Abstract

Based on the above background, the purpose of this study is to find out how the implementation of Article 48 of the Minister of social Affairs Regulation Number 1 2018 concerning Evaluation of bebeficiaries of the family hope program in villages Ujung Gading, Sihapas Barumun subdistrict, Padang Lawas Regency and how implemation of the participation of the beneficiaries of the family hope program in graduation Ujung Gading Villlage Sihapas Barumun subdistrict Padang Lawas regency. The type of research used by researchers is descriptive qualitative research the data used are primary and secondary data, data collection methods are observation, interviews and documents. The data collected were analyzed using editing, verification and analysis methods. Based on the results of the research above, it is obtained that implementation minister of social affairs regulation number 1 of 2018 article 48 concerning the evaluation of beneficiaries of the family of hope program in Ujung Gading village, Padang Lawas District, I can be judged that the family of hope program has been successfully implemented in Ujung Gading village and every regulation and steps recommended by the government can be implemented according to with the regulations of the ministry of social affairs. The implementation of evaluation and participant graduation still has many shortcomings and irregularities, especially for PKH participants from the closest circle of the village head.

Abstract

This study examines how to dissolve HTI organizations. The type of this research is normative research with a law approach, while the primary data source is Law no. 17 of 2013 concerning Community Organizations, PERPPU No. 2 of 2017 concerning Community Organizations and secondary data from books, journals and documents related to this research, the data collection technique is by tracing and documenting, while the data analysis technique uses inventory, identification, classification and systematization. The results of this study that the dissolution of HTI did not go through the procedures based on Law no. 17 of 2013 because Law No. 17 of 2013 concerning Ormas cannot explicitly and quickly deal with HTI which in the government's view has opposed Pancasila and HTI is trying to change the state ideology into the ideology of caliphate and this threatens the integrity of the Unitary Republic of Indonesia. If the government dissolves HTI with the procedure of Law no. 17 of 2013 it will take a long time because it must go through a judicial process first. The issuance of PERPPU No. 2 of 2017 concerning Ormas even though there is still Law no. 17 of 2013 because the government saw a threat from mass organizations that spread an ideology that was contrary to Pancasila.

Abstract

This article discusses the implementation of the requirements for prospective leaders in article 33 of law number 6 of 2014 concerning villages in Natal District, Mandailing Natal Regency from the perspective of Fiqh Siyasah. The type of research used in this research is field research with an empirical normative legal approach. The data source for this research is the data source used is primary data, which is data obtained from the Secretary of Sikara-kara IV Village, head of RT, community of Sikara-kara IV Village. secondary data is data that includes documents, books, journals, articles and those related to research, while data collection techniques are through interviews, observation and documentation while data analysis techniques use descriptive qualitative techniques. The results of this study indicate that the Requirements for the Implementation of Candidate Leaders have not been implemented properly, in the sense that the law has not been complied with in the election of leaders in Sikara-kara IV Village, this needs to be corrected so that there are laws that must be obeyed or obeyed properly. From this research it can be concluded that the requirements to become a leader in Siyasah Fiqh studies must be fair, honest, trustworthy, intelligent, like the characteristics of the Prophet Muhammad SAW.

Abstract

Seiring perubahan waktu kekejaman dalam perkawinan terus bertambah, dipengaruhi pola hidup menempatkan laki - laki sebagai pemegang kekuasaan utama selanjutnya berlangsung sepanjang masa. Kesejajaran sex yang kini belum terlihat dan kultur umum senantiasa harus hidup rukun sampai memiliki kecendrungan untuk selalu mendakwa wanita, aturan telah dibentuk oleh otoritas, namun hasil belum maksimal. Penelitian ini dilakukan untuk mengetahui sebab-sebab kekejaman dalam perkawinan, pola-pola kekejaman dalam perkawinan, dan proteksi aturan yang diperoleh korban kekejajaman dalam perkawinan.Penelitian ini bersifat yuridis-normatif melalui penggunaan arsip sekunder.Penyebab kekejaman dalam perkawinan meliputi kekerasan total berbasis gender disebabkan  oleh pola hidup patriarki yang terus berlangsung sepanjang masa, kesetaraan gender yang kini belum terlihat dan nilai-nilai budaya masyarakat yang senantiasa harus hidup rukun sehingga memiliki kecenderungan untuk menyudutkan isteri Ini disebabkan oleh macam-macam hal yaitu sebab ekonomi, alkohol, dan pola kekejaman dalam perkawinan bervariasi yaitu ringan  berat bahkan sampai sekarat dan mati. Proteksi pidana bagi korban kekejaman dalam perkawinan, dari aspek yuridis, pihak korban sering kali menempuh jalur privat, beberapa jalur publik (pidana) Sebagian besar korban menentukan opsi berpisah jalur litigasi (pidana) dan beberapa lewat musyawarah keluarga.

