Abstract

AbstractThis article aims to assert that some regulatory mechanisms, such as the appointment of members of and the voting for decision in both Indonesia Peoples Deliberative Assembly (MPR) and village flows in a formalizing pattern from the top governmental body of the central, to the regional, and to the ends at the boom level, the village. This also applies the procedural aspects of the democratic system where the organizational body is made as formal, uniform, and permanent in structure (despite the periods). This somehow seems contradictory with the noon of deliberative democracy (demorasi permusyawaratan) once upheld by the founding fathers of Indonesia. However, the vague understanding surrounding the noon of deliberative democracy necessitates a closer study for a more comprehensive overview, which should also be conducted for beer comprehension on the concept of democracy adopted by the MPR. This article serves only as a preliminary study to prelude a more in-depth study. The derivation of legal policy in this article has the purpose of identifying the political direction towards which the village democracy was taken. This article highlights a paradigmatic shift in the legal policy change of the democratic pattern from the village to the MPR, then later from the MPR to the village.Arus Balik Polik Hukum Gagasan Demokrasi Permusyawaratan dari Majelis Permusyawaratan Rakyat ke Pemerintahan Desa (Suatu Kajian Awal)AbstrakPada tulisan ini hendak dikemukakan pengaturan, misalnya mengenai pengambilan keanggotaan dan putusan, serta kelembagaan desa, menamakan pola imitasi dari kelembagaan di pusat, daerah, maupun desa begitu pula mengenai tata cara kehiduan berdemokrasi dari kelembagaan demokrasi, badan representasinya dibuat secara formal, seragam, dan permanen walaupun terdapat periodisasi. Hal ini tampak kontradif dengan konsep demorasi permusyawaratan yang diusung oleh para founding fathers ketika Indonesia berdiri. Namun demikian, pemahaman mengenai demokrasi permusyawaratan itu sendiri masih harus digali agar lebih tergambar secara komrehensif begitu pula mengenai konsep berdemokrasi dalam kelembagaan. Tulisan ini merupakan kajian awal sebagai pengantar untuk kajian yang lebih mendalam. Alasan hal ini ditarik sebagai sebuah politik hukum adalah untuk melihat apabila terdapat desain arah kebijakan terhadap entitas desa untuk dapat melaksanakan kehiduan demokrasi. Abstract

Kewajiban negara terhadap hak asasi manusia akan terlaksana dan menguat jika daerah turut berperan, sebab secara substansi berbagai isu hak asasi manusia melekat dalam urusan pemerintahan daerah baik yang bersifat wajib maupun pilihan. Demikian pula dengan komitmen pemerintah terhadap tujuan pembangunan berkelanjutan, salah satunya adalah menjadikan pemerintah daerah khususnya desa dengan segala karakter dan potensi yang dimilikinya menjadi subjek pembangunan. Dalam rangka pengarusutamaan HAM dalam pembangunan hingga ke daerah, Kementerian Hukum dan Hak Asasi Manusia membentuk Peraturan Menteri tentang Kriteria Kabupaten/Kota Peduli HAM yang telah diperbaharui beberapa kali. Jika kriteria ini akan diterapkan untuk desa, maka diperlukan penyesuaian. Artikel ini merumuskan model kriteria desa peduli HAM untuk Jawa Barat. Beberapa penyesuaian dilakukan khususnya pada aspek kewenangan dan konteks sesuai dengan karakter desa. Model kriteria yang dihasilkan tidak diorientasikan untuk kompetisi, namun sebagai pedoman untuk menyusun tahapan-tahapan disertai evaluasi berkala. Model of Guidelines on Human Right Village in the Context of West Java Abstract The states obligations on human rights will be implemented and strengthened if the local government play a role, because substantially some human rights issues are inherent in the affairs of local government, which are distributed both ini obligatory and voluntary affairs. Similarly, the governments commitment to the goal of sustainable development, one of which is to make the local government, especially the village with all the characters and potentials it has become the subject of development. Emphasizing to the human rights mainstream, the Ministry of Law and Human Rights has established a Ministerial Regulation on the criteria of human rights city, that has been renewed several times. If these criteria will be applied to the village, adjustments are required. This article formulates a model of criteria for human rights villages for West Java. Some adjustments are made especially on the aspect of authority and context in accordance with the village character. The resulting criteria model is not oriented to competition, but as a guide for arranging the stages with periodic evaluations.DOI: https://doi.org/10.22304/pjih.v4n3.a4

