Abstract

The phenomenon of juvenile delinquency, or child crime, is currently frequently encountered, especially crimes that harm society or other people, such as criminal acts of theft committed by children. The purpose of this research is to determine the factors that influence children in committing a crime of theft and to analyze the decision of the Semarang District Court judge No: 2/Pid.Sus-Anak/2023/PN Smg in the crime of theft committed by a child. The method used in this research is the Normative Juridical Method, the specifications used are Analytical Descriptive, and the method used in this research is Literature Study. The influencing factors are caused by heredity and environmental factors. Congenital or hereditary factors are the first factor that influences a child's growth and development. This factor can be interpreted as all individual traits or characteristics that are inherited from children or all the physical and psychological potential that a person has from the time of conception as an inheritance from parents. Based on the provisions of Article 5 paragraph 1 of Law Number 11 of 2012 concerning the Juvenile Criminal Justice System, in resolving juvenile cases through the Juvenile Criminal Justice System, it is mandatory to prioritize a restorative justice approach.

Abstract

Deviant behavior is behavior that violates the moral principles of decency, both in terms of individual humanity and justification as a characteristic of social beings. Not only adults, children also currently show deviant behavior. The current speed of communication flow can foster children's curiosity and encourage them to try new things. The purpose of this study is to explain deviant behavior that often occurs in the environment around PPA and what factors influence children to carry out deviant behavior. In addition, this study aims to explain the efforts made by PPA in preventing deviant behavior in children. This research was carried out using sociological juridical research methods, the specifics of this research are descriptive. The research data was sourced from interviews. Data analysis using qualitative methods. The results of the study (1) factors that influence children to carry out deviant behavior are biological factors, psychological factors, and sociological factors, besides that there are factors from a bad environment, lack of attention from parents and influence from friends. (2) Efforts to overcome deviant behavior in children can be carried out with prevention efforts without punishment, such as the participation of community social institutions. PPA is a community social institution that in responding to children's deviant behavior is by providing infrastructure that accommodates children's creativity, improving children's mental health.

Abstract

The crime of sexual violence is part of a crime against decency, where the act does not occur to adults but also occurs to minors, either directly or indirectly. Legal considerations for imposing restitution for victims of the crime of sexual violence in the Herry Wirawan incident With reference to the problems that have been described, this study aims to examine criminal acts of sexual violence in the Herry Wirawan incident, especially regarding legal considerations in granting restitution to victims and the legal protection that should be given to the victim's children. This research uses normative legal methods with statutory and case approaches. This research is an in-concreto legal research. The results of the study show that the judge's considerations in making decisions are based on the public prosecutor's indictments, the statements of the accused, the statements of witnesses, and evidence. For legal protection for the victim, the defendant is sentenced to death, and the victim's children are entitled to receive compensation or restitution from the defendant. In addition, child victims also receive protection in the form of social rehabilitation and psychosocial assistance during their treatment process until their recovery. Protection and assistance for the victim's children is also provided at every stage of the examination, starting from investigation, prosecution, to trial. This aims to provide comprehensive protection for victims and ensure that their rights are guaranteed during the law enforcement process.

Abstract

Emergence of Restorative Justice as a criticism of the implementation process in the criminal justice system, which has been viewed as ineffectual in resolving problems in people's lives. Restorative Justice is a procedural approach to settling criminal cases that entails the active involvement of individuals responsible for the offense, victims, relatives of both perpetrators and victims, as well as other pertinent stakeholders. The primary objective of this approach is to achieve a fair resolution by prioritizing the restoration of the affected parties to their original state, rather than focusing solely on retaliation. This research will analyze and explain how Restorative Justice is implemented against persecutors of the crime of persecution at the Semarang District Attorney, as well as what the obstacles in its implementation. This study employs a normative juridical research type with in concreto research specifications, secondary data gathered from library materials, and a qualitative data analysis methods. The results of the study show (1) Because the prosecution complied with the conditions of article 5 of Prosecutor's Regulation No. 15 of 2020 regarding Termination of Prosecution, Restorative Justice may no longer be applied to those who committed the crime of persecution at the Semarang District Attorney's Office. According to restorative justice, a first-time offender is subject to punishment under Article 351 for crimes and criminal acts of persecution (1) of the Criminal Code, as well as for the implementation mechanism through several stages beginning with stage two, peace efforts, peace process regulated in Article 7 to Article 12 until the prosecution is terminated with the issuance of a Decission Letter on Termination of Prosecution.(2) here are no obstacles in the application of Restorative Justice due to the interrelation of legal structure, legal substance and legal culture.
