Abstract

Family law is a branch of law that regulates relationships and interactions between family members. Because underlying family law are a number of factors that reflect the complexity and diversity of societies as well as different cultural values throughout the world. This research aims to carry out an indepth analysis of certain aspects of family law, such as regulations on marriage, divorce, child custody or family inheritance. This analysis can include a study of legal developments, comparisons with other legal systems, and evaluation of the effectiveness of implementing regulations, then understanding how social changes and changes in values in society affect family law. The method used is bibliometric analysis with a systematic literature review approach, there are 72 documents originating from Scopus metadata. Family law publications have increased from year to year over a period of 20 years, in 2011 there were 39 publications regarding family law, then they fell again in line with little attention to aspects of family law, from 2015 to the peak in 2020 there were 77 publications which has been published. Factors that cause this are due to social change, technological progress, and the evolution of societal values, social change. Increased awareness of individual rights, especially the rights of women and children, has encourage interest in change and reform of family law and Globalization brings new ideas and cultural influences that can influence the way family law is viewed. Research findings may have limitations in terms of applicability or relevance if laws or policies change. Family law is subject to continuous change and adaptation, particularly in response to changes in society and values. Research may not always be able to capture or respond quickly to changes.

Abstract

The level of legal awareness and citizens' obedience to the law can show the progress of a country. The life of society and the country will be more orderly if the legal awareness and legal obedience of the population is higher. These factors of legal awareness and legal compliance play an important role in legal progress; The level of public legal awareness is negatively correlated with the level of legal compliance, and conversely, the level of public legal awareness is negatively correlated with the level of legal compliance. Public legal awareness will create an effective law enforcement environment, which can provide a sense of justice, create legal certainty in society, and provide justice. The aim of legal counseling is to increase public legal awareness through legal consultations, collaborating with local legal consultants, and disseminating information about law in Tebet District, South Jakarta City. Abstract

Upaya Pemerintah untuk menanggulangi kekerasan dalam rumah tangga adalah : dengan dikeluarkannya UU No. 23 Tahun 2004 Tentang Penghapusan Kekerasan Dalam Rumah Tangga. Tetapi setelah kurang lebih 8 tahun berjalan, kekerasan dalam rumah tangga tetap saja masih sering dilakukan suami atau orang tua kepada istri atau anak mereka. Untuk itu peneliti mencoba untuk mengetahui faktor-faktor dominan apa saja yang menjadi pemicu terjadinya kekerasan dalam rumah tangga sertaupaya-upaya untuk menanggulanginya. Selain itu, peneliti juga ingin melihat apakah pemberlakuan UU No. 23 tahun 2004 telah efektif atau tidak dalam menanggulangi kasus-kasus kekerasan terhadap wanita dan anak dalam rumah tangga di Indonesia Penelitian ini memakai metode penelitian empiris dan normatif. Penelitian empiris dimaksudkan untuk mendapatkan data primer, yaitu data yang langsung di dapat dari masyarakat melalui pengisian kuisioner, dan penelitian kepustakaan untuk menemukan norma-norma hukum yang menjadi objek penelitian.Diharapkan dari penelitian ini di dapatkan solusi-solusi yang berupa pencegahan, antisipasi dan penanganan yang tepat terhadap kasus-kasus kekerasan dalam rumah tangga yang menimpa anak dan wanita di dalam rumah tangga.

Abstract

Indonesia sebagai negara kepulauan yang terletak di Cincin Api Pasifik kerap menghadapi bencana alam seperti gempa bumi, tsunami, banjir, dan kecelakaan transportasi. Fenomena ini menuntut adanya lembaga yang mampu melakukan tindakan cepat dalam operasi pencarian dan pertolongan. Badan Nasional Pencarian dan Pertolongan (BASARNAS) dibentuk berdasarkan Undang-Undang Nomor 29 Tahun 2014 untuk menjalankan fungsi tersebut. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan studi dokumen terhadap peraturan perundang-undangan dan literatur terkait. Hasil penelitian menunjukkan bahwa BASARNAS memiliki kedudukan hukum yang kuat dalam sistem kelembagaan negara, dengan kewenangan luas dalam operasi SAR yang mencakup darat, laut, dan udara. BASARNAS juga memiliki mekanisme koordinasi yang efektif dengan berbagai lembaga pemerintah dan internasional. Meskipun demikian, BASARNAS masih menghadapi tantangan dalam keterbatasan sumber daya manusia dan materiil yang perlu diatasi melalui pengembangan kapasitas dan kerjasama internasional untuk meningkatkan efektivitas operasionalnya.     Kata Kunci : BASARNAS, Pencarian, Pertolongan, Koordinasi Lembaga

Abstract

This study analyzes the implementation of Law No. 23 of 2004 concerning the Elimination of Domestic Violence (KDRT) in Karang Suraga Village, Cinangka, Serang, Banten. The main focus of the study is to identify the effectiveness of the implementation of the law in the context of a village community that still strongly adheres to a patrilineal system. Using a qualitative approach with a normative-empirical legal research method, this study combines analysis of legal aspects and social realities in the field. Data collection was conducted through in-depth interviews with community leaders, law enforcement officers, victims of domestic violence, and village officials, and supported by non-participant observation and documentation studies. The results of the study indicate that the implementation of the Domestic Violence Law in Karang Suraga Village still faces significant challenges rooted in patriarchal cultural factors, socio-economic conditions, and the level of community education. Although the village government has established a complaint and family counseling post, its effectiveness is hampered by the view of the community that still considers domestic violence as a family disgrace. The identified impacts of domestic violence include prolonged trauma for victims and negative effects on child development. This study recommends the importance of a comprehensive approach that combines legal aspects with socio-cultural transformation to create sustainable change in efforts to eliminate domestic violence at the village level.