Abstract

The problem in this study is how far the implementation of Article 7 Paragraph (2) of the Regional Regulation of South Tapanuli Regency Number 10 of 2006 concerning Retribution for Recreation and Sports Places in Aek Sijorni, Aek Libung Village, Sayur Matinggi District, South Tapanuli Regency. Because the levies collected are not in accordance with existing regulations. The purpose of this study is to describe and analyze the implementation of Article 7 Paragraph (2) of the Regional Regulation of South Tapanuli Regency Number 10 of 2006 concerning Retribution for Recreational and Sports Places in Aek Sijorni, Aek Libung Village, Sayur Matinggi District, South Tapanuli Regency. The author raises the formulation of the problem, namely how the implementation of the levy policy for recreation areas in Aek Sijorni and what are the inhibiting factors for the implementation of the levy policy for recreational areas in Aek Sijorni, South Tapanuli Regency. The research method used in this research is a qualitative approach using descriptive methods, namely describing the phenomena or vices that occur in the field. Data collection instruments used in this study consisted of interviews, observation, and documentation. The result of this research is that the implementation of Article 7 Paragraph (2) of the Regional Regulation of South Tapanuli Regency Number 10 of 2006 concerning Retribution for Recreational and Sports Places that from the government of South Tapanuli Regency has not been implemented because of the many regulations governing the amount of fees for different recreational areas. However, in its implementation, the South Tapanuli Regency government has carried out socialization and mediation with the community together with the Head of Sayur Matinggi District and the South Tapanuli Regency Tourism Office. The inhibiting factor in the Implementation of Article 7 Paragraph (2) Regional Regulation of South Tapanuli Regency Number 10 of 2006 concerning Retribution for Recreational and Sports Places in Aek Sijorni is the status of land ownership towards Aek Sijorni, the Mindset of the People who are Still Underdeveloped, Lack of Communication between the Community and the Government and Local Community Employment Status.

Abstract

Theft is a type of crime regulated in positive law in Indonesia, the implementation of the sanctions using the provisions in the Criminal Code (KUHP). However, this is as applies in the life of the people of Mompang Julu Village, Kec. North Panyabungan imposes sanctions for perpetrators of theft based on the Criminal Code as well as customary law as additional penalties for perpetrators of criminal acts of theft.From these problems, the author wants to know how the witness of theft in Mompang Julu Village, Kec. Panyabungan Utara and how the review of Islamic criminal law on additional penalties in cases of theft in Mompang Julu Village, Kec. Panyabungan Utara.The type of research used in this research is field research, namely the preparation of going directly to the field to research a problem, the data used are primary and secondary data, data collection methods are literature study methods, documents, interviews and direct observation. The data collected is analyzed using qualitative descriptive methods that are inductive and deductive, which is an effort to find existing facts and analyze them according to existing library materials.The results of this study state that, 1. the crime of theft in the village of Mompang, Julu, kec. North Panyabungan is settled by positive law based on the provisions of the Criminal Code (KUHP) and customary law in the form of an agreement. 2. Review of Islamic Criminal Law against the agreement as an additional punishment in the criminal case of theft in Mompang Julu Village, Kec. Pangabung Utara is in accordance with its application in the rules of Islamic law, namely there may be additional punishment based on the majority of the opinions of scholars who refer to the hadith of the Prophet SAW in a narration from Bahz bin Hukaim which talks about people who are reluctant to pay camel zakat, and the narration from Amr bin Syu ' disgrace that speaks of someone taking fruit

Abstract

The establishment of laws according to Law No. 12 of 2011 covers the stages of planning, drafting, discussing, ratifying and promulgating. Abstract

The purpose this study to implementation of the agreement between PT.MIR (MAJU INDO RAYA) and ampolu village community. This research is emprical Field Researeh. With data collection techniquedone by interview and observation. Data were analyzed using qualitative approach method. The result of the research shows that the  implementation of the agreement between PT.MIR (MAJU INDO RAYA) and ampolu village community.  Not in accordance with what  was promised as well as violating the agreement that has been made by PT.MIR (MAJU INDO RAYA). Where  PT.MIR (MAJU INDO RAYA) does   not water the road three  times a  day,  PT.MIR (MAJU INDO RAYA)  does not fill  the road with sertu and  pare maintenance isnotcarried out.

Abstract

According to the theory of effectiveness, the findings found by researchers have not reached the benchmark for the effectiveness of protected forests as confirmed in Law 41 of 1999 Article 47 on Forest Protection. The problem that occurs is the problem that is the main supporter of achieving the effectiveness of forest protection. The effectiveness of law no. 41 of 1999 Article 47 concerning benchmarks for effectiveness in the supervision of protected forests in order to maintain their sustainability. where there are problems faced by the agency responsible for the preservation of protected forests. factors inhibiting the effectiveness of law no. 41 of 1999 concerning Forest Protection is a budget cut since COVID-19 which hinders Forest Protection, then lack of public awareness of forest preservation, and lack of legal firmness from law enforcement officers. According to the theory of effectiveness that has not met the requirements or has not achieved this into a serious problem, lack of personnelForest Police Team (only two people), inadequate supporting facilities/infrastructure.figh siyasa review of the effectiveness of law no. 41 of 1999 concerning Forest Protection emphasizes that humans are able to be responsible for everything that Allah SWT has created.
