Abstract

Blockchain is a revolutionary concept in information technology that allows the creation and storage of data in a decentralized and encrypted manner. However, blockchain is still a new system in the economic world, so it is necessary to ensure that this technology complies with Sharia standards. In this case, the Compilation of Sharia Economic Law is an essential guideline in Sharia economics in Indonesia because it provides legal certainty, regulatory standards, and consumer protection and supports the development of Sharia finance. This article was written to provide an overview of the opportunities for utilizing blockchain technology in the economic sector from a KHES perspective. The method used is library research, a normative juridical approach, by analyzing documents and information related to the study problem. The results show that KHES articles suit the blockchain character, some of which are articles 21, 179-180, 200, 413, and 577. However, an in-depth analysis is needed regarding the principles of Sharia and the need for a fatwa. Apart from that, it is essential to make clear regulations by the government and government authorities regarding the use of blockchain technology. With proper regulations, blockchain can become helpful in developing the Sharia economy. Abstrak Blockchain adalah konsep yang revolusioner dalam teknologi informasi yang memungkinkan pembuatan dan penyimpanan data secara terdesentralisasi dan terenkripsi. Keunggulan utama dari blockchain adalah transparansi dan keamanan. Kendati demikian, blockchain tetaplah system baru dalam dunia ekonomi, sehingga perlu dipastikan jika teknologi ini sesuai dengan standar syariah. Dalam hal ini, Kompilasi Hukum Ekonomi Syariah menjadi pedoman penting dalam ekonomi syariah di Indonesia karena memberikan kepastian hukum, standar regulasi, perlindungan konsumen, dan dukungan pengembangan keuangan syariah. Artikel ini ditulis untuk memberikan gambaran mengenai konsep blockchain dan peluang pemanfaatan teknologi blockchain di bidang ekonomi dalam perspektif KHES. Metode yang digunakan adalah library research, pendekatan normatif yuridis. Tahapan dalam penelitian ini, meliputi: pengidentifikasian secara sistematik, serta analisis dokumen dan informasi yang berkaitan dengan masalah kajian. Hasil menunjukkan terdapat pasal KHES yang sesuai karakter blockchain, beberapa diantaranya: pasal 21, pasal 179-180, Pasal 200, Pasal 413 dan Pasal 577. Meski demikian, dibutuhkan analisis mendalam terkait prinsip kepatuhan syariah dan perlu adanya fatwa khusus. Selain itu, penting dibuatnya regulasi yang jelas oleh pemerintah dan otoritas keuangan mengenai penggunaan teknologi blockhcain. Dengan regulasi yang tepat, edukasi yang memadai, dan penilaian dari ahli syariah, blockchain dapat menjadi alat yang sangat berguna dalam mengembangkan ekonomi syariah yang lebih adil dan transparan.

Abstract

Pertumbuhan fintech yang pesat telah memberikan dampak signifikan pada perubahan lanskap ekonomi global. Dengan perubahan tersebut fintech dapat menghadirkan berbagai manfaat dan tantangan secara sekaligus. Di satu sisi, fintech meningkatkan inklusivitas dan efisiensi keuangan, sementara di sisi lain, fintech memicu munculnya risiko disebabkan lemahnya keamanan dan privasi data pengguna layanan keuangan. Namun bagi masyarakat Islam, pemanfaatan fintech tidak hanya ditinjau dari aspek manfaat dan resikonya, melainkan harus didasarkan pada penegakan prinsip-prinsip muamalah Islam untuk memastikan kepatuhan terhadap ajaran agama yang bermuara pada kemaslahatan dan kesejahteraan masyarakat. Adapun tujuan penelitian ini, yakni untuk menganalisis peran Financial Technology (Fintech) dalam pemberdayaan ekonomi umat melalui perspektif Hukum Ekonomi Syariah dengan menggunakan pendekatan kualitatif deskriptif-analitis. Hasil penelitian menunjukkan bahwa fintech dengan pengawasan pemerintah yang ketat dapat menjadi alat yang efektif dalam memberdayakan ekonomi umat, mendukung kesejahteraan sosial, dan memajukan inklusivitas keuangan sesuai dengan prinsip-prinsip Islam yang berorientasi pada kemaslahatan.

Abstract

This study aims to enrich and develop understanding of the status of non-Muslim citizenship in Indonesia from the perspective of Nahdlatul Ulama (NU) as the largest community organization in Indonesia. The type of research used is library research, with a theological-normative, sharia and historical approach. This study uses data collection methods in the form of quoting, filtering and analyzing using content analysis of representative literature that is relevant to the problem discussed, then reviewing and concluding it. The results of this study are an analysis of the status of non-Muslim citizenship in Indonesia according to Nahdlatul Ulama categorized as non-Muslim citizens. In fiqh that limits the rights of non-Muslims does not apply in the concept of a nation state implemented in Indonesia. Therefore, this study recommends that political and religious categorization not be monopolized by one particular entity or group. In addition, this study also suggests that the government, the Indonesian Ulema Council (MUI), as well as community organizations such as Nahdlatul Ulama or Muhammadiyah need to re-knit the threads that have become tangled due to identity politics, and reconstruct the understanding of classical fiqh teachings and doctrines into a contemporary perspective that is more in line with the concept of an inclusive nation state, as implemented in Indonesia.

