Abstract

Artikel ini menjelaskan tentang Perspektif Hukum Islam Tentang Tradisi Perkawinan adat Kh­ususnya membahas tentang adat Melayu Riau Desa Bencah Kelubi Kabupaten Kampar. Pe­rkawinan dapat dinyatakan Sah apabila terpenuhinya Rukun dan Syarat didalamnya sesuai dengan syariat Islam. Prosesi Perkawinan Adat Melayu Khususnya di Kabupaten Kampar pr­ovinsi Riau sebuah desa terpencil yaitu desa Bencah Kelubi jauh berbeda dengan syariat dan rukun islam, tetapi tidak melanggar Nash ­Al-qur’an, yaitu ketika melaksanakan Perkawinan me­nggunakan adat Maka seluruh rangkaian kegiatan serta prosesi harus ditempuh dan di­laksanakan. Penulisan karya tulis ini menggunakan Metode Deskriptif Analisis dengan menelaah dan menganalisa suatu peristiwa hokum, khususnya hukum islam mengenai Perspektif Hukum Islam Terhadap Perkawinan Adat Melayu, penelitian ini mengacu kepada data yang didapat di Ka­bupaten Kampar desa Bencah Kelubi sebagai data Primer berupa wawancara pemuka adat se­te­mpat. Hasil dari riset ini Rangkaian kegiatan perkawinan adat Melayu yang terdiri dari 12 (dua belas) rangkaian adat, yang pertama Merisik Tidak Resmi hingga Hari meminta Restu orang tua (Me­nyembah). Perspektif Hukum Islam dalam rangkaian prosesi kegiatan adat tersebut me­mbolehkan apabila menggunakan prosesi adat Melayu Riau (Mubah).

Abstract

Penelitian akan mengupas persoalan poligami dalam kerangka hukum Nasional, yang secara normatif menghendaki terealisasikannya asas monogami, melalui redaksi formal undang-undang perkawinan No. 1/1974 Pasal 1 (3) dimana laki-laki dan perempuan menikahi satu pasangan dalam satu kurun waktu pernikahan dengan tidak ada tandingan dalam jumlah. Sedangkan faktualnya, ada tumpang tindih aturan, melihat poligami dalam paradigma fikih konservatif tidak pernah memasuki ranah "haram" selama dijalankan sesuai ketentuan yang meliputinya berlandaskan penafsiran ayat 3 Qur'an surah an-Nisā dengan indikasi kebolehan beristri lebih dari satu meskipun tidak menganjurkan dan mencegahnya, sesuai asbāb al-nuzūl-nya perlindungan hukum bagi anak-anak yatim yang disalahgunakan oleh para walinya setelah ditinggal mati kedua orang tua dalam peperangan. Maka tujuan yang hendak dicapai, adalah membedah konkret konsepsi poligami yang hendak disampaikan Qur'an dan keadilan yang menjadi syarat primernya, dikorelasikan dengan formalisasi hukum Islam di era modern dalam peraturan kompilasi perundang-undangan yang mentransformasikan hukum-hukum fikih. Penelitian menerapkan metode kualitatif berbasis pendekatan kepustakaan merujuk pada berbagai literatur ilmiah terhadap suatu norma hukum berlaku secara yuridis normatif (doctrinal) dari ragam sumber data terkini dan terdahulu yang masih relevan. Berangkat dari temuan seperangkat aturan hukum poligami dalam Kompilasi Hukum Islam (KHI) mengenai prosedural ketat yang mengarah pada kebolehan (Buku I Bab IX Pasal 55-59), UUP dan pelaksanaannya dalam PP No. 9/1974 Bab VIII (Pasal 41-44), sampai kultur masyarakat yang belum mengindahkan dan memandang hukum positif sebelah mata sehingga poligami ramai dilaksanakan di bawah tangan, saat tujuan sakīnah, mawaddah, dan raḥmah tidak lagi dirasakan pada satu istri. Syariat yang mulanya bertitik tolak pada bagaimana keadilan ditegakan dalam keluarga poligamis, mulai bergeser pada kemaslahatan lain sesuai perkembangan zaman.   The research will explore the issue of polygamy within the framework of national law, which normatively requires the realization of the principle of monogamy, through the formal wording of marriage law No. 1/1974 Article 1 (3) where men and women marry one partner in one period of marriage with no match in number. While in fact, there seems to be an overlap of rules, looking at the conservative fiqh paradigm polygamy never enters the realm of "haram" as long as it is carried out according to the provisions that cover it, based on the interpretation of verse 3 of the Qur'an surah an-Nisā with an indication of the permissibility of having more than one wife even though it does not encourage and prevent it, according to the asbāb al-nuzūl of legal protection for orphans who are abused by their guardians after the death of both parents in war. The purpose of this study is to dissect the conception of polygamy that the Qur'an wants to convey and the justice that is the primary requirement, correlated with the formalization of Islamic law in the modern era in the compilation of legislation that transforms the laws of fiqh. The research applies a qualitative method based on a literature approach referring to various scientific literature on a legal norm applicable juridically normative (doctrinal) from a variety of current and previous data sources that are still relevant. Starting from the findings of a set of legal rules for polygamy in the Compilation of Islamic Law (KHI) regarding strict procedures that lead to permissibility (Book I Chapter IX Articles 55-59), UUP and its implementation in PP No. 9/1974 Chapter VIII (Articles 41-44), to the culture of the community that has not heeded and underestimated positive law so that polygamy is often carried out under the hand, when the goal of sakīnah, mawaddah, and raḥmah is no longer felt in one wife. The Shari'ah, which was originally based on how justice was upheld in polygamous families, began to shift to other benefits according to the times.

