Abstract

The concept of marital property is still an interesting topic to discuss. Because there is still a disagreement between the concept of marital property to described by contemporary scholars through the approach of syirkah and the financial reality of today's family in Indonesia. This is because syirkah mufawadhah and syirkah 'abdan which explain is the type of syirkah 'uqūd that requires ijab-kabul and its provision for business. While in the context of marital property this concept is not achieved. Because the concept of marital property in Indonesia is more suitable towards the concept of syirkah amlak that does not require ijab-kabul and non-business. However, if want to conform to the concept of syirkah 'uqūd or syirkah business then there needs to be an improvement that must be preceded by a syirkah agreement or a contractual agreement on joint property either before marriage on premarital agreement or during marriage.

Abstract

This study aimed to examine the effectiveness of Fatwa No. 14/Ijtima' Ulama/VIII/2024 in clarifying the ambiguities of No. 83 of 2023, which addresses the boycott of products affiliated with Israel. The legal certainty provided by Fatwa No. 14, its role in guiding the public and businesses, and its broader socio-economic implications were evaluated. The study adopted content analysis, historiographical review, and documentary to analyze primary and secondary sources, such as official fatwas, policy reports, academic journals, and media reports. This method assesses the fatwa’s clarity, its social impact, and potential economic consequences. The result showed that Fatwa No. 14 aimed to resolve the ambiguity of No. 83 by promoting domestic products, local ownership, and national labor. However, the criteria remain imprecise, particularly concerning foreign ownership limits and the proportion of local raw materials, leading to public confusion and potential economic losses for unrelated businesses. Reactions to the fatwa have been polarized, with some perceiving the decree as a demonstration of economic solidarity, while others criticize the adverse effects of the fatwa on local businesses. This study provides a comprehensive legal and socio-economic assessment of MUI's fatwa on product boycotts, showing legal ambiguities and policy gaps that have yet to be addressed. By bridging Islamic legal studies and economic analysis, the study offers a novel perspective on the intersection of religious decrees and market dynamics. There is also a need for clearer guidelines and regulatory frameworks to ensure the fatwa’s effectiveness while minimizing unintended economic repercussions. In conclusion, this study contributes to the broader discourse on Sharia legal certainty, religious fatwas, and the impact on socio-economic justice.

Abstract

This study investigates the legal implications of waiting time fees imposed in the Delivery Food and Shop service of the Maxim ride-hailing platform in Palu City. It is an empirical legal research that employs a statutory approach to analyze Law No. 8 of 1999 on Consumer Protection and a conceptual approach to examine the ijarah contract within the framework of Islamic commercial law (fiqh muamalah). Primary data were collected through field observations and interviews with Maxim users, driver-partners, and staff, while secondary data were obtained from legal documents and academic literature. The findings reveal that the current fee policy charging IDR 250 per minute after a 20-minute grace period lacks adequate transparency and user consent, thereby introducing elements of gharar (uncertainty) in sharia and potentially violating the principles of fair contracting in positive law. Although such fees are permissible under Islamic law when clearly agreed upon, the absence of upfront disclosure renders the contract problematic. The study recommends that Maxim improve price transparency and in-app information delivery to ensure fairness, legal certainty, and compliance with applicable legal norms. Abstrak Penelitian ini mengkaji implikasi hukum dari penerapan biaya waktu tunggu pada layanan Delivery Food and Shop oleh platform ojek online Maxim di Kota Palu. Penelitian ini merupakan penelitian hukum empiris yang menggunakan pendekatan perundang-undangan untuk menganalisis Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen serta pendekatan konseptual untuk mengkaji akad ijarah dalam kerangka hukum ekonomi Islam (fiqh muamalah). Data primer diperoleh melalui observasi lapangan dan wawancara dengan pengguna, mitra pengemudi, serta staf Maxim, sementara data sekunder diperoleh dari dokumen hukum dan literatur akademik. Hasil penelitian menunjukkan bahwa kebijakan tarif saat ini—Rp250 per menit setelah masa tunggu gratis 20 menit—tidak disertai dengan transparansi dan persetujuan awal dari pengguna secara memadai. Hal ini menimbulkan unsur gharar (ketidakpastian) dalam perspektif syariah dan berpotensi melanggar prinsip keadilan kontraktual dalam hukum positif. Meskipun biaya tersebut dibolehkan dalam hukum Islam jika disepakati secara jelas, ketiadaan informasi yang disampaikan sejak awal membuat kontrak menjadi bermasalah. Studi ini merekomendasikan agar Maxim meningkatkan transparansi tarif dan penyampaian informasi dalam aplikasi untuk menjamin keadilan, kepastian hukum, dan kepatuhan terhadap norma hukum yang berlaku.

Abstract

The study aims to analyze the polemic of commercialization of modified applications in copyright enforcement through an integrative approach between legal certainty, justice and expediency. The method of research used by the author is the normative juridical method, using secondary data, in the form of primary legal materials such as Law Number 28 of 2014 concerning Copyright and its implementing regulations; secondary legal materials in the form of legal literature, journal articles, research results, legal news and legal opinion articles which are then analyzed deductively. The novelty of this research lies in the assessment of copyright law that has not reflected substantive justice in the face of infringement through the commercialization of modified applications, using the approach of Hans Kelsen's Stufenbau theory and Gustav Radbruch's Integrative theory. The results show that the polemic of copyright enforcement against modified applications is mulltidimensional. On the legal side, the unclear norms in the Copyright Law regarding application modification activities, the weak monitoring and enforcement system, and the lack of technical regulations (PP and Permenkumham) governing digital applications. On the other hand, social, cultural, and economic factors such as low legal awareness, the rampant culture of using modified applications, and the economic inability of the community also exacerbate this illegal commercialization practice. The conclusion is that copyright enforcement of modified applications is not optimal due to the gap between normative regulation and practice. Based on Gustav Radbruch's integrative theory, the solutions offered include: (1) from the aspect of justice, the government needs to change the complaint offense into an ordinary offense for application copyright infringement and issue special regulations in the form of Government Regulations or Permenkumham for the protection of digital applications, coupled with improving the integrity of law enforcement officials; (2) from the aspect of legal certainty, it is important to revise Article 52 of the Copyright Law and strengthen supervision of the distribution of modified applications by e-commerce; and (3) from the aspect of expediency, solutions include public education, the use of open source applications as an alternative, open source application development, more affordable pricing strategies, to inclusive payment systems by official developers.
