Abstract

Ketika kita mempelajari dan mendalami ulmul Qur’an, nasakh wa mansukh adalah tema yang paling banyak mengundang perdebatan sampai sekarang. Hal ini bukan hanya datang dari kalangan umat Islam saja melainkan juga datang dari para Islamonolog dan orientasi yang tertarik pada kajian al-Qur’an. Perbedaan pendapat ini bermula dari perbedaan dalam penggunaan terminologi nasakh wa mansukh dan selanjutnya menghasilkan ikhtilaf (perbedaan). Sebagian ulama mengartikan nasakh dengan artian memindahkan atau an-naql, membatalkan atau al-ibthal dan menghapus atau al-izalah. Sedangkan penggunaan terminologi yang dibahas sebelumnya masing-masing memiliki implikasi secara operatif. Oleh karena itu pembahasan ini adalah pembahasan yang menarik dari masa-kemasa.

Abstract

This article describes the tradition of marlojong (elopement) perspective of Islamic law. The focus of research in this article is in Padangsidimpuan district of Angkola Julu, Padangsidimpuan, North Sumatra. Marlojong tradition is a marriage performed by a man bringing a woman to his parents' house to be his wife without being known by the female master. Marlojong marriage occurs because the mother of the woman does not give her blessing to her child in choosing a soul mate chosen by her own child. There are some negative impacts for those who do marlojong marriages in the process: For parents, especially parents of women marlojong marriage will get a poor image. Based on the results of the examination, it can be concluded that the practice of marlojong marriage that occurred in Padangsidimpuan Angkola Julu District and carried out by young Muslims Batak Angkola tribe is a practice marriage that is contrary and not in accordance with Islamic sharia. In addition to marlojong marriage has existed from the past and until now still exists, and then this tradition belongs to urf al-fasidah. Urf al-fasidah is a habit carried out by man but contrary to syara‟, legalizing the haram, or rescinding obligations.

Abstract

Abstract

As a democratic country based on Pancasila, Indonesia must be able to defend the rights of its citizens in accordance with established standards. In Pancasila, religion has a sacred position in the legal order in Indonesia. So that these religious values have been included in the Indonesian constitution. This research is library research. The nature of this research is qualitative in accordance with the object of research study. The method used in this study uses a literature review, namely by collecting library materials including books, journals and others. Among the results of this research is that Indonesia has adopted the Maqashid Sharia system in many aspects of human life. Indonesia already has good regulations in Islamic banking, religious courts, child protection laws, violent sex crimes, drug laws, criminal laws, civil laws, and others. All of them aim to protect the religion, soul, spirit, property, and descendants of the Indonesian nation. This is in accordance with the values of the teachings of Islamic Shari'a.

Abstract

The community of Patiluban Mudik village, Natal District Mandailing Natal regency is a society tht is guided by Islamic Law, where many village people follow the teachings and sunnah of the Propehet such as making sacrifices, so a group is formed or the implementation of arsan qurban. The problem that the researchers will discuss in this discussion is how the implementation and view of Islamic Law arisan qurban eidh al Adha in the village of Patiluban Mudik, Natal District. The method used in this study is using a type of field research (field research). The nature of research uses a qualitative research approach, data sources, primary and secondary, data collection techniques are carried out by observation, interviews and documentation. The results of this study indicate that the implementation of the qurban gathering in Patiluban Mudik village aims to be able to sacrifice in a light way using a loan agreement, but in practice this qurban gathering becomes a burden for someone because the members cannot pay the installments, while the Islamic Law review of this qurban arisan is not in accordance whit Islamic Shari’a. Because the purpose of debts is to help each other, but debts owed in this social gathering tyrannize the committee, religious knowledge that lacks qurban worship becomes burdensome, making inheritance debts. La dharar wa la dhirar. Masyarakat Desa Patiluban Mudik, Kecamatan Natal, Kabupaten Mandailing Natal merupakan masyarakat yang berpedoman pada Hukum Islam maupun Syariat Islam, dimana masyarakat desa banyak yang mengikuti ajaran dan sunnah Rasulullah seperti berqurban, banyak kalangan masyarakat yang kurang mampu ingin ikut serta berqurban, sehingga dibentuklah sebuah kelompok atau pelaksanaan arisan qurban. Permasalah yang akan peneliti dalam pembahasan ini adalah bagaimana Pelaksanaan dan pandangn Hukum Islam arisan qurban idul adha di desa Patiluban Mudik, Kecamatan Natal, Kabupaten Mandailing Natal, Metode yang digunakan dalam penelitian ini adalah menggunakan jenis penelitian lapangan (field research). Sifat penelitiannya menggunakan pendekatan penelitian kualitatif, sumber data, primer dan sekunder, teknik pengumpulan data dilakukan dengan observasi, wawancara dan dokumentasi. Hasil penelitian ini menunjukkan bahwa pelaksanaan arisan qurban di Desa Patiluban Mudik bertujuan untuk dapat berqurban dengan cara yang ringan menggunakan akad hutang-piutang, namun pada praktiknya arisan qurban ini menjadi beban bagi seseorang karena anggota yang tidak dapat membayar cicilan. sedangkan tinjauan Hukum Islam terhadap arisan qurban ini tidak sesuai dengan Syariat Islam. Karena Tujuan hutang-piutang adalah untuk saling tolong menolong, tapi hutang piutang dalam arisan ini menzolimi panitia, pengetahuan agama yang kurang ibadah qurban ini menjadi berat menjadikan hutang warisan. Abstract

