Abstract

Hukum bukan hanya berguna sebagai sarana pengendali untuk memelihara ketertiban sosial, tetapi juga untuk mengendalikan perubahan masyarakat ke arah yang dikehendaki. Pancasila sebagai ideologi bangsa adalah paradigma atau kerangka pikir, sumber nilai, dan orientasi arah bagi penegakan. Perwujudan nilai-nilai itu menjadi keniscayaan, karena dalam praktik penegakan hukum terjadi diskrepansi, yakni ketidaksesuaian antara harapan dan kenyataan. Penegakan hukum dan kebijakan politik kerap melukai rasa keadilan. Dalam penegakan hukum pidana dan hukum tata negara telah meninggalkan rasa keadilan dan kebijakan politik kian elitis tak berpihak pada yang lemah. Mewujudkan hukum berkeadilan secara progresif adalah solusi sistemik untuk mewujudkan keadilan substansial. Maka dari itu, menjalankan hukum progresif adalah keniscayaan, yakni menegakkan hukum dengan memilih cara tidak hanya menurut prinsip logika, tetapi harus dengan independensi, perasaan, kepedulian, dan pemihakan kepada yang lemah. Hal ini sejalan dengan ajaran nilai-nilai yang terkandung dalam Pancasila, yakni berketuhanan, berperikemanusiaan, berpersatuan, berkerakyatan, dan berkeadilan. Inilah cara menjaga Pancasila dalam praktik penegakan hukum di Indonesia. Operasionalisasi hukum berkeadilan secara progresif adalah dengan cara mencari cara-cara baru (role breaking) dan terobosan inovatif, jika cara normal dan normatif tak mampu segera mewujudkan asas dan nilai mazhab Pancasila. Kata Kunci: Berkeadilan, Hukum Progresif, dan Pancasila

Abstract

The Regional Election Commission has the responsibility to increase the participation of disabled voters in local legislative elections. Democratic elections at the local level are characterized by the enthusiasm of disability voters in the election. The purpose of this paper is to map out legislation on the protection and respect of disability voters, to explore some of the constraints facing electoral voters in the election, and to examine the policies and obstacles faced by the The Regional Election Commission in an effort to increase voter participation in disability. This study uses socio-legal research methods, ie research that is interdisciplinary to provide a meeting room between the science of law and the sciences outside the law. The results show that, there are international law and national laws. Barriers facing disability voters include: theoretically there is no uniformity about the disability study; the culture of the people who tend to stigmatize the bad, not counting the right to vote; lack of accurate data of disability voters. The policies made by the The Regional Election Commission in increasing the participation of disability voters are: to implement Article 1 number 25 and Article 149 of Law No. 8 of 2012 on General Election of Members of DPR, DPD and DPRD. While the obstacles, namely: the weakness of family and community awareness; lack of human resources capacity of voter registration officers and data on the List of Potential Voters of Electoral Residents (DP4) does not mention information about disability.

Abstract

It is very important to protect the justice rights of journalists in carrying out their duties to maintain freedom of the press and freedom of expression, as well as to prevent intimidation, threats, and violence against journalists in carrying out their journalistic functions.This study uses a normative method with a statutory approach.Overall, the protection of journalists' rights has not met human rights standards in several aspects. Therefore, journalists should join a journalist organization to get help when they face legal problems. Currently, the legal protection received by journalists is still more repressive. One of the things that hinders journalists' organizations in carrying out their duties is that journalists who experience persecution often choose not to pursue the case they have reported to the authorities because they are worried about the consequences they will face if they report or pursue the case to the authorities.

Abstract

Campus sexual violence is a pervasive issue affecting institutions worldwide, with a concerning upward trend in reported incidents. This article scrutinizes legal policies and the efficacy of collaborative governance in mitigating this pervasive problem. The model of collaborative governance, a globally recognized legal policy approach, is at the heart of this study. Utilizing socio-legal research methods, the article employs comparative legal and conceptual legal approaches, drawing from secondary literature sources. The study reveals that the implementation of legal policies and collaborative governance can significantly curb campus sexual violence in Indonesia. This can be achieved by actively engaging both academic community and the wider public. By drawing lessons from countries such as the United States, the Netherlands, Canada and the United Kingdom, Indonesia can replicate their success in reducing campus sexual crimes. These measures include the creation of legal policies, establishing partnerships with central and local governments, and fostering collaborative governance. Key initiatives that have proven effective in these countries include the development of service guidelines that prioritize victim and survivor protection, amplified anti-sexual violence campaigns on campuses, and the promotion of sexual violence awareness education. The establishment of a National Campus Sexual Assault Commission to evaluate the enforcement of educational ministerial regulations and religious affairs ministerial regulations in preventing and addressing campus sexual violence is also recommended. This article offers valuable insights for policymakers in their efforts to devise effective legal strategies to prevent sexual violence on campus.

Abstract

There are too many overlapping MSMEs determination policies which result in hampering MSMEs empowerment. The dynamics of global change require a fast and responsive response because, without policy reformulation, economic growth will stagnate or even slow down. This article delves into the necessity of regulatory reform to enhance the ease of doing business for MSMEs, using the Omnibus Law method. Conducted as normative legal research, this study uses normative legal research and analyzes secondary data to examine the existing challenges. The findings reveal various obstacles faced by MSMEs, including complexities in obtaining business licenses, cumbersome tax payment systems, limited access to business capital, and the absence of a formal business entity. To address these regulatory issues, alternative solutions are proposed through the Omnibus Law method, emphasizing the simplification of regulations, fostering public participation, and harmonizing both vertical and horizontal regulations. Moreover, drawing lessons from the Netherlands, where the government established the Dutch Advisory Board on Regulatory Burdens (ATR) to reduce administrative burdens on SMEs, Indonesia can prioritize similar measures to simplify regulations and lower costs. By emulating the ATR's independent and collaborative approach, Indonesia has the potential to establish its own advisory body, fostering a supportive business environment for SMEs and promoting economic growth.

