Abstract

The debate of certain circles who tend to appoint Indonesian Islamic society is desirous to restore the seven words of the 1945 Constitution, as a nation-state foundation like the Medina Charter which is the benchmark for how Islam behaves during the time of the Prophet Muhammad became a continuous growing issue. This allegation should not be raised continuously, as it is well known that Islam has a strong influence on the birth of the 1945 Act. This paper is put forward as an attempt to provide a proper understanding and meaning, regarding the influence of Islam on the emergence of the 1945 Constitution. In this paper is a historical method with a juridical approach, with the specification of literature research approach The influence of Islam in the 1945 Constitution came from the nine committee which has 8 members who are Muslims. Another influence is reflected in the sincerity of the emergence of editorial changes from the opening of the 1945 Constitution, from the initial agreement. The change is related to the loss of seven words known as the Jakarta Charter

Abstract

Melayu sebagai bangsa yang melahirkan peradaban di wilayah Asia Tenggara tidak menjadi satu-satunya bangsa yang memiliki peran berkembang Islam di wilayah ini, etnis lain seperti Creole, Arab, Turki, Persia, Pathan, Mogul Bengalis, dan Indo-Mongoloid memiliki peran tersebut. Akulturasi yang terjadi memunculkan berbagai macam pemahaman keagamaan yang berkembang di wilayah Islam Asia Tenggara, keberkembangan pemahaman agama memunculkan perbedaan dalam bidang teologi, fiqih dan tasawuf. Perbedaan yang muncul tidak lantas mengurangi esensi dari ketiga pemahaman keagamaaan tersebut. Tulisan ini mencoba mengurai perjalanan masuknya Islam sebagai sebuah tataran keagamaan yang mengedepan kesalehan sosial, dengan berlandaskan ajaran ketauhidan yang dicerminkan melalui al-Quran dan al-Hadits melalui rentang waktu yang didasari kepada masuknya mazhab fiqih, mazhab kalam, dan mazhab tasawwuf. Fiqih Syafi’i menjadi dominan dalam ruang lingkup peribadatan bagi sebagian besar populasi muslim di kawasan Asia Tenggara, teologi Ahl al-Sunnah wa al-Jama’ah muncul sebagai doktrin yang tidak terpisahkan dengan ritualitas Ke-Tauhid-an bangsa melayu sebagai mayoritas penganut aliran kalam, walaupun tidak menafikan adanya aliran lain. Tarekat sebagai bagian terakhir yang menjadi identitas Islam di Asia Tenggara dalam ruang lingkup tasawuf di warnai oleh berbagai macam aliran. Tarekat yang mempengaruhi Islam Asia Tenggara diwakili oleh sembilan kelompk tarekat yaitu: Qadiriyyah, Naqsyabandiyyah, Rifa’iyyah, Syadzliyyah, Chistiyyah, Syattariyyah, Ahmadiyyah Idrisiyyah, Tijaniyyah dan ‘Alawiyyah.