Abstract

The rulings of the constitutional court to review the Act No. 7 of 2004 on Management of Water Resources, Act No. 22 of 2001 on Crude Oil and Natural Gas, Act No. 20 of 2002 on Electricity caused controversy. These decisions gives a different interpretation of Article 33 of the Constitution of 1945, which likely have implications for Indonesia’s economic development policy. Branches of production which is important for the livelihoods of people and natural resources, is placed in the area of public law rather  than private. The consequences are arranged by state control rights as a collective representation of Indonesian society. Thus, the form that allows management of a joint is through cooperatives and the state delegation of the management of public goods to the non-state (cooperative), can only  be done with the instrument of one-sided legal action.

Abstract

Particular problem in judicial review frequently found is there a contradiction between the subsidiary legislation and the constitution. Unfortunately, in several Supreme Court verdict on judicial review, there is no usage of constitutional interpretation on their legal reasoning. However within domain of Supreme Court authority, constitution is not the touchstone, but constitution perspective must be included to maintain consistency of legislation hierarchy. There are two reasons on that posibilities, first the approximation of constitutional review by the court and second, the consequences of Indonesian’s legal system that implementing legislation hierarchy. Responsibility as the guardian of constitution not only applied on Constitutional Court, but on all the state institutions including every citizen. In the context of guarding consistency of legislation hierarchy, Supreme Court might also develop constitutional interpretation in order to ensure conformity regulations that is examined to the constitution. In addition, meaning of the constitution can be developed by a judge that can be found in accordance with contextuality. The perspective is assessed to highlight more detailed the mapping of the use of constitutional interpretation on Judicial Review in supreme court post amandment of Constitution of Republic Indonesia 1945. This article formulatesthe notion of constitutional interpretation on Judicial Review. Within this concept, will be prepared by the use of mapping of constitutional interpretation on Judicial Review in supreme court post amandment of Constitution of Republic Indonesia 1945. Thus this research was intended to make the judge use constitutional interpretation. Of course if the recommendations are applied, it can be achieved not instantly in a short time. With the use of Constitutional interpretation on Judicial review in supreme court, the constitutionallity can be reflected later on legislation hierarchy as a whole legal system.

