Abstract

This article discusses the implementation of the requirements for prospective leaders in article 33 of law number 6 of 2014 concerning villages in Natal District, Mandailing Natal Regency from the perspective of Fiqh Siyasah. The type of research used in this research is field research with an empirical normative legal approach. The data source for this research is the data source used is primary data, which is data obtained from the Secretary of Sikara-kara IV Village, head of RT, community of Sikara-kara IV Village. secondary data is data that includes documents, books, journals, articles and those related to research, while data collection techniques are through interviews, observation and documentation while data analysis techniques use descriptive qualitative techniques. The results of this study indicate that the Requirements for the Implementation of Candidate Leaders have not been implemented properly, in the sense that the law has not been complied with in the election of leaders in Sikara-kara IV Village, this needs to be corrected so that there are laws that must be obeyed or obeyed properly. From this research it can be concluded that the requirements to become a leader in Siyasah Fiqh studies must be fair, honest, trustworthy, intelligent, like the characteristics of the Prophet Muhammad SAW.

Abstract

The problem in this research is the implementation of the Regulation of the Minister of Public Works of the Republic of Indonesia Number 03/PRT/M/2013 Article 35 concerning Selection of Final Disposal Sites in Padangsidimpuan City. The type of research used is field research with a qualitative approach. The primary data source in this research is Padangsidimpuan City Environment and Community Service employees. Meanwhile, secondary data are books and scientific journals that are considered relevant to this research. Data collection techniques use observation, interviews and documentation with qualitative descriptive data analysis techniques. The results of this research show that the implementation carried out by the Environmental Service is first, waste sorting which is carried out manually by scavengers. Second, waste processing still uses the Open Dumping system, namely just throwing away waste without any processing. Third, supervision of final disposal sites, namely creating guard posts and people responsible for controlling piles of rubbish at final disposal sites. Then the supporting factor for the Padangsidimpuan City final disposal site is that long before regulations regarding final disposal sites were formed, the final disposal site in Simatohir village already existed. The surrounding environment at the Padangsidimpuan City landfill is also still surrounded by residents' gardens, where air pollution caused by burning smoke from the landfill can be controlled, as can the lechate from the landfill. Then the inhibiting factors for moving the Padangsidimpuan City landfill from Simatohir village to Batang Bahal require large funds, air pollution, and the absence of socialization from the government.

Abstract

This study discusses the implementation of the electronic identity card service at the Department of Population and Civil Registration, North Padang Lawas Regency.  The method in this study uses a type of empirical normative research, namely an understanding of the law in terms of norms and the implementation of the rule of law in real behavior as a result of the application of legal norms, the approach taken by the researcher is the legal approach and the sociological legal approach, the data source used by the researcher is data  primary (obtained directly from the main source) secondary data (obtained from documents and books).  The data collection techniques carried out by researchers are observation (directly on the object of research), interviews (direct discussions with parties related to the research) and documentation (written or picture).  The data analysis technique used by the researcher is descriptive qualitative analysis, that is, efforts are made by working with data, organizing data, sorting it into manageable units, synthesizing it, looking for patterns, finding out what is important, what is learned, what is told to others.  The results showed that the implementation of the electronic identity card service for North Padang Lawas Regency was not in accordance with Law Number 25 of 2009 concerning Public Services.  And it should be carried out in accordance with a system where the public can obtain an e-KTP by inputting, processing and producing an e-KTP issuance output.  Supporting factors so that the implementation of the electronic identity card service runs well is the existence of an e-ID card, adequate budget and human resources so that the service can run smoothly.  And for the inhibiting factors, namely internet access that is less than optimal, the discipline of office employees who are still not punctual, inadequate facilities and infrastructure, completion times that are not as determined and also lack of public awareness.

Abstract

This study examines how to dissolve HTI organizations. The type of this research is normative research with a law approach, while the primary data source is Law no. 17 of 2013 concerning Community Organizations, PERPPU No. 2 of 2017 concerning Community Organizations and secondary data from books, journals and documents related to this research, the data collection technique is by tracing and documenting, while the data analysis technique uses inventory, identification, classification and systematization. The results of this study that the dissolution of HTI did not go through the procedures based on Law no. 17 of 2013 because Law No. 17 of 2013 concerning Ormas cannot explicitly and quickly deal with HTI which in the government's view has opposed Pancasila and HTI is trying to change the state ideology into the ideology of caliphate and this threatens the integrity of the Unitary Republic of Indonesia. If the government dissolves HTI with the procedure of Law no. 17 of 2013 it will take a long time because it must go through a judicial process first. The issuance of PERPPU No. 2 of 2017 concerning Ormas even though there is still Law no. 17 of 2013 because the government saw a threat from mass organizations that spread an ideology that was contrary to Pancasila.