Abstract

Abstract. The DPD has the authority to submit draft laws to the DPR, participate in discussing draft laws and provide considerations to the DPR on the APBN Bill. The word "participate" in the 1945 Constitution article 22D paragraph (2) discusses the draft bill that makes the DPD not have effective legislative power. The word "can" in Article 22D paragraph (1) makes the DPD not have effective power in terms of supervision over the implementation of the Act. DPD in Article 23 paragraph (2) of the phrase "taking into account the considerations of the DPD" makes the DPD not have effective power in terms of budget functions. Based on this phenomenon, the problems in this research are formulated as follows: (1) What are the functions, objectives and positions of the Regional Representatives Council in providing considerations and discussions on the RAPBN? (2) How is the external supervision carried out by the Regional Representatives Council on the implementation of the APBN? The approach method used in this research is normative juridical, namely legal research conducted by examining library materials or secondary data. The results of this study are: In giving consideration and discussion of the RAPBN function, purpose, and position of the DPD, the function of the DPD is considered to be still not balanced with the function of the DPR, the limited authority of the DPD shows the objectives of the Regional Representative Council. Regional Representative Council with limited supervision which is only regulated in the 1945 Constitution of the Republic of Indonesia. Abstrak. DPD memiliki kewenangan mengajukan rancangan undang-undang kepada DPR, ikut membahas rancangan undang-undang serta memberikan pertimbangan kepada DPR atas RUU APBN. Kata “ikut” dalam UUD 1945 pasal 22D ayat (2) membahas rancangan RUU membuat DPD tidak mempunyai kekuasaan legislatif yang efektif. Kata “dapat” dalam pasal 22D ayat (1) membuat DPD tidak mempunyai kekuasaan yang efektif dalam hal pengawasan atas pelaksaaan Undang-Undang. DPD dalam Pasal 23 ayat (2) adanya frase “dengan memperhatikan pertimbangan DPD” membuat DPD tidak mempunyai kekuasaan yang efektif dalam hal fungsi anggaran. Berdasarkan fenomena tersebut, maka permasalahan dalam penelitian ini dirumuskan sebagai berikut: (1) Bagaimana fungsi, tujuan dan kedudukan Dewan Perwakilan Daerah dalam memberikan pertimbangan dan pembahasan atas RAPBN? (2) Bagaimana pengawasan eksternal yang dilakukan Dewan Perwakilan Daerah atas pelaksanaan APBN? Metode pendekatan yang digunakan dalam penelitian ini adalah yuridis normatif, yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka atau data sekunder. Hasil dari penelitian ini adalah: Dalam memberikan pertimbangan dan pembahasan RAPBN fungsi, tujuan, dan kedudukan DPD ialah fungsi DPD dianggap masih belum seimbang dengan fungsi DPR, Kewenangan DPD yang terbatas menunjukkan tujuan dari Dewan Perwakilan Daerah. Dewan Perwakilan Daerah dengan melakukan pengawasan terbatas yang mana hanya diatur di dalam konstitusi Undang-undang Dasar 1945.

Abstract

Abstact. Licensing in Indonesia is one aspect of the law as part of state administrative decisions. Licensing as a part of state administrative decisions has several characteristics and positions, these characteristics and positions are related to state administrative decisions. The nature and position of permits can be seen in several sources of formal law in Indonesia, and compared with the nature and position contained in state administrative decisions in determining whether or not a permit is legal as a product of state administrative decisions. The approach method used in this paper is normative juridical, using a central study approach. This method is based on primary and secondary legal materials that refer to legal norms and rules contained in the applicable laws and regulations, and adapts tertiary legal materials to complement existing primary and secondary data. Permits as a product of state administrative decisions have a final binding nature. The final nature of the commercial license or operational permit is not fulfilled, because after the permit is issued it does not yet have binding legal force. The position of a commercial permit or operational permit as a product of a state administrative decision can be canceled or declared null and void. Abstrak. Perizinan di Indonesia merupakan salah satu aspek dari hukum sebagai bagian dari keputusan tata usaha negara. Perizinan sebagai salah satu bagian dari keputusan tata usaha negara memiliki beberapa sifat serta kedudukan, sifat serta kedudukan tersebut berkaitan dengan keputusan tata usaha negara. Sifat serta kedudukan izin dapat dilihat dalam beberapa sumber hukum formil di Indonesia, dan dikomparasikan dengan sifat serta kedudukan yang termuat dalam keputusan tata usaha negara dalam menentukan sah atau tidaknya suatu izin sebagai produk dari keputusan tata usaha negara. Metode pendekatan yang digunakan di tulisan ini adalah yuridis normatif, dengan menggunakan metode pendekatan studi pusataka. Metode ini didasarkan pada bahan hukum primer dan sekunder yang mengacu pada norma serta kaidah hukum yang terdapat dalam peraturan perundang-undangan yang berlaku, serta mengadaptasi bahan hukum tersier guna melengkapi data primer dan sekunder yang telah ada. Izin sebagai produk keputusan tata usaha negara memiliki sifat final yang mengikatnya. Sifat final dalam izin komersial atau izin operasional tidak terpenuhi, karena setelah izin tersebut diterbitkan belum memiliki kekuatan hukum mengikat. Kedudukan izin komersial atau izin operasional sebagai produk keputusan tata usaha negara yaitu dapat dibatalkan atau dinyatakan batal.

