Abstract

ABSTRACT Every individual has the right to enjoy physical and mental well-being, have decent housing, and live in a healthy environment in accordance with the 1945 Constitution. The right to protect and preserve nature has been regulated by laws oriented toward the interests of nature. The importance of nature lies in the obligation to preserve it. Despite Indonesia, especially Southeast Sulawesi, being rich in mineral resources such as nickel, the management of natural resources must comply with environmental laws and regulations. Coastal areas and small islands, including Wawonii Island, need to be preserved. However, the granting of mining permits on Wawonii Island has previously resulted in negative impacts on the local environment and community. The nickel mining company, PT Gema Kreasi Perdana (PT GKP), resumed operations on Wawonii Island in 2018, creating controversy by violating regulations, such as the prohibition of mineral mining on small islands that could harm the environment and surrounding communities. The local government of Konawe Regency issued a Regional Regulation (Perda) supporting mining activities, despite conflicting with higher legal regulations. The impacts of PT GKP's activities, such as water pollution, have led to a clean water crisis, forcing residents to buy bottled water. Residents filed a lawsuit in the Administrative Court (PTUN) Kendari, and the Supreme Court (MA) annulled the Regional Regulation supporting mining on Wawonii Island. Nevertheless, PT GKP filed a judicial review against Law No. 27/2007, which prohibits mining activities on small islands. This research aims to analyze the provisions for granting nickel mining business permits in the coastal areas of Konawe Regency based on the Environmental Protection and Management Law. Additionally, the study aims to analyze criminal accountability for damage to water sources on the coastal areas due to nickel mining activities, based on the Environmental Protection and Management Law. The research results are expected to contribute both theoretically and practically. Theoretically, the research is expected to contribute to scientific knowledge, especially in the context of granting mining permits on small islands. Practically, the research findings are expected to serve as a foundation for local governments, mining companies, and communities to understand and address the environmental damage resulting from nickel mining activities in Konawe Regency.

Abstract

Abstrak, Menurut UUPA jual beli tanah hak milik dilakukan dihadapan Pejabat Pembuat Akta Tanah dan dilakukan pendaftaran ke kantor pertanahan. Praktiknya di Desa Padaasih jual beli tanah hak milik dilakukan dibawah tangan antar warga desa dengan menggunakan kuitansi. Tujuan penelitian ini adalah untuk mengetahui serta menganalisis akibat hukum jual beli tanah hak milik dengan menggunakan kuitansi bagi para pihak di Desa Padaasih Kecamatan Cijati Kabupaten Cianjur, serta kepastian hukum dalam jual beli tanah hak milik yang menggunakan kuitansi di Desa Padaasih Kecamatan Cijati Kabupaten Cianjur. Hasil penelitian, Akibat hukum jual beli tanah hak milik dengan menggunakan kuitansi bagi para pihak di Desa Padaasih Kecamatan Cijati Kabupaten Cianjur. Menurut Syarifin, akibat hukum adalah dampak yang timbul dari perbuatan hukum subyek terhadap obyek hukum yang disebabkan oleh kejadian hukum tertentu. Apabila dikaitkan dengan jual beli menurut UUPA timbul akibat hukum berupa kepastian hukum, jika dilakukan pendaftaran sesuai ketentuan PP 24/1997. Selanjutnya, jika jual beli hak milik atas tanah dilakukan dengan kuitansi, diatur dalam KUHPerdata bahwa pembeli wajib membayar harga dan berhak menerima tanah dan penjual berhak menerima permbayaran dan wajib menyerahkan tanah. Abstract, According to the UUPA, the sale and purchase of freehold land is carried out in front of a Land Deed Official and registered with the Land Office. In practice in Padaasih Village, the sale and purchase of freehold land is carried out under the hands of villagers using receipts. The purpose of this study is to determine and analyse the legal consequences of buying and selling of freehold land using receipts for the parties in Padaasih Village, Cijati District, Cianjur Regency, and legal certainty in buying and selling freehold land using receipts in Padaasih Village, Cijati District, Cianjur Regency. The results of the study, the legal consequences of buying and selling freehold land using receipts for the parties in Padaasih Village, Cijati District, Cianjur Regency. According to Syarifin, legal effect is the impact arising from the subject's legal action on the legal object caused by certain legal events. If it is related to sale and purchase according to UUPA, legal consequences arise in the form of legal certainty, if registration is carried out in accordance with the provisions of PP 24/1997. Furthermore, if the sale and purchase of land ownership rights is carried out with receipts, it is regulated in the Civil Code that the buyer is obliged to pay the price and is entitled to receive the land and the seller is entitled to receive payment and is obliged to hand over the land.

