Abstract

Indonesia consisted of multiculture, ethnic and religion. There are six legal religions in Indonesia. Religious plurality is part of Indonesian life. In Religion, adherents always tried to compare between their own religion with other religions that can cause a truth claim of superiority of their religion. This caused any conflict like the case of GKI Yasmin in Bogor, three massive bomb blasts of Bali, and conflict of Ambon.  This is a library reseach applying sosiological approach. To analyze the problem, author used the conflict theory of Gillin and Gillin saying that conflict can be caused by deferences. Therefore, it is necessary to understand how the intersection of religions in order to prevent the conflict, included religious intolerence.  This research find that the intersection of religion can be found in values of humanity or the horizontal aspect (ḥabl  min al-nās). While the vertical aspect (ḥabl  min Allāh), they are different. By understanding the intersection of religions and nature of these differences, it is expected that religious harmony can be reinforced.***Indonesia terdiri dari beragam budaya, etnis dan agama. Terdapat enam agama yang diakui di Indonesia. Pluralitas tersebut merupakan bagian dari kehidupan masyarakat Indonesia. Pada kenyataannya, seseorang selalu ingin mem­banding­kan antara agama mereka sendiri dengan agama-agama lain, sehingga yang dapat menyebabkan klaim kebenaran. Kondisi ini menyebabkan terjadinya konflik seperti kasus GKI Yasmin di Bogor, tiga bom Bali, dan konflik Ambon. Penelitian ini adalah penelitian kepustakaan dengan menggunakan pendekatan sosiologi. Analisis kajian menggunakan teori konflik Gillin dan Gillin yang menyatakan bahwa konflik dapat disebabkan oleh perbedaan. Oleh karena itu, perlu untuk memahami bagaimana titik pertemuan antar agama untuk mencegah konflik, termasuk intoleransi agama. Penelitian ini menemukan bahwa pertemuan agama dapat ditemukan dalam nilai-nilai kemanusiaan atau aspek horizontal (ḥabl  min al-nās). Sedangkan aspek vertikal (ḥabl  min Allāh), mereka berbeda. Dengan memahami pertemuan antar agama dan sifat perbedaan ini, diharapkan kerukunan beragama dapat diperkuat.

Abstract

Abstrak Tujuan penelitian ini adalah untuk meningkatkan kreativitas siswa dan hasil belajar matematika pada siswa. Penelitian ini merupakan Penelitian Tindakan Kelas (PTK). Subjek penelitian ini adalah siswa kelas VII B SMP Sultan Agung Purworejo yang berjumlah 31 siswa. Tahapan peneltian terdiri dari perencanaan, pelaksanaan, pengamatan, dan refleksi. Tindakan dilaksanakan dalam 2 siklus dan tiap siklus terdiri dari 3 pertemuan. Metode pengumpulan data yang digunakan adalah observasi dan tes. Pembelajaran menggunakan Open-Ended. Hasil penelitian menunjukan rata-rata tes evaluasi siswa pada siklus I sebesar 59,84 dengan persentase ketuntasan klasikal hasil tes siswa 64,51% dan pada siklus II meningkat menjadi 71,77 dengan persentase ketuntasan klasikal hasil tes siswa 80,64%. Sedangkan hasil observasi kreativitas siswa pada siklus I diperoleh rata-rata persentase 72,58% dengan kategori kurang meningkat pada siklus II 84,68% dengan kategori kreatif. Dengan demikian dapat disimpulkan bahwa pembelajaran Open-Ended dapat meningkatkan kreativitas siswa VII B SMP Sultan Agung Purworejo tahun pelajaran 2013/2014. Abstract

Currently, the implementation of religious education is faced with various problems both internally such as its learning methodology, and externals such as the strengthening of the culture of materialism, consumerism, and hedonism, which has led to changes in people's lifestyle. In this context, it is very important for Islamic education innovations to improve the quality of Islamic education learning, to answer the challenges of globalization today. This study aims to find Islamic education learning innovations that are integrative-interconnective based on direct experience in Brawijaya University. Therefore, this research included case study research with data collection techniques using interviews, observation, and documentation. Data analysis uses descriptive-qualitative analysis. The results of the study show that Islamic education innovation in Brawijaya University covers several things, namely the paradigm, approach, strategy, method, and learning evaluation system. The learning paradigm is changed from dichotomous to integrative-interconnective, the learning approach is oriented towards student-centered with focus, namely problem, spiritual-scientific, and philosophical-normative. Learning strategies cover direct instruction, contextual teaching and learning, problem-based learning, and meaningful learning. Learning methods are oriented to direct experience. While the evaluation does not only lead to cognitive aspects but affective and psychomotor aspects by using observation and self-assessment techniques. The implications for understanding students are getting better. It can be seen in the result of student grades.

