Abstract

Penelitian ini bertujuan untuk memberikan masukan kepada pemerintah terkait pemenuhan beberapa indikator penting yang perlu diperhatikan bagi perlindungan Hak Asasi Manusia (HAM) khususnya perlindungan hak atas tempat tinggal yang layak bagi masyarakat yang terdampak pengadaan tanah untuk pembangunan PSN Rempang Eco City Batam. Penelitian ini menggunakan metode yuridis normatif yang disajikan secara kulitatif melalui pendekatan desktriptif analitis dan problem identification (case approach). Hasil penelitian menunjukkan bahwa pelaksanaan relokasi terhadap warga terdampak pembangunan Rempang Eco City masih belum berpedoman pada indikator-indikator mengenai perlindungan Hak Ekosob khususnya pemenuhan hak atas tempat tinggal yang layak sebagaimana diatur di dalam Komentar Umum PBB No. 4 dan No. 7, Pasal 11 ayat (1) UU No. 11 Tahun 2005 Tentang Pengesahan Ratifikasi Konvensi Hak Ekosob dan Pasal 40, UU No. 39/1999 Tentang HAM. Berbagai peraturan tersebut penting dipedomani agar pembangunan bisa sejalan dengan prinsip-prinsip HAM sesuai mandat konsitusi, undang-undang terkait lainnya serta berbagai hukum internasional.

Abstract

Nowadays, there is a trend of creating parody content from one of Indosiar's soap operas or television films (FTV) that shows an unusual scene of a traveling merchant. Creating parody content like this is detrimental to the original content creator, in this case, Indosiar. Some of the disadvantages include but are not limited to, misuse of logos and works and violating exclusive rights to economic rights. The parody content creators can profit from the parody content they create because most of the parodies are commercialized, thus generating material benefits for the parody content creators. The other side of the manifestation of the parody work is a different work and is not a plagiarism of the original creation even though there are similarities. Copyright only protects the final result of the manifestation of creation and does not protect the ideas behind a creation. This study will discuss the status of parody within the scope of copyright and the legal implications of commercialized parodies. This study uses a juridical-normative legal research type with a statutory approach, a comparative approach, and a conceptual approach. The results of this study found that the position of the parody has not been regulated in the laws and regulations in Indonesia and found that Indosiar's action to take legal action against the perpetrators of parody was appropriate. Parody violates the integrity rights or moral rights of the creator and also falls under the fair use doctrine. Parody can still be done as long as it has permission from the creator or copyright holder of the original work. However, if permission is not obtained and it is still done, then parody becomes an illegal activity.Keywords: Copyright, Economic Rights, Parody AbstrakDewasa ini terdapat tren membuat konten parodi dari salah satu sinetron atau film televisi (FTV) Indosiar yang menayangkan adegan pedagang keliling yang tidak lazim. Pembuatan konten parodi seperti ini jelas merugikan sang pencipta konten yang asli dalam hal ini adalah Indosiar. Beberapa kerugiannya mencakup, tetapi tidak terbatas pada adanya penyalahgunaan logo dan hasil karya serta melanggar hak eksklusif terhadap hak ekonomi. Para konten kreator parodi tersebut dapat mengambil keuntungan dari konten parodi yang mereka perbuat karena kebanyakan hasil parodi tersebut dikomersialisasikan, sehingga menimbulkan keuntungan materiil bagi para konten kreator parodi tersebut. Sisi lain dari perwujudan hasil karya parodi tersebut merupakan karya yang berbeda dan bukan hasil jiplakan dari ciptaan awalnya meskipun ada kemiripan. Hak cipta sejatinya hanya melindungi hasil akhir perwujudan suatu ciptaan dan tidak melindungi ide gagasan yang melatarbelakangi suatu ciptaan. Penelitian ini akan membahas mengenai status parodi dalam ruang lingkup hak cipta dan implikasi hukum atas parodi yang dikomersialisasikan. Penelitian ini menggunakan jenis penelitian hukum yuridis-normatif dengan pendekatan perundang-undangan, pendekatan komparatif, dan pendekatan konseptual. Hasil penelitian ini adalah menemukan bahwa kedudukan parodi belum diatur dalam peraturan perundang-undangan di Indonesia dan mengetahui bahwa tindakan Indosiar untuk melakukan upaya hukum bagi pelaku parodi sudah tepat. Sejatinya parodi melanggar hak integritas atau hak moral pencipta dan juga masuk ke dalam doktrin fair use. Parodi tetap dapat dilakukan sepanjang mendapat izin dari pencipta atau pemegang hak cipta karya asli. Namun, jika tidak mendapat izin dan tetap dilakukan, maka parodi menjadi kegiatan yang melanggar hukum.Kata Kunci: Hak Cipta, Hak Ekonomi, Parodi

Abstract

This study aims to determine the correlation between religiosity and aggressiveness of Islamic boarding school students in Samarinda. This study uses a quantitative approach.The population consisted of 193 students attending an Islamic boarding school at the high school level. A sample size of 130 students was obtained. The research subjects were selected using cluster random sampling techniques. The measuring instruments used were a religiosity scale and an aggressiveness scale. The collected data were analyzed using a correlation analysis test with the Pearson product moment technique to determine the correlation between the two variables. Based on the research that had been conducted, it was found that: 1) religiosity has a correlation with the aggressiveness of Islamic boarding school students in Samarinda. This result was proven by the calculated r value = -0.489 and p = 0.000 (p <0.05) indicating the hypothesis that H1 is accepted and H0 is rejected; 2) the two variables, namely religiosity and aggressiveness, have a negative correlation and the strength of the correlation is in the middle category; 3) the results of the partial correlation test show that aspects of worship and morals are correlated with aspects of physical aggression; all aspects of religiosity, which are belief, worship and morals are correlated with the aspects of verbal aggression; moreover the aspects of belief and morals are correlated with aspects of anger, and aspects of belief and worship are correlated with aspects of hostility.

Abstract

Abstract Protection for shareholders is essential in corporate practice to provide legal certainty for shareholders. This study aims to analyze the effectiveness of shareholders agreements as an important instrument for overcoming the limitations of articles of association in order to increase legal certainty for shareholders, as well as to analyze legal comparisons between Indonesia and Canada regarding the regulation of shareholders agreements in order to increase legal certainty for shareholders. The research method used is normative juridical, with a legislative approach and a comparative law approach. The results of the study show that in Indonesia, shareholders agreements are recognized as civil agreements that are binding on the parties as long as they do not conflict with the UUPT and the articles of association. However, in Indonesia, this is not explicitly regulated in the law. In contrast, in Canada, shareholders agreements have obtained special provisions through the Unanimous Shareholders Agreement (USA), which can explicitly limit or take over some of the authority of the board of directors. In Canada, shareholders agreements can be an alternative for dispute resolution. This study recommends harmonizing shareholders agreements with the articles of association and explicit provisions regarding shareholders agreements. Keywords: Shareholder Protection, Shareholders Agreement, Indonesian Law, Canadian Law.