Abstract

This study examines the phenomenon of disclosure of family conflicts on social media from the perspective of Islamic law, with particular emphasis on the social and psychological effects and violations of sharia values. Qualitative research methods were used through the analysis of the texts of the Qur'an, Hadith, and Islamic legal literature, as well as case studies of viral conflicts on Instagram, Facebook, TikTok, and Twitter. The results showed that this practice contradicts the principles of ghibah (gossip), namimah (divisive gossip), and ifk (false accusations). These principles violate family privacy and the honor of al-'irdh as part of maqashid syaria. The spread of conflict in the digital public sphere causes greater problems, emotional distress, social stigma, and the separation of family relationships, as seen in viral inheritance, polygamy, and intergenerational conflicts. Solutions offered by Islamic law include the concept of islah, or reconciliation, which emphasizes digital ethics education, mediation by neutral parties, and closed conflict resolution. First, deliberation with good intentions, second, the application of the principle of forgiveness (al-'afw), third, raising awareness about the long-term impact of conflict exposure, and fourth, setting boundaries of privacy on social media. This study found that to maintain family harmony in the digital age, sharia-based ethics education and the principle of islah must be combined. The academic results enhance Islamic legal research on social media dynamics. On the other hand, the practical consequences offer guidelines for practitioners and families to resolve conflicts in a way that is in accordance with Islamic values. Strengthening digital literacy based on prudence and optimizing community-based mediation are two main recommendations.

Abstract

The concept of equality in Islamic marriage aims to avoid the negative impact of inequality between husbands and wives in matters of physical, nasab, property, work, fear and religion. However, the aspect of equity in such matters can have a negative impact, namely, caste as a social stratification system that contradicts Islamic teachings as in marriage between Syriph and Sayyid that makes nasab as the main parameter. As for this research, the aim is to find the problematic factors that emerge from the application of the concept of kafa’ah and also to discover the reconceptualization of kafa'ah in the realization of Islamic marriages that do not raise caste systems in society. This research uses descriptive qualitative methods with library study techniques and case studies. And this study concludes that criteria other than religion in the concept of selfishness can cause social stratification even discrimination in society especially in the marriage between Shariah and Sayyid. Therefore, there is a need for a re-understanding of the concepts of self-ishness in society that is more emphasized on the criteria of religion rather than others. Thus, the existence of the existing kafa’ah is very important by placing the kafa’ah proportionally due to the change of times and societies so that the concept of kafa’ah in the fiqih remains relevant and the value of the merit of the establishment of a law kafa'ah can continue to live and in accordance with the mission or basic principles of Islam that is the principle of egalitarianism.

Abstract

This paper discusses Muhammad Shahrur’s proposal for a “new way” to practice the concept of milk al-yamin in Islam. He believes that the Qur’anic verses pertaining to milk al-yamin can no longer be applied today because of their close connection to slavery. Shahrur argues that the practice of milk al-yamin—particularly in the context of the permissibility of engaging in sexual relations without a marriage contract—can be carried out through mutual consent. This consent is formed through an agreement between a man and a woman, solely for the purpose of engaging in sexual relations. The aim of this paper is to analyze Shahrur’s arguments within the framework of his milk al-yamin theory. The method used in this paper is a normative literature study, employing a juridical-normative approach. The findings of this paper indicate that Shahrur’s theory of milk al-yamin tends to align more closely with Western values of sexual consent than with Islamic values. Moreover, Shahrur’s proposal for milk al-yamin could have significant implications for the development of family law, particularly in Indonesia.

Abstract

Cases of sexual violence are crimes against humanity that not only physically injure the victim, but also cause deep psychological trauma. However, the phenomenon that occurred in Mataram in 2024 shows a different condition, where people with physical disabilities are actually perpetrators of sexual violence. This raises complex legal issues, especially related to the limits of criminal liability and the application of the principle of justice. This study aims to analyze the criminal liability of perpetrators with physical disabilities in cases of sexual violence based on the Mataram District Court Decision Number 23/Pid.Sus/2025/PN Mtr and review its relevance to the principles of Islamic criminal law. The method used is normative juridical with a case approach, through the study of primary legal sources in the form of the Qur'an, hadith, fiqh jinayah books, as well as laws and regulations such as Law Number 12 of 2022 concerning the Crime of Sexual Violence and Law Number 8 of 2016 concerning Persons with Disabilities. The results of the study show that in positive law, perpetrators with physical disabilities can obtain mitigating considerations, as reflected in Decision Number 23/Pid.Sus/2025/PN Mtr which imposes a lighter sentence than the prosecutor's demands. While in the perspective of Islamic criminal law, the measure of criminal liability is determined by reason (?aql) and moral awareness (ahliyyah al-ad?), not by physical conditions. Therefore, people with physical disabilities who have common sense are still seen as full mukallaf who are obliged to account for their actions. Acts of sexual violence in this context are classified as jarimah ta'z?r syadidah (heavy ta'zir), the sanctions of which can be increased according to the level of social and moral damage caused. This study emphasizes the importance of applying the principles of substantive justice and benefits in deciding cases involving perpetrators with disabilities, without removing the essence of criminal responsibility. These findings are expected to contribute to the development of inclusive and contextual Islamic criminal law on disability and sexual violence issues in Indonesia.
