Abstract

The type of crime that can be applied to the offender's offender is regulated in Article 71 of the Child Criminal Justice System Act, namely principal and additional criminal penalties. The principal crimes consist of criminal warnings, criminal conditions (coaching outside the institution, community service; or supervision), job training, coaching in institutions, and prisons. Additional penalties consist of: Deprivation of profits obtained from criminal acts or fulfillment of customary obligations . This is intended to provide an opportunity for the judge to choose which criminal is suitable for the child in the case he is handling. In practice, judges do not always impose criminal offenses similar to the types of criminal acts listed in the material criminal law in accordance with the article which are violated by the offender's offender, even the judge is not bound by the prosecutor's demands. The judge has the freedom to impose a criminal in accordance with his conscience. In addition to being influenced by juridical considerations, judges' decisions are also non-judicial considerations, namely the sociological, psychological, ethical, and historical aspects of the child.

Abstract

Narcotics and psychotropic actually only use for the treatment and the development of science, however, lately often misused is not used as intended. Law enforcement again t drug abuse by law enforcement officers are police officers as the spearhead of the criminal justice system, attorney, and court. Law enforcement against drug abuse is done by a variety of efforts such as : pre emtif efforts, preventive efforts, the efforts made by check urine and rasia-rasia, and efforts refresif. That is done the againts drug abuse experiencing barriers are :lack of budget from the Government to conduct operations in the control and prevention of drug abuse, lact of infrastructure, the limited number of vehicles that can be used for operational, weak human resources owned by Police, both in terms of number, of psychic ability, lack of coordination and integration between the agencies involved in drug law enforcement process. As well as criminal chargers and the verdict is too light.

Abstract

The spread of Corona Virus Disease 2019 (COVID-19) in Indonesia, is used by irresponsible people to spread fake news (hoaxes) that can disturb the public. The ITE Law in it has regulated the crime of hoaxes, the perpetrators can be subject to criminal sanctions, however, the sanctions in the ITE Law do not prevent people from spreading false news through social media, many cases occur in the community regarding these crimes, but problems arise in proving the hoax crime case, where it is not the ITE Law that is used as the basis for convicting the perpetrator but using Article 14 of Law no. 1 of 1946, namely spreading false news conventionally without any element of electronic means, this is because the Criminal Procedure Code does not regulate digital evidence.

Abstract

Law is a social phenomenon that has various aspects and dimensions of the broad and diverse. Therefore, scientifically, we can study law from several points of view. Based on the purpose and characters, the science of law can be divided into two types, namely the Normative Jurisprudence and Empirical Jurisprudence. These two approaches to do dichotomy and opposed to each other, but rather complement each other as a connecting line.Hukum adalah gejala kemasyarakatan yang mempunyai berbagai aspek dan dimensi yang luas dan majemuk., karena itu, hukum secara ilmiah dapat dipelajari dari beberapa sudut pandang. Berdasarkan tujuan dan sifatnya, ilmu hukum dapat dibedakan ke dalam dua jenis, yakni Ilmu Hukum Normatif dan Ilmu-ilmu Hukum Empirik. Ke dua pendekatan ini jangan dikhotomikan dan dipertentangkan satu dengan  lainnya, melainkan  saling mengisi sebagai suatu garis menyambung

Abstract

Criminal acts of sexual abuse under Article 82 of Law Protection of children, also under Article 292 of the Criminal Code, as general criminal law where criminal threats 5 years imprisonment, against the actions of sufficient age, who do obscene acts with other people the same sex, which known or reasonably should be expected, that was not old enough. These acts of abuse against people want castrated using chemicals. This paper provides an alternative in criminal policy for perpetrators of sexual disorder which criminal act of abuse by using medic rehabilitation and social rehabilitation, in Psychiatric Hospital or Psychiatric Therapy, considering the criminal act of abuse committed by perpetrators of sexual disorders like people whose souls disturbed because of illness, so that Article 44 can apply to cases.

