Abstract

ABSTRAK Kehadiran koordinasi manfaat atau yang kerap disingkat COB, dimaksudkan sebagai skema yang memungkinkan setiap orang yang telah lebih dulu memiliki jaminan sosial sebelum kepesertaan BPJS kesehatan diwajibkan, untuk memiliki jaminan sosial lebih dari satu. Oleh karenanya, skema COB harus menjadi solusi bagi penguatan pemenuhan hak asasi dibidang kesehatan. Akan tetapi dalam pelaksanaan, skema COB justru tidak mencerminkan penguatan pemenuhan hak asasi di bidang kesehatan dalam paham negara kesejahteraan. Permasalahan inilah yang hendak diteliti dengan mengajukan rumusan masalah apakah implementasi skema Koordinasi Manfaat dapat memperkuat jaminan pemenuhan hak asasi warga negara di bidang kesehatan? Dan agaimanakah seharusnya skema Koordinasi Manfaat (Coordination Of Benefit) yang dapat memberikan jaminan pemenuhan hak asasi dibidang kesehatan yang semakin baik. Penelitian menggunakan metode penelitian hukum normatif. Hasil penelitian menyimpulkan bahwa skema COB yang saat ini tersedia belum mampu menjadi jawaban bagi penguatan pemenuhan hak asasi dibidang kesehatan dalam paradigma negara kesejahteraan. Hal ini dikarenakan adanya keharusan mendahulukan penggunaan BPJS Kesehatan tanpa memberi ruang bagi pemilik jaminan sosial dalam memilih layanan kesehatan yang dapat akan digunakan. Oleh karena itu, skema COB kedepan harus diperbaiki dengan memperhatikan aspek penguatan hak dibidang Kesehatan, yang dalam UUD NRI 1945 diformulasikan sebagai hak asas manusia di satu sisi, dan kewajiban negara untuk menyediakan layanan dan fasilitas Kesehatan pada sisi yang lain.   ABSTRACT The presence of benefit coordination, or what is often abbreviated as COB, is intended as a scheme that allows everyone who already had social security before BPJS health participation was mandatory, to have more than one social security. Therefore, the COB scheme must be a solution to strengthen the fulfillment of human rights in the health sector. However, in implementation, the COB scheme does not reflect the strengthening of the fulfillment of human rights in the health sector within the welfare state understanding. This problem is what we want to examine by proposing a problem formulation: whether the implementation of the Benefits Coordination scheme can strengthen guarantees for the fulfillment of citizens' human rights in the health sector? And what should be the Coordination of Benefits scheme that can guarantee better fulfillment of human rights in the health sector? The research uses normative legal research methods. The results of the research conclude that the COB scheme currently available is not yet an answer to strengthening the fulfillment of human rights in the health sector within the welfare state paradigm. This is due to the need to prioritize the use of BPJS Health without providing space for social security owners in choosing which health services to use. Therefore, the COB scheme in the future must be improved by paying attention to aspects of strengthening rights in the health sector, which in the 1945 Constitution of the Republic of Indonesia are formulated as human rights on the one hand, and the state's obligation to provide health services and facilities on the other hand.

Abstract

AbstrakSalah satu terobosan dalam pelaksanaan tugas pokok kepolisian yang dilakukan oleh Kepolisian Resort Bau Bau adalah pemanfaatan kemajuan teknologi melalui aplikasi K Polisi. Dengan keberadaan aplikasi K Polisi, masyarakat dapat dengan mudah mengakses layanan kepolisian melalui fitur Tombo Darurat, E-Lapor, dan Surat kehilangan. Keberadaan aplikasi ini diharapkan dapat menungkatkan kualitas pelaksanaan tugas kepolisian. Peneltian ini dimaksudkan untuk meneliti dampak dari penggunakan aplikasi K Polisi terhadap penganggulangan kejahatan di wilayah hukum kepolisian resort Bau Bau pada tahun 2019. Untuk meneliti hal tersebut, penelitian menggunakan metode penelitian hukum empiris, sebagai salah satu jenis penelitian hukum yang menganalisis dan mengkaji bekerjanya hukum dalam masyarakat. Dari hasil penelitian, ditemukan bahwa terdapat korelasi berupa dampak penggunaan aplikasi K Polisi terhadap penurunan tingkat kejahatan di di wilayah hukum kepolisian resort Bau Bau pada tahun 2019 sebesar 16,9%, dibandingkan tahun sebelumnya. Adapun faktor penghambat belum efektifnya penggunaan aplikasi K Polisi di antaranya adalah adanya lebih dari satu aplikasi, masih lemahnya sosialisasi aplikasi K Polisi kepada masyarakat, adanya kendala dalam hal pendanaan, dan masih minimnya sarana dan prasarana penunjang bagi masyarakat dalam mengoperasionalkan aplikasi K Polisi.Kata Kunci: K Polisi, Pengaruh, Kejahatan, dan, Kepolisian Resort Bau Bau. AbstractOne of the breakthroughs in carrying out the main police duties carried out by the Bau Bau Resort Police is the use of technological advances through the K Polisi application. With the existence of the K Polisi application, public can easily access police services through the Emergency Tombo, E-Report, and Letter of Loss features. The existence of this application is expected to improve the quality of carrying out police duties. This research is intended to examine the impact of using the K Polisi application on crime prevention in the jurisdiction of the Bau Bau Resort police in 2019. For examination, this research uses empirical legal methods, as a type of legal research that analyzes and examines the operation of law in society. As the results of the study, it was found that there was a correlation in the form of the impact of using the K Polisi application on a decrease in crime rates in the jurisdiction of the Bau Bau Resort Police in 2019 by 16.9%, compared to the previous year. The inhibiting factors for the ineffective use of the K Polisi application include the existence of more than one application, the waek socialization of the K Polisi application to the community, there are constraints in terms of funding, and the lack of supporting facilities and infrastructure for the community in operating the K Polisi application.Keywords: K Polisi, Impact, Crime, and Bau Bau Resort Police.

