Abstract

This study aims to determine the determination of position formations Land Deed Officer (PPAT) in Tanggamus and factors penghambat- his. Determination of position formations PPAT in Tanggamus yet by 3 (three) factors according Permeneg formulation Agrarian / BPN No. 4 of 1999 on the Implementation of the Provisions of Government Regulation No. 37 of 1998 on Regulation of Land Deed Officer Position. In determining the amount of formation of PPAT in a district / city to be seen from the number of districts, the number of registrations and the number of registration of transfer of rights encumbrance. Abstract

This study aims to determine: setting the status of the land in order to establish the village, the authority of local government in the formation of the village, the significance of soil status the establishment of a village, and the policy of the Government of the Regency / City in Lampung province in the formation of the village related to land status. The analysis showed that the regency / municipal government has the authority to conduct the formation of the village which must be incorporated into regional regulation. Abstract

Problems in this activity are: 1) Lack of knowledge or information received by society about Law of Domestic Violence; 2) Lack of legal understanding of the community about the content of the Law on Domestic Violence; 3) There is still violence in the household, which is not discovered. Problem solving is done by means of legal communication. Legal communication is the process of conveying messages in accordance with the law that the contents of a rule of law, with the aim of creating mutual understanding or understanding of the law, resulting in either a change of mind, attitude and behavior of recipients, without any coercion from outside. The results of the activities showed an increase understanding and knowledge of citizens related to the rules / laws governing the elimination of domestic violence, which was originally to have knowledge of the value of 55.25, after the project is implemented have knowledge of the value of 74.75. This kind of activity needs to be done for the future, to continuously provide understanding and knowledge related to the rules of community life.

Abstract

The study aims at knowing the implementation of Pancasila values in national agrarian law, national agrarian law from political perspective and the construction of national agrarian law in the globalization era. The result of study shows that Pancasila has rooted deeply in Agrarian Law Number 5 Year 1960. Accordingly it can be potential tools to explain, anticipate and provide solution for any legal problems in agrarian law issues in Indonesia. The Agrarian Law Number 5 Year 1960 as responsive political product of law is able to fulfill demand of justice of the society in Indonesia. Abstract

The rise of corruption in Indonesia has caused losses to state finances. There were 1,261 cases of corruption from 2004 to 3 January 2022, with state losses in 2021 reaching IDR 62.9 trillion and in 2020 with a total loss of IDR 56.7 trillion. Seeing this phenomenon, researchers conducted research on whether public accountants can calculate state financial losses using a theory of authority approach with a normative research methodology. The study results show that there are practically no laws and regulations which state that a Public Accountant has the authority to calculate State Financial Losses unless assigned by the BPK and the Attorney General's Office. The authority to audit state finances can be carried out by several state institutions such as the BPKP, KPK and BPKP, but the authority to calculate state finances based on laws and regulations is still the authority of the Indonesian Financial Audit Agency (BPK RI).

Abstract

One of the objectives of transmigration is to move people from one area to another in the context of population distribution and development. Transmigration participants will be given residential land and business land. The promised land for business often needs to be clarified or still has the status of forest land. Transmigrants are still facing the problem of obtaining business land so horizontal and vertical land disputes are often found in the province of Lampung. This study aims: first, to analyze government policies in resolving land status disputes in transmigration villages in Lampung Province. The type of research used is normative empirical with a statutory approach. Legal materials required by legislation, documents, and library materials. The data obtained were analyzed using qualitative methods. The results of the study show that the Government's Policy in Settlement of Transmigration Village Land Status Disputes in Lampung Province, especially in the Purwotani village area which is included in Register 40 Gedongwani is carried out through a community empowerment program in the form of a social forestry program which is in line with Presidential Regulation 88 of 2017 concerning the Settlement of Land Tenure in Forest Areas. The legal implication is that transmigrants do not get land ownership rights as business land but only use forest land (social forestry). It is recommended to the government considering that transmigrants control land business first then the determination of the Gedongwani Register 40 forest area, the government should release the forest area by changing the forest area boundaries and give it to transmigrants with land ownership rights, and not limited to social forestry.