Abstract

AbstractA by-law as a product of local government is valuable as a legal instrument in implementing the duty to regulate and to administer local affairs. Contemporary, the regulation regarding supervision on by-law points a dynamic and controversial respond. The indication has appeared since the competence of the central government to nullify by-law is repealed through the Constitutional Court Verdict. Government reaction on this Verdict indicates a disharmony, due to some ventures to control local government forwards to tight, for which several other legal instruments are issued. This study aims to find a developed notion of supervision on a by-law to enhance the purpose of devolution. In doing so, a lesson learned from New Zealand will be taken into account following the gap found in the legal position of Indonesia. The research finding shows that a trend of regulation on supervision in New Zealand reflects a transitional relationship between central government from hierarchical to a partnership, through empowerment. In contrast, the legal position in Indonesia addresses to a discouragement or distrust mindset. For this reason, the what can fulfil the gap as a lesson learned from New Zealand is by emerging a unique consultative process to the public both in by-law making, repealing, amending, and or reviewing.Keywords: comparative; local government; supervisionAbstrakAnggaran rumah tangga sebagai produk pemerintah daerah berharga sebagai instrumen hukum dalam melaksanakan tugas untuk mengatur dan mengelola urusan lokal. Indikasi ini muncul sejak kompetensi pemerintah pusat untuk membatalkan anggaran rumah tangga dicabut melalui Putusan Mahkamah Konstitusi. Reaksi pemerintah atas Putusan ini menunjukkan ketidakharmonisan, karena beberapa usaha untuk mengen-dalikan pemerintah daerah ke depan dengan ketat, yang mana beberapa instrumen hukum lainnya dikeluarkan. Penelitian ini bertujuan untuk menemukan gagasan yang dikembangkan tentang pengawasan terhadap anggaran rumah tangga untuk meningkatkan tujuan devolusi. Dengan melakukan hal tersebut, pelajaran yang dipetik dari Selandia Baru akan diperhitungkan menyusul kesenjangan yang ditemukan dalam posisi hukum Indonesia. Temuan penelitian menunjukkan bahwa tren regulasi tentang pengawasan di Selandia Baru mencerminkan hubungan transisi antara pemerintah pusat dari hirarki ke kemitraan, melalui pemberdayaan. Sebaliknya, posisi hukum di Indonesia mengarah pada keputusasaan atau pola pikir ketidakpercayaan. Untuk alasan ini, apa yang dapat memenuhi kesenjangan sebagai pelajaran yang dipetik dari Selandia Baru adalah dengan memunculkan proses konsultatif yang unik kepada publik baik dalam pembuatan by-law, pencabutan, amandemen, dan atau peninjauan.Kata kunci: komparatif; pemerintah lokal; pengawasan

Abstract

Basically, the Aceh Special Autonomy Fund policy is to provide wider authority for local governments and the people of Aceh to regulate and take care of themselves within the framework of the Republic of Indonesia. This broader authority also includes the authority to regulate the use of natural resources in the Aceh Province area, as much as possible for the prosperity of the Acehnese people, empowering their economic, social, and cultural potential, including providing a significant role for the indigenous people of Aceh to be involved in the process of formulating regional policies, determining development strategies while still respecting the equality and diversity of people's lives in the Province Aceh. Therefore, the author reviews the relationship between central and regional authorities in the Republic of Indonesia with the regions, especially Aceh in the Special Autonomy Law with qualitative methods and through understanding the concept of decentralization. The results clearly show that, however, the implementation of the Special Autonomy Fund in Aceh is different from what is described in autonomy as stated in the law. In fact, in the field, so far, the central government's assistance, coaching and supervision have not been seen.

Abstract

Human rights law encourages the implementation of state obligations by enacting policies that remove accessibility barriers for persons with disabilities, including a guaranteed access to information. Unfortunately, attention and efforts to facilitate the accessibility of people with deaf disabilities are insufficient, especially regarding religious information. The West Java Islamic Da’wah Center (Pusat Dakwah Islam/Pusdai), as one of the social service units within the local government, barely has a systematic policy basis to facilitate access to religious information, particularly for the “Friday Sermon” for persons with Hard of Hearing (HOH). This article identifies that human rights law can be the underlying basis for the fulfilment of visual communication for persons with HOH. This article discusses a visual design construction that may facilitate communication barriers for deaf-disabled persons in accessing religious information in Pusdai. By employing a socio-legal approach, including visual communication design lens, this study finds a gap in the visual information availability and facility for people with HOH. This study contends that visualization, in the form of moving and static signs, is necessary to facilitate the convenience of persons with HOH and it is seen as an effort to realize inclusive religious services. Such a measure needs to be incorporated into the National Action Plan on Human Rights (RANHAM) in West Java Province.

