Constitution, which mandates the right of citizens to get a decent job and life. Every citizen has the same rights and the state (government) has regulated these rights in terms of obtaining employment without exception, including persons with disabilities. This study uses a juridical-empirical (non-doctrinal) approach, which examines how employment opportunities and legal protection of persons with disabilities in the city of Semarang, especially in PT. Samwon Clothing Indonesia. Primary data sources were obtained from PT. Samwon Busana Indonesia through interviews, secondary data in the form of legal material. Data Collection Method with Interview and Documentation methods, Data Analysis is done by a descriptive method. The results showed that employment opportunities for workers with disabilities in the city of Semarang, especially in PT Samwon Busana Indonesia had fulfilled one percent of the total employees. The total disability workers at the company are 14 out of a total of 1317 employees. In terms of legal protection, all employees both with disabilities and do not get the same rights and opportunities to be treated fairly. In addition, fulfillment of the rights of workers with disabilities is also fulfilled without discrimination.

Abstract

Judge forgiveness (rechterlijk pardon) is a new concept in the Draft Criminal Code (RKUHP) which authorizes judges not to impose a crime even though the defendant is proven guilty with several provisions as a condition of forgiveness. The position of the victim becomes important to discuss regarding the existence of this concept because the defendant who should be responsible for his actions can be released from the charge, on the other hand, the victim as the object of the crime, in general, is the party who has suffered losses for his legal interests. So, this concept ideally accommodates the interests of the victim adequately as a condition for forgiveness. The urgency of the victim's position in the concept was rechterlijk pardon further elaborated through a study entitled "An Overview of the Concept of Judge (Forgiveness Rechterlijk Pardon) concerning the Legal Interests of Criminal Victims (Concept Study of the 2019 RKUHP)". The focus of this research problem is to find out the history and concept of judge forgiveness in the RKUHP and to further review the concept of judge forgiveness about the legal interests of victims of criminal acts. This research is juridical-normative research using a historical approach, a comparative approach, and a conceptual approach. Sources of data used are data secondary consisting of legal materials (primary, secondary, tertiary). The method of collecting data is through literature or document studies and presented in a descriptive-analytical manner. The results showed that the formulation of rechterlijk pardon since the first RKUHP (1993) was motivated by the desire to include the goals and guidelines of punishment as a general principle of the Indonesian criminal system. While the concept is based on the "idea of balance" from the main elements of public interest and individual interests (actor-victim), actions and inner attitudes, certainty, flexibility, and justice. The current formulation does not represent this idea because the formulation is incomplete and clear regarding the terms of forgiveness so that from the victim's side there is uncertainty about the protection of his legal interests.Pemaafan hakim (rechterlijk pardon) merupakan konsep baru dalam Rancangan Kitab Undang-Undang Hukum Pidana (RKUHP) yang memberi kewenangan kepada hakim untuk tidak mengenakan pidana meskipun terdakwa terbukti bersalah dengan beberapa ketentuan sebagai syarat pemaafan. Posisi korban menjadi penting didiskusikan terkait keberadaan konsepsi, sebab terdakwa yang seharusnya mempertanggungjawabkan perbuatannya dapat dibebaskan dari tuntutan itu, di sisi lain korban sebagai objek kejahatan secara umum adalah pihak yang mengalami kerugian atas kepentingan hukumnya. Maka konsep ini idealnya mengakomodir kepentingan korban secara memadai sebagai syarat adanya pemaafan. Urgensitas kedudukan korban tersebut dalam konsep rechterlijk pardon dielaborasi lebih lanjut melalui penelitian dengan judul “Tinjauan Terhadap Konsep Pemaafan Hakim (Rechterlijk Pardon) Kaitannya dengan Kepentingan Hukum Korban Tindak Pidana (Studi Konsep RKUHP 2019)”. Fokus permasalahan penelitian ini adalah untuk mengetahui sejarah dan konsep pemaafan hakim dalam RKUHP serta meninjau lebih jauh konsep pemaafan hakim kaitannya dengan kepentingan hukum korban tindak pidana. Penelitian ini merupakan penelitian yuridis-normatif dengan menggunakan pendekatan historis, pendekatan perbandingan, serta pendekatan konseptual. Sumber data yang digunakan adalah data sekunder yang terdiri dari bahan-bahan hukum (primer, sekunder, tersier). Metode pengumpulan data dilakukan melalui studi kepustakaan atau dokumen dan disajikan secara deskriptif-analitis. Hasil penelitian menunjukkan bahwa perumusan rechterlijk pardon sejak RKUHP pertama (1993) dilatarbelakangi oleh kehendak memasukkan tujuan dan pedoman pemidanaan sebagai prinsip umum sistem pemidanaan Indonesia. Sedangkan konsepsinya didasarkan pada“ ide keseimbangan” dari unsur pokok kepentingan umum dan kepentingan perorangan (pelaku-korban), perbuatan dan sikap batin, kepastian, fleksibilitas dan keadilan. Rumusan saat ini belum merepresentasikan ide tersebut disebabkan formulasi yang tidak lengkap dan jelas perihal syarat-syarat pemberian maaf sehingga dari sisi korban terdapat ketidakpastian perlindungan atas kepentingan hukumnya.