Abstract

Tindakan yang dilakukan oleh kepolisian dalam menangani kasus imigran ilegal yang tidak mempunyai dokumen perjalanan maka dapat dikenakan sanksi berdasarkan Pasal 119 ayat (1) Undang-Undang Nomor 6 Tahun 2011 Tentang Keimigrasian. Dari beberapa imigran dapat kita lihat adanya imigran ilegal yang tidak memiliki paspor dan dokumen, akan tetapi mereka tidak diproses berdasarkan peraturan perundangundangan yang berlaku, para imigran tersebut ditempatkan di ruang detensi imigrasi untuk di deportasi, dalam kajian asas territorial menjelaskan bahwa aturan pidana dalam perundang-undangan Indonesia berlaku bagi setiap orang yang melakukan perbuatan pidana di wilayah Negara Republik Indonesia. Rumusan permasalahan dalam penelitian ini yaitu: 1) Bagaimanakah Implementasi Kebijakan Hukum Di Indonesia Dalam Menangani Imigran Ilegal di indonesia? 2) Apa sajakah yang menjadi hambatan dalam Implementasi Kebijakan Hukum Di Indonesia Dalam Menangani Imigran Ilegal?. Penulis menggunakan pendekatan yuridis sosiologis. Metode ini digunakan dengan alasan bahwa dalam penelitian ini ditekankan pada ilmu hukum dan penelaahan kaidah - kaidah hukum yang berlaku dalam masyarakat yang berhubungan dengan penyalahgunaan izin  keimigrasian oleh imigran illegal. Kerjasama institusi Pemerintah dengan Polri dalam menangani imigran gelap bekerjasama dengan organisasi internasional IOM dan UNHCR juga tidak maksimal, karena pada waktu tertentu UNHCR tidak dapat selalu memberikan solusi. Salah satu usaha yang dilakukan oleh Pemerintah Indonesia adalah  dengan membangun banyak Rudenim Rumah Hunian (detensi) bagi para imigran gelap, namun hal ini bukan merupakan solusi yang tepat. Usaha ini sama saja dengan membuka kesempatan bagi para imigran gelap untuk lebih banyak lagi datang ke Indonesia karena terjamin tempat tinggalnya. Selain itu, membangun detensi juga akan banyak menghabiskan biaya.

Abstract

This study aims to determine the role of the government in providing legal protection to workers who have been laid off due to the COVID-19 pandemic. The impact of Covid 19 has shaken the Indonesian economy and of course the biggest impact is felt in industrial relations, both macro and micro. Many companies are threatened with the continuity of their production, which has an impact on the survival of our workers. Many have been laid off with wages not paid in full. To support the welfare and continuity of work for workers as well as to support workers who have been laid off due to Covid-19, the Government has issued variousincentives for employers and workers, namely in the form of cash assistance in the form of Wage Subsidy Assistance (BSU) and issuing pre-employment cards thataims to provide training, namely to provide skills that can be used for industrial and entrepreneurship needs.

Abstract

Kebijakan pembebasan warga binaan pemasyarakatan melalui asimilasi dalam upaya menekan laju penyebaran virus Covid-19 di Lapas oleh Pemerintah  menyisakan problematik di masyarakat. Masyarakat belum siap untuk menerima warga binaan. Masyarakat resah, was-was  terhadap keamanan di lingkungan tempat tinggal maupun di tempat umum, karena faktor ekonomi yang tidak jelas, dan pengangguran sehingga menjadi factor kriminogen. Over capacity Lapas tetap merupakan problematik social yang harus dicarikan solusinya, oleh karenanya perlu membuat pedoman pemidanaan yang ditujukan pada hakim. Pedoman pemidanaan tersebut misalnya hakim harus mengefektifkan pidana denda, tidak menjatuhkan pidana kurungan pengganti denda, mengefektifkan pidana bersyarat, restorative justice, dan sebagainya, atau melakukan pembaharuan hukum pidana dengan tujuan menghemat pidana penjara

Abstract

Pengawasan Klien Pemasyarakatan Pada Saat Asimilasi Selama Covid-19  oleh Bapas  dilaksanakan secara virtual online ataupun daring melalui telepon, video call, sms ataupun whatsapp, melalui aplikasi Siwasklija atau Sistem Pengawasan Klien Jarak Jauh  untuk melakukan pengecekan apakah klien bener-benar aman tidak melakukan tindakan yang buruk dan berada di rumah serta melakukan pengecekan apabila klien mengalami kesulitan, dalam implementasinya terdapat Kendala yaitu:  jumlah klien pemasyarakatan yang  mendapat integrasi sosial tidak sebanding dengan sumber daya manusia di Bapas, hal ini berpengaruh terhadap proses pembimbingan dan pengawasan yang dilakukan oleh pembimbing kemasyarakatan. faktor ekonomi berpengaruh terhadap kemampuan klien pemasyarakatan dalam kepemilikan gadget atau smartphone serta kurangnya pemahaman klien mengenai teknologi, dan minimnya data dukung klien pemasyarakatan seperti keakuratan nomor telepon klien  mengganti nomor telepon sehingga tidak bisa dihubungi balik, klien memanipulasi data yang sebenarnya. Sehingga dengan pengawasan yang hanya melalui daring ini dapat menghambat dalam  proses reintegrasi sosial.

Abstract

Besides having been ordered by God Almighty, the statesman leader was also not formed immediately. A statesman leader will always place professionalism and morals as the main standard. Leaders of statesmen whose policies depart from the collective interests of the people and minimize the domination of collegial interests originating from the group interested sts and encouragement. Leaders of statesmen never mathe ke empty promises. If you promise, the promithe se is a debt that will be accounted for vertically and horizontally. General elections are one of the vehicles for democracy as a manifestation of people's sovereignty. From the above expectations, we should be able to build a civilized democracy, a naresearchocracy that brings goodness and dignity and welfare to society (welfare state), far from SARA intrigues or identity politics. The role of the younger generation as the future leadership relay must be positioned, seated, and understood about future statesman leadersingle-spacedf 11-pointl parties is not only to produce a political leader but also to be able to produce a statesman leader.