Abstract

The level of maturity is a reference that a person is capable of carrying out a marriage. Facts in the field show that there are cases of divorce carried out by couples who have met the age requirements. Reaching the minimum age of maturity in marriage is not enough to conclude that a person is mature. In Marriage Law Number 16 of 2019, only the minimum age limit for marriage is explained or it can be explicitly said that a person is an adult it was 19 years old. Meanwhile, you should also consider the emotional maturity of the person. So it is necessary to clarify the oncept of maturity in marriage law in Indonesia. The aim of this research is to examine maturity regulations based on the Marriage Law in Indonesia. This research is normative legal research with a philosophical approach, a statutory approach and a conceptual approach. The techniques used to analyze legal materials are survey, question, read, recite/recal, review using deductive thinking. The results of the analysis show that maturity plays a major role in the success or failure of a relationship, maturity influences a person's ability to truly commit to a lifelong relationship and understand that commitment means giving up all other partner options. Maturity impacts a person's ability to understand concepts and apply the skills necessary to form and maintain healthy relationships. This can be used as a consideration in legal reform in order to create responsive and progressive legal rules.

Abstract

The development of Islamic banking in Indonesia, with the Murabahah financing contract dominating, is not free from disputes among the parties involved. Dispute resolution can be settled out of court (non-litigation), one of which can be through the National Sharia Arbitration Board (Basyarnas) and through the Religious Courts (litigation). Legislation has regulated the absolute authority of the institution responsible for litigation dispute resolution through Article 49 letter (i) of Law Number 3 of 2006, as amended in Law Number 50 of 2009 Regarding the Second Amendment of Law Number 7 of 1989 and Article 55 paragraph (1) of Law Number 21 of 2008 Regarding Islamic Banking, namely the Religious Court. A conflict of norms appears in the Murabahah financing contract, which still includes a clause for dispute resolution litigation in the District Court. This raises the first issue formulation regarding what the legal consequences are for the parties in the Murabahah financing contract with the choice of forum clause in the District Court when resolving litigation disputes and what choice of forum clause is stipulated in the Murabahah financing contract to provide a balanced position for the parties when resolving litigation disputes.

Abstract

Pejabat Pembuat Akta Tanah adalah pejabat umum yang diberi kewenangan untuk membuat akta-akta otentik mengenai perbuatan hukum tertentu mengenai hak atas tanah serta bertugas melaksanakan pendaftaran tanah. Terdapat delapan akta tanah yang dibuat PPAT, salah satunya yaitu akta hibah. Timbulnya sengketa dalam hibah dapat terjadi apabila ada pihak yang merasa dirugikan. Pihak yang dirugikan misalnya pihak yang merasa ikut memiliki benda hibah atau tidak sesuainya dengan Pasal 210 Kompilasi Hukum Islam. Menurut Pasal 210 Kompilasi Hukum Islam orang yang telah berumur sekurang-kurangnya 21 tahun, berakal sehat tanpa adanya paksaan dapat menghibahkan sebanyak-banyaknya 1/3 harta bendanya kepada orang lain atau lembaga di hadapan dua orang saksi untuk dimiliki. Tujuan penulis yakni untuk membahas bagaimana kedudukan PPAT dalam hibah hak atas tanah dengan persetujuan sebagian anak dan bagaimana perlindungan bagi para pihak dalam hibah hak atas tanah dengan persetujuan sebagian anak. Metode penelitian yang digunakan adalah penelitian hukum normatif. Pendekatan penelitian yang dilakukan oleh peneliti yakni pendekatan perundang-undangan, pendekatan konsep, dan pendekatan komparatif. sumber data yang digunakan adalah bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Teknik analisis bahan hukum dalam penelitian ini, penulis menggunakan teknik deskripsi dan teknik interpretasi. Dalam penelitian ini penulis mengumpulkan bahan hukum primer, sekunder, dan tersier melalui studi kepustakaan, kemudian mengumpulkan bahan hukum primer dan bahan hukum sekunder berdasarkan topik permasalahan dan diklasifikasi menurut sumber dan hierarkinya untuk dikaji secara komprehensif. Dari penelitian ini menunjukkan bahwa PPAT membuat akta berdasarkan kewenangan atribusi yang diperoleh dari peraturan perundang-undangan. Perlindungan hukum preventif bagi para pihak yang dapat dilakukan yakni tidak terlepas dengan peran PPAT yang mensyaratkan bagi pihak pemberi hibah untuk mendapatkan persetujuan dari seluruh anaknya, serta memastikan bahwa harta benda yang dihibahkan merupakan miliknya dan tidak lebih dari 1/3. Perlindungan represifnya yakni melalui Pengadilan Agama.