Abstract

This research is entitled The Role of Community Leaders in the Election of the Village Consultative Body in Sipange Godang Village, South Tapanuli Regency. The problem in this research is how the role of community leaders in the election of members of the Village Consultative Body and the selection system for members of the Village Consultative Body. The formulation of the problem in this research is how the role of community leaders in the selection of members of the Village Consultative Body in Sipange Godang Village, Sayur Matinggi District, South Tapanuli Regency and how the system for selecting members of the Village Consultative Body in Sipange Godang Village, Sayur Matinggi District, South Tapanuli Regency. So the purpose of this research is to find out the role of community leaders in the election of members of the Village Consultative Body and the selection system for members of the Village Consultative Council. To obtain the results of this study, researchers used a type of field research (Field research) which is descriptive qualitative. The data collection used is interview technique, observation, and documentation data. While the data analysis technique was carried out using several steps, namely editing, verification, data analysis and drawing conclusions. Based on the results of the research, the role of community leaders in the selection of members of the Village Consultative Body (BPD) in Sipange Godang Village, Sayur Matinggi District, South Tapanuli Regency is as a motivator, dynamist, and as a social control. The election system for members of the Village Consultative Body is carried out by means of a consensus deliberation system, lobbying system, and voting system.

Abstract

Berdasarkan fakta di lapangan, peneliti menemukan masih banyak produsen yang tidak mengikuti aturan yang telah ditetapkan oleh MUI dan pemerintah daerah. Rumusan masalah dalam penelitian ini adalah bagaimana penerapan sertifikasi halal pada produk pangan di Kota Padangsidimpuan dan apa saja kendala pelaksanaan sertifikasi halal produk pangan di Kota Padangsidimpuan. Penelitian ini merupakan penelitian kualitatif dengan pola deskriptif. Informan dalam penelitian ini adalah pemilik usaha, karyawan, dan pembeli. Sedangkan instrumen pengumpulan data dalam penelitian ini adalah observasi dan wawancara. Hasil penelitian menyimpulkan bahwa pelaksanaan Sertifikasi Halal Produk Pangan di Kota Padangsidimpuan saat ini belum ada.Bahwa mereka belum sepenuhnya mengetahui tata cara pembuatan label halal pada makanan dengan alasan bahwa toko mereka belum memenuhi syarat untuk mendaftarkan sertifikasi halal pada makanan. Karena mereka mengatakan bahwa untuk menjaga label halal, mereka harus memiliki toko yang besar dan memiliki cabang di beberapa kota. Hambatan Pelaksanaan Sertifikasi Halal Produk Pangan di Kota Padangsidimpuan. Persepsi mereka tentang sertifikasi halal pada makanan adalah prosedur yang sangat sulit ditambah yang kita keluarkan begitu besar dan proses sertifikasi halal terlalu banyak sehingga perusahaan yang mendaftarkan produk membutuhkan waktu lama karena sertifikasi halal pada makanan. produk sangat sulit didapatkan.Karena mereka mengatakan bahwa untuk menjaga label halal, mereka harus memiliki toko yang besar dan memiliki cabang di beberapa kota. Abstract

The background of this research problem is the effectiveness of the implementation of the Regional Regulation Number 7 of 2005. This of course has an impact on the lack of level of public understanding of local regulations regarding the prohibition of the sale and distribution of liquor, it causes more and more people to sell and distribute liquor. The formulation of the problem of this research is how the effectiveness of implementing the regional regulations of the City of Padangsidimpuan Number 7 of 2005 concerning the prohibition of the sale and distribution of liquor in the VII Environment of Batunadua Jae Village, Padangsidimpuan City and the factors that become obstacles in the implementation of the Padangsidimpuan City area Number 7 of 2005 concerning the prohibition of sales and distribution. liquor in the VII Ward of Batunadua Jae Urban Village, Padangsidimpuan City. This type of research used by researchers is field research (field research) which took place in the KelurahanBatunaduajae and the Office of the SATPOL PP Padangsidimpuan City. So to find out the results or the correctness of the problems in this study, researchers used data collection instruments by means of interviews and documentation. Meanwhile, data management is done by identification, category, analysis, and conclusions. The results obtained from this study indicate that the implementation of regional regulation number 7 of 2005 concerning the prohibition of the sale and distribution of liquor has not been effective, because there are still many fields that sell and distribute liquor in the VII Ward of Batunadua Jae Village, Padangsidimpuan City.