Abstract

Abstract. A good and healthy environment is the right of every person. This can be achieved if people have an awareness of the importance of preserving the environment. The difference in people's mindset in viewing the environment allows people to commit violations. With this matter, this research aims to have an insight into the supervision of the implementation of environmental permit revocation sanctions against PT Sawit Inti Prima Perkasa in relation to Law Number 32 of 2009 concerning Environmental Protection and Management and other environmental law enforcement efforts that can be taken against PT Sawit Inti Prima Perkasa in relation to Law Number 32 of 2009 concerning Environmental Protection and Management. This research uses a normative juridical approach method with descriptive analytical research specifications. Data collection in this research is through literature study. The result of this research is that the implementation of supervision carried out by the government by appointing environmental supervisory officials to oversee the compliance of the business responsible for the permits owned and orders in administrative sanctions that have been applied, to then be able to provide recommendations for follow-up law enforcement if declared disobedient, the responsible person can be subject to more severe administrative sanctions if disobedient which only applies up to the suspension of business licenses. Environmental law enforcement efforts can also be through criminal law enforcement if the person responsible for the business is indicated to have committed an environmental crime, and civil law enforcement which can be carried out by resolving disputes by filing a lawsuit either by an aggrieved individual, environmental organization, government or through a group representative lawsuit, to hold the business responsible, especially in terms of compensation. Abstrak. Lingkungan hidup yang baik sehat merupakan hak yang dimiliki oleh setiap orang. Hal tersebut dapat dicapai apabila masyarakat memiliki kesadaran akan pentingnya melakukan upaya pelestarian terhadap lingkungan hidup. Adanya perbedaan pola pikir masyarakat dalam memandang lingkungan hidup memungkinkan masyarakat untuk melakukan pelanggaran. Dengan hal tersebut penelitian ini bertujuan untuk memahami pengawasan pelaksanaan sanksi pencabutan izin lingkungan hidup terhadap PT. Sawit Inti Prima Perkasa dihubungkan dengan Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup serta upaya penegakan hukum lingkungan hidup yang lain dapat ditempuh terhadap PT. Sawit Inti Prima Perkasa dihubungkan dengan Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup. Penelitian ini menggunakan metode pendekatan yuridis normatif dengan spesifikasi penelitian bersifat deskriptif analisis. Pengumpulan data dalam penelitian ini melalui studi kepustakaan. Hasil dari penelitian ini adalah pelaksanaan pengawasan dilakukan oleh pemerintah dengan menunjuk pejabat Pengawas lingkungan hidup untuk mengawasi ketaatan penanggungjawab usaha terhadap perizinan yang dimiliki serta perintah dalam sanksi administratif yang telah diterapkan, untuk kemudian dapat memberikan rekomendasi tindak lanjut penegakan hukum apabila dinyatakan tidak taat, penanggungjawab dapat dikenakan sanksi adminstratif lebih berat apabila tidak taat yang hanya berlaku sampai hingga pembekuan izin berusaha. Upaya penegakan hukum lingkungan hidup juga dapat melalui penegakan hukum pidana apabila penanggungjawab usaha terindikasi melakukan suatu tindak pidana lingkungan hidup, dan penegakan hukum perdata yang dapat dilakukan dengan penyelesaian sengketa dengan mengajukan gugatan baik oleh perorangan yang dirugikan, organisasi lingkungan hidup, pemerintah serta melalui gugatan perwakilan kelompok, untuk meminta tanggung jawab dari penanggungjawab usaha, khususnya dalam hal ganti rugi.