Abstract

AbstractCompensation is a method that can be used in consumer protection from defective product that produce by producer. Therefore, this paper explore compensation with it form as consumer protection. Juridis normative with descriptive analytis aprroach is research method that use in this paper. The producer have liability to give compensation to consumer that used defective product, with to percieve calculated concret and/or past loss, and also to consider the consumer obligation as the right of producer have been done, it form can be money because the simplicity term.Key words: compensation, protection, consumer, producer, defective productAbstrakGanti rugi merupakan sarana yang dapat digunakan untuk memberikan perlindungan bagi konsumen terhadap produk cacat yang diproduksi oleh pelaku usaha. Oleh sebab itu, tulisan ini mengkaji mengenai ganti rugi serta bentuknya akibat produk cacat sebagai upaya perlindungan bagi konsumen. Pendekatan normatif yuridis dengan deskriptif analitis merupakan metode penelitian yang digunakan dalam tulisan ini. Produsen mempunyai tanggung jawab untuk memberikan ganti rugi kepada konsumen, akibat menggunakan atau mengonsumsi produk cacat, dengan memperhatikan kerugian nyata dan yang dapat diduga, dan mempertimbangkan kewajiban konsumen yang menjadi hak produsen telah dilaksanakan. Abstract

The journey of life of the Messenger of Allah influences and forms the Shari’a. Ethnography in the Arabian peninsula (especially Mecca and Medina) influenced the development of Islam in the time of the Prophet, especially Mecca with trade culture and Medina culture agriculture.The Shari'a is influenced by the ethnographic situation in the Arabian peninsula, especially in the holy cities of the Islamic Community, namely Mecca and Medina. Ethnography can influence the development of Islam in the time of the Prophet, especially the Mecca that developed form exchanges of information by traders while the Islamic Medina developed from areas that were culturally derived from agricultural societies. The uniqueness of ethnography and his life’s journey refer to tashri (sharia) in terms of interpretation. Ethnography also influences the growth and development of Islam in Indonesia, which makes Islam acculturate with local culture.This paper is put forward as an effort to show the sirah nabawiyah (the journey of the Prophet's life) as one aspect of sharia formation, influenced by various factors in the spread, growth and development both in the Mecca and Madinah regions, as centers of Islamic teachings and Indonesia which has social differences , cultural, political and economic. The method put forward in this paper is the historical method, with the specification of a library research approach that refers to primary and secondary sources.Ethnography is one of the factors that can influence religious teachings to spread, grow and develop, a reality that also takes place on Islamic teachings. The teachings are influenced by the conditions of Mecca and Medina in shaping the law (tasyr’i). The teachings of Islam in Indonesia are spread and developed and grow sourced from the commercial activities carried out by the Arabian Peninsula in the 7th century AD, but trade does not dwarf the agricultural community that simultaneously embraces Islam, which at the same time also the community of agricultural communities trade with the spreaders of Islam in the Coast region.Keywords: Ethnography, Indonesia, Nabawiyyah, Sirah, Tasyri'