Abstract

the purpose of writing this article is to discuss the urgency of arranging a written Umrah departure agreement. The study uses a normative juridical method with a statutory approach and an analytical approach. Law Number 18 of 2019 concerning the Implementation of the Hajj and Umrah Pilgrimage does not require written agreements so that problems often arise that are detrimental to the congregation. Collaboration between the bureau and the umrah congregation can run smoothly if the agreement is implemented in writing. This is to reduce the risk of fraud or other things that could harm one or both parties. A written agreement provides more legal certainty and protection to the parties which is used as a guide for the bureau and the congregation to act in accordance with what was promised

Abstract

As an educational institution, Islamic boarding schools are required to carry out significant acceleration and transformation. If in the past the scope of output was limited to the religious dimension, now pesantren graduates are expected to be able to contribute a lot in various aspects of people's lives. The development of applications in the field of information technology has a major impact in various fields of life, including in the creative industries such as printing, digital image processing and graphic design. This requires us to provide training to students so that they can follow developments and be able to use it for preparation after they graduate. Training on the use of these applications is important to equip students' creativity so that later when they leave the boarding school, they can develop these skills to be more independent. Even these skills can also equip students for entrepreneurship, so they can support their economy. Based on this reality, the MPK Center Community Service Team initiated to assist Islamic boarding schools in developing students' creativity through graphic design training. This is because the human resources owned by Islamic boarding schools in the field of graphic design are minimal or even non-existent. With the graphic design training, it is hoped that it can help pesantren in equipping students with skills so that their creativity is formed.

Abstract

The current development of information and communication technology has triggered a digital transformation that has changed the industrial order. If in the Industrial 4.0 era technology was only placed as a machine or tool to access information, then in the Social 5.0 era technology and its functions have been emphasized more as part of human life. Islamic boarding schools as educational institutions are currently also required to be able to accelerate and transform according to these developments. If previously the da'wah media was more conventional with a very limited reach, now it is hoped that santri can expand their da'wah by using digital media so that their contribution can reach all levels of society. This is an opportunity and a challenge for Islamic boarding schools in developing da'wah. This activity uses a personal approach by providing understanding to caregivers and administrators of the Tahfidz Al-Quran Islamic Boarding School Merjosari Lowokwaru Malang "Oemah al-Quran" about the importance of digital da'wah for students as a provision when students have graduated from the Islamic boarding school. For this reason, the UPT PKM Universitas Brawijaya community service team provided a solution by holding digital da'wah training by inviting competent resource persons in their fields. In this community service activity, the Community Service Team collaborates with preachers as well as content creators who are experts in the field of virtual preaching. Some of the digital platforms that are in digital da'wah training are Twitter, Instagram, Facebook, and Twitter. From the results of the training, some students already understand how to make da'wah material that is interesting and can be delivered in the virtual world. From the results of the evaluation carried out by the community service team, it was found that the majority of students had good enthusiasm for the material presented because awareness grew both when the material was delivered, or during the socialization process.

Abstract

Kajian ini bertujuan untuk mengoptimalkan potensi suku Bajo desa Torosiaje sebagai desa wisata toleransi yang berbasis pada kearifan lokal. Suku tersebut dikenal juga dengan sebutan suku pelaut, karena mereka tinggal di atas laut. Penduduknya tidak hanya berasal dari suku Bajo, namun juga suku-suku yang ada di Indonesia. Menariknya, mereka hidup rukun tanpa memperhatikan latar belakang suku. Selama ini, suku Bajo hanya popular dengan wisata laut, padahal sisi kehidupan mereka dapat menjadi pembelajaran “toleransi” bagi wisatawan. Dalam konteks inilah maka pengabdian ini dilakukan. Pendekatannya menggunakan pendekatan personal melalui wawancara, dialog dan observasi. Metode yang digunakan adalah dengan sosialisasi. Berdasarkan analisis SWOT, dapat dirumuskan beberapa strategi pengembangan potensi desa wisata pendidikan toleransi suku Bajo desa Torosiaje, yaitu: (1) Bekerjasama dengan dinas pariwisata setempat, karena kurangnya SDM masyarakat desa Torosiaje yang memahami dan mengerti tentang pengembangan pariwisata. (2) Membranding desa wisata pendidikan toleransi desa Torosiaje melalui media sosial. (3) Pemerintah mendukung dengan memberikan kemudahan transportasi menuju ke desa Torosiaje (4) Mempromosikan kearifan lokal desa Torosiaje melalui perayaan atau ritual yang diselenggarakan oleh penduduk setempat. Ini dapat menarik anak-anak muda untuk tetap mengenal dan cinta pada kearifan lokal di tengah-tengah modernitas.
