Abstract

Legal protection on religion is certainty for a state with Pancasila principle. The first principle    the Divinity of the Only God has been spirit of the following points, as living guidance for Indonesian country.  The believing of    the Divinity of the Only God shows that the Indonesian Republic is religious based country by protecting freedom to have religion for its people.  This regulation has implication in governmental circle, that the country makes Religion Ministry as one of ministries that its existence has the same position to other state institutions.   The implementation of legal protection toward religion needs legitimating in the field of civil law, showed in issuing President   Decree   No. 1 of 1965 on the Preventing of    Misuse and/or Religion Staining. The existence of this   Decree  in Old Order has been legitimated  newly as a Law  by issuing the Law   No. 5 of 1969, thus the  President Decree has been added to the  Criminal Code, Act   156a.

Abstract

Since 2005 the rule of Bank Indonesia is already issued a policy about consumer credit facilities in order to get a place or a home for foreign people who live in Indonesia, but it is not enough to make all the bank that took place in Indonesia give that facilities. One of the reasons discrepancy of a number banks to give that credit facilities to foreign people is because the risk in case there is a failure or the person is not fulfilling the obligation. Considering the debtor is a foreigner, while the object of the guarantee is a land with a right of use that has a limited period, and until now there is still no regulations from both the Indonesian government and from Bank Indonesia that specifically provide protection against banks on consumer credit facilities for foreigners. In this paper, the writer will discuss the effort of legal protection that can be done by the Bank are preventive effort and repressive effort. Preventive legal protection efforts undertaken by banks is with credit agreements. Repressive legal protection effort, if the foreign debtors can not fulfill the obligation one of them is to stop the consumer credit agreement.

Abstract

The authority and responsibility of the notary on the deed of Statement of Meeting Decision and to analyze the strength of notary proof of the deed of Statement of Meeting Decision. The method used in this research is normative law research with approach method of legislation. The primary, secondary and tertiary law materials obtained by the authors will be analyzed by using literature techniques using grammatical and logical legal interpretations. The result of research with the above method indicates that Notary of Notary's responsibility to Statement of Meeting Decision is only responsible only for formal truth, while the truth of the contents of the deed is the responsibility of the parties to the notary because the notary does not know and attend the meeting. The Declaration of Decision of the Meeting includes the evidence of letters and including the "Partij Deed" category made by the general officers appointed by oath and against the verification otherwise able to be challenged, without accusing his falsehood, by stating that the statements of the parties concerned are described in full in the deed, but the information is false, meaning that the information given is permitted otherwise.

Abstract

One of the causes of the successful development of community forests in Probolinggo Regency was the participation of religious leaders. This study explored the dynamics of the role of religious leaders in the development of community forests. Through a qualitative research design with a phenomenological approach and a Naturalistic paradigm, it was found that religious leaders carried out dynamic roles from the pioneering period to the period of obtaining international ecolabel certificates. From this discovery, three propositions were drawn to which after inter-relation between the concepts, two substantive theories were drawn, namely (1) Followers’ Need-Based Visionary Leader Theory, dan (2) Theory of Change-and-Innovation Enabling Leader Quality (Attributes of Change-and-innovation Enabling Leader).

Abstract

Indonesia has large fisheries and marine resources. However, most of Indonesia's marine ecosystems are still under threat. One of them is the coast of Lamongan. The damage is caused by destructive fishing using destructive gears such as tiger trawls, cantrang (a modified Danish seine), explosives, and others. Government  regulations  to  prevent  those  activities  have  not  been  effective. Therefore, alternative approaches are needed. One approach to be chosen is the Islamic law approach. Because the Lamongan coastal community has a strong Islamic  culture,  the  Islamic  view  of  destructive  fishing  is  expected  to  offer  a better alternative solution. Therefore, this article examines the ecological ijtihād of Nahdlatul Ulama (NU) and Muhammadiyah ulama in Lamongan. This is empirical legal research, with data from focused-group discussions and in-depth interviews.  The  study  finds  that  the  NU  Ulama  had  issued  a  fatwa  through Bahtsul Masail, stating that preserving marine ecology is the obligation of every Muslim  and  destructive  fishing  is  prohibited.  Meanwhile,  Muhammadiyah ulama have not issued fatwas institutionally. Nonetheless, the fatwa of the two communities has become a reinforcement for government policies in preventing marine ecosystems damage through eco-fishing.Keywords: destructive fishing; ecological ijtihād; NU; Muhammadiyah AbstrakIndonesia memiliki sumber daya perikanan dan kelautan yang besar. Namun, sebagian besar ekosistem laut Indonesia masih terancam di antaranya di  pesisir  Lamongan.  Kerusakan  ini  disebabkan  oleh  penangkapan  ikan  yang merusak dengan menggunakan alat tangkap yang merusak seperti pukat harimau,  cantrang,  bahan  peledak  dan  lainya.  Pencegahan  aktivitas  tersebut dengan peraturan pemerintah tidak berjalan efektif. Oleh karena itu, diperlukan pendekatan alternatif yang lebih efektif. Salah satu pendekatan yang dapat dipilih adalah pendekatan hukum Islam karena masyarakat pesisir Lamongan mempunyai kultur keislaman yang kuat. Artikel ini mengkaji ijtihād ekologis ulama pesisir Lamongan yang berafiliasi NU dan Muhammadiyah. Penelitian dilakukan dengan pendekatan yuridis-empiris, dengan data didapatkan dari diskusi kelompok dan wawancara mendalam. Penelitian ini menemukan bahwa Ulama NU di Paciran Lamongan telah mengeluarkan fatwa melalui Bahtsul Masail yang menyatakan bahwa  menjaga  kelestarian  ekologi  laut  adalah  kewajiban  setiap  umat  Islam sehingga  destructive  fishing  dilarang.  Sementara  ulama  Muhammadiyah  belum mengeluarkan  fatwa  secara  kelembagaan,  namun  mayoritas  secara  pribadi menyatakan bahwa kegiatan tersebut juga dilarang. Meskipun demikian, fatwa kedua  komunitas  tersebut  menjadi  penguat  bagi  kebijakan  pemerintah  dalam mencegah kerusakan ekosistem laut melalui eco-fishing.Kata Kunci: destructive fishing; ijtihād ekologi; NU; Muhammadiya
