Abstract

Desa Bongo yang terletak di Kecamatan Batudaa Pantai Kabupaten Gorontalo Provinsi Gorontalo, sejak tahun 2004 ditetapkan  sebagai “ Desa Wisata Religius Bubohu”. Kunjungan wisatawan ke daerah ini hanya untuk wisata religi padahal Desa ini memiliki potensi wisata laut dan bukit yang indah sehingga bila potensi ini dikembangkan akan menjadi obyek wisata baru yang dapat meningkatkan kesejahteraan masyarakat. Metode yang digunakan adalah survey, observasi dan wawancara serta aksi langsung di lapangan. Hasil yang dicapai adalah: 1) Terbentuknya obyek wisata baru dengan nama “Pantai Dulanga” mengekspose pantai dan perbukitan yang ditata secara alami dan indah, telah menarik minat wisatawan lokal maupun asing untuk berkunjung sehingga  memberikan dampak positif terutama pada peningkatan pendapatan masyarakat. 2) Terwujudnya masyarakat sadar wisata, peningkatan partisipasi masyarakat maupun pemerintah terhadap pengembangan pariwisata berkelanjutan di Desa Bongo. Development of Culture and Environment Based Tourism Village in Bongo Village, Batudaa Pantai Sub-district, Gorontalo RegencyAbstract: Bongo Village of Batudaa District, Gorontalo Regency has been established as "Bubohu Religious Tourism Village" since 2004. The tourists' main purpose to visit this place is for religious tourism. Whereas, this village has the potential of beautiful marine and hill tourism that will increase community prosperity if those potential are becoming new tourism spots. The research methods employed survey, observation, and direct action in the field. The result achieved include: 1) the establishment of new tourism spot "Dulanga Beach" by exposing beach and hills that are naturally and beautifullylaid out. The village has attracted local and foreignvisitors, which has resulted in an increase in community income. 2) The manifestation of community tourism awareness, and the enhancement of community and government involvement toward sustainable tourism development in Bongo Village.

Abstract

Implementation of article 31 paragraph 2 letter C of National Police Chief Regulation no. 12 of 2009 regarding the investigation of abuse due to alcohol at the Gorontalo Resort Police. The research used is Empirical Research, which is legal research that uses empirical facts taken from human behavior, both verbal behavior obtained from interviews and real behavior carried out through direct observation. The research results obtained by the author in conducting this research include the application of Article 31 paragraph 2 letter C of the National Police Chief Regulation no. 12 of 2009 at the Gorontalo Resort Police, it has been implemented but is still not able to be implemented optimally because it is seen from the immediate situation and conditions in the field which are not expected. This article has also been effectively implemented in investigations but will be implemented within existing provisions. In investigations, the process is not always handled based on the provisions in these regulations, because investigators carry out the investigation process based on the level of vulnerability and the potential to threaten public safety.

Abstract

Abstract The purpose of this research is 1) To determine and analyze the accountability for criminals of online fraud and criminal of conventional fraud which set in the Code of Criminal Law 2) To determine and analyze the juridical consequences of Article 28 paragraph (1 ) of the Code of Information and Electronic Transactions Article 378 of the Code of Penal, as well as providing insight into the crime of online fraud that uses the internet as the main medium. The result of study is the Article 378 of the Code of Criminal Law concerning criminal fraud can not be used to punish the online fraud criminals, there are obstacles in the way to punish the criminal sanctions on criminals such as limitation of the proof which limited by the Code of Criminal Procedure (Criminal Code) and jurisdiction. Given the shortcomings in the Criminal Code, Article 28 paragraph (1) juncto Article 45 paragraph (2) of Law No. 8 of 2011 on information and electronic transactions can be used to charge the criminals to take account for his actions in the case of criminal fraud online, because Article 28 paragraph (1) of the Act ITE is Lex Specialis of Article 378 which is Lex Generalis. Juridical consequences of using Article 28 paragraph (1) Code of Information and Electronic Transactions against Article 378 of the Code of Criminal Law on online fraud is both of article in a two code laws that override and exclude each other.

Abstract

Kota Gorontalo memiliki situs bawah air Leato, yang dikenal juga dengan sebutan situs kapal tenggelam Japanese Cargo Wreck. Namun realitasnya, belum ada produk hukum yang menata prosedur penyelaman di lokasi situs bawah air Leato / Japanese Cargo Wreck. Rumusan masalah dalam penelitian ini, bagaimana model regulasi wisata minat khusus scuba diving kaitannya dengan optimalisasi perlindungan hukum situs bawah air Leato / Japanese Cargo Wreck? Metode penelitian yang digunakan metode penelitian normatif. Tujuan penelitian yaitu mengkaji urgensi optimalisasi perlindungan hukum situs bawah air Leato / Japanese Cargo Wreck melalui pembuatan regulasi hukum dan mendeskripsikan model regulasi wisata minat khusus scuba diving kaitannya dengan optimalisasi perlindungan hukum situs bawah air Leato / Japanese Cargo Wreck. Kegunaan penelitian memberikan kepastian hukum. Hasil kajian, realitasnya melalui langkah hukum yang progresif yakni menghadirkan regulasi hukum prosedur penyelaman rekreasi di lokasi situs bawah air Leato / Japanese Cargo Wreck dalam rangka menyikapi pesatnya pertumbuhan industri selam beserta potensinya. Model regulasi hukum prosedur penyelaman rekreasi di lokasi situs bawah air Leato / Japanese Cargo Wreck sebagai sebuah proses pembangunan hukum yang ditujukan untuk menata aktivitas hukum ke arah yang lebih baik dan kontributif khususnya terkait kesinambungan pemanfaatan situs bawah air Leato / Japanese Cargo Wreck dibidang wisata bahari minat khusus Scuba Diving tanpa mengenyampingkan pelestariannya dan juga status hukumnya sebagai kawasan konservasi maritim. Terdapat kebijakan-kebijakan hukum baik internasional maupun nasional yang dapat dijadikan landasan formulasi regulasi dan salah satunya yakni regulasi jalur penyelaman di U.S.A.T. Liberty di Tulamben, Provinsi Bali. Kesimpulan, memiliki Regulasi hukum guna optimalisasi perlindungan hukum situs bawah air Leato / Japanese Cargo Wreck sekaligus memaksimalkan potensinya pariwisatanya. Model regulasi dapat menjadikan menjadikan U.S.A.T Liberty di Tulamben, Bali sebagai percontohan penerapan regulasi prosedur menyelam pada situs bawah air. Sekaligus pengelolaannya dibidang pariwisata.

