Abstract

This research aims to the meaning and limitations of a notary's obligation to “safeguard the interests of the parties involved in legal acts” as stipulated in Article 16 paragraph (1) letter a of the Indonesian Notary Position Act. This provision raises ambiguity or lack of clarity due to the insufficient explanation in the law, particularly regarding the phrase "safeguard the interests of the parties." Using a normative juridical research method with a legislative and conceptual approach, with legal materials consisting of primary and secondary legal sources to be analyzed through grammatical interpretation, this study explores the extent to which notaries are required to act neutrally, faithfully, and independently in carrying out their duties. The research finds that the ambiguity of the provision may lead to varying interpretations among notaries, which in turn affects the consistency of the law's application in practice. There is a need for more detailed or explicit guidance in the law to avoid multiple interpretations that could trigger ambiguity in the performance of a notary's duties. This study emphasizes the importance of reformulating the legal provisions to ensure that the notary's obligations in safeguarding the interests of the parties involved are clearer, thereby ensuring legal certainty and protection for all parties involved in legal acts.

Abstract

This article aims to analyze the application of Article 36 of Law Number 31 of 1999 concerning the Original of the deed as evidence in corruption criminal cases and the legal implications if investigators fail to obtain permission from the Honorary Council of Notaries to examine the Original of the deed. This study employs a normative juridical research method, using both the statute approach and the conceptual approach. The legal materials consist of primary legal sources, which include Article 66 of Law Number 2 of 2014 amending Law Number 30 of 2004 concerning the Position of Notary and Article 36 of Law Number 31 of 1999 on the Eradication of Corruption Crimes, as well as secondary legal sources, including relevant publications related to the issues raised in this study. These legal materials are analyzed using a perspective analysis, employing grammatical and systematic interpretation methods. The research findings indicate that, based on Article 36 of Law Number 31 of 1999 on the Eradication of Corruption Crimes, which regulates investigations and prosecutions of corruption offenses, there is no legal certainty in its application due to the involvement of the Indonesian Prosecutor's Office and the Honorary Council of Notaries or sectoral ego within each institution. The legal implication of failing to grant investigators permission to examine the Original of the deed of the Honorary Council of Notaries is that it prevents the achievement of perfect proof, as the Original of the deed holds a perfect evidentiary value in proving the alleged corruption crime.

Abstract

AbstractNovation is one method of breaking an agreement. Novation is not effectively governed in Article 1413 of the Civil Code, the Banking Law, or the Mortgage Law. Therefore, it is frequently observed in practice that novations are carried out unilaterally by creditors and without the original debtor’s involvement (passive subjective novation). When the Novation is implemented for the Credit Agreement and is also weighed down by Mortgage Rights, issues arise. The legal relationship between the Creditor and the original Debtor will be terminated when the Debtor is renewed. Between new Debtors and existing Creditors, Novation creates a new legal relationship. Only if there has been an engagement between himself and the original Debtor would the new Debtor have the right to the guarantee of Mortgage. Novation can be one of the exit strategies for avoiding the possibility of bad loans, but particularly for Credit Agreements that are Mortgage-burdened, it is necessary to use the principle of prudence, which includes the urgency of having a companion deed as well as other administrative procedures, so that the existence of Mortgage can still be a “safety measure” for the agreement for the renewed credit.Keywords: Novation; Bank Credit Agreement; Land Mortgage; Notary. AbstrakSalah satu cara mengakhiri perikatan adalah Novasi. Di dalam Pasal 1413 KUHPerdata, Undang-Undang Perbankan dan Undang-Undang Hak Tanggungan, Novasi tidak diatur secara. Oleh karena itu, di dalam praktek banyak ditemui Novasi dilakukan secara sepihak oleh Kreditur dan tanpa melibatkan Debitur lama (Novasi Subyektif Pasif). Permasalahan muncul ketika Novasi tersebut dilakukan untuk Perjanjian Kredit dibebani pula Hak Tanggungan. Bahwa adanya pembaharuan Debitur, maka hubungan hukum antara Kreditur dengan Debitur lama menjadi terhapus. Novasi menghadirkan hubungan hukum baru antara Kreditur dengan Debitur baru. Dalam kaitannya dengan jaminan Hak Tanggungan, maka Debitur baru hanya akan mempunyai hak, jikalau telah terjadi perikatan antara dirinya dengan Debitur lama. Novasi dapat menjadi salah satu exit strategy dalam mengatasi kemungkinan kredit macet, namun khususnya untuk Perjanjian Kredit yang dibebani Hak Tanggungan, perlu asas kehati-hatian termasuk urgensi adanya akta pendamping dan juga proses administrasi lainnya sehingga keberadaan Hak Tanggungan tetap dapat menjadi “pengaman” atas perjanjian kredit yang diperbaharui tersebut.Kata Kunci: Novasi; Perjanjian Kredit Perbankan; Hak Tanggungan Atas Tanah; Notaris.

Abstract

This paper analyzes the legal position of suretyship (borg) in Indonesian bankruptcy and debt suspension (PKPU) proceedings, focusing on the principle of justice. The study addresses the incomplete norms in Law Number 37 of 2004, which do not explicitly regulate petitions against sureties. Using a normative juridical method based on statutory, conceptual, and case approaches, the research finds that sureties are often treated as debtors, even though the Indonesian Civil Code defines suretyship as accessory and subsidiary. Several court verdicts have accepted joint petitions against debtors and sureties without independent proof or separate legal assessment. This precedent undermines commutative and procedural justice, as the surety does not bear primary responsibility and is not a joint and several debtors. These findings indicate the need for legal reform to ensure that the surety receives separate procedural treatment aligned with their legal capacity.