Abstract

The granting of Land Cultivation Rights (HGU) for up to 190 years in the Nusantara Capital City (IKN), as stipulated in Government Regulation No. 12 of 2023, raises fundamental legal and economic concerns. This policy is considered to deviate from the fundamental principles of the Basic Agrarian Law (UUPA), particularly regarding the social function of land, state control, and equitable access to agrarian resources. This study applies a normative juridical method with statutory, conceptual, and historical approaches, supported by qualitative-prescriptive analysis. It examines key legal frameworks including the UUPA, the IKN Law, the Investment Law, and their implementing regulations. The analysis is guided by the Theory of Justice (John Rawls), Economic Analysis of Law (Richard Posner), legal certainty, and statutory hierarchy principles. Findings reveal that the long-term HGU scheme risks undermining legal certainty, promoting land monopolization by private investors, and marginalizing local communities. Economically, the absence of periodic evaluation mechanisms may lead to inefficient land use and hinder inclusive, sustainable development. The study concludes that the HGU policy in IKN requires regulatory revision to ensure alignment with agrarian justice, legal predictability, and long-term national economic goals.

Abstract

The banking sector poses a serious threat to the integrity of the financial system and national development. Corruption cases at Bank Negara Indonesia (BNI) Tanjungkarang Branch showed abuse of authority, document manipulation, fictitious credit granting, and collusion between bank officials and debtors which caused state financial losses. This research aims to analyse criminal law enforcement against corruption in the provision of credit facilities with a case study at BNI Tanjungkarang. The method used is normative legal research with statutory and theoretical approaches, and qualitative prescriptive analysis. The results showed that law enforcement officials have carried out the law enforcement process through the stages of investigation, investigation, prosecution, and examination in court. The handling of this case reflects the seriousness of law enforcement in eradicating corruption in the state financial sector. This study concludes that the effectiveness of law enforcement requires clarity of legislation, solid inter-agency coordination, increased capacity of law enforcement officials, and strengthening the internal control system in the banking environment to prevent the recurrence of similar corrupt practices

Abstract

Pemekaran daerah merupakan salah satu wujud pelaksanaan otonomi daerah yang bertujuan untuk mendekatkan pelayanan publik, mempercepat pembangunan, serta meningkatkan kesejahteraan masyarakat. Dalam konteks ini, Dewan Perwakilan Rakyat Daerah (DPRD) memiliki peran strategis melalui kewenangannya dalam fungsi legislasi, pengawasan, dan penganggaran. Penelitian ini bertujuan untuk menganalisis peran dan kewenangan DPRD dalam dinamika pemekaran daerah, khususnya di Kabupaten Lampung Selatan, dengan menggunakan pendekatan yuridis normatif dan didukung oleh data yuridis empiris melalui studi kasus. Tujuan dari penelitian ini adalah untuk mengetahui Peran Dan Kewenangan DPRD dalam Proses Pemekaran daerah Menurut Ketentuan Peraturan Perundang-Undangan Tentang Otonomi Daerah. Hasil penelitian menunjukkan bahwa meskipun DPRD memiliki legitimasi formal dalam memberikan persetujuan usulan pemekaran, implementasi kewenangan tersebut seringkali terhambat oleh tarik-menarik kepentingan politik, keterbatasan regulasi teknis, dan kurangnya koordinasi dengan pemerintah pusat. Dari perspektif otonomi daerah, keterlibatan aktif dan akuntabel DPRD menjadi penting untuk menjamin bahwa proses pemekaran berjalan sesuai asas desentralisasi dan demokrasi lokal. Penelitian ini merekomendasikan penguatan kerangka hukum serta peningkatan kapasitas kelembagaan DPRD dalam merespons tuntutan pemekaran yang berbasis kebutuhan riil masyarakat

Abstract

Determining the level of business risk and imposing administrative sanctions are two important pillars in the regulatory framework for investment and business in Indonesia, including in Lampung Province. This policy, which is based on the Job Creation Law and its implementing regulations, aims to create a conducive business climate while ensuring compliance with legal norms. However, the implementation of this policy often faces crucial challenges in balancing the principles of justice and legal certainty. Justice demands that the treatment of business actors must be proportional, considering the capacity, intent, and impact of violations, and providing equal opportunities. Meanwhile, legal certainty requires clear, transparent, and predictable standards in the risk assessment and sanctioning process, so that business actors have a definite grip. This study aims to analyse in depth how the principles of justice and legal certainty are internalized and implemented in the regulations and practices of determining the level of business risk and imposing administrative sanctions in Lampung Province. The normative legal research method with a conceptual and legislative approach is used to examine relevant laws and regulations and policy documents. In addition, an empirical approach through interviews with relevant stakeholders (local governments, business actors, and academics) will enrich the analysis with a practical perspective. The results of the study are expected to identify potential disharmony between the two principles, formulate an ideal model for determining risk and imposing more balanced sanctions, and provide policy recommendations to improve the effectiveness and legitimacy of the regulatory system in Lampung Province, in order to support sustainable economic growth based on justice and the supremacy of law