Abstract

Pengadaan tanah merupakan proyek kepentingan umum melibatkan upaya memperoleh tanah diatur dalam Undang-Undang Nomor 2 Tahun 2012 tentang pengadaan tanah bagi pembangunan untuk kepentingan umum dan Peraturan Pemerintah Nomor 19 Tahun 2021 tentang penyelenggaraan pengadaan tanah bagi pembangunan untuk kepentingan umum. Dengan memberikan kompensasi kepada pemilik yang melepaskan tanah, bangunan, tanaman, dan aset terkait. Seringkali, proses ini menimbulkan konflik di masyarakat khususnya berkaitan dengan ganti rugi. Penelitian ini bertujuan untuk memahami pengadaan tanah pembangunan Tol Cisumdawu Kabupaten Sumedang sudah sesuai dengan ketentuan yang berlaku, dan kepastian hukum ganti rugi bagi masyarakat yang terdampak pengadaan tanah pembangunan Tol Cisumdawu Kabupaten Sumedang. Metode penelitian yang digunakan dalam penelitian ini adalah metode pendekatan yuridis normatif. Spesifikasi Penelitian adalah deskriptif analitis. Tahap penelitian dilakukan dengan melakukan penelitian kepustakaan dan wawancara sebagai bahan pendukung data sekunder dan Analisis data dilakukan menggunakan metode yuridis kualitatif. Hasil penelitian menunjukan bahwa skripsi ini untuk menjawab permasalahan tidak sesuai dengan ketentuan yang berlaku yang terdapat dalam Undang-Undang Nomor 2 Tahun 2012 tentang pengadaan tanah dan Peraturan Pemerintah Nomor 19 Tahun 2021 tentang penyelenggaraan pengadaan tanah bagi pembangunan untuk kepentingan umum. ABSTRACT. Land acquisition is a public interest project that involves efforts to acquire land by providing peace to owners who release land, buildings, plants and related assets. Often, this process creates conflict in society, especially regarding compensation.Therefore, this research aims to obtain land for the construction of the Cisumdawu Toll Road, Sumedang Regency in accordance with applicable regulations, and ensure legal compensation for communities affected by the land procurement for the construction of the Cisumdawu Toll Road, Sumedang Regency. The research methodology uses a normative juridical approach, qualitative research type, descriptive analysis research specifications, data collection methods and techniques in the form of library research to collect secondary data consisting of primary legal materials, secondary legal materials and tertiary legal materials, as well as qualitative analysis methods using interpretation. grammatically with a statutory regulatory approach. The research results show that this thesis is to answer the problem so that it does not continue to become a mistake over and over again, so it is important to understand the format, basis and procedures for determining compensation in the context of land acquisition for the public interest.

Abstract

ABSTRAK-Asuransi terdiri dari beberapa jenis, salah satu jenis asuransi yang dapat digunakan oleh kita adalah asuransi pengangkutan atau pengiriman barang. Asuransi pengiriman barang ini memberikan perlindungan atas kerusakan atau kehilangan obyek atau kepentingan yang dapat dipertanggungkan selama dalam proses pengangkutan dari suatu tempat ke tempat lain dengan alat angkutan darat, laut maupun udara. Ganti Rugi yang diberikan oleh pihak penyedia asuransi ini sebesar biaya penggantian barang yang hilang, atau rusak maksimal sebesar nilai pertanggungan sebagaimana tertuang dalam Peraturan Otoritas Jasa Keuangan Nomor 73/POJK.05/2016/Tentang Tata Kelola Perusahaan Yang Baik Bagi Perusahaan Perasuransian Pasal 1 ayat (6). Tujuan dalam penelitian ini adalah untuk mengetahui pengaturan asuransi pengiriman barang yang timbul pada transaksi melalui E-commerce Tokopedia menurut UU Perasuransian dan UU ITE pelaksanaannya oleh Perusahaan Asuransi Tokio Marine Indonesia. Penelitian ini menggunakan metode yuridis normatif berdasarkan bahan pustaka dan bahan sekunder yang kemudian hasil dari data tersebut dianalisis secara kualitatif. Hasil dari penelitian ini menunjukan bahwa pengaturan asuransi pengiriman barang yang timbul dalam transaksi melalui E-commerce di Tokopedia sudah sesuai dengan peraturan yang berlaku di Indonesia, karena berdasarkan Pasal 18 ayat (1) UU ITE mempertegas bahwa transaksi elektronik yang dituangkan kedalam kontrak elektronik bersifat mengikat para pihak dan Sah hukumnya. Maka dari ketentuan pasal tersebut memperjelas adanya keterikatan dari suatu kontrak atau perjanjian yang dilakukan melalui transaksi elektronik adalah sah, karena perjanjian tersebut tetaplah perjanjian sebagaimana perjanjian konvensional yang mengikat para pihak serta melahirkan hak dan kewajiban bagi masing-masing pihak yang terikat didalamnya. ABSTRACT-Insurance consists of several types, one of the types of insurance that we can use is transportation or delivery of goods. Shipping insurance provides protection against damage or loss of objects or interests that can be borne during the process of transportation from one place to another by means of land, sea or air. Compensation for losses granted by this insurer is the amount of replacement costs for lost goods, or damage is the maximum amount of liability as stipulated in Financial Services Authority Regulation No. 73/POJK.05/2016/On Good Corporate Governance for Insurance Companies Article 1 para. (6). The purpose of this study is to find out the insurance arrangements for the delivery of goods arising from transactions through e-commerce Tokopedia according to the Insurance Act and the ITE Act implemented by the Tokyo Marine Indonesia Insurance Company. This research uses normative juridic methods based on library material and secondary material which results from such data are then qualitatively analyzed. The results of this study show that the arrangement of insurance of delivery of goods arising in transactions through E-commerce in Tokopedia is already in accordance with the regulations in force in Indonesia, because according to Article 18 paragraph (1) of the ITE Act it affirms that the electronic transaction referred to in the electronic contract is binding on the parties and is legally binding.