Abstract

The problem in this research is related to the Constitutional Court Decision Number 91/PUU-XVIII/2020 on the Review of Law Number 11 of 2020 concerning Job Creation. This type of research is library research through a normative juridical approach. The data sources used are primary and secondary legal materials. Primary legal materials consist of the Constitutional Court Decision Number 91/PUU-XVIII/2020, Law Number 24 of 2003, Law Number 12 of 2011). While secondary legal material includes official documents consisting of scientific articles, books, journals. Data collection techniques in this study were case study and documentation methods. Furthermore, the data analysis technique used in this study is qualitative analysis that is collecting secondary and primary legal materials on the Constitutional Court's decision related to the problem being studied. The results of this study state that the review of Law Number 11 of 2020 concerning Job Creation refers to the provisions of Law Number 12 of 2011 concerning Formation of Legislation. In the process of its formation it did not apply the principles of forming good laws, including not applying the principle of transparency. So that it does not provide space for participation for the public to participate in discussing the law. The consideration of the Constitutional Court judges in composing the decision is the consideration of justice through Conditional Unconstitutional. Then the legal consequences of the formation of the Job Creation Law included cutting severance pay, termination of employment, no maternity leave and miscarriages for women workers.

Abstract

This study discusses the implementation of the Minister of Energy and Mineral Resources Regulation No. 21 of 2017 Article 3 Paragraph (1) concerning the Management of Drill Mud and Drill Cutting Waste in Geothermal Drilling by the Mandailing Natal Regency Environmental Service. This research was motivated by complaints from residents of the village of Sibanggor Tonga, Puncak Sorik Marapi District, Mandailing Natal Regency about the waste flowing into the residents' agricultural land which resulted in the residents' rice plants not developing as usual, causing implementation that was not in accordance with existing regulations.  This type of research is afield researchusing a qualitative descriptive analysis method. The method of collecting data for this research is by means of interviews and documentation in accordance with the provisions contained in the Regulation of the Minister of Energy and Mineral Resources Number 21 of 2017.  The results of the study state that the implementation of the Minister of Energy and Mineral Resources Regulation Number 21 of 2017 Article 3 Paragraph (1) concerning the Management of Drill Mud and Drill Cutting Waste in Geothermal Drilling by the Mandailing Natal Regency Environmental Service has been implemented, this can be seen from the form of implementation that has been implemented by The Environment Agency is to carry out direct supervision of the location of the flow of waste, give warnings to geothermal energy companies if they have violated the provisions in the regulations and impose sanctions on the agency or company if they have violated applicable regulations or are not in accordance with the company's way of working.

Abstract

Based on the above background, the purpose of this study is to determine the implementation of the Padangsidimpuan City Regional Regulation Number 41 of 2003 Article 9 concerning the Prohibition of Selling on Public Roads. This research is motivated because there are lots of traders who sell who occupy places that have been determined by the Regional Government, but there are also traders who sell not in the right place or traders who sell in places that can disturb the community or other road users such as in sidewalk.The type of research used by the researcher is a qualitative research that is normative and empirical. the data used are primary and secondary data, data collection methods by observation, interviews and documents. The data collected were analyzed using editing, verification and analysis methods.Based on the results of the research above, it is obtained that the implementation of Regional Regulation Number 41 of 2003 Article 9 concerning the Prohibition of Selling on Public Road Agencies in Padangsidimpuan City has been running but not yet ideal. The Civil Service Police Unit has carried out raids, given warnings, provided sanctions in accordance with Article 9, but in the process of socializing and supervising street vendors who are still selling on Jalan Thamrin, it is not yet fully ideal, this can be seen by the number of street vendors selling on the street. Padangsidimpuan City Public Road Agency. And as for the obstacles/obstacles in this implementation: the lack of socialization of the Civil Service Police Unit to street vendors in the Public Road Agency, the lack of mindset of the street vendors in Padangsidimpuan City, and the lack of communication between the community and the Government. Judging from Fiqh Siyasah, that is actually the content of Regional Regulation Number 41 of 2003 Article 9 concerning the Prohibition of Selling in the Padangsidimpuan City Public Road Agency. Made for the benefit of the people, especially the public transport parties who do not feel the congestion anymore, pedestrians get comfort and space to walk comfortably