Abstract

West Java Province affects a Tourism Provincial Regional Regulation (Perda) of 2008.  Recently, the respected Perda remains down to date both in the regulatory reasoning and normative structure. Such a lacuna is due to the issuance of Tourism Law No. 10 of 2009, in which expression the philosophical base acknowledges tourism activities as a part of human rights. This is coupled with various renewals of the National Action Plan for Human Rights (RANHAM), Indonesia's commitment to the Sustainable Development Goals, and the New Urban Agenda 2016. All of those sharpen efforts to localize human rights through various sectors of development and community services. This study aims to identify the frameworks for the renewal of the respected Perda. Through the study of legal materials, documents, secondary data in, namely, “Neraca Satelit Pariwisata Jawa Barat 2019-2020”, this paper emphasizes the juridical, philosophical, and sociological reasonings on the need for the renewal of the Perda. These perspectives lead to the highlight of vulnerable groups as part of the inclusion of fulfilling socio-economic rights. Not only being the centre of attention for economic and cultural activities, but it is also time for a human rights perspective to be inseparable from the tourism sector. Provinsi Jawa Barat (Jabar) telah memberlakukan Peraturan Daerah (Perda) yang mengatur kepariwisataan sejak tahun 2008. Dengan berbagai perkembangan, Perda tersebut nampaknya menyisakan kesenjangan baik dari landasan-landasan pengaturannya maupun sistematisasi penormaan. Kesenjangan tersebut terjadi sejak keluarnya Undang-Undang Nomor 10 Tahun 2009 tentang Kepariwisataan yang di antara politik hukumnya sekaligus sebagai landasan filosofis adalah menempatkan wisata sebagai bagian dari hak asasi manusia. Hal itu ditambah dengan berbagai pembaharuan Rencana Aksi Nasional Hak Asasi Manusia (RANHAM), komitmen Indonesia sebagai salah satu negara yang turut menargetkan Agenda 2030 Tujuan Pembangunan Berkelanjutan, disertai dengan Agenda Baru Perkotaan yang dideklarasikan tahun 2016. Kesemuanya menajamkan upaya melokalkan HAM melalui berbagai sektor pembangunan dan pelayanan masyarakat. Dalam kajian ini hendak diidentifikasi bagaimana  pokok-pokok kerangka pemikiran dapat ditawarkan untuk pembaruan Perda Jabar yang dapat direkomendasikan. Melalui studi bahan-bahan hukum dan berbagai dokumen, termasuk data sekunder berupa Neraca Satelit Pariwisata Jabar Barat 2019-2020, tulisan ini menggarisbawahi landasan-landasan yuridis, fislosofis, dan sosiologis sebagai alasan kebutuhan pembaharuan Perda tersebut. Kesemua persepektif tersebut mengarah pada perhatian terhadap titik berat kelompok rentan sebagai bagian dari inklusifitas pemenuhan hak-hak ekonomi, sosial, dan budaya. Tidak hanya menjadi pusat perhatian kegiatan ekonomi dan kebudayaan, sudah saatnya perspektif HAM tidak terpisahkan dari sektor wisata.

Abstract

Artikel ini mengajukan pola fast-track legislation dalam pembentukan Peraturan Daerah tentang Pembubaran Bank berbentuk BUMD yang dalam tahap likuidasi oleh LPS. Persoalan yang dikaji dalam artikel ini adalah karena adanya prinsip otonomi daerah bagi Pemerintah Daerah dalam pelayanan publik berupa pembentukan dan pembubaran bank BUMD pada satu sisi, namun pada sisi lain LPS yang berwenang melakukan likuidasi tidak dapat menunggu lama proses pembentukan Perda secara reguler karena dapat menggangu prinsip prediktabilitas dan kepastian hukum penyelesaian likuidasi bank. Artikel ini beragumen bahwa pola fast-track legislation dapat menjadi jalan tengah dua rezim hukum yang berbeda yakni hukum perbankan bagi LPS dan rezim hukum pemerintahan daerah bagi pemerintah daerah itu sendiri. Pola fast-track legislation itekankan pada perencanaan kumulatif terbuka, tidak perlunya Naskah Akademik, penyederhanaan dan percepatan waktu pembahasan maupun penetapan, pengesahan dan pengundangan.