Abstract

Abstract. Pemungutan Pajak Bumi dan Bangunan(PBB) merupakan salah satu jenis pajak yang ada di Indonesia, orang yang menggunakan atau memanfaatkan tanah diwajibkan membayar PBB.Pengertian PBB adalah pajak yang dikenakan atas harta tak bergerak, maka pajak PBB disebut sebagai pajak yang objektif, sehingga objek dari PBB adalah tanah dan/atau bangunan. Objek tanah yang dikenakan biaya PBB merupakan bumi dan/atau bangunan yang dimiliki atau dikuasai atau dimanfaatkan oleh orang pribadi atau badan yang Nilai Jual Objek Pajaknya (NJOP) lebih dari sepuluh juta rupiah atau tidak kurang dari sepuluh juta rupiah. Subjek dan objek merupakan dua hal yang tidak bisa dipisahkan dari konteks pertanahan nasional, Pajak Bumi dan Bangunan (PBB) merupakan pajak kebendaan dimana objek dari PBB adalah tanah dan bangunan, penetapan objek Pajak Bumi dan Bangunan (PBB) sendiri bergantung terhadap subjek dari PBB itu sendiri, menurut UUHKPD Pasal 39 ayat 2, wajib pajak PBB merupakan orang atau badan yang secara nyata mempunyai hak atas bumi, berdasarkan UUPA Pasal 16 ayat 1, hak atas bumi meliputi hak milik, hak guna usaha, hak guna bangunan, hak pakai, sehingga penetapan PBB bergantung terhadap status yuridis kepemilikan atau pengusaan tanah dari subjek PBB itu sendiri, sehingga secara pratiknya antara Pajak Bumi dan Bangunan (PBB) dengan hak atas tanah memiliki keterkaitan. Bedanya Pajak Bumi dan Bangunan (PBB) bukan merupakan bukti kepemilkan tetapi dapat menjadi bukti penguasaan, sedangkan hak atas tanah merupakan bukti kepemilikan atas tanah. Individuals who use or benefit from land are obligated to pay PBB. The understanding of PBB is that it is a tax imposed on immovable property, hence it is referred to as an objective tax. Therefore, the objects of PBB are land and/or buildings. The land objects subject to PBB are land and/or buildings owned, controlled, or utilized by individuals or entities with a Tax Object Sales Value (NJOP) of more than ten million rupiahs or not less than ten million rupiahs.Subjects and objects are two inseparable elements in the context of national land. The Land and Building Tax (PBB) is a property tax where the objects are land and buildings. The determination of the Land and Building Tax object depends on the subject of the tax itself. According to Article 39 paragraph 2 of Law No. 12/1994 concerning Rural and Urban Land Spatial Planning, PBB taxpayers are individuals or entities who actually have rights to the land. Based on Article 16 paragraph 1 of Law No. 5/1960 concerning Basic Agrarian Principles, land rights include ownership rights, land-use rights, building-use rights, and utilization rights. Therefore, the determination of PBB depends on the juridical status of land ownership or use by the PBB subject. In practice, there is a connection between the Land and Building Tax (PBB) and land rights. The difference is that the Land and Building Tax (PBB) is not proof of ownership but can be evidence of possession, while land rights are evidence of ownership of the land