Abstract

Abstract The village head is the head of village government administration who has authority. Regulation of the village head's authority in managing village funds in goods/services procurement activities is regulated in the Regulation of the Goods and Services Procurement Policy Institute Number 12 of 2019 concerning Guidelines for Procedures for Procurement of Goods and Services in Villages. This regulation aims to ensure that village heads can implement their authority and avoid abuse of authority. The cause of the vulnerability to misuse is a lack of understanding of village budget management, so that village heads and village officials arbitrarily use village funds for personal interests. In order to avoid various forms of abuse of authority, the parties involved in the procurement of goods/services in the village, namely the Village Head, Section Head (Kasi) / Head of Affairs (Kaur), Activity Implementation Team (TPK), Providers and also the Community must cooperate with each other. work together and know their duties, functions and authority so that the process of implementing the procurement of goods/services sourced from village funds is in accordance with good governance. Abstrak Kepala desa merupakan kepala penyelenggaraan pemerintahan desa yang mempunyai wewenang. Pengaturan wewenang kepala desa dalam pengelolaan dana desa pada kegiatan pengadaan barang/jasa di atur dalam Peraturan Lembaga Kebijakan Pengadaan Barang dan Jasa Nomor 12 Tahun 2019 tentang Pedoman Tata Cara Pengadaan Barang dan Jasa di Desa. Peraturan ini bertujuan agar kepala desa dapat mengimplementasikan wewenangnya dan terhindar dari penyalahgunaan wewenang. Penyebab rentannya terjadi penyalahgunaan adalah kurangnya pemahaman terhadap pengelolaan anggaran desa, sehingga kepala desa dan perangkat desa sewenang-wenang menggunakan dana desa untuk kepentingan pribadi. Agar terhindar dari berbagai bentuk penyalahgunaan wewenang, Pihak-pihak yang terlibat di dalam pengadaan barang/jasa di desa yaitu Kepala Desa, Kepala Seksi (Kasi) /Kepala Urusan (Kaur), Tim Pelaksana Kegiatan (TPK), Penyedia dan juga Masyarakat harus saling bekerja-sama dan mengetahui tugas,fungsi dan wewenangnya agar proses pelaksanaan pengadaan barang/jasa yang bersumber dari dana desa tersebut sesuai dengan tata kelola pemerintahan yang baik. Abstract

Abstrak- Wilayah pesisir pantai merupakan wilayah yang rentan terhadap perubahan, baik perubahan tersebut yang disebabkan oleh alam itu sendiri maupun oleh perbuatan manusia, oleh sebab itu wilayah pesisir perlu dilindungi agar tidak dicemari oleh orang yang tidak bertanggung jawab. Kabupaten Pangadaran merupakan salah satu Kabupaten di Indonesia yang memiliki banyak kawasan pantai karena Kabupaten Pangandaran terletak di wilayah pesisir pantai selatan Jawa Barat, salah satu pantai di Kabupaten Pangandaran adalah Pantai Batukaras dan pada kenyataanya terdapat beberapa bangunan yang berdiri di wilayah pesisir pantai dan dalam skripsi ini mencoba melihat fenomena tersebut menggunakan Undang-Undang No. 1 Tahun 2014 Tentang Pengelolaan Wilayah Pesisir dan Pulau-Pulau Kecil yang dihubungkan dengan Kearifan Lokal. Hasil penelitian ini menunjukan bahwa Undang-Undang No.1 Tahun 2014 tetap mengakui dan menghormati masyakat hukum adat yang bermukim di wilayah pesisir pantai dan memberikan wewenang sepenuhnya kepada masyarakat adat di Desa Batukaras dalam pemanfaatan wilayah pesisir dan pulau-pulau kecil. Dari sisi Pemerintah Kabupaten Pangandaran kurang memberikan sosialisasi terhadap masyarakat yang membangun di wilaya pesisir pantai. Dan di sisi masyarakat harus sadar bahwa mendirikan bangunan di wilayah pesisir pantai sangat berbahaya bagi keselematan dan dapat merusak lingkungan di wilayah pesisir pantai. Penelitian ini menggunakan metode penelitian hukum empiris dengan menggunakan pendekatan deskriptif kualitatif. Sumber data yang digunakan adalah sumber primer dan sekunder. Metode pengumpulan data dengan teknik wawancara dengan beberapa orang yang dianggap relevan dalam penelitian ini, dokumentasi, dan observasi langsung. Metode analisis data yang digunakan pada penelitianini menggunakan analisis deskriptif kualitatif. Abstract- Coastal areas are areas that are vulnerable to change, both those changes caused by nature itself and by human actions, therefore coastal areas need to be protected so as not to be polluted by irresponsible people. Pangadaran Regency is one of the regencies in Indonesia that has many coastal areas because Pangandaran Regency is located in the southern coastal area of West Java, one of the beaches in Pangandaran Regency is Batukaras Beach and in fact there are several buildings that stand in the coastal area and in this thesis try to see the phenomenon using Law No. 1 of 2014 concerning the Management of Coastal Areas and Small Islands associated with Local Wisdom. The results of this study show that Law No. 1 of 2014 still recognizes and respects customary law communities living in coastal areas and gives full authority to indigenous peoples in Batukaras Village in the use of coastal areas and small islands. From the side of the Pangandaran Regency Government, it does not provide socialization to people who build in coastal areas. And on the community side, they must be aware that erecting buildings in coastal areas is very dangerous for safety and can damage the environment in coastal areas. This research uses empirical legal research methods using a qualitative descriptive approach. The data sources used are primary and secondary sources. Data collection methods with interview techniques with several people considered relevant in this study, documentation, and direct observation. The data analysis method used in this study uses qualitative descriptive analysis.