Abstract

National electric cars play a strategic role in achieving the Sustainable Development Goals. Challenges in developing nationally electric-based cars include infrastructure, regulations, and the readiness of the domestic industry to adopt new technologies. This article examines the challenges and opportunities within Indonesian law to develop a national electric car industry. This article is a legal study with a comparative approach focusing on India, Thailand, and Malaysia to identify best practices in their national electric car policy frameworks. The study reveals that Presidential Regulation No. 79 of 2023 on Electric Motor Vehicles is a stage to support sustainable development and a commitment to international environmental law such as the Paris Agreement. Although the Domestic Component Level policy has faced criticism in the context of global trade, this approach can be justified under international law if it aims at environmental protection, is proportionate, and is not discriminatory. This aligns with the WTO jurisprudence in the 2012 China-Raw Materials case and the recognition that Article XX of GATT allows countries to implement environmentally friendly policies. Abstract

This study aims to examine in depth the authority of notaries to make a Certificate of Inheritance Rights Article 111 paragraph (1) letter c number 5 of the Regulation of the Minister of ATR/Head of BPN Number 16 of 2021 in relation to the provisions of the Notary Position Law. This study uses a normative legal method with a statutory and conceptual approach to analyze the inconsistencies in norms that arise after the enactment of the Regulation of the Minister of ATR/BPN 16 of 2021. The results of the study indicate that although the UUJN still grants authority to Notaries in making a Certificate of Inheritance Rights (SKHW), the inconsistency of the wording in the Regulation of the Minister of ATR/BPN 16 of 2021 has the potential to cause differences in interpretation and administrative obstacles in the process of registering inherited land. This inconsistency can weaken legal certainty for heirs and has the potential to cause land disputes. Therefore, harmonization is needed between the Regulation of the Minister of ATR/BPN and the UUJN to ensure that the authority of Notaries in making SKHW remains clearly recognized in the land administration system. In addition, technical guidelines from the National Land Agency (BPN) are needed to avoid implementation obstacles and ensure legal certainty in the registration of inherited land. Studi ini bertujuan untuk mengkaji secara mendalam terkait kewenangan notaris Pembuatan Surat Keterangan Hak Waris Pasal 111 ayat (1) huruf c angka 5 Peraturan Menteri ATR/Kepala BPN Nomor 16 Tahun 2021 dikaitkan dengan ketentuan Undang-Undang Jabatan Notaris. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan konseptual guna menganalisis inkonsistensi norma yang timbul pasca-berlakunya Permen ATR/BPN 16 Tahun 2021. Hasil penelitian menunjukkan bahwa meskipun UUJN tetap memberikan kewenangan kepada Notaris dalam pembuatan Surat Keterangan Hak Waris (SKHW), ketidaksesuaian redaksi dalam Permen ATR/BPN 16 Tahun 2021 berpotensi menimbulkan perbedaan tafsir dan kendala administratif dalam proses pendaftaran tanah warisan. Inkonsistensi ini dapat melemahkan kepastian hukum bagi ahli waris dan berpotensi menimbulkan sengketa pertanahan. Oleh karena itu, diperlukan harmonisasi antara Permen ATR/BPN dan UUJN guna memastikan bahwa kewenangan Notaris dalam pembuatan SKHW tetap diakui secara jelas dalam sistem administrasi pertanahan. Selain itu, pedoman teknis dari Badan Pertanahan Nasional (BPN) diperlukan guna menghindari kendala implementasi dan memastikan kepastian hukum dalam pendaftaran tanah warisan.

Abstract

This research aims to discover the urgency of regulating written agreements for Umrah pilgrimage departures. The chosen theme is motivated by the absence of positive law governing written agreements for Umrah pilgrimage departures. Numerous issues have arisen, including cases where Umrah travel agencies fail to fulfill their obligation of sending prospective pilgrims or provide facilities and services as promised to the prospective pilgrims. This study adopts a juridical-normative method with the statutory approach and analytical approach. Legal materials obtained by the author will be analyzed using a descriptive-analytical technique, which involves determining the content and meaning of the legal rules regarding the organization of Umrah pilgrimages and the Civil Code. Based on the results of the research using the aforementioned method, an urgent written agreement is proposed with the aim of facilitating smooth cooperation between travel agencies and Umrah pilgrims, while also reducing the risk of fraud or any detrimental actions to either party. The written agreement serves as a guide for both the travel agencies and pilgrims to act in accordance with the promises made in the agreement and the established regulations.

Abstract

Through a Digital Market, the commercial activities of business actors are conducted virtually and can have a global reach. Commercial activities that no longer require face-to-face meetings in conducting transactional activities and that involve cashless payment methods have made it possible for business actors to transgress the jurisdictional boundaries of a state as they conduct their business activities. Digital Market becomes an inevitability as well as a legal matter in the application of Law No. 5 of Year 1999, particularly in relation to the legal standing of business actors. The consideration is that in the context of a virtual market, geographical boundaries no longer firmly limit the jurisdictional territory of a state. Therefore, the discussion regarding the characteristics of a Digital Market and the legal standing of business actors in a Digital Market becomes an urgent need. Through juridical normative research, this article intends to analyze the characteristics of a Digital Market and the legal standing of business actors in a Digital Market according to Law No. 5 of Year 1999.