Abstract

Abstract, every business and/or activity that generates hazardous waste is required to conduct hazardous waste management either independently or by using hazardous waste management services by other parties. Hazardous waste management must have a license. CV Master Laundry, one of the businesses in Bandung Regency, manages hazardous waste independently without having a license and manages hazardous waste that is not in accordance with the UUPPLH, PP on Hazardous Waste Management, and Bandung Regency Regional Regulation No. 2/2018 on Hazardous Waste Management. This research aims to understand the regulation of hazardous and toxic liquid waste management in Indonesia in relation to Bandung Regency Regional Regulation No. 2/2018 on Hazardous and Toxic Waste Management and its implementation by CV Master Laundry in Bandung Regency. This research uses a normative juridical approach method with the type of literature study research and analytical descriptive research specifications. The results of the study concluded that the regulation of B3 liquid waste management in Indonesia, which is related to the Bandung Regency Regional Regulation No. 2/2018 concerning B3 Waste Management, is that every business and / or activity is required to manage the B3 waste it produces, by reducing, storing, collecting, transporting, utilizing, processing, and / or stockpiling B3 waste, by obtaining a B3 waste processing license. The implementation by CV. Master Laundry in Bandung Regency is to process its own B3 waste but does not have a B3 waste processing license, so that the processing of B3 waste is also not in accordance with applicable regulations. Law enforcement against CV. Master Laundry that commits violations in the management of B3 liquid waste in relation to Bandung Regency Regional Regulation No. 2/2018 concerning Management and Control of Hazardous Waste can be subject to administrative law enforcement and environmental crimes. Abstrak. Setiap usaha yang menghasilkan limbah Bahan Berbahaya dan Beracun (B3) wajib melakukan pengelolaan limbah, baik mandiri maupun dengan menggunakan jasa pihak lain, dan harus memiliki perizinan. CV Master Laundry di Kabupaten Bandung terlibat dalam pengelolaan limbah B3 secara mandiri tanpa izin, melanggar UU Pengelolaan Limbah B3, PP Pengelolaan Limbah B3, dan Peraturan Daerah (Perda) Kabupaten Bandung No. 2/2018 tentang Pengelolaan Limbah B3.Penelitian ini bertujuan memahami regulasi pengelolaan limbah cair B3 di Indonesia terkait Perda Kabupaten Bandung No. 2/2018 dan implementasinya oleh CV. Master Laundry di Kabupaten Bandung. Metode penelitian yang digunakan adalah pendekatan yuridis normatif dengan studi kepustakaan, bersifat deskriptif analitis.Hasil penelitian menunjukkan bahwa setiap usaha harus mengelola limbah B3 dengan kegiatan pengurangan, penyimpanan, pengumpulan, pengangkutan, pemanfaatan, pengolahan, dan/atau penimbunan, serta harus memiliki perizinan pengelolaan limbah B3. CV. Master Laundry di Kabupaten Bandung, meskipun melakukan pengolahan limbah B3, tidak memiliki izin yang sesuai dengan peraturan. Pelanggaran ini dapat dikenakan penegakan hukum administratif dan pidana lingkungan hidup sesuai Perda Kabupaten Bandung No. 2/2018.

Abstract

Abstrak Penyebaran karya cipta melalui media digital, seperti e-commerce, memiliki dampak positif bagi penciptanya. Ini membantu pemegang hak cipta untuk memperkenalkan dan meningkatkan popularitas serta penghasilan dari karyanya. Namun, di sisi lain, penyebaran melalui media digital juga dapat menimbulkan dampak negatif, seperti pelanggaran hak cipta oleh pelaku usaha yang tidak bertanggung jawab. Salah satu contohnya adalah kasus pelanggaran hak cipta yang dialami oleh band musik lokal, 'The Panturas', di mana merchandise mereka diproduksi dan dijual secara tidak resmi di e-commerce tanpa izin. Pelanggaran hak cipta semacam ini terus terjadi, menciptakan konsekuensi yang merugikan bagi pemegang hak cipta. Dalam konteks ini, penelitian ini dilakukan untuk memahami implikasi dari penjualan bootleg merchandise 'The Panturas' dan pertanggungjawaban hukum yang harus ditanggung oleh pelaku usaha yang terlibat. Hasil penelitian menunjukkan bahwa implikasi dari penjualan merchandise ilegal ini belum sepenuhnya diatasi, karena pelaku usaha tidak meminta izin dan tidak memberikan ganti rugi kepada 'The Panturas'. Selain itu, tanggung jawab hukum atas pelanggaran hak cipta juga belum terlaksana karena 'The Panturas' sendiri tidak mengambil langkah hukum terhadap permasalahan tersebut. Abstract The dissemination of copyrighted works through digital media, such as e-commerce, has a positive impact on the creator. It helps copyright holders to introduce and increase the popularity and income of their works. However, on the other hand, dissemination through digital media can also have negative impacts, such as copyright infringement by irresponsible business actors. One example is the case of copyright infringement experienced by local music band, 'The Panturas', where their merchandise was unofficially produced and sold on e-commerce without permission. This kind of copyright infringement continues to occur, creating adverse consequences for copyright holders. In this context, this research was conducted to understand the implications of bootleg sales of 'The Panturas' merchandise and the legal liability that must be borne by the business actors involved. The results show that the implications of these illegal merchandise sales have not been fully addressed, as the business actors did not seek permission and did not provide compensation to 'The Panturas'. In addition, legal responsibility for copyright infringement has also not been implemented because 'The Panturas' themselves did not take legal action against the problem.