The definition of wakalah bi Al-istismar contract is a contract used in several products on the capital market, such as sukuk and mutual funds. This contract includes the renewal of the wakalah contract combined with the investment contract. While the purpose of wakalah bi al-istismar, which is where someone represents a party so that he invests his funds, either with or without compensation. This wakalah law is in accordance with the permitted MUI DSN. In this contract scheme, initially it was related to investors or what was called muwakkil giving power to representatives or proxies in making investments, both managing and developing their funds. Then the representative who invests the funds owned by the muwakkil of the party who authorizes it with several contracts that are in accordance with sharia principles. Then from the investment produces the name of the result or risk in it. All these results and risks are the rights and responsibilities of the authorizer and the last stage is the refund to the muwakkil.

Abstract

Mangolat boru is an event to confront the bride and groom before the bride's departure to the namboru's house (in-law) which is carried out by the namboru's son from the bride as a farewell so that there is a pangolat wage or money. Pangolat money will be given by the men to the namboru from the women. the wages or pangolat money given by the groom is not enough, so the namboru child of the bride continues to hold and ask for more mangolat wages to the groom. In addition to slowing down, sometimes the time of the mangolat jam approaches the Maghrib call to prayer, which is where the implementation of this mangolat still continues. The purpose of the study was to find out how Islamic law reviews the mangolat tradition in marriage customs in the Bondar flower family, Sipirok district, South Tapanuli district and to find out the implementation of the mangolat tradition in the community of Bunga Bondar village. This type of research is field research. Research conducted in collecting data on phenomena that occur, is natural and scientific. The data collection of this research uses observational field studies, interviews, as well as documentation and libraries, and uses a systematic discussion. The results revealed in the thesis entitled Mangolat Tradition in Marriage Customs in the Bunga Bondar Village, Sipirok District, South Tapanuli Regency is that the mangolat custom tradition carried out by the community has been carried out for generations in various generations, this mangolat event is the last event in the implementation of the mandatory custom. carried out in a wedding ceremony, with that wages or money pangolat will always be a complement to the implementation of the mangolat pickle, where the mangolat event will take a lot of time so that the departure of the bride and groom will take a long time due to the implementation of this mangolat event.

Abstract

This research is motivated by the role of religious leaders in resolving marital disputes in Sayurmatinggi Village. Religious figures are people who are prominent, respected and have a big role in the development of religious teachings, in this case Islam. The position of religious leaders who play an important role in society because they are considered as people who have a higher level and knowledge of religion compared to other members of the community. The problem in this study is about the role of religious leaders in mediating or efforts to reconcile the family or household of someone who is in a dispute that has the potential to lead to divorce is never done at all by religious leaders and even after the divorce then religious leaders play a role in it. This study aims to determine the role of religious leaders in mediating marital disputes in the Vegetable Sayurmatinggi community.This research was conducted directly in the field to obtain information and data as accurately as possible by using data collection techniques through interviews, observation and documentation. The objects in this study are the Village Head of Sayurmatinggi, traditional leaders, religious leaders, people in conflict.From the results of the research conducted, people are less aware of the role of religious leaders in the social order and religious leaders cannot play an active role in mediating marital disputes because a dispute in the household is a disgrace to the family itself while religious leaders are not part of the family. And the comments of the people in Sayurmatinggi village that it is more thick with custom in matters of marriage, on the grounds that culture and customs from ancient times have been applied in marriage matters, as well as statements by religious leaders although negative effects often follow later which can trigger various customary problems. prioritized in terms of marriage in Sayurmatinggi Village.

Abstract

The basic problem in this research is regarding the practice of distributing inheritance in Nagari Lansek Kadok, South Rao District, Pasaman Regency, West Sumatra Province. This problem is motivated by the practice of inheritance distribution that girls get more inheritance than boys. Whereas the community in Nagari Lansek Kadok, South Rao District, Pasaman Regency, West Sumatra Province, the majority are Muslim with a population of 2,250 families of which there are 1,350 families if it is divided into 60% who are not subject to the practice of dividing inheritance into 2 parts and women 1 part.The results of this study are,, the firstly reason why the people in Nagari Lansek Kadok practice the distribution of inheritance for men 1 part and women 2 parts, the reason is because the people in Nagari Lansek Kadok use matrilineal customs which divide inheritance from the mother's lineage which makes the difference, namely because in In practice, women in Nagari Lansek Kadok receive more inheritance than men, while the share of pusako received by boys is the traditional sako title passed down from mamak to nephews. In addition to serving as the successor of women's descendants in Minangkabau, their existence is highly respected and also involved in deliberation in the family and village. the second purpose of compiling Islamic law in the practice of dividing inheritance, while the inheritance system in the Compilation of Islamic Law (KHI) refers to the heirs by referring to faraidh, namely bilateral inheritance, meaning that men and women have the same right to inherit from the heir.