Abstract

This study examines the phenomenon of the 30% quota of women's representation in the Indonesian House of Representatives (DPR RI) legislative institution not being met even though affirmative policies have been implemented for almost two decades. Using a normative legal method supported by a legislative, conceptual, comparative, and historical approach, this study identifies various factors inhibiting women's representation. The results of the study show that women's representation in the Indonesian House of Representatives (DPR RI) still reached 20.52% in the 2019 Election, not meeting the 30% target. The identified structural obstacles include the subordination of women in politics, the practice of money politics, a gender-biased recruitment system, and a deficit in women's political-social capital. The study recommends a comprehensive strategy in the form of gender mainstreaming in policy, women's capacity building, gender-just legal reform, political culture transformation, and a multi-stakeholder approach. This study contributes to the development of studies on gender politics and women's political representation, while also providing input for policy makers to improve regulations on women's representation in the general election system.

Abstract

This research analyzes the comparative legal construction between BIMCO standard agreements and Indonesian Sea Transportation Agreements in the context of ship chartering. Using a normative juridical method with statutory, conceptual, and comparative approaches, the research identifies fundamental divergences in the orientation and objectives of these legal instruments. BIMCO standards demonstrate a commercial global orientation with transaction flexibility and efficiency, while Indonesian Sea Transportation Agreements maintain a regulatory-national orientation focusing on domestic maritime policies. This disparity creates harmonization challenges for cross-border shipping operators, increasing transaction costs and dispute resolution complexity. This research formulates an ideal legal construction model through a selective harmonization approach with three pillars: commercial adaptability, protection of national interests, and legal certainty. Implementing this model has the potential to strengthen the competitiveness of Indonesia's shipping industry in the global maritime ecosystem and support the Global Maritime Fulcrum vision.

Abstract

This study examines the phenomenon of criminal acts of fund embezzlement and position abuse in foundations as non-profit organizations in Indonesia. Using normative juridical method with descriptive-analytical approach, the research analyzes characteristics and modus operandi of embezzlement, causative factors, effectiveness of criminal law enforcement, impacts on foundation operations and public trust, and comprehensive prevention strategies. Research findings indicate that inclusion in foundations is generally committed by individuals with direct access to financial management through financial report manipulation, aid fund diversion, and procurement abuse. Main causative factors include weak corporate governance, paternalistic culture, and minimal internal-external oversight. Implementation of criminal law provisions faces obstacles of regulatory overlap, evidence complexity, and verdict inconsistency. Systemic impacts in the form of public trust erosion hinder the philanthropic sector as a whole. Prevention strategies require governance structure improvement, law enforcement coordination enhancement, and technology utilization for fraud detection in maintaining the integrity of Indonesia's philanthropic sector

Abstract

This research examines the overlapping land ownership dispute between Certificate of Land Ownership (SHM) No. 39/Desa Pulau Sari of 1978, owned by the heirs of Rusdiansyah Bin Haji Sabri Razak, and SHM No. 748/Desa Bingkulu of 2010, owned by Sundariati, based on Decision No. 11/G/2021/PTUN.Bjm. The main issue discussed is the annulment of SHM No. 748 by the State Administrative Court of Banjarmasin and the legal protection available to the certificate holder whose certificate was annulled. This study uses a normative approach with qualitative analysis of secondary data, including laws, jurisprudence, and related literature. The main finding of this research shows that discrepancies in the land registration system, the transition to digital measurement, and administrative weaknesses led to overlapping land certificates. In this case, although the annulment of the certificate by the court provides legal certainty for the previous right holder, the holder of the annulled certificate, Sundariati, may seek protection through a tort claim based on Article 1365 of the Indonesian Civil Code. This research emphasizes the need for reforms in the land registration system to enhance protection for bona fide right holders and prevent future disputes.

Abstract

Digital transformation has brought about fundamental changes in the Indonesian civil law system. This study aims to analyze the impacts, challenges, and opportunities of digital transformation in the context of civil law, as well as to formulate an ideal transformation model to accommodate the needs of the digital era. This study uses a normative legal research method with a qualitative approach based on literature studies and analysis of primary and secondary legal documents, including the application of sharia principles in digital transactions. One example of a case raised is the implementation of the murabahah contract in sharia e-commerce transactions that have not received explicit protection and recognition in the Civil Code, especially regarding the agreement clause and non-physical objects of sale and purchase such as digital assets. In practice, this sharia contract clause is often not accommodated by the conventional civil law structure, especially Article 1320 of the Civil Code concerning the valid conditions of an agreement and Article 1457 concerning sale and purchase. The results of the study indicate that digital transformation requires a reinterpretation of the basic concepts of civil law, the development of an adaptive regulatory framework, and the strengthening of digital infrastructure. The ideal legal transformation model should prioritize the principles of neutral technology and international harmonization, while maintaining the characteristics of the national legal system and the values ​​of sharia economic law. Key challenges include the digital divide, cybersecurity, and personal data protection, while opportunities include increasing the efficiency, accessibility, and transparency of the legal system. This study recommends developing a comprehensive regulatory framework, strengthening digital infrastructure, and increasing human resource capacity to support inclusive digital civil law transformation that is in line with sharia principles.