Abstract

This article analyses and critiques the practice of qânûn in Aceh on guaranteeing women's freedom. Research data were collected from library research, including primary data obtained from scientific publications in journals, books, and proceedings on six qânûn documents in Aceh; secondary data consist of laws and regulations. The data were also gathered from interviews with Acehnese figures who were familiar with qânûn, Islamic law, and Acehnese customs. The analysis method refers to a descriptive-qualitative approach that combines doctrinal-normative and socio-legal analysis. The results show that all qânûn in Aceh are normatively valid legal products, as the Regional People's Representative Council ratifies them. However, their formulation and ratification reveal gender bias, as only 5% of female legislators have been involved, and in some regions, the percentage of female members remains at 0% until 2024. In its implementation, gender bias is also considered to be obvious, particularly in the application of caning punishment in public places, which gives social pressure on women, leaving women's interests not fully affirmed. The interviews with Acehnese figures suggest that qânûn is essentially a recognition of the synergy having existed since ancient times, when Aceh was still a kingdom where Islamic law and customary practices in Acehnese society placed women in policymaking roles.

Abstract

Abstract:The House of Representatives (DPR) is an embodiment of the provisions of Article 1 Paragraph (2) of the 1945 Constitution of the Republic of Indonesia. Sociologically, the existence of the DPR as people's representatives is a mandate from all Indonesian people that must be carried out. In Indonesian constitutional practice, the role of the DPR as a people's representative institution is manifested in the form of a faction, which is an extension of the political parties and DPR institutions. The faction was formed to optimize the functions, duties, and powers of the DPR. This study uses a qualitative research method with a statutory approach. The data recorded is the result of the author's research in the form of literature collection and interviews with several related parties. The results showed that the membership of political parties in the DPR towards the existence of the DPR as the implementer of the people's sovereignty did not show any connection between one another. The existence of political party membership and DPR membership are two different things that have no juridical relevance.Keyword: DPR, Political Party, General Election Abstrak:Dewan Perwakilan Rakyat (selanjutnya disebut DPR) merupakan lembaga perwakilan rakyat, yang merupakan perwujudan dari ketentuan Pasal 1 Ayat (2) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Secara sosiologis keberadaan DPR sebagai wakil rakyat merupakan amanat dari seluruh rakyat Indonesia yang harus dijalankan. Dalam praktek ketatanegaraan Indonesia, peran DPR sebagai lembaga perwakilan rakyat diwujudkan dalam bentuk fraksi, yang merupakan perpanjangan tangan partai politik dan lembaga DPR. Fraksi dibentuk dengan maksud untuk mengoptimalkan   fungsi, tugas, dan wewenang DPR. Penelitian ini menggunakan metode penelitian kualitatif dengan pendekatan peraturan perundang-undangan. Data yang didata merupakan hasil riset penulis dalam bentuk pengumpulan literature dan wawancara kepada beberapa pihak terkait. Hasil penelitian menunjukan bahwa keanggotaan partai politik di DPR terhadap eksistensi DPR sebagai pelaksana kedaulatan rakyat ternyata tidak menunjukkan adanya keterkaitan antara satu dengan yang lain. Adanya keanggotaan partai politik dan keanggotaan DPR merupakan dua hal berbeda yang tidak memiliki relevansi secara yuridis.Keyword: DPR, Partai Politik, Pemilu Аннотация:Палата представителей - это учреждение представителей народов, которое является реализацией положений в статьях 1 пункт (2) Конституции государства Республики Индонезии от 1945 года. Существование DPR в качестве представителя народа является социологически мандатом от всего народа Индонезии, который должен быть выполнен. В практике государственного управления в Индонезии, роль DPR как учреждения представителя народов проявляется в виде фракции, которая является продолжением политических партий и DPR. Фракция была сформирована с целью оптимизации функций, обязанностей и полномочий DPR. Данное исследование использует качественный метод с подходом нормативных актов. Полученные данные являются результатом исследования автора в виде сбора литературных материалов и интервью с несколькими связанными сторонами. Результаты исследования показали, что не существует какой-либо связи между членством в политической партии в DPR и наличием DPR как исполнителем суверенитета народов. Членство в политической партии и членство в DPR это две разные вещи, которые не имеют отношения к юридической стороне.Ключёвые Слова: DPR, Политическая Партия, Всеобщие Выборы

Abstract

Indonesia and South Korea are two countries that both use a presidential system. This indicates that the two countries have something in common, especially regarding presidential institutions. But if we dive deeper, there are also differences between the two countries. But if you dive deeper, there are also differences between the two countries. This research has two research questions. What is the similarity between the presidential system in Indonesia and South Korea, and what are the differences between them. The results of the study found that although both use the presidential system of government, such a thing does not guarantee the equality of the position of the presidential institution in each country. In constitutional practice, there are variants of similarities and differences.