Abstract

ABSTRAK- Dalam persengketaan pertanahan, suatu kepemilikan tanah dapat dibuktikan yang salah satunya didasari oleh perbuatan hukum jual beli tanah. Suatu bukti perbuatan hukum jual beli dapat dibuktikan salah satunya oleh kuitansi. Akan tetapi, kuitansi tidak menguraikan secara rinci suatu perjanjian, maka perlu didukung dengan alat bukti lain yang membuktikan bahwa perjanjian tersebut adalah dasar penerimaan uang yang diuraikan dalam kuitansi. Penyelesaian sengketa tanah dapat diupayakan melalui peranan kantor wilayah Badan Pertanahan Nasional untuk mendapatkan penanganan dan penyelesaian. Adapun alternatif penyelesaian sengketa pertanahan yang dilaksanakan oleh kantor wilayah Badan Pertanahan Nasional dengan cara mediasi sesuai ketentuan Peraturan Menteri Agraria Nomor 21 Tahun 2020. Peran Badan Pertanahan Nasional dalam suatu persengketaan pertanahan adalah sebagai mediator otoritatif yang netral. Akan tetapi, alternatif penyelesaian sengketa melalui upaya mediasi seringkali dinilai tidak efektif dikarenakan sulitnya tercapai kesepakatan perdamaian diantara para pihak yang bersengketa. Maka dari itu penulis tertarik untuk melakukan penelitian deskriptif-analitis dengan metode pedekatan yuridis normatif. Dalam metode pengumpulan data yang digunakan adalah dengan mewawancarai narasumber bersangkutan yang ada kaitannya terhadap penelitian yang diteliti. Penulis juga menggunakan metode penelitian kepustakaan. Data yang dikumpulkan berupa sumber-sumber hukum yang terdiri dari sumber hukum primer yang berdasarkan Undang-Undang Dasar 1945, Undang-Undang Pokok Agraria, KUHPerdata, Peraturan Pemerintah Nomor 24 Tahun 1997. Proses mediasi baru dapat dilakukan apabila para pihak yang terlibat sengketa sudah saling sepakat untuk menyelesaikan sengketa secara mediasi. Kemudian dalam sistem hukum Lawrence Friedman menunjukkan terdapat persoalan dalam aspek budaya hukum ABSTRACT- In land disputes, a land ownership can be proven, one of which is based on a legal act of buying and selling land. However, a receipt does not detail a contract in full, so it needs to be supported by other evidence that proves that the contract is the basis for the acceptance of the money detailed in the receipt. The settlement of land disputes can be attempted through the role of the regional office of the National Land Agency to obtain handling and settlement. The alternative land dispute settlement carried out by the regional office of the National Land Agency through mediation in accordance with the provisions of the Minister of Agrarian Affairs Regulation Number 21 of 2020. The role of the National Land Agency in a land dispute is as an authoritative and neutral mediator. However, the alternative settlement through mediation efforts is often considered ineffective due to the difficulty of reaching a peace agreement among the disputing parties. Therefore, the writer is interested in conducting a descriptive-analytic research with a normative legal approach method. In the data collection method used, the writer interviewed relevant sources related to the research being studied. The writer also used a library research method. The collected data consisted of legal sources, including primary legal sources based on the 1945 Constitution, the Basic Agrarian Law, the Civil Code, and Government Regulation Number 24 of 1997. Then, secondary legal sources based on books, journals, articles, and opinions of legal experts... Based on this research, it was found that the National Land Agency (BPN) has a role as a mediator that helps disputing parties understand each other's perspectives and find what is important to them. The mediation process can only be carried out if the parties involved in the dispute agree to settle the dispute through mediation. Furthermore, in the legal system of Lawrence Friedman, it is shown that there is a problem in the cultural aspect of law