Abstract

Bank Syariah Indonesia (BSI), as an Islamic financial institution, provides takeover financing services to facilitate the transition of customers from conventional banks to Sharia-compliant banking. One of its flagship products, the Mitraguna facility, has attracted significant public interest in switching to the Islamic financial system. This study aims to analyze the legal compliance of Bank Syariah Indonesia in implementing Fatwa No. 31/DSN-MUI/VI/2002 on Debt Transfer, issued by the National Sharia Council of the Indonesian Ulema Council (Dewan Syariah Nasional Majelis Ulama Indonesia / DSN-MUI), particularly in the context of takeover financing through the Mitraguna facility for civil servants. Using a normative-empirical method with a descriptive-analytical approach, data were collected through interviews with BSI employees (Basuki Rahmat Branch, Palu City), BSI’s official website, and library research. The findings indicate that the implementation of takeover financing at BSI through the Mitraguna facility aligns with the provisions of the fatwa, specifically through the use of the musyarakah mutanaqisah (MMQ) contract, which corresponds to Alternative II outlined in the DSN-MUI fatwa. This research is expected to contribute to the development of Sharia economic law and serve as a reference for ensuring Sharia compliance in Islamic financial institutions.Keywords: Mitraguna; Civil Servants; Takeover Financing; Bank Syariah Indonesia

Abstract

The Implementation of Islamic Economic Law Values ​​on the Products of BNI Sharia of Pangkep Branch which Includes, 1) Amar ma’rūf nahyi munkar, 2) Ta’āwun, 3) Justice, 4) Not usury, 5) Not garar in getting treasure has not been optimally implemented considering there is still element of garar in micro finance products where the bank as a seller selling an object of goods that have not owned. It was happened due to several factors such as: 1. The fulfillment of hard-to-reach annual targets, 2. The dishonest and closed clients concerning the proposed financing purposes, 3. The clients demanding liquidation as soon as possible, and 4. The employees of BNI Sharia of Pangkep Branch particularly did not understand the nature and legal consequences of sale and purchase of garar coupled with the lack of customers’ understanding related to murabahah bi al-wakalah so that the process of financing with a predetermined flow cannot be executed according to the rules in force.

Abstract

The study aims to analyze the polemic of commercialization of modified applications in copyright enforcement through an integrative approach between legal certainty, justice and expediency. The method of research used by the author is the normative juridical method, using secondary data, in the form of primary legal materials such as Law Number 28 of 2014 concerning Copyright and its implementing regulations; secondary legal materials in the form of legal literature, journal articles, research results, legal news and legal opinion articles which are then analyzed deductively. The novelty of this research lies in the assessment of copyright law that has not reflected substantive justice in the face of infringement through the commercialization of modified applications, using the approach of Hans Kelsen's Stufenbau theory and Gustav Radbruch's Integrative theory. The results show that the polemic of copyright enforcement against modified applications is mulltidimensional. On the legal side, the unclear norms in the Copyright Law regarding application modification activities, the weak monitoring and enforcement system, and the lack of technical regulations (PP and Permenkumham) governing digital applications. On the other hand, social, cultural, and economic factors such as low legal awareness, the rampant culture of using modified applications, and the economic inability of the community also exacerbate this illegal commercialization practice. The conclusion is that copyright enforcement of modified applications is not optimal due to the gap between normative regulation and practice. Based on Gustav Radbruch's integrative theory, the solutions offered include: (1) from the aspect of justice, the government needs to change the complaint offense into an ordinary offense for application copyright infringement and issue special regulations in the form of Government Regulations or Permenkumham for the protection of digital applications, coupled with improving the integrity of law enforcement officials; (2) from the aspect of legal certainty, it is important to revise Article 52 of the Copyright Law and strengthen supervision of the distribution of modified applications by e-commerce; and (3) from the aspect of expediency, solutions include public education, the use of open source applications as an alternative, open source application development, more affordable pricing strategies, to inclusive payment systems by official developers.

Abstract

This study aims to analyze the implementation of personal data protection under Law Number 27 of 2022 and to examine the urgency of establishing an independent supervisory authority for personal data protection. The research employs a normative juridical approach by reviewing primary and secondary legal sources as well as relevant literature, then analyzed descriptively to identify regulatory and institutional weaknesses. The findings indicate that although Law Number 27 of 2022 marks a significant step in protecting personal data in Indonesia, its provisions remain partial due to the absence of an independent supervisory body. The lack of such authority may undermine law enforcement, as a body directly under the president is vulnerable to political and bureaucratic interests. This study emphasizes that an independent supervisory institution is essential to ensure legal compliance, the enforcement of sanctions, and the effective protection of citizens’ privacy rights. Therefore, the establishment of an autonomous supervisory authority is urgent to realize the objectives of the Personal Data Protection Law in ensuring justice, legal certainty, and utility.

Abstract

PTSP is an innovation in the bureaucratic system designed to improve efficiency, transparency, and accountability of services to the public. In this case, the Supreme Court, through the Director General of Religious Courts, has stipulated the Director General of Badilag's decree No. 1403.b concerning guidelines for one-stop integrated services in the Religious Courts. Therefore, this study aims to analyze the transformation of public services through implementing One-Stop Integrated Services (PTSP) in Religious Courts, specifically in Palu Religious Court with Class 1A status, which should be an example of other Religious Courts with lower classes. The research method used is qualitative with a case study approach. Data were collected through in-depth interviews, observation, and document analysis. The results showed that implementing PTSP in Palu Religious Court Class 1A has brought significant changes in various aspects of public services. Service time has become faster, procedures have become more straightforward, and public satisfaction with services has increased. However, this study also found several obstacles in the implementation of PTSP: first, the infrastructure that is not yet optimal; second, the unavailability of bank officers at any time; and third, the malfunction of the PTSP Online service system due to the need for periodic upgrading and system development.