Abstract

Identifikasi bahaya adalah cara untuk menentukan situasi dimana sumber energi digunakan di tempat kerja tanpa kendali yang memadai. PT XYZ berkomitmen untuk melindungi semua asetnya agar dapat terus meningkatkan kualitas produk dan layanan melalui perlindungan kesehatan dan keselamatan kerja dengan menetapkan target zero accident yaitu berusaha meningkatkan Sistem Manajemen Kesehatan dan Keselamatan Kerja (SMK3) agar pekerja tidak mengalami kecelakaan dengan melakukan identifikasi bahaya dan penilaian risiko. Unit kerja di PT XYZ menggunakan peralatan modern yang dalam pengoperasian nya banyak terdapat bahaya yang berpotensi menimbulkan kecelakaan atau penyakit akibat kerja. Berdasarkan permasalahan diatas, maka dilakukan penelitian untuk mengetahui pelaksanaan Sistem Manajemen K3 secara umum serta mengidentifikasi bahaya dan risiko yang dapat terjadi pada aktivitas bekerja di PT XYZ. Jenis penelitian ini adalah deskriptif kuantitatif dengan obyek penelitian yaitu pekerjaan yang mengandung bahaya pada proses inspeksi lensa di area Quality Control PT XYZ. Teknik pengumpulan data yaitu observasi lapangan dan wawancara. Dari hasil penelitian menggunakan metode JSA menunjukkan bahwa terdapat 5 potensi bahaya antara lain: mengalami penyakit akibat kerja (PAK), korsleting, tersengat arus listrik, terjepit dan terkena luka bakar. Hasil identifikasi bahaya masuk dalam kategori medium risk atau risiko sedang. Sumber risiko yang menjadi penyebab terjadinya risiko kecelakaan kerja di PT XYZ berasal dari sumber risiko yang berasal dari dalam perusahaan itu sendiri dan terdiri dari beberapa factor yaitu manusia dan mesin.

Abstract

The purpose of this research is to find out the implementation of Islamic religious education and morals at SD N 2 Jiwan Karangnongko Klaten. (Case study of obstacles and how to overcome them). Method This type of research is observation with a qualitative method where the data and research location are located at SD Negeri 2 Jiwan Karangnongko Klaten. The sample of this study was 19 people consisting of 8 girls and 11 boys who were in class VI at SD N 2 Jiwan Karangnongko Klaten. The methods used in this study are: Observation, Interview and Documentation. The data analysis techniques in this study were data reduction, data presentation. Research showing the implementation of learning Islamic Religious Education and Characteristics of SD N 2 Jiwan Karangnongko Klaten (Case Study of obstacles and how to overcome them) teachers use the lecture method, discussion method, and jigsaw cooperative method. The obstacles include: students who are easily bored in this learning, teachers who are less professional, less infrastructure, and an incomplete school environment. The way to overcome this is by motivating students, educators use various methods in class learning, increase the professionalism of educators with independent learning and actively participate in training to enrich insights, complete educational facilities and infrastructure, the school environment by providing activities that can support student learning in class . From these results the category is good with an average value of 82.42.