Abstract

This article applies the theory of restorative justice to the analysis of state losses resulting from corrupt activities. This study employs socio-legal research, which is a type of normative legal research that is dependent on values and facts. The study's findings revealed that two (2) points of view are based on the fundamental notion that restorative justice can compensate the state for damages incurred through acts of corruption. First, in order to make up for the losses sustained by the state as a result of corrupt criminal acts, law enforcement must be centered around the idea of restorative justice. Secondly, the fact that the Constitutional Court's ruling Number 25-PUU-XIV-2016 eliminated the word "may" from Article 2 paragraph (1) and Article 3 of Law Number 20 Year 2001 in combination with Law Number 31 Year 1999 for the Eradication of Corruption remains a reality. In order to ensure that substantive justice in the application of restorative justice does not clash with current laws and regulations and is administered with chosen criteria, the A quo ruling nullifies Article 4 of the Corruption Crime Eradication Law.

Abstract

The use of electric bicycles is currently becoming a primadonna among the community. The combination of transportation and technology makes it a creative and revolutionary innovation. High public interest and also based on the thought of the movement to save the Earth from carbon emissions has increasingly popularized the use of electric bicycles.  The purpose of this study was to determine and analyze the urgency of regulating electric bicycles in Gorontalo City in a progressive legal perspective.  The research method used is statute approach and conceptual approach.  Electric bicycles have begun to be traded in the Gorontalo Province. Of course, this indicates that Gorontalo Province has good market potential. Nationally, the rules for the use of electric bicycles have indeed been accommodated in the Minister of Transportation Regulation, but their embodiment in regional regulations is still needed considering that Gorontalo Province in general and Gorontalo City in particular certainly have special conditions. which must also be accommodated in a regulation because the facilities and infrastructure as well as local wisdom that live in the community are certainly not at the same level nationally. It is appropriate that the use of electric bicycles as a means of transportation is made a legal umbrella in the regions. Law through the lens of progressiveness must move faster than society itself considering that law is rigid while society is dynamic

Abstract

Instant profit-making patterns have been established by the current online purchasing and selling practices. For example, brushing is the activity of internet retailers or merchants fabricating favorable reviews or fraudulent endorsements to boost the reputation of their goods or services. When a customer receives a product or service that falls short of their expectations, brushing can be harmful. This study aims to investigate the legality of online buying and selling in Indonesia, specifically the practice of "brushing," or using fictitious orders, reviews, and buyers.  The methods used are Statute Approach, Case Approach, Conceptual Approach, Analytical Approach, Theoretical Approach.   The findings indicated that, from the standpoint of Indonesian telematics and consumer protection legislation, brushing activities frequently contravene a number of relevant rules and laws. As a result, brushing may be deemed unlawful in Indonesia and subject to penalties based on relevant legislation. In order to prevent brushing activities, it is critical that the government and regulatory agencies bolster law enforcement, protect consumers from brushing practices, and inform consumers of their rights in this regard. Enforcing stringent regulations and ensuring their efficient implementation are crucial for safeguarding consumers and upholding the integrity of Indonesia's online ecosystem.

Abstract

This research aims to determine criminal acts of fraud with the motive of counterfeiting Qris Barcodes in terms of the aspect of prevention through the Indonesian Criminal Law. This research is normative research which is analyzed descriptively, using a law and case approach. The results of the research are that regulations regarding criminal acts of fraud are generally regulated in Article 378 of the Criminal Code, and to strengthen the legal basis it can be accommodated through Article 35 of Law Number 19 of 2016 concerning Information and Electronic Transactions. As a special law, the ITE Law is at least a guideline and legal basis for members of the public in carrying out activities in the online world. Overcoming the occurrence of criminal acts of online fraud is carried out with preventive (non-penal) and repressive (penal) efforts. Repressive efforts in this case are regulated based on Article 35 of the ITE Law and Article 378 of the Criminal Code. Meanwhile, preventive efforts are carried out by taking precautions so that criminal acts of online fraud can be minimized without applying criminal law, but rather by carrying out preventive efforts before the criminal act occurs, such as improving the community's economy, socializing to the public how to use the internet properly and the characteristics of electronic transaction-based criminal acts of fraud.