Abstract

Abstract. Waste is a hazardous liquid that is disposed of in a certain place that can damage the environment around waste, contains pollutants that are toxic and dangerous. This waste is known as B3 (Hazardous and Toxic Materials) waste. This material is formulated as a relatively small amount of material but has the potential to pollute / damage the living environment and resources. As waste, its presence is quite worrying, especially those sourced from industry. For this reason, a correct process is needed to process waste so that it is not harmful to the environment. Industrial factories should also have permits that have been set by the government so that they always obey and comply with existing regulations. To facilitate processing and monitoring, waste treatment requires sophisticated control equipment in the form of a programmable logic controller (PLC). The method of approach to this research uses normative juridical, namely by researching secondary literature materials/data. The specification of this study uses a descriptive analysis method, namely describing legislation with legal theories. The data collection technique uses document studies and field research. Research Data Collection is carried out by searching and collecting data both from legislation, literature, interviews, and related to the problem being researched. Data Processing Through data that has been obtained and collected from literature or books, interview results and information related to the right to a healthy environment for the community Abstrak. Limbah adalah cairan berbahaya yang di buang pada suatu tempat tertentu yang dapat merusak lingkungan sekitar limbah mengandung bahan pencemar yang bersifat racun dan bahaya. Limbah ini dikenal dengan limbah B3 (Bahan Berbahaya dan Beracun). Bahan ini dirumuskan sebagai bahan dalam jumlah relatif sedikit tapi mempunyai potensi mecemari /merusak lingkungan kehidupan dan sumber daya. Sebagai limbah kehadirannya cukup mengkhawatirkan terutama yang bersumber dari industri. Untuk itu diperlukan suatu proses yang benar untuk mengolah limbah agar tidak berbahaya bagi lingkungan. Pabrik industri pun seharusnya memiliki perizinan yang telah ditetapkan oleh pemerintahan agar selalu menaati dan mematuhi peratiran yang ada. Untuk mempermudah pengolahan dan monitoring, pengolahan limbah diperlukan alat pengontrol yang canggih berupa programmable logic controller (PLC). Metode pendekatan penelitian ini menggunakan yuridis normatif yaitu dengan meneliti bahan pustaka/data sekunder. Spesifikasi penelitian ini menggunakan metode deskritif analisis yaitu menggambarkan perundang-undangan dengan teori-teori hukum. Teknik pengumpulan data menggunakan studi dokumen dan penelitian lapangan. Pengumpulan Data Penelitian dilakukan dengan cara mencari dan mengumpulkan data baik dari perundang-undangan, literatur, wawancara, maupun yang berkaitan dengan masalah yang diteliti. Pengolahan Data Melalui data yang telah diperoleh dan dikumpulkan dari literatur atau buku-buku, hasil wawancara dan keterangan-keterangan yang berkaitan dengan hak atas lingkungan hidup yang sehat bagi masyarakat.

Bullying, a form of aggressive behavior characterized by intentional repetitive damage, has become a common problem in schools around the world. Its detrimental effects on victims' social-emotional well-being, academic achievement, and overall health have raised concerns among educators, parents, and policymakers. To effectively address these issues, it is imperative to implement preventive measures and create a safe and inclusive learning environment. This article uses normative juridical writing methods, with secondary data materials with primary data, secondary data and tertiary data, analyzed using analytical descriptive methods. Legal education has an important role in efforts to prevent bullying behavior at SMK Bani Mahfud and other schools. Through legal education, students can gain a better understanding of their rights and responsibilities as individuals. They can learn about the laws and regulations in place to protect them from bullying and how to take action if they become victims.