Abstract

This article aims to explore the challenges increasing number of workers leads to a decrease in workers' bargaining power, which in turn raises the potential for abuse by employers. The government, as the policymaker, is expected to protect workers and guarantee Human Rights as stipulated in the 1945 Constitution. This research adopts a non-doctrinal approach with a normative perspective, utilizing documentation and literature studies as data sources. The research findings indicate that the issues of equality and justice in Indonesian labor law have not yet been fully realized. Changes in norms in various aspects of labor law, from Law Number 13 of 2013 concerning Manpower to Law Number 6 of 2023 concerning the Determination of Government Regulations replacing Law Number 2 of 2022 concerning Copyright, further highlight the disparities faced by workers, who are often subject to oppression in their relationships with employers. Several forms of injustice that still frequently occur include discrimination in recruitment processes and treatment in the workplace, harassment, intimidation, labor exploitation, violations of Health and Safety (K3) norms, injustice in the wage system, and the fulfillment of workers' rights in termination of employment.Artikel ini bertujuan mengkaji tantangan peningkatan jumlah tenaga kerja menyebabkan posisi tawar pekerja menjadi lebih lemah, yang pada akhirnya meningkatkan kemungkinan terjadinya penyalahgunaan oleh pengusaha. Pemerintah diharapkan dapat melindungi hak pekerja dan memastikan pemenuhan Hak Asasi Manusia sesuai dengan UUD 1945. Penelitian ini memakai pendekatan normatif non-doktrinal dengan memanfaatkan studi dokumentasi dan literatur sebagai sumber data. Hasil penelitian mengindikasikan bahwa prinsip kesetaraan dan keadilan dalam Hukum Ketenagakerjaan di Indonesia masih belum sepenuhnya terlaksana. Perubahan norma dalam aspek ketenagakerjaan dari Undang-Undang Nomor 13 Tahun 2013 ke Undang-Undang Nomor 6 Tahun 2023 menunjukkan adanya ketimpangan yang menyebabkan pekerja sering menjadi korban penindasan dalam hubungan kerja dengan pengusaha. Beberapa bentuk ketidakadilan yang masih sering terjadi meliputi diskriminasi dalam proses rekrutmen dan perlakuan di tempat kerja, pelecehan, intimidasi, eksploitasi tenaga kerja, pelanggaran norma Kesehatan dan Keselamatan Kerja (K3), ketidakadilan dalam sistem pengupahan, serta pelanggaran hak pekerja yang mengalami PHK.

Abstract

The digital labor market has introduced profound changes to employment practices, presenting both new opportunities and heightened risks for women and children. This article examines the essential role of legal frameworks in empowering these vulnerable groups and ensuring their protection within this evolving landscape. It begins by exploring existing legal standards and international conventions, such as the International Labour Organization (ILO) conventions and United Nations guidelines, which provide foundational principles for labor rights and protections. The article then evaluates the effectiveness of current regulations in addressing specific challenges faced by women and children in digital work environments, including issues of exploitation, harassment, and discrimination. By analyzing case studies and policy implementations, the research highlights the gaps in existing legal frameworks and proposes comprehensive legal reforms aimed at enhancing safety and inclusivity. The article advocates for the adoption of adaptive and forward-looking legal measures that reflect the realities of the digital era, ensuring that women and children are protected and empowered in the future workforce. In conclusion, reinforcing legal frameworks is crucial for fostering a safer and more equitable digital labor market for all.