Abstract

Indonesia’s Election Management Bodies (EMBs), constitutionally mandated to manage legislative and presidential elections, face substantial risks, including accidents and fatalities. However, their social security rights are often overshadowed by the focus on civil servants and private-sector workers. This study, employing normative legal research, urges the need for state protection of EMBs’ social security rights, drawing on secondary data sources. EMBs should receive comprehensive work-related accident benefits, death benefit programs, and old-age protection schemes from the Workers Social Security Agency (BPJS Ketenagakerjaan). The legal basis for these social security rights can be found in several legislative provisions, including the Indonesian 1945 Constitution, the National Social Security System Law, and other related regulations. Recognizing EMBs as state-serving workers is a crucial step in safeguarding their social security rights. This recognition is not merely a matter of legal interpretation; it is a necessity to ensure a fair and secure electoral environment. By ensuring that EMBs are accorded the same rights and protections as other workers, the state can create a more equitable electoral process and reinforce the integrity of its democratic institutions.

Abstract

This research aims to study and explore the phenomenon of corruption in local government and strategic efforts to prevent it from realizing good local governance. This type of research is socio-legal research with a statutory and conceptual approach and is presented in descriptive-qualitative form. The results of the study show that the factors that cause corruption in the regions are high political costs of regional elections, Regional heads' intervention in the planning of the Regional Expenditure Budget (APBD), regional heads intervene in the management of the APBD, regional heads participate in determining the implementation of permits, regional heads determine the procurement of goods and services, and regional heads buy and sell positions. The strategies to prevent corruption in the regions include reducing the political costs of direct elections, prevention through strengthening internal government supervision, prevention through the performance accountability system of government agencies, prevention through LHKPN reporting and transfer of officials' wealth to the state, and prevention of corruption favoritism.

Abstract

Pilkada is one form of democracy in the regions that need to be ensured that its implementation is in accordance with procedures so as not to lose the meaning of democracy itself. Bawaslu has an essential role in realizing elections with integrity without the practice of money politics. One of the tasks of Bawaslu is to prevent the practice of money politics. One of the crucial components in the implementation of regional head elections (Pilkada) is the village and its citizens. The village, which is the closest component to the community in the election, becomes a place for the practice of money politics. The integrity of the Pilkada can be destroyed because of the practice of money politics that occurs in the village. A strategy to prevent money politics is needed in the village by building an anti-money politics village in order to strengthen local democracy.

Abstract

Penelitian ini bertujuan untuk meningkatkan kapasitas literasi digital prajurit TNI AD di lingkungan Denjasa Ang IV/B SMG Bekangdam IV Diponegoro sebagai bagian dari penguatan ketahanan nasional di era Revolusi Industri 4.0 dan Society 5.0. Kegiatan pengabdian ini dilaksanakan melalui pendekatan edukatif dan partisipatif dengan metode ceramah interaktif, diskusi kelompok terarah (FGD), simulasi penggunaan teknologi digital, serta evaluasi berbasis Kirkpatrick’s Four-Level Training Evaluation Model. Sasaran kegiatan adalah prajurit aktif yang telah menggunakan media sosial dan perangkat digital dalam kehidupan sehari-hari. Hasil kegiatan menunjukkan peningkatan kesadaran kritis peserta terhadap ancaman siber seperti hoaks, phishing, dan perjudian daring, serta pemahaman baru mengenai peran strategis prajurit sebagai agen perubahan literasi digital. Wawancara informal dengan beberapa peserta menunjukkan perubahan sikap dan refleksi mendalam atas pentingnya etika digital dan tanggung jawab sosial dalam bermedia. Simpulan dari kegiatan ini menegaskan bahwa literasi digital bukan sekadar kecakapan teknis, melainkan bagian integral dari pembinaan karakter dan profesionalisme militer di era digital. Kolaborasi antara institusi pendidikan tinggi dan militer terbukti mampu menghasilkan model penguatan literasi digital yang kontekstual dan berkelanjutan dalam mendukung agenda pembangunan berkelanjutan (SDGs 2030).

Abstract

According to the constitution, the state concept in constitutional practice can be divided into two opposite poles, namely welfare and liberal state. They have different characteristics in which the first concept (welfare state) requires a strong and extensive state functions to regulate an economic justice, on the contrary the second concept (liberal state) relies on the free market economy which state’s role should be marginalized. Sosio-legal research is used in this article. Based on the Article 33 of Indonesian post constitutional amendment of 1945, Indonesia embraced the concept of welfare state. Yet, the practice sociologically tends to embrace a liberal state that is not suitable with the welfare of the people. There are challenges, in the context of liberal state, faced by Indonesia, such as applying the capitalist economic system. We may fight the capitalist economic system by two legal policy, namely: first one, we may re-create the role of state functions as a controller and regulator of the economy. The second one, we may increase the state income through taxes along with the higher social spending to achieve the social welfare and economic justice.Keywords: welfare state, the constitution of 1945, legal policy