Abstract

The evolution of criminal law in Indonesia reflects a complex interplay between indigenous legal traditions and external influences, including Islamic law. This article examines the contribution model of al-mas'ūliyyah al-jinā'iyyah (criminal liability in Islamic law) to formulating criminal liability in Indonesia’s New Criminal Code (KUHP Baru). The study adopts a qualitative research method, utilizing a comparative legal analysis framework to explore the dialectic between Islamic criminal law and the New Criminal Code. Data sources include classical legal texts, the book of Qur’anic exegesis and Hadith interpretations, legislative documents related to the New Criminal Code, academic literature, legal commentaries, and jurisprudential analyses. Through this method, the study identifies an elegant interplay between the principles of ḍarar (harm) and the fundamental criminal liability provisions in both systems. This study's findings reveal significant similarities and key differences, such as the role of intent, the typology of legal subjects, and the broader scope of liability for corporate crimes under the New Criminal Code (KUHP Baru). This article concludes that the contribution of al-mas'ūliyyah al-jinā'iyyah to the New Criminal Code lies primarily at the level of values while highlighting the potential for further alignment in specific areas.

Abstract

This research aims to investigate and analyze the career paths of graduates of the Banking and Microfinance Skills Program at XYZ University through a tracer study approach. The main focus of this research is to evaluate the extent to which the BMWs (Fields of Interest and Competencies) acquired during the studies influence their professional careers as well as the relevance of the acquired competencies to the needs of the job market in the banking and microfinance sectors. A qualitative approach was used in this research, with structured in-depth interview techniques with graduates as the main data collection method. Interviews will focus on graduates' career experiences, how they apply the knowledge and skills obtained from the study program, as well as evaluation of their preparation in facing challenges and demands in the workplace. This research receives urgency due to changing dynamics in the banking and microfinance sectors which are increasingly complex and changing rapidly. By tracking graduates' career trajectories, this research will provide a deeper understanding of the extent to which higher education curricula can adapt to these changes as well as BMW's real contribution in preparing graduates for success in the world of work. It is hoped that the results of this research can provide valuable input for the development of educational programs, enable universities to increase the relevance of curricula to industry needs, and provide insight to prospective students regarding career prospects and skills required in the banking and microfinance sectors

Abstract

Pendidikan Agama Islam (PAI) memiliki peranan yang sangat penting dalam membentuk karakter dan moral generasi muda, terutama di tingkat pendidikan menengah. Namun, proses pembelajaran PAI di SMA Negeri 1 Muaro Jambi masih menghadapi berbagai tantangan, seperti rendahnya motivasi belajar siswa, metode yang kurang variatif, serta terbatasnya fasilitas pendukung yang dapat meningkatkan efektivitas pembelajaran. Penelitian ini bertujuan untuk menganalisis faktor-faktor yang mempengaruhi pembelajaran PAI di sekolah tersebut, dengan fokus pada kualitas metode pembelajaran, motivasi siswa, lingkungan sosial, dan keberagaman karakteristik siswa. Metode yang digunakan dalam penelitian ini adalah deskriptif kualitatif, yang melibatkan wawancara, observasi, dan studi dokumentasi untuk mengumpulkan data langsung dari guru dan siswa. Hasil penelitian menunjukkan bahwa tantangan utama yang dihadapi adalah rendahnya motivasi siswa, penggunaan metode yang monoton, dan kurangnya partisipasi aktif siswa. Selain itu, faktor eksternal seperti fasilitas yang belum optimal dan kurangnya perhatian terhadap keberagaman gaya belajar siswa turut menghambat proses pembelajaran yang lebih inovatif. Penelitian ini memberikan rekomendasi untuk memperbaiki kualitas metode pembelajaran dengan pendekatan yang lebih interaktif dan inovatif, serta memperhatikan karakteristik siswa secara individual. Selain itu, peningkatan fasilitas yang mendukung lingkungan belajar yang kondusif juga sangat diperlukan. Dampak dari penelitian ini diharapkan dapat memberikan kontribusi dalam pengembangan kurikulum dan metode pembelajaran PAI yang lebih efektif, serta memberikan wawasan bagi kebijakan pendidikan di sekolah-sekolah lain guna menciptakan pengalaman belajar yang lebih bermakna dan relevan bagi siswa.
